This yearвЂ™s event was held on January 5, 2012, at the Tampa Bay Times Forum and the event committee was chaired by April Neil and Janet Stephens. April and Janet continued a great tradition of strong leadership, welcomed several new volunteers to the committee and helped raise awareness of the TGH Foundation throughout the community. Each year $2,500 sponsors and above are invited to attend the PatronsвЂ™ Party preceding the circus performance. This year 550 guests were greeted by the ringmaster and entertained by face painters, a juggler, balloon twisters, a DJ and members of the circus cast. Net proceeds of $175,000 from this yearвЂ™s event will benefit the Tampa General Hospital ChildrenвЂ™s Medical Center. SunTrust returned as our Three Ring Sponsor for a fifth year. The Lightning Foundation also returned as our PatronsвЂ™ Party Sponsor. Other major sponsors included the David A. The WomenвЂ™s Leadership Council has committed over ninety thousand dollars ($90,000) for ten patient care equipment projects. With the funding cuts from Medicare and Medicaid, the funding for these projects is appreciated even more. We are grateful to the WomenвЂ™s Leadership Council for their generous support. I look forward to seeing everyone on May 5th at this yearвЂ™s Foundation Gala. The theme of the Gala is focused on the happenings surrounding the State Fair. Cardiac Telemetry Unit Earns Beacon Award for Excellence Tampa GeneralвЂ™s Cardiac Telemetry Unit has received a Silver Beacon Award for Excellence from the American Association of Critical-Care Nurses (AACN). It is the hospitalвЂ™s first noncritical-care unit to receive the award. According to the AACN website, Tampa General is the only Tampa Bay area hospital and is one of only three hospitals in the state receiving a Beacon Award, which runs through 2014. The 50-bed unit includes inpatient and outpatient areas and provides continuous telemetry monitoring for patients with a variety of cardiac-related conditions. It is located on the fifth floor of the West Pavilion. The AACN, the largest specialty nursing organization in the world, represents more than 500,000 nurses who care for acutely and critically ill patients. Its Beacon Award for Excellence recognizes the nationвЂ™s hospital units that use evidence-based practices to improve patient and family outcomes. It includes three award levels: bronze, silver, and gold. Since its establishment in 2003, the award has only recognized critical care and progressive care units. But with new criteria established this year, the award is now open to all hospital units that provide care for high acuity and critically ill patients that meet evidence-based standards of excellence and patient safety. The Cardiac Telemetry Unit recently earned a 2011-2014 Silver Beacon Award for Excellence from the American Association of Critical-Care Nurses. Gasparilla Pirates Visit Tampa General Drew Yetto, of Winter Park, was among the patients in the ChildrenвЂ™s Medical Center who enjoyed a visit from Ye Mystic Krewe of Gasparilla pirates (left to right) Devon Carter, Shamus Warren and Rick Wolfe. The pirates brought the children Gasparilla beads, footballs, and other trinkets. 300th Lung Transplant Tampa GeneralвЂ™s transplant program marked another milestone when its 300th lung transplant was performed on November 17. Rita Sivils, MD, of Lutz, received the double lung transplant, performed by Cardiothoracic Surgeon Christiano Caldeira, MD. She is a retired Army physician who served in Iraq and also worked as a former emergency room supervisor at various area hospitals. Tampa GeneralвЂ™s first lung transplant was performed on June 19, 2002. Since then, the program has grown and is ranked as the fifth busiest in the nation according to data compiled last year by the Organ Procurement and Transplantation Network (OPTN). FoundationвЂ™s WomenвЂ™s Leadership Council Funds Ten Patient Care Equipment Projects The Tampa General Hospital FoundationвЂ™s WomenвЂ™s Leadership Council recently awarded $90,600 to buy new patient-care equipment in several departments of the hospital. Since 2009, each council member has donated $1,000 annually to fund the projects. Since that time, the council has provided $256,000 for a variety of projects. вЂњThe idea is that every gift makes a difference,вЂќ said Robin DeLaVergne, executive director of the Tampa General Hospital Foundation. Each year council members review proposals and listen to presentations from hospital staff before deciding on the winning proposals. вЂњItвЂ™s really important because it connects our The team currently responds on foot to the injured personвЂ™s location. The cart, which will arrive in a few months, is similar to the hospitalвЂ™s shuttle used to transport visitors and employees to and from the parking garage. Christina Potter, coordinator of the hospitalвЂ™s spinal cord program, was thrilled that her request for a $14,650 pressure mapping system to help prevent pressure wounds on wheelchairbound patients was approved this year. вЂњI literally jumped up and down for joy,вЂќ said Christina, who is also a physical therapist and assistive technology practitioner in the TGH Rehabilitation Center. The equipment will be used in the rehabilitation centerвЂ™s Outpatient Wheelchair Clinic and for inpatients, she said. Patients sit on a thin barrier placed on the wheelchair seat. The barrier is connected to a computer, and all of the pressure contact points are displayed on a monitor. The data allows technicians to modify the wheelchair seat and determine the types of cushions or other equipment to prevent pressure wounds, Christina said. In addition, the rehabilitation center received $18,000 to purchase a multi-position prone cart for patients with pressure sores who canвЂ™t tolerate sitting and a multi-position sling gurney to help patients with poor trunk control take showers. The hospital will soon have a new emergency code cart, similar to the one pictured here, that will allow the hospitalвЂ™s Rapid Response Team to respond quickly to visitors or employees needing medical assistance when a Code Purple is called. It is one of 10 projects to recently receive funding from the FoundationвЂ™s WomenвЂ™s Leadership Council. supporters with the hospital in a tangible way,вЂќ said Robin. This year the group selected 10 projects. One of them is a $15,000 electric-powered emergency response cart that will help the hospitalвЂ™s Rapid Response Team respond more quickly to Code Purples. The Pediatric Intensive Care Unit also received $6,472 for a new pediatric sedation crib. Fisher, Jr. Reilly, Fisher & Solomon, PA Donors are well aware of the current income tax benefits of charitable contributions to qualified U.S. charities. After all, we see these itemized deductions on our own personal income tax returns year after year. What may be less familiar to donors are the estate tax benefits of bequests to charities made at death. to fulfill charitable aspirations, as these amounts are not taxed at all to a charity while they would be taxed twice to a family member. While there is a special income tax rule called the вЂњdeduction in respect of decedentвЂќ which gives some relief, the tax burden on IRA or qualified plan assets which move through an estate is rather extreme. This will be an important planning consideration for a successful professional who has accumulated a fair amount of wealth In the recent past, the estate tax exemption amounts have been unusually high. At 3 1/2 million dollars in 2009, followed by no estate tax at all in 2010, followed by two years of an estate tax exemption of 5 million dollars, many donors have gotten used to the idea that the estate tax really doesnвЂ™t touch them at all. Currently, a married couple with fairly straightforward planning can exclude up to 10 million dollars from the estate tax. Next year, this picture changes considerably. On January 1, 2013 Next year, this picture changes considerably. On January 1, 2013 we will return to a 1 million dollar per person estate tax exemption and the top marginal rate will revert to 55 percent. we will return to a 1 million dollar per person estate tax This means that once a decedent is in the top estate tax bracket, if he or she wishes to leave $1,000 to a non-spouse family member, only $450 will end up in the pocket of that beneficiary. $550 will go to estate taxes. Naturally, many donors will prefer that the entire $1,000 goes instead to a lifelong favorite charity. This is why so often an estate tax attorney or trusted CPA when consulting with a donor on their estate plan will inquire as to whether or not there is a favorite charity that the donor would like to benefit once all of their family members have been taken care of. exemption and the top marginal rate will revert to 55 percent. in qualified plans or IRAs and also has plenty of other assets to leave to children, grandchildren and other family members. Indeed it can be as simple as that. The will simply needs to state the amount or the property that is to pass to the charity upon death. The fair market value of that property will be included in the decedentвЂ™s taxable estate, but the estate will also get a charitable estate tax deduction equal to the fair market value of the property which the decedent has directed to be paid to the charity. Prefunding Date of Death Charitable Gifts Some taxpayers with appreciated assets may wish to prefund some of their at-death transfers to charity so that they can retain an income stream from the assets during their life, diversify by selling these appreciated assets, and even achieve a current income tax deduction for the amounts which will ultimately go to charity. This planning idea is called the Charitable Remainder Trust. What assets to whom? Of course, decedents own many different kinds of assets, some of which would be more or less beneficial to a charity and some of which would be more or less attractive to leave to a family member. Taking the example of family heirlooms, jewelry and silverware, it certainly makes more sense to keep these sorts of items in the family. While a charity can certainly derive benefit from them, the sentimental and memorial value of such items within a family are certainly greater than they would be without. The taxpayer would put property, ideally appreciated property, into a special trust which at death would pay out to a favorite charity. During the taxpayerвЂ™s life, or perhaps for a term of years, the trust would make payments back to the donor. These payments could be in the form of a fixed dollar annuity or could be based annually on the fair market value of the assets (a so-called вЂњUnitrustвЂќ). Upon death or the close of the term of years, the trust terminates and the charity receives whatever assets are left in the trust. At the formation of the trust, there is an actuarial calculation performed according to IRS rules which estimates mathematically the assets which will remain in the hands of the charity at the end. This actuarial remainder amount is allowed as a current income tax deduction to the donor. On top of that, while the donor is taxed upon the receipt of the annual annuity, the trust itself is not taxed. Therefore, if the trust had a large gain on the sale of the contributed asset in its first year, that gain could be deferred over the entire lifetime of the trust, and some gain may escape taxation entirely. On the other hand, qualified plan and IRA type assets typically bring with them an inherent income tax burden. Such assets, never having been taxed, are called вЂњincome with respect of decedent.вЂќ Since a qualified charity does not pay any income taxes, a charity would receive the full benefit of IRA or qualified plan assets while a family member would receive what was left only after paying all of the estate taxes and furthermore paying all of the income taxes on the amounts once distributed to the taxpaying beneficiary. If the family members can be taken care of with other assets in the estate, then it is preferable for IRA or qualified plan assets to be used (continues on page 8) 7 Tampa GeneralвЂ™s Geriatric Nursing Care Recognized with NICHE Designation Tampa General has received recognition for its high level of geriatric nursing care by being designated as a Nurses Improving Care for Healthsystem Elders (NICHE) site by the Hartford Institute for Geriatric Nursing. It is the third time the hospital has received NICHE designation. help them understand the unique needs of older patients. It also helps them gain knowledge of common issues that occur when caring for geriatric patients, such as falls, delirium, restraint issues, pain, skin problems and wounds, the use of advance directives, and family decision making. According to the organizationвЂ™s website, TGH is the only hospital in Tampa, and one of only 12 in Florida, to be named a NICHE site. вЂњWeвЂ™re a hospital that understands the elderly population, and we do all we can to care for them,вЂќ said Nicole Cole, nurse manager of the hospitalвЂ™s Acute Care for the Elderly (ACE) unit. вЂњWeвЂ™re focused on them, and we understand that they have special considerations.вЂќ The Hartford Institute for Geriatric Nursing of New York UniversityвЂ™s College of Nursing launched the NICHE program in 1994. (continued from page 7) On the donorвЂ™s estate tax return after death, he or she would be required to include the entire value of the trust as part of their taxable estate. However, that full value passing to the charity would also be allowed as a charitable estate tax deduction. The result? The amount in the trust is effectively excluded from the estate, the charity gets a wonderful benefit at death, the donor got a charitable income tax deduction at the beginning, and furthermore received a predictable stream of income during the term of the trust. On top of all of this, the taxable gain on the appreciated property was deferred over many years. In the right circumstances this may be very effective lifetime planning for a charitable gift at death. mathematically the amount of the trust assets that are expected to go to the charity, and the amount of the assets that are expected to go to family. On the estate tax return of the decedent, the actuarial value of the assets passing to the charity would be allowed as a deduction, reducing the estate tax. In the actuarial calculation, one uses IRS assumptions and interest rates. If the actual performance of the assets exceeds the interest rates used in the IRS calculation, all of that extra benefit passes free of estate tax to the family members benefiting from the Charitable Lead Trust. Furthermore, in the case of the testamentary Charitable Lead Trust, there are no punitive estate tax inclusion period rules which disfavor this type of planning for grandchildren or later generations. Therefore, the donor can achieve multiple objectives: 1) benefiting the charity in the years right after their death, 2) moving assets very efficiently under the estate tax system and particularly avoiding generation-skipping transfer tax to younger generations where the assets outperform the actuarial calculations, and 3) keeping the assets out of the hands of a certain class of beneficiaries until later. This planning opportunity was popularized by its well-publicized use in the estate planning documents of Jacqueline Kennedy Onassis. Leaving it like Jackie O Another interesting planning opportunity at death is basically the mirror image of the above-described strategy, the so-called testamentary Charitable Lead Trust. LetвЂ™s say instead that the donor had plenty of assets to meet the needs of family members, had a lifelong favorite charity which he or she wanted to benefit for a number of years after death, and also had a class of family members, say grandchildren or great-grandchildren, who were in a position to wait for their bequest and would also particularly benefit in the case of substantial appreciation of those assets during the waiting period. These are the circumstances in which a testamentary Charitable Lead Trust may be attractive. Summary We are all aware of the income tax benefits of charitable contributions because we see these itemized deductions on our own income tax returns on an annual basis. Other tax benefits extend right out to our deaths as well, as charitable bequests and charitable gifts at death present the opportunity for great estate tax benefits, benefits which will be increasing substantially as we revert to the old estate tax rules in January of 2013. In this mirror image, upon death assets would be placed in trust and annual payments would be made not to family members, but to charity. The charity could receive this fixed annuity for a term of years and at the end of that term the trust would terminate and the remainder would pass not to charity, but to family.
