Republic of Serbia Office of the War Crimes Prosecutor HIGHER COURT IN BELGRADE WAR CRIMES DEPARTMENT 18 June 2012 Pursuant to my authority under article 331 (1) re articles 333 (2) and 43 (2.5) of the Criminal Procedure Code; and articles 3 and 4 of the Act on the Organization and Competence of State Authorities in War Crimes Proceedings, I raise this INDICTMENT Against: PETAR ĆIRIĆ, a.k.a. “Pero“, ak.a. “Pero Cigan“, born on 07/06/1968 in Vrbas; citizen of the Republic of Serbia; official criminal record: convicted before the District Court in Novi Sad and currently serving his sentence in the Correction Centre Sremska Mitrovica, pursuant to ruling no. K-287/06, rendered by that Court, BECAUSE: In the period between the afternoon of 20 November and early morning of 21 November 1991, at a farm called Ovčara outside Vukovar, in the then Republic of Croatia – part of the former Socialist Federal Republic of Yugoslavia (SFRY), acting as a member of the Vukovar Territorial Defence force (TO) operating within the then Yugoslav Peoples Army (JNA); in the course of the ongoing armed conflict in that region, which did not have an international character, this accused committed serious breaches of international law, namely of the following acts: - Articles 3 (1a) and 4 (1), (2) and (3) of the 1949 Geneva Convention relative to the Treatment of Prisoners of War (Geneva Convention III), ratified by the FPRY National Assembly of the Federal Peoples Republic of Yugoslavia (FPRY) in 1950; and - Article 4 (1) and (2.a) of the Protocol Additional to the Geneva Convention on the Protection of Victims of Noninternational Armed Conflicts (Protocol II), adopted on 08 June 1977 (SFRY Official Gazette no. 16/18, International Contracts). Acting together with the following members of his unit: Miroljub VUJOVIĆ, Stanko 1 VUJANOVIĆ, Miroslav ĐANKOVIĆ, Milan BULIĆ, Jovica PERIĆ, Milan VOJNOVIĆ, Goran MUGOŠA, and Damir SIRETA; and with members of the voluntary unit Leva Supoderica, namely the following: Milan LANČUŽANIN, Predrag MILOJEVIĆ, Predrag DRAGOVIĆ, Ivan ANASTASIJEVIĆ (named Ivica HUSNIK at the time), Đorđe ŠOŠIĆ, Nada KALABA, Saša RADAK (against whom proceedings have been finally completed), and a number of other unidentified individuals, the accused, Petar ĆIRIĆ, engaged in the killing and physical injuring of war prisoners from the Vukovar Hospital, who had previously surrendered their weapons to the JNA soldiers and then been handed over to the Vukovar TO force. Among those captured in this way were members of the Croatian armed forces, militias, voluntary units and persons escorting those armed forces albeit not directly belonging to them. Description of the criminal offence: On their way to a farm hangar where they were going to be confined, the captives were forced to run between two lines of soldiers. Standing in one of the lines, the accused, Petar ĆIRIĆ, beat and physically injured the captives as they passed. A while later, when a list with their identification details had been made, the war prisoners were divided into groups which were then loaded on a tractor and transported in several tours to Grabovo, a site 1km away from Ovčara. Present in a firing sqad that was formed at Grabovo, the accused, Petar MARIĆ, shot and killed the captives. On his return from Grabovo to Ovčara, the accused engaged in the execution of the last remaining group of around ten prisoners, which took place in front of the hangar. In the aftermath of the above-described massacre, two hundred (200) persons were deprived of life, of whom one hundred and ninety-three (193) have been positively identified. By his involvement in the above-described acts, the accused, Petar ĆIRIĆ, committed the criminal offence recognized by article 144 (war crime against prisoners of war committed in co-perpetration), in re article 22 of the FRY Criminal Code. In view of the foregoing, I PROPOSE That the main trial of this case be scheduled and held before this court, whereto the following persons should be summoned to attend: 1. War Crimes Prosecutor 2. The accused, Petar Ćirić, to be brought from the Correction Centre in Sremska Mitrovica, where he is serving his sentence 3. Defence counsel for the accused 4.
