MANUAL OF DISTRICT COURT DEHRADUN UNDER SECTION 4 (1) (b) OF RIGHT TO INFORMATION ACT, 2005. SECTION 4 (1) (b) (i) The particulars of District Judge’s, Dehradun; functions and duties; Particulars: District Judge, Dehradun Functions: It is a principal court of the District as envisaged in Article 233 of the Constitution of India, subordinate to the High Court of the State in which that District exists. Duties: (1) (2) Administrative – The District Judge has the Administrative Control over day to day work of all the other courts of the District. Judicial - The District Judge being the Principal Judge of the District Court is also known as Sessions Judge under whose subordination all the other Additional District & Sessions Judges, Civil Judges (Sr. Div.), Civil Judges (Jr. Div.), Chief Judicial Magistrate and other Judicial Magistrates function. The District & Sessions Judge and Additional District & Sessions Judges, hear and dispose of Appeals/ revisions filed against the orders passed by the Civil Judges (Sr. Div.), Civil Judges (Jr. Div.), Chief Judicial Magistrate/ Additional Chief Judicial Magistrates and other Judicial Magistrates. SECTION 4 (1) (b) (ii) The powers and duties of officers and employees of District Court’s Dehradun; Powers and duties of Judicial Officers of Dehradun Judgeship; Adjudication and administrative work as per provisions of law. Powers & Duties of Officers of the District Court, Dehradun; The officers and employees discharge their duties as per General Rules (Civil), 1957 and General Rules (Criminal), 1977. The Judicial Officers exercise the jurisdiction for trying Civil and Criminal Cases and other cases under Special Enactment for which they are conferred with the powers under issuance of Notifications by the State Government/ High Court of the State. SECTION 4 (1) (b) (iii) The procedure followed in the decision making process, including channels of supervision and accountability. The cases are decided as per the provisions of Law. The administrative decisions are taken by the District Judge. SECTION 4 (1) (b) (iv) The norms set for the discharge of the functions of the District Courts of Uttarakhand; General Rules (Civil) 1957, General Rules (Criminal) 1977, Laws and Judgements/ Rulings of Hon’ble Supreme Court of India and Hon’ble High Court SECTION 4 (1) (b) (v) The rules, regulations, instructions, manuals and records, held it by or under its control or used by its employees for discharging its functions; 1. All the laws are applicable. 2. General Rules (Civil) 1957, General Rules (Criminal) 1977 and Circular Orders of the Hon’ble High Court issued from time to time. SECTION 4 (1) (b) (vi) A statement of the categories of documents that are held by it or under its control; 1. Judicial Record. 2. Administrative Record. SECTION 4 (1) (b) (vii) The particulars of any arrangements that exists for consultation with, or presentation by, the members of the public in relation to the formulation of its policy or implementation thereof; That is not required as per the provisions of the law. SECTION 4 (1) (b) (viii) A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public. The decisions are taken by the District Judge. SECTION 4 (1) (b) (ix) A telephone directory is prepared containing telephone/ fax numbers of the Hon’ble Judge’s & Officers of the High Court including the Judicial Officers of each District of the state by the Hon’ble High Court and revised annually. Besides, a local list of Telephone numbers of all the Judicial Officers (Office and residence both) is also prepared and revised from time to time.
