UVJETI KORIŠTENJA MOBILNE APLIKACIJE ZA USLUGU epostcard
1. PREDMET UVJETA
1.1.
Ovi Uvjeti korištenja mobilne aplikacije za uslugu epostcard (u daljnjem tekstu: Uvjeti) sastavni su dio
ugovora o pružanju usluge epostcard iz točke 2. ovih Uvjeta i vrijede za sve narudžbe usluge epostcard (u
daljnjem tekstu: usluga epostcard).
1.2.
Na sve odnose između društva HP-Hrvatska pošta d.d. (u daljnjem tekstu: davatelj usluge) i korisnika
usluge epostcard kao naručitelja i pošiljatelja epostcarda (u daljnjem tekstu: korisnik) koji nisu uređeni ovim
Uvjetima primjenjuju se odredbe vrijedećih mjerodavnih propisa RH, odredbe vrijedećih Općih uvjeta za
obavljanje ostalih poštanskih usluga i Općih uvjeta za obavljanje univerzalne usluge davatelja usluge.
Prihvaćanjem ovih Uvjeta korisnik potvrđuje da je upoznat s navedenim općim uvjetima davatelja usluge te na
njih pristaje. Korisnik također potvrđuje da je upoznat da se ovi Uvjeti, kao i ostali vrijedeći primjenjivi opći uvjeti
davatelja usluge te njihove izmjene i dopune objavljuju na internetskim stranicama davatelja usluge
www.epostcard.hr i www.posta.hr te se obvezuje o njima informirati uvidom u navedene internetske stranice.
1.3.
Uz navedeno u točki 1.2. ovih Uvjeta, u slučaju plaćanja usluge epostcard mobilnim plaćanjem
(pokretnom javnom komunikacijskom mrežom operatera) primjenjuju se i odredbe vrijedećih uvjeta operatera
elektroničkih komunikacijskih usluga kao posrednika između korisnika platnih usluga i davatelja usluge
primjenjivih s obzirom na vrstu usluge.
1.4.
Uz navedeno u točki 1.2. ovih Uvjeta, u slučaju plaćanja usluge epostcard debitnim ili kreditnim platnim
karticama primjenjuju se i odredbe vrijedećih uvjeta izdavatelja platnih kartica primjenjivih s obzirom na vrstu
usluge.
2. SKLAPANJE UGOVORA
2.1.
Odabirom opcije Plati u mobilnoj aplikaciji usluge epostcard korisnik potvrđuje da je upoznat s ovim
Uvjetima te da ih u potpunosti razumije i prihvaća. Ugovor o pružanju usluge epostcard smatra se sklopljenim s
davateljem usluge od trenutka dobivanja potvrde o uspješno izvršenom odabiru opcije Plati putem SMS poruke
(u daljnjem tekstu: odabir opcije Plati i dobivanje potvrde o uspješnom odabiru opcije Plati zajedno se nazivaju
transakcija).
2.2.
Sklapanjem navedenog ugovora o pružanju usluge epostcad korisniku će se naplatiti usluga epostcard
u skladu s Cjenikom poštanskih usluga u unutarnjem i međunarodnom prometu davatelja usluge vrijedećem na
dan sklapanja ugovora, koji čini sastavni dio ugovora o pružanju usluge epostcard.
2.3.
Ugovor o pružanju usluge epostcard sklapa se na određeno vrijeme do njegova izvršenja u skladu s
rokovima iz točke 8. ovih Uvjeta.
3. OSNOVNE INFORMACIJE O USLUZI
3.1.
Usluga epostcard je usluga koja putem mobilne aplikacije omogućava individualno oblikovanje
razglednice u fizičkom obliku prema specifikaciji korisnika s pomoću pametnog telefona (smartphone) ili uz
pomoć neke druge tehničke naprave za obradu podataka te njezino tiskanje i uručenje primatelju. Usluga
omogućava oblikovanje bez slike, s postojećom slikom ili tek snimljenom slikom. Nakon toga korisnik unosi
podatke o primatelju ili primateljima te odabire način plaćanja. Nakon uspješno obavljene transakcije korisnik
usluge dobiva SMS poruku o uspješno obavljenoj transakciji te se u rokovima iz točke 8. ovih Uvjeta primatelju
uručuje razglednica u fizičkom obliku. Uspješno obavljena transakcija podrazumijeva da su digitalni sadržaj
epostcarda i preostali podatci iz točke 3.2. ovih Uvjeta uspješno učitani na poslužitelj mobilne aplikacije za
uslugu epostcard te da je ugovor o pružanju usluge epostcard uspješno sklopljen i naplaćen od strane korisnika.
3.2.
Mobilna aplikacija za uslugu epostcard namijenjena je uređajima s operativnim sustavima iOS i Android.
3.3.
Razglednica u fizičkom obliku i izrađena korištenjem usluge epostcard (u daljnjem tekstu: epostcard)
sastoji se od:
1. tekstualnog područja, kao sastavnog dijela svake razglednice, u koji se unosi tekst s mogućnošću
potpisivanja
2. adrese primatelja kao obveznog podatka
3. propisane oznake (logotip usluge; digitalni prikaz poštanske marke)
4. praznog područja/polja u koje se može nešto otisnuti; u prazno polje korisnik ugrađuje digitalno
prenesenu sliku, motiv, grafiku, kao i tekst (u daljnjem tekstu: prikaz). Nije moguća naknadna obrada
prenesenih prikaza od strane davatelja usluge.
3.4.
Epostcard tiska se na tvrdom papiru u obliku pravokutnika (dimenzije: 120x180 mm), obostrano u boji,
plastificira radi zaštite i otprema prema primatelju bez omotnice.
3.5.
Zaštićeni su svi dijelovi prikaza te ih davatelj usluge, bez prethodnog pismenog odobrenja od korisnika,
neće upotrebljavati ni za kakvu daljnju potrebu osim u svrhu realizacije naručene usluge epostcard.
3.6.
Korisnik može na temelju jednog ugovora o pružanju usluge epostcard naručiti više epostcarda pri
čemu najveći broj epostcarda koji se mogu naručiti i platiti na temelju jednog ugovora o pružanju usluge
epostcarda određuje operater elektroničkih komunikacijskih usluga kao posrednik između korisnika kao
korisnika platne usluge mobilnog plaćanja i davatelja usluge, dok navedena ograničenja ne postoje u slučaju
plaćanja usluge epostcard platnim karticama ponuđenim unutar mobilne aplikacije usluge epostcard.
4. FORMAT PRIKAZA
Prikaz (standard formata za izradu fotografije) koji je poslao korisnik mora odgovarati sljedećim zahtjevima:
 format slike: JPG
 najmanja veličina: 2400x1440 piksela.
5. ODGOVORNOST KORISNIKA
Korisnik jamči da je u skladu sa Zakonom o autorskim i srodnim pravima autor ili nositelj autorskih prava i /ili
drugih srodnih prava u pogledu slikovnog ili tekstualnog sadržaja epostcarda te da ona nisu ograničena u korist
trećih osoba. Korisnik snosi svu materijalnu i kaznenu odgovornost u slučaju kršenja prava intelektualnog
vlasništva. Navedenim postupanjem korisnik potvrđuje i pristanak svake osobe koja se nalazi na prikazu za
korištenje kroz uslugu epostcard i na epostcardu. U slučaju da davatelj usluge razložno posumnja u ovlašteno
korištenje prikaza, ovlašten je zatražiti od korisnika dokaz o pravnoj osnovi istog.
6. NADZOR NAD KORIŠTENJEM USLUGE
6.1.
Korisnik je sporazuman da davatelj usluge zadržava pravo u bilo kojem trenutku i bez prethodne
obavijesti ograničiti odnosno obustaviti pružanje usluge epostcard (te time raskinuti ugovor o pružanju usluge
epostcard) ako se korisnik koristi uslugom epostcard na nedopušten i/ili neprihvatljiv način te radi zaštite
sigurnosti i poštivanja etičkih standarda. U tom slučaju korisnik nema pravo na povrat plaćene cijene za uslugu
epostcard. U navedenom slučaju davatelj usluge će uz navođenje razloga o navedenom obavijestiti korisnika na
ostavljenu adresu elektroničke pošte ili putem ostavljenog broja kontaktnog telefona.
6.2.
Korisnik snosi potpunu odgovornost za zakonitost, kvalitetu prikaza i istinitost podataka koje učini
dostupnim davatelju usluge i javnosti korištenjem usluge epostcard.
6.3
Korisnik je dužan koristiti se uslugom epostcard na prihvatljiv i dopušten način. Pod neprihvatljivim i
nedopuštenim načinom korištenja usluge epostcard smatra se svako korištenje usluge epostcard koje bi prema
procjeni davatelja usluge dovelo do povrede zakona i drugih propisa Republike Hrvatske, etičkih normi ili koje bi
moglo dovesti do nastanka bilo koje vrste štete, a osobito:
- distribuiranje podataka protivnih vrijedećim propisima, koji su uvredljivi, koji bi mogli ugroziti prava osobnosti
pojedine fizičke odnosno pravne osobe, osobito takvih koji obuhvaćaju podatke o djeci;
- distribuiranje podataka koji bi mogli nanijeti štetu davatelju usluge;
- distribuiranje sadržaja kojima se krši intelektualno vlasništvo davatelja usluge ili trećih osoba;
- distribuiranje sadržaja kojim se očito reklamiraju marke duhanskih proizvoda, pornografija ili drugi proizvodi
kojima je ograničeno ili zabranjeno reklamiranje u Republici Hrvatskoj.
6.4.
Davatelj usluge zadržava pravo pregleda naručenih epostcarda te neće tiskati/otpremati naručene
epostcarde s prikazima i tekstom koji nisu u skladu s prihvatljivim i dopuštenim načinom korištenja usluge
epostcard u skladu s točkom 6.3. ovih Uvjeta, osobito one koji vrijeđaju slobodu i prava drugih ljudi, pravni
poredak i javni moral, koji su uvredljivi, vulgarni, prijeteći, rasistički, šovinistički, štetni ili diskriminacijski na bilo
koji drugi način, o čemu će obavijestiti korisnika te davatelj usluge ima pravo prijaviti ovlaštenim tijelima svako
kršenje zakona i propisa u smislu ove odredbe.
7. NARUDŽBA
Narudžba usluge epostcard obavlja se uz pomoć učitavanja (upload) prikaza koji se nalazi unutar mobilne
aplikacije za uslugu epostcard, popunjavanjem obveznih polja te plaćanjem usluge epostcard.
8. ROKOVI IZRADE I DOSTAVE
8.1.
Davatelj usluge obvezuje se obaviti uslugu u cijelosti i uručiti epostcard primatelju u roku od pet (5)
dana od trenutka uspješno izvršene transakcije.
8.2.
Korisnik preuzima odgovornost da svoj mobilni uređaj poveže s podatkovnim prometom kako bi se
narudžba epostcarda isporučila na poslužitelj (server) ugovorenog pružatelja grafičkih usluga, pri čemu sam
korisnik snosi povezane dodatne troškove.
9. PRAVO RASKIDA UGOVORA O PRUŽANJU USLUGE epostcard
Prihvatom ovih Uvjeta korisnik daje izričitu suglasnost i pristanak da davatelj usluge počne obavljanje usluge
odmah nakon sklapanja ugovora o pružanju usluge epostcard. Stoga korisnik nakon sklapanja ugovora o
pružanju usluge epostcard ne može mijenjati narudžbu, uključujući i sadržaj epostcarda. Budući da se ugovor o
pružanju usluge epostcard sklapa na daljinu, a kako je predmet istog ugovora epostcard prilagođen korisniku i
izrađen prema njegovoj specifikaciji, korisnik nakon prihvata ovih Uvjeta te odabira opcije Plati nema pravo na
jednostrani raskid ugovora o pružanju usluge epostcard, ne navodeći razloge za to, te nema pravo na povrat
plaćene cijene za uslugu epostcard. Ujedno, prihvatom ovih Uvjeta korisnik potvrđuje da je upoznat s
navedenim isključenjem prava na jednostrani raskid ugovora o pružanju usluge epostcard u skladu sa Zakonom
o zaštiti potrošača.
10. JAMSTVO I ODGOVORNOSTI
10.1. Ako se naručeni epostcard ne otisne u skladu s narudžbom, osim ako je riječ o manjim odstupanjima,
npr. sitni tragovi obrade, sitna odstupanja od boje, sitna odstupanja u pozicioniranju prikaza na praznom polju
za otiskivanje unutar fiksnog okvira i dr. korisnik ima pravo zahtijevati izradu novog epostcarda ili pravo
zahtijevati snižavanje cijene usluge epostcard ili pravo raskinuti ugovor o pružanju usluge epostcard uz pravo
na naknadu štete u skladu s propisima.
10.2. Korisnik može podnijeti prigovor (reklamaciju):
1. u poslovnim prostorijama davatelja usluge
2. elektroničkom poštom na: [email protected]
3. telefaksom na broj: 01 6626 889
4. poštom na adresu: HP-Hrvatska pošta d.d., Sektor za korisnike, Branimirova 4, 10000 Zagreb.
10.3. Pravo na prigovor (reklamaciju) u skladu s prethodnom točkom, kao i pravo na prigovor iz svih drugih
osnova korisnik ima u roku od tri (3) mjeseca u unutarnjem prometu odnosno u roku od šest (6) mjeseci u
međunarodnom prometu računajući od trenutka uspješno izvršene transakcije. Na sve prigovore davatelj usluge
odgovorit će u roku od najviše trideset (30) dana od dana zaprimanja prigovora u unutarnjem prometu odnosno
u roku od najviše šezdeset (60) dana od dana zaprimanja prigovora u međunarodnom prometu. Na zaštitu
korisnika u slučaju da se ostvare propisane pretpostavke primjenjuje se postupak podnošenja prigovora i
rješavanja sporova propisan Zakonom o poštanskim uslugama, kao i općim uvjetima davatelja usluge
navedenim u točki 1.2 ovih Uvjeta.
10.4. U slučaju odgovornosti davatelja usluge za štetu povezanu s uslugom uručenja epostcarda primjenjuju
se odredbe Zakona o poštanskim uslugama te primjenjivih općih uvjeta davatelja usluge iz točke 1.2. ovih
Uvjeta.
10.5. Korisnik preuzima odgovornost za tekstualni i slikovni sadržaj epostcarda te se neopozivo i bezuvjetno
obvezuje nadoknaditi davatelju usluge ili trećoj osobi svu štetu koja može nastati korištenjem usluge epostcard.
10.6. Davatelj usluge neće biti odgovoran za neizvršavanje preuzetih obveza ako je neizvršenje rezultat više
sile, tj. događaja izvan kontrole davatelja usluge i nezavisno od njegove volje te izravno utječe na izvršenje
obveza. Viša sila uključuje, ali nije ograničena na elementarne nepogode, ratno stanje, štrajk, embargo odnosno
restrikcije bilo koje vrste.
11. CIJENA USLUGE I PLAĆANJE
11.1. Cijena usluge epostcard utvrđena je Cjenikom poštanskih usluga u domaćem i međunarodnom prometu
davatelja usluge vrijedećem na dan sklapanja ugovora o pružanju usluge epostcard.
11.2. U cijenu usluge epostcard nije uračunat podatkovni promet, troškovi bilo koje druge vrste do kojih može
doći prilikom pregleda ili pretraživanja internetske stranice www.epostcard.hr ni naknada za platni promet
operatera elektroničkih komunikacija. Eventualne troškove doznačavanja novčanih sredstava i bankovne
troškove snosi sam korisnik. Davatelj usluge nije ni na koji način odgovoran za odnos između korisnika i
operatera elektroničkih komunikacijskih usluga i izdavatelja platnih kartica. Davatelj usluge ne snosi
odgovornost za bilo koju štetu koja bi mogla nastati zbog prekida internetske veze prilikom korištenja usluge
epostcard.
11.3. Plaćanje naknade za uslugu epostcard može se obaviti jednom od mogućnosti plaćanja ponuđenih u
mobilnoj aplikaciji za tu uslugu, i to mobilnim plaćanjem putem pokretne javne komunikacijske mreže operatera
elektroničkih komunikacijskih usluga ili platnim karticama ponuđenim unutar mobilne aplikacije usluge
epostcard.
11.4. Plaćanje usluge, povjerljivost i zaštita podataka osigurani su SSL protokolom sa 128-bitnom enkripcijom
podataka čime se osigurava siguran prijenos informacija te onemogućuje nedopušten pristup podatcima od
strane trećih osoba.
12. MJERODAVNO PRAVO
Za tumačenje, primjenu i pravne učinke svih dopuštenja, isključenja i uvjeta korištenja usluge epostcard
mjerodavno je hrvatsko pravo, a za sve zahtjeve i sporove koji nastanu kao rezultat korištenja usluge epostcard
ili u svezi s njima jedino je mjesno nadležan sud u Zagrebu.
13. ZAVRŠNE ODREDBE
13.1. Ovi Uvjeti primjenjuju se od 1. 7. 2014.
13.2. Davatelj usluge zadržava pravo izmjene ovih Uvjeta u skladu s propisima. Sve izmjene bit će dostupne
u poštanskim uredima davatelja usluge i na internetskoj stranici www.epostcard.hr prije stupanja na snagu.
13.3. Izmjene Općih uvjeta za obavljanje univerzalne usluge, Općih uvjeta za obavljanje ostalih poštanskih
uvjeta, Cjenika poštanskih usluga u unutarnjem prometu i Cjenika poštanskih usluga u međunarodnom prometu
obavljaju se u skladu s navedenim aktima.
13.4. Ovi Uvjeti sadrže sve sastavnice obavijesti iz članka 57. stavak 1. Zakona o zaštiti potrošača te korisnik
njihovim prihvatom potvrđuje da je prije sklapanja ugovora o usluzi epostcard bio na jasan i razumljiv način
obaviješten o svim propisanim informacijama, uključujući glavna obilježja usluge epostcard, podatke o davatelju
usluge, cijenama i načinu te uvjetima plaćanja usluge epostcard, troškovima uporabe sredstava daljinske
komunikacije u svrhu sklapanja ugovora o pružanju usluge epostcard, o isključenju prava na raskid ugovora o
pružanju usluge epostcard, postojanju odgovornosti za materijalne nedostatke, trajanju ugovora o pružanju
usluge epostcard i mehanizmima izvansudskog rješavanja sporova. Stoga se ovi Uvjeti, u slučaju njihova
prihvata od strane korisnika i to odabirom opcije Plati u mobilnoj aplikaciji usluge epostcard, te nakon dobivanja
potvrde o uspješno izvršenom odabiru opcije Plati smatraju i potvrdom o sklopljenom ugovoru iz članka 69.
stavak 1. Zakona o zaštiti potrošača.
13.5. Davatelj usluge obvezuje se čuvati privatnost osobnih podataka korisnika do kojih može doći na temelju
korištenja usluge epostcard u skladu sa Zakonom o zaštiti osobnih podataka i drugim primjenjivim propisima.
Prihvatom ovih Uvjeta korisnik pristaje na to da se njegovi osobni podatci moguće sadržani u elektroničkom
obrascu mobilne aplikacije usluge epostcard koriste u svrhu sklapanja i izvršenja ugovora o usluzi epostcard te
za interne evidencije davatelja usluge povezane s istom uslugom. Davatelj usluge nije odgovoran ni po kojoj
osnovi ni za kakvu štetu koja može nastati kao posljedica nepravilnog odnosno neovlaštenog postupanja s
osobnim podatcima korisnika, a ako navedeni nisu u domeni davatelja usluge. Ako korisnik posumnja u
neautorizirano korištenje svojih podataka, o tome treba u najkraćem roku obavijestiti davatelja usluge na adresu
elektroničke pošte: [email protected].

CONDITIONS FOR USE OF EPOSTCARD SERVICE MOBILE APPLICATION
1. SUBJECT OF CONDITIONS
1.1.
This Conditions for use of epostcard service mobile application (hereinafter: Conditions) are an integral
part of theagreement onproviding epostcard service from point 2 of theConditionsand are valid for all orders of
epostcard service (hereinafter: epostcard service).
1.2.
All relations betweenthe company HP-Hrvatska pošta / Croatian PostInc(hereinafter: service
provider)and the epostcard service useras purchaserand sender of epostcard (hereinafter: user) which are not
regulated in the Conditionsare subject to relevant valid regulations of the Republic of Croatia,regulations of the
General conditions for performing other postal services and General conditions for performing universal service
of the service provider, which are in force.By accepting the Conditionsthe user affirmsthat he is aware of the
cited general conditions of the service provider and agrees to them. The user also affirmsthat he is aware of the
fact that the Conditions,other applicable general conditions in force of the service provider as well as their
amendments are published onweb page of the service providerwww.epostcard.hrandwww.posta.hrand commits
to use them as source of information thereof.
1.3.
Along with the above stated in point 1.2of the Conditions, in case of payment for epostcardservice by
mobile application (mobile public communication network of an operator) also the stipulations of conditions in
force of electronic communication operators asintermediary between the user of payment services andthe
service provider apply, applicable with regard to the kind of service.
1.4.
Along with the above stated in point 1.2 of the Conditions, in case of payment for epostcard service by
debit or credit cardsalso the stipulationsof conditions in force of the card issuers apply, applicable with regard to
the kind of service.
2. CONCLUSION OF AGREEMENT
2.1.
By selecting the optionPayin mobile application of the epostcard service the user affirms that he is
informed about the Conditions and that he fully understands and accepts them. The agreement on provision of
epostcard service is considered as concluded with the service providerfrom the moment of receiving
confirmation of successfully selected optionPaythroughSMSmessage(hereinafter: selection of option Payand
receipt of confirmation of successfully selected option Pay together are referred to as transaction).
2.2.
Upon conclusion of the aforementioned agreementon providing epostcard service the user will be
charged forepostcardservice in accordance with the Pricelist of postal services in national and international
traffic of the service provider, in force on the date of agreement conclusion, which is an integral part of the
agreement on provision of epostcard service.
2.3.
The agreement on provision of epostcard service is concluded for definite time period until its
realisation, in accordance with deadlines from point 8 of the Conditions.
3. BASIC INFORMATION ABOUT THE SERVICE
3.1.
Epostcardservice is a service enabling individual designing of a postcard in physical form through
mobile application, according to specifications by the user and by means of smartphone or some other technical
device for data processing as well as its printing and delivery to the addressee. The service offers options
ofdesign without photograph, with already existing photographor just taken photograph. Then, the user enters
addressee(s)’ data and selects the way of payment. After successfully accomplished transaction the service
userreceives anSMSmessageon the successfully accomplished transaction whereupon the postcard is
delivered in its physical form to the addressee within deadlines from point 8of the Conditions.Successfully
accomplished transactionimplies that digital content of epostcard and other data from point3.2of the
Conditionshave been successfully downloadedby the server of mobile application forepostcard service and that
the agreement on epostcard serviceprovision has been successfully concluded and the user charged
accordingly.
3.2.
Mobile application for epostcard service is intended for devices with iOS and Android operating
systems.
3.3.
The postcard in physical form, produced by usingepostcard service(hereinafter: epostcard)consists of:
1.Text field, as integral part of each postcard, where text is entered with the option of signature
2. Receiver's address as mandatory data
3.Prescribed indication (service logo; digital presentationof postage stamp)
4. Empty area/fieldwhere something can be printed;here the userimportsa digitally transferred image,
motif, graphicsas well as text (hereinafter: depiction).Subsequent shaping of downloaded depictionsby
the service provider is not possible.
3.4.
Epostcardis printed on hard paperin rectangular form (paper size: 120x180mm), on both sides in colour,
it is coated for protectionand dispatched to the addressee without envelope.
3.5.
All parts of depiction are protectedand the service provider shall not use them without prior approval in
writing by the service user for any other purpose but the realisation of the ordered epostcard service.
3.6.
On the basis of one agreement on providing epostcard service the user cannot order more epostcards,
whereat the highest number of postcards that can be ordered and paid based on one agreement on providing
epostcardservice is determined by the electronic communications operator as intermediarybetween the user as
the user of mobile payment service and the service provider;the aforementioned limitations do not exist for
paymentsofepostcard service withpayment cardsoffered by the mobile application of epostcard service.
4. FORMAT OF DEPICTION
Depiction (format standard for photo developing) sent by the user must meet following requirements:
 Picture format: JPG
 Minimum size: 2400x1440 pixels.
5. USER'S LIABILITY
The user guaranteesthat in accordance with the Copyright and Related Rights Act he is the author or the holder
of author rights and/orother related rights concerningvisual or textual content of theepostcardand that these
rights are not limited on behalf of third persons. The user bears all material and criminal responsibility in case of
violation of the intellectualproperty right.Hereby, the user also confirms consent of any other person shown in
the depiction ofepostcardservice and on epostcard itself. In case the service provider reasonably doubts
authoriseduse of the depiction, he is entitled to request a proof of legal basis thereof from the user.
6. CONTROL OF SERVICE USE
6.1.
The user consents that the service provider preserves the right to limit i.e. interrupt the provision of
epostcard service at any momentand without prior notice (and thus terminates the agreement on epostcard
service provision)if the user uses the epostcard service in illicit and/or unacceptableway,or for security reasons
and respect of ethical standards.In such case the user has no right to claim refund of the price paid for the
epostcard service.In this case the service provider shall inform the user accordingly, using the user’s e-mail
address or his telephone number provided for contacts.
6.2.
The user bears full responsibility for the legality, quality of depiction, and truth of data which he makes
available to the service provider and the public byusing epostcard service.
6.3
The user is obliged to use theepostcard service in acceptable and permitted way.Under unacceptable
and unpermittedway ofepostcard service use any use ofepostcard service is understood which according to the
estimate of the service provider might result in an offence of law and other regulations of the Republic of
Croatia as well as ethic norms, or which could result in any kind of damage incurred, especially:
- distribution of datacontrary toregulations in force, which are offensive, which could affect personal rights of a
particular physical or legal person, especially such rights which concern data about children;
- distribution of data which could harm the service provider;
- distribution of contents which violate intellectualproperty of service providers or third parties;
- distribution of contents which obviouslyadvertisetobacco industry brands, pornographyor other productswhose
advertising is limited or prohibited in the Republic of Croatia.
6.4.The service provider reserves the right to control the ordered postcardsand shall not print /dispatchordered
epostcardswith depictions and textsthat are not in accordance with acceptable and permitted way of use of
epostcardservice in line with point6.3. of the Conditions, especially those which offend freedom and rights of
other people, legal system and public morality and which are offensive, vulgar, threatening, racist,
chauvinist,harmfulor discriminatory in any other way, whereof the service provider shall inform the userand
which heis entitled to report to authorisedbodies for any violation of lawand regulations in terms of this
stipulation.
7. ORDER
The order of the epostcard service is performed by uploadingdepiction from mobile applicationforepostcard
service, filling in the mandatory fieldsand payingfor the epostcard service.
8. DEADLINES FOR PREPARATION AND DELIVERY
8.1.
The service provider commits to perform the complete service anddeliver epostcardto the
addresseewithin five (5)daysfrom the moment of successfully accomplished transaction.
8.2.
The user is responsible for connecting his mobile device to online data flow to enable that the
epostcardorder is delivered to the serverof the contractedgraphic services provider, whereat the user bears the
relatedadditional costs.
9. RIGHT TO TERMINATION OF THE AGREEMENT ON THE PROVISION OF EPOSTCARD SERVICE
By accepting the Conditionsthe user gives his explicitconsent andagreement to the service provider to start
performing the serviceimmediately upon concluded agreement on the provision of epostcard service.
Therefore, the user cannot change his order or the content of the epostcard after conclusion of the agreement
on the provision of epostcard service. Since the agreement on the provision of epostcard service is concluded at
distance, and sincethe subject of the agreement on provision of epostcard service is adapted to the user and
created according to his specifications, the user has no right after the acceptance of Conditions and selection of
Pay option to one-sided termination of the agreement on epostcard service provision without stating the reasons
and no right to the restitution of the fee paid for the epostcard service. Accordingly, by accepting the Conditions
the user affirms that he is informed about the stated exclusion of right to one-sided termination of the agreement
on epostcard service provision in accordance with the Consumer Protection Law.
10. GUARANTEE AND LIABILITIES
10.1. If the orderedepostcardis not printed in accordance with the order,with the exemption of smaller
aberrations, e.g. tiny traces of processing, slight colour aberrations, slight aberrations in depiction positioningin
the empty field for printing within fixed frameetc, the user has the right to demand the production of new
epostcard,the price reduction of the epostcard service or the right to terminate the agreement onprovision of
epostcard service and demand the indemnification for damage in accordance with regulations.
10.2. The user can submit claim (reclamation):

10.3. Right to claim(reclamation)in accordance with the above point,as well as the right derived from other
groundscan be exercised within three (3)monthsin national service i.e. six months in international service,
counting from the moment of successfully accomplished transaction.The service provider shall resolve all
claims within the maximum of thirty (30) days from the date of claim receipt in national service and the
maximum of sixty (60) daysfrom the date of claim receipt in international service. As concerns consumer
protection, in case the prescribed presumptions occur, the procedure of claim submission and dispute solving
prescribedby the Postal Services Act as well as in general conditions of the service providerstated in point1.2
of the Conditions apply.
10.4. In case ofliability of theservice providerfor damage in connection with the delivery of epostcard the
regulations of the Postal Services Act and applicable general conditions of the service provider from point 1.2 of
theConditions apply.
10.5. The user assumes responsibilityfor textual and visualcontent of epostcardand is irrevocably and
unconditionally obligedto compensate the service provider or third parson any damage that might result from the
use of epostcard service.
10.6. The providershall not be held responsiblefor the fulfilment of obligations from the agreement if the nonperformance is result of force majeurei.e. events outside control of the service providerand independent from his
will, which directly influencethe service performance.The force majeure implies but is not limited to natural
disasters, wars, strikes, embargo i.e. restrictions of any kind.
11. SERVICE PRICE AND PAYMENT
11.1. The price of postcard service is determined in the Pricelist of postal services in national and
international traffic of the service provider, in force on the day of conclusion of the agreement on provision of
epostcard service.
11.2. The price of the epostcard service does not include data traffic, any other costs which can incurduring
reviewing or search of web pagewww.epostcard.hror payment services fees of the electronic communications
operator. Possible costsof money transfersand bank costsare born by the user. The service provider is in no
wayresponsible for the relationship between the user and the operator of electronic communications services
and issuer of payment cards.The service provider is not responsible for any damage which might result from the
interruption of Internet connection during use of epostcard service.
11.3. Payment of fees for epostcard servicecan be performed in one of the ways offered in the mobile
application of the service, i.e. by payment through mobile public communication networkof the operator of
electronic communications services or by payment cards offered in the mobile application of the epostcard
service.
11.4. Payment of service, confidentiality and data protection are secured by the SSL protocolwith 128bitedata encryption which ensures safe transfer of information andprevents unauthorised access to data by third
persons.
12. RELEVANT LAW
As concerns interpretation, applicationand legal effects of all permissions, exclusionsand conditions for the use
of epostcard service, relevant is Croatian law and for all claims and disputes which may arise as the result of
the use of epostcard service and in relation to it, the only territorial jurisdiction is the court in Zagreb.
13. FINAL REGULATIONS
13.1. The Conditions apply from1/7/2014.
13.2. The service provider reserves the right to change the Conditions in accordance with regulations. All
amendments will be available in post offices of the service provider and atwww.epostcard.hrbefore entering into
force.
13.3. The amendments of General conditions for provision of universal service, General conditionsfor
performance of other postal services, Pricelist of postal services in national traffic and Pricelist of postal services
in international traffic are introduced in accordance with the cited documents.
13.4. The Conditions containall components of the information from Article 57,item1 of the Consumer
Protection Law and by accepting them the user affirms that before concluding the agreement on epostcard
service he was in clear and understandable way informed about all prescribed information, including the main
features of the epostcard service, data on service provider, prices and the way and conditions of payment for
epostcard service,costs of use of devices for distant communication for the purpose of concluding the
agreement on provision of epostcard service, on exclusion of the right to terminate the agreement on epostcard
service provision,on the existence of liability for material deficiencies, on the duration of the agreement on
epostcard service provision and on mechanismsof out- of-court dispute solving.Therefore, these Conditions, if
accepted by the user by selecting the Pay option in mobile application of the epostcard serviceand upon receipt
of the confirmation of successfully selectedPayoption, are considered as confirmation of the conclusion of
theagreement from Article69,item1 of the Customer Protection Law.
13.5. The service provider commitsto keep secret users' personal datawhich he received based on the use of
epostcard service in accordance with the Personal Data Protection Act and other applicable acts. By accepting
the Conditions the user accepts also that his personal data which might be contained in the electronic form of
the mobile applicationof the epostcard service are used to the purpose of concluding and executing the
agreement on epostcard service and for internal records of the service provider in connection with the service.
The service provider is not liable in any case for any damagewhich can occur as consequence of irregular or
unauthorised treatment of users' personal dataif such data are not in the domain of service provider.If the user
doubts unauthorised use of his data,he can in the shortest possible time inform thereof the service providerby
sending an e-mail at: [email protected].
