WINDOWS 7 ULTIMATE FOR EMBEDDED SYSTEMS
WINDOWS 7 PROFESSIONAL FOR EMBEDDED SYSTEMS (ALL VERSIONS)
These license terms are an agreement between you and Rimage Corporation. Please read them. They
apply to the software included on this device. The software also includes any separate media on which
you received the software.
The software on this device includes software licensed from Microsoft Corporation or its affiliate.
The terms also apply to any Microsoft

updates,

supplements,

Internet-based services, and

support services
for this software, unless other terms accompany those items. If so, those terms apply.
If you obtain updates or supplements directly from Microsoft, then Microsoft, and not Rimage
Corporation, licenses those to you.
As described below, using the software also operates as your consent to the transmission of
certain computer information for Internet-based services.
By using the software, you accept these terms. If you do not accept them, do not use the
software. Instead, contact Rimage Corporation to determine its return policy for a refund or
credit.
If you comply with these license terms, you have the rights below.
1. OVERVIEW.
a. Software. The software includes desktop operating system software. This software does not
include Windows Live services. Windows Live services are available from Microsoft under a
separate agreement.
2. USE RIGHTS.
a. Use. The software license is permanently assigned to the device with which you acquired the
software. That device is the “licensed device”. You may use the software on the licensed device.
b. Processor Limit. You may use the software with no more than two processors at any one time.
c. Alternative Versions. You may only use the version of the software that is installed on the
licensed device. You may not change it to any other version (such as the 32-bit or 64-bit
version, or another language version).
3. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS.
a. Specific Use. Rimage Corporation designed the licensed device for a specific use. You may
only use the software for that use.
b. Other Software. You may use other programs with the software as long as the other programs

directly support the specific use for the licensed device, or

provide system utilities, resource management, or anti-virus or similar protection.
Software that provides consumer or business tasks or processes may not run on the licensed
device. This includes email, word processing, spreadsheet, database, scheduling and personal
finance software. The licensed device may use terminal services protocols to access such
software running on a server.
c. Device Connections. You may not use the software as server software. In other words, more
than one device may not access, display, run, share or use the software at the same time. You
may allow up to twenty other devices to access the software to use

File Services,

Print Services,

Internet Information Services, and

Internet Connection Sharing and Telephony Services.
The twenty connection limit applies to devices that access the software indirectly through
“multiplexing” or other software or hardware that pools connections. You may use unlimited
inbound connections at any time via TCP/IP.
d. Remote Access Technologies. You may access and use the software remotely from another
device using remote access technologies as follows.
Remote Desktop. The single primary user of the licensed device may access a session from any
other device using Remote Desktop or similar technologies. A “session” means the experience of
interacting with the software, directly or indirectly, through any combination of input, output and
display peripherals. Other users may access a session from any device using these technologies,
if the remote device is separately licensed to run the software.
Other Access Technologies. You may use Remote Assistance or similar technologies to share an
active session.
Other Remote Uses. You may allow any number of devices to access the software for purposes
other than those described in the Device Connections and Remote Access Technologies sections
above, such as to synchronize data between devices.
e. Font Components. While the software is running, you may use its fonts to display and print
content. You may only
f.

embed fonts in content as permitted by the embedding restrictions in the fonts; and

temporarily download them to a printer or other output device to print content.
Icons, images and sounds. While the software is running, you may use but not share its icons,
images, sounds, and media.
4. POTENTIALLY UNWANTED SOFTWARE. The software includes Windows Defender. If Windows
Defender is turned on, it will search this device for “spyware,” “adware” and other potentially
unwanted software. If it finds potentially unwanted software, the software will ask you if you want
to ignore, disable (quarantine) or remove it. Any potentially unwanted software rated “high” or
“severe,” will be automatically removed after scanning unless you change the default setting.
Removing or disabling potentially unwanted software may result in

other software on your computer ceasing to work, or

your breaching a license to use other software on this device.
By using this software, it is possible that you will also remove or disable software that is not
potentially unwanted software.
5. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some
rights to use the software. Rimage Corporation and Microsoft reserve all other rights. Unless
applicable law gives you more rights despite this limitation, you may use the software only as
expressly permitted in this agreement. In doing so, you must comply with any technical limitations in
the software that allow you to use it only in certain ways. For more information, see the software
documentation or contact Rimage Corporation. You may not:

work around any technical limitations in the software;
•
reverse engineer, decompile or disassemble the software;
•
make more copies of the software than specified in this agreement;
•
publish the software for others to copy;
•
rent, lease or lend the software; or
•
use the software for commercial software hosting services.
Except as expressly provided in this agreement, rights to access the software on this device do not
give you any right to implement Microsoft patents or other Microsoft intellectual property in software
or devices that access this device.
•
INTERNET-BASED SERVICES. Microsoft provides Internet-based services with the
software. Microsoft may change or cancel them at any time.
a. Consent for Internet-Based Services. The licensed device may contain one or more of
the software features described below. These features connect to Microsoft or service
provider computer systems over the Internet. In some cases, you will not receive a separate
notice when they connect. For more information about these features, visit
go.microsoft.com/fwlink/?linkid=104604.
By using these features, you consent to the transmission of this information.
Microsoft does not use the information to identify or contact you.
Computer Information. The following features use Internet protocols, which send to the
appropriate systems computer information, such as your Internet protocol address, the type
of operating system and browser, and the name and version of the software you are using.
Microsoft uses this information to make the Internet-based services available to you. Rimage
Corporation has elected to turn on the following features in the licensed device.

Plug and Play and Plug and Play Extensions. You may connect new hardware to your
device. Your device may not have the drivers needed to communicate with that
hardware. If so, the update feature of the software can obtain the correct driver from
Microsoft and install it on your device.

Web Content Features. Features in the software can retrieve related content from
Microsoft and provide it to you. Examples of these features are clip art, templates,
online training, online assistance and Appshelp. You may choose not to use these web
content features.

Digital Certificates. The software uses x.509 version 3 digital certificates. These digital
certificates confirm the identity of users sending information to each other and allow you
to encrypt the information. The software retrieves certificates and updates certificate
revocation lists over the Internet.

Auto Root Update. The Auto Root Update feature updates the list of trusted certificate
authorities. You can switch off this feature.

Windows Media Digital Rights Management. Content owners use Windows Media digital
rights management technology (WMDRM) to protect their intellectual property, including
copyrights. This software and third party software use WMDRM to play and copy
WMDRM-protected content. If the software fails to protect the content, content owners
may ask Microsoft to revoke the software’s ability to use WMDRM to play or copy
protected content. Revocation does not affect other content. When you download
licenses for protected content, you agree that Microsoft may include a revocation list with
the licenses. Content owners may require you to upgrade WMDRM to access their
content. Microsoft software that includes WMDRM will ask for your consent prior to the
upgrade. If you decline an upgrade, you will not be able to access content that requires
the upgrade. You may switch off WMDRM features that access the Internet. When these
features are off, you can still play content for which you have a valid license.

Windows Media Player. When you use Windows Media Player, it checks with Microsoft for

compatible online music services in your region;
•
new versions of the player; and
•
codecs if your device does not have the correct ones for playing content.

Malicious Software Removal/Clean On Upgrade. Before installation of the software, the
software will check and remove certain malicious software listed at
www.support.microsoft.com/?kbid=890830 (“Malware”) from your device. When the
software checks your device for Malware, a report will be sent to Microsoft about any
Malware detected or errors that occurred while the software was checking for Malware.
No information that can be used to identify you is included in the report.

Network Awareness. This feature determines whether a system is connected to a
network by either passive monitoring of network traffic or active DNS or HTTP queries.
The query only transfers standard TCP/IP or DNS information for routing purposes. You
can switch off the active query feature through a registry setting.

Windows Time Service. This service synchronizes with www.time-windows.com once a
week to provide your computer with the correct time. The connection uses standard NTP
protocol.
b. Use of Information. Microsoft may use the computer information, error reports, and
Malware reports to improve our software and services. We may also share it with others,
such as hardware and software vendors. They may use the information to improve how their
products run with Microsoft software.
c. Misuse of Internet-based Services. You may not use these services in any way that
could harm them or impair anyone else’s use of them. You may not use the services to try to
gain unauthorized access to any service, data, account or network by any means.
6. VALIDATION.
a. Validation verifies that the software has been activated and is properly licensed. It also verifies
that no unauthorized changes have been made to the validation, licensing, or activation functions
of the software. Validation may also check for certain malicious or unauthorized software related
to such unauthorized changes. A validation check confirming that you are properly licensed,
permits you to continue to use the software, certain features of the software or to obtain
additional benefits. You are not permitted to circumvent validation. This is to prevent
unlicensed use of the software. For more information, see

b. The software will from time to time perform a validation check of the software. The check may
be initiated by the software or Microsoft. To enable the activation function and validation checks,
the software may from time to time require updates or additional downloads of the validation,
licensing or activation functions of the software. The updates or downloads are required for the
proper functioning of the software and may be downloaded and installed without further notice
to you. During or after a validation check, the software may send information about the software,
the computer and the results of the validation check to Microsoft. This information includes, for
example, the version and product key of the software, any unauthorized changes made to the
validation, licensing or activation functions of the software, any related malicious or unauthorized
software found and the Internet protocol address of the computer. Microsoft does not use the
information to identify or contact you. By using the software, you consent to the transmission of
this information. For more information about validation and what is sent during or after a

c. If, after a validation check, the software is found to be counterfeit, improperly licensed, or a nongenuine Windows product, or if it includes unauthorized changes, then the functionality and
experience of using the software will be affected. For example:
Microsoft may

repair the software, and remove, quarantine or disable any unauthorized changes that may
interfere with the proper use of the software, including circumvention of the activation or
validation functions of the software; or
·
check and remove malicious or unauthorized software known to be related to such
unauthorized changes; or
·
provide notice that the software is improperly licensed or a non-genuine Windows product;
and you may
·
receive reminders to obtain a properly licensed copy of the software; or
·
need to follow Microsoft’s instructions to be licensed to use the software and reactivate;
and you may not be able to
·
use or continue to use the software or some of the features of the software; or
·
obtain certain updates or upgrades from Microsoft.
d. You may only obtain updates or upgrades for the software from Microsoft or authorized sources
(including Rimage Corporation). For more information on obtaining updates from authorized

7. PRODUCT SUPPORT. Contact Rimage Corporation for support options. Refer to the support number
provided with the device.
8. MICROSOFT .NET BENCHMARK TESTING. The software includes one or more components of the
.NET Framework (“.NET Components”). You may conduct internal benchmark testing of those
components. You may disclose the results of any benchmark test of those components, provided that
you comply with the conditions set forth at go.microsoft.com/fwlink/?LinkID=66406.
Notwithstanding any other agreement you may have with Microsoft, if you disclose such benchmark
test results, Microsoft shall have the right to disclose the results of benchmark tests it conducts of
your products that compete with the applicable .NET Component, provided it complies with the same
conditions set forth at go.microsoft.com/fwlink/?LinkID=66406.
9. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall
the software on the device.
10. DOCUMENTATION. Any person that has valid access to your computer or internal network may
copy and use the documentation for your internal, reference purposes.
11. UPGRADES. To use upgrade software, you must first be licensed for the software that is eligible for
the upgrade. Upon upgrade, this agreement takes the place of the agreement for the software you
upgraded from. After you upgrade, you may no longer use the software you upgraded from.
12. PROOF OF LICENSE. If you acquired the software on the device, or on a disc or other media, a
genuine Certificate of Authenticity label with a genuine copy of the software identifies licensed
software. To be valid, this label must be affixed to the device, or included on or in Rimage
Corporation’s software packaging. If you receive the label separately, it is not valid. You should
keep the label on the device or packaging to prove that you are licensed to use the software. To

13. TRANSFER TO A THIRD PARTY. You may transfer the software only with the device, the
Certificate of Authenticity label, and these license terms directly to a third party. Before the transfer,
that party must agree that these license terms apply to the transfer and use of the software. You
may not retain any copies of the software including the backup copy.
14. NOTICE ABOUT THE H.264/AVC VISUAL STANDARD, THE VC-1 VIDEO STANDARD, THE
MPEG-4 VISUAL STANDARD AND THE MPEG-2 VIDEO STANDARD. This software may include
H.264/AVC, VC-1, MPEG-4 Part 2, and MPEG-2 visual compression technology. If the software
includes those visual compression technologies MPEG LA, L.L.C. requires this notice:
THIS PRODUCT IS LICENSED UNDER ONE OR MORE VIDEO PATENT PORTFOLIO LICENSES SUCH
AS, AND WITHOUT LIMITATION, THE AVC, THE VC-1, THE MPEG-4 PART 2 VISUAL, AND THE
MPEG-2 VIDEO PATENT PORTFOLIO LICENSES FOR THE PERSONAL AND NON-COMMERCIAL USE OF
A CONSUMER TO (i) ENCODE VIDEO IN COMPLIANCE WITH THE ABOVE STANDARDS (“VIDEO
STANDARDS”) AND/OR (ii) DECODE VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A
PERSONAL AND NON-COMMERCIAL ACTIVITY OR WAS OBTAINED FROM A VIDEO PROVIDER
LICENSED TO PROVIDE VIDEO UNDER SUCH PATENT PORTFOLIO LICENSES. NONE OF THE
LICENSES EXTEND TO ANY OTHER PRODUCT REGARDLESS OF WHETHER SUCH PRODUCT IS
INCLUDED WITH THIS PRODUCT IN A SINGLE ARTICLE. NO LICENSE IS GRANTED OR SHALL BE
IMPLIED FOR ANY OTHER USE. ADDITIONAL INFORMATION MAY BE OBTAINED FROM MPEG LA,
L.L.C. SEE WWW.MPEGLA.COM.
15. NOT FAULT TOLERANT. The software is not fault tolerant. Rimage Corporation installed
the software on the device and is responsible for how it operates on the device.
16. RESTRICTED USE. The Microsoft software was designed for systems that do not require fail-safe
performance. You may not use the Microsoft software in any device or system in which a
malfunction of the software would result in foreseeable risk of injury or death to any person. This
includes operation of nuclear facilities, aircraft navigation or communication systems and air traffic
control.
17. THIRD PARTY PROGRAMS. The software contains third party programs. The license terms with
those programs apply to your use of them.
18. NO WARRANTIES FOR THE SOFTWARE. The software is provided “as is”. You bear all
risks of using it. Microsoft gives no express warranties, guarantees or conditions. Any
warranties you receive regarding the device or the software do not originate from, and
are not binding on, Microsoft or its affiliates. When allowed by your local laws, Rimage
Corporation and Microsoft exclude implied warranties of merchantability, fitness for a
particular purpose and non-infringement.
19. LIABILITY LIMITATIONS. You can recover from Microsoft and its affiliates only direct
damages up to two hundred fifty U.S. Dollars (U.S. $250.00), or equivalent in local
currency. You cannot recover any other damages, including consequential, lost profits,
special, indirect or incidental damages.
This limitation applies to:
•
anything related to the software, services, content (including code) on third party
internet sites, or third party programs, and
•
claims for breach of contract, breach of warranty, guarantee or condition, strict
liability, negligence, or other tort to the extent permitted by applicable law.
It also applies even if Microsoft should have been aware of the possibility of the
damages. The above limitation may not apply to you because your country may not
allow the exclusion or limitation of incidental, consequential or other damages.
20. EXPORT RESTRICTIONS. The software is subject to United States export laws and regulations.
You must comply with all domestic and international export laws and regulations that apply to the
software. These laws include restrictions on destinations, end users and end use. For additional

21. ENTIRE AGREEMENT. This agreement, additional terms (including any printed-paper license terms
that accompany the software and may modify or replace some or all of these terms), and the terms
for supplements, updates, Internet-based services and support services that you use, are the entire
agreement for the software and support services.
22. APPLICABLE LAW.
a. United States. If you acquired the software in the United States, Washington state law governs
the interpretation of this agreement and applies to claims for breach of it, regardless of conflict of
laws principles. The laws of the state where you live govern all other claims, including claims
under state consumer protection laws, unfair competition laws, and in tort.
b. Outside the United States. If you acquired the software in any other country, the laws of that
country apply.

远程桌面。许可设备的单一主要用户可以使用远程桌面或类似技术从任何其他设备访问会话。“会
话”指通过输入、输出和显示外围设备的任意组合，直接或间接地与该软件进行交互的体验。如果
远程设备已经单独得到运行该软件的许可，其他用户可以使用这些技术从任何设备访问会话。
其他访问技术。您可以使用远程协助或类似技术共享活动会话。

e. 字体组件。在该软件运行时，可以使用其字体来显示和打印内容。您只能：

图标、图像和声音。在该软件运行时，您可以使用但不得共享其图标、图像、声音和媒体。
4. 可能不需要的软件。该软件包含有 Windows Defender。打开 Windows Defender 后，该程序将在此设
备中搜索“间谍软件”、“广告软件”和其他可能不需要的软件。如果 Windows Defender 找到了可能
不需要的软件，它会询问您是忽略、禁用（隔离）还是删除相应软件。除非您更改默认设置，否则在扫
描结束后，将自动删除所有级别为“高”或“严重”的可能不需要的软件。删除或禁用可能不需要的软
件可能导致：

您计算机上的其他软件停止运行，或

违反该设备上其他软件的使用许可。
使用该软件还可能导致删除或禁用不属于“可能不需要的软件”的软件。
5. 许可范围。该软件并未出售，只是授予许可。本协议只授予您使用该软件的某些权利。Rimage
Corporation 和 Microsoft 保留所有其他权利。除非适用的法律赋予您此项限制之外的权利，否则您只
能在本协议明示允许的范围内使用该软件。在按规定使用该软件时，您必须遵守软件中的所有技术限

基于 INTERNET 的服务。Microsoft 随该软件提供基于 Internet 的服务，Microsoft 可随时更改或

Les présents termes du contrat de licence constituent un contrat entre vous et Rimage Corporation.
Lisez-les attentivement. Ils s’appliquent au logiciel fourni sur ce dispositif. Le logiciel comprend également
le support sur lequel vous l’avez reçu, le cas échéant.
Le logiciel compris sur ce dispositif comprend un logiciel concédé sous licence par Microsoft Corporation
ou l’un de ses affiliés.
Ce contrat porte également sur les produits Microsoft suivants :

les mises à jour,

les suppléments,

les services Internet, et

les services d’assistance technique
de ce logiciel à moins que d’autres termes n’accompagnent ces produits, auquel cas ces derniers
prévalent.
Si vous obtenez des mises à jour ou des suppléments directement auprès de Microsoft, Microsoft, et non
Rimage Corporation, vous en concède les licences.
Comme décrit ci-dessous, en utilisant le logiciel, vous consentez à ce que Microsoft recueille
certaines informations de votre ordinateur pour des services Internet.
En utilisant le logiciel, vous acceptez ces termes. Si vous ne les acceptez pas, n’utilisez pas le

1. PRÉSENTATION.

Microsoft au titre d’un contrat distinct.
2. DROITS D’UTILISATION.
a. Utilisation. La licence de logiciel est attribuée de manière permanente au dispositif avec lequel
vous avez acquis le logiciel. Ce dispositif est le « dispositif concédé sous licence ». Vous êtes
autorisé à utiliser le logiciel sur le dispositif concédé sous licence.
b. Restrictions concernant les processeurs. Vous êtes autorisé à utiliser le logiciel sur un
nombre maximum de deux processeurs simultanément.
c. Autres versions. Vous êtes autorisé à utiliser uniquement la version du logiciel installée sur le
dispositif concédé sous licence. Vous n’êtes pas autorisé à changer de version (telle que la
version 32 octets ou 64 octets, ou dans une autre langue).
3. CONDITIONS DE LICENCE ET/OU DROITS D’UTILISATION SUPPLÉMENTAIRES.
a. Utilisation Spécifique. Rimage Corporation a conçu le dispositif concédé sous licence pour une
utilisation spécifique. Vous ne pouvez vous servir de ce logiciel que dans le cadre d’une telle
utilisation.
b. Autres Logiciels. Vous pouvez utiliser d’autres programmes avec le logiciel si les autres
programmes

prennent en charge directement l’utilisation spécifique prévue pour le dispositif concédé sous
licence, ou

fournissent des utilitaires système, une gestion des ressources, un anti-virus ou une
protection similaire.
Les logiciels proposant des tâches ou processus clients ou métiers ne peuvent être exécutés sur
le dispositif concédé sous licence. Citons par exemple, les logiciels de courrier électronique,
traitement de texte, tableur, base de données, planification et de gestion des finances
personnelles. Le dispositif concédé sous licence peut utiliser des protocoles de services Terminal
Server pour accéder à un tel logiciel exécuté sur un serveur.
c. Connexion des dispositifs. Vous ne devez pas utiliser le logiciel comme un logiciel serveur. En
d’autres mots, un seul dispositif peut accéder au, afficher, être exécuté sur, partager ou utiliser le
logiciel en même temps. Vous pouvez autoriser jusqu’à dix autres dispositifs à accéder au logiciel
pour utiliser

des services de fichier,

des services d’impression,

des services d’information Internet et

un partage de connexion Internet et des services de téléphonie.
Le nombre maximal de dix connexions s’applique aux dispositifs qui se connectent au logiciel
indirectement par le biais de logiciels ou de matériels de multiplexage ou d’autres logiciels et
matériels qui concentrent les connexions. Vous pouvez utiliser un nombre illimité de connexions
entrantes à tout moment via TCP/IP.
d. Technologies d’accès à distance. Vous pouvez accéder au logiciel et l’utiliser à distance à
partir d’un autre dispositif utilisant les technologies d’accès à distance comme indiqué cidessous :
Bureau à distance. L’unique utilisateur principal du dispositif concédé sous licence peut accéder à
une session à partir de n’importe quel autre dispositif qui utilise le Bureau à Distance ou des
technologies similaires. Une « session » correspond à l’interaction avec le logiciel, directement ou
indirectement, par l’intermédiaire d’une combinaison de périphériques d’entrée, de sortie et
d’affichage. D’autres utilisateurs peuvent accéder à une session à partir de n’importe quel
dispositif, à l’aide de ces technologies, si le dispositif distant exécute le logiciel acquis sous
licence séparément.
Autres technologies d’accès à distance. Vous pouvez utiliser les technologies d’Assistance à
Distance ou des technologies similaires pour partager une session active.
Autres utilisations à distance. Vous êtes autorisé à connecter un nombre quelconque de
dispositifs au logiciel à d’autres fins que celles décrites dans les sections Connexion des dispositifs
et Technologies d’accès à distance ci-dessus, par exemple pour synchroniser les données entre
les dispositifs.
e. Polices. Pendant le fonctionnement du logiciel, vous êtes autorisé à utiliser ses polices afin
d’afficher et d’imprimer le contenu. Vous êtes uniquement autorisé à :

incorporer des polices dans un contenu à condition de vous conformer aux restrictions
relatives à l’incorporation dans les polices ; et

les télécharger temporairement vers une imprimante ou un autre dispositif de sortie en vue
d’en imprimer le contenu.
f.
Icônes, images et sons. Pendant que le logiciel est en cours d’exécution, vous êtes autorisé à
utiliser ses icônes, ses images, ses sons et ses données multimédias mais pas à les partager.
4. LOGICIELS POTENTIELLEMENT INDÉSIRABLES. Le logiciel contient Windows Defender. Si
Windows Defender est activé, il recherche sur ce dispositif la présence de logiciels espions, de
logiciels de publicité ainsi que d’autres logiciels potentiellement indésirables. S’il en trouve, il vous
demande si vous souhaitez les ignorer, les désactiver (mise en quarantaine) ou les supprimer. Tout
logiciel potentiellement indésirable dont le niveau de dangerosité est « élevé » ou « grave » est
automatiquement supprimé après détection, sauf si vous modifiez le paramétrage par défaut. La
suppression ou la désactivation de logiciels potentiellement indésirables peut entraîner :

l’arrêt du fonctionnement d’autres logiciels sur votre ordinateur, ou

la violation d’une licence pour utiliser d’autres logiciels sur ce dispositif.
En utilisant ce logiciel, il est possible que vous supprimiez ou désactiviez également des logiciels qui
ne sont pas potentiellement indésirables.
5. CHAMP D’APPLICATION DE LA LICENCE. Le logiciel n’est pas vendu mais concédé sous licence.
Le présent contrat vous confère certains droits d’utilisation du logiciel. Rimage Corporation et
Microsoft se réservent tous les autres droits. Sauf si la loi en vigueur vous confère d’autres droits,
nonobstant la présente limitation, vous n’êtes autorisé à utiliser le logiciel qu’en conformité avec les
termes du présent contrat. À cette fin, vous devez vous conformer aux restrictions techniques
contenues dans le logiciel qui vous permettent de l’utiliser d’une certaine façon. Pour plus

n’êtes pas autorisé à :

contourner les restrictions techniques contenues dans le logiciel ;
•
reconstituer la logique du logiciel, le décompiler ou le désassembler ;
•
effectuer plus de copies du logiciel que ce qui n’est autorisé dans le présent contrat ;
•
publier le logiciel en vue d’une reproduction par autrui ;
•
louer ou prêter le logiciel ; ou
•
utiliser le logiciel en association avec des services d’hébergement commercial.
Sauf stipulation expresse contraire du présent contrat, les droits d’accès au logiciel sur ce dispositif
ne vous autorisent pas à exploiter des brevets appartenant à Microsoft ou tous autres droits de
propriété intellectuelle de Microsoft sur le logiciel ou tous dispositifs qui accèdent à ce dispositif.

SERVICES INTERNET. Microsoft fournit des services Internet avec le logiciel. Microsoft peut les
modifier ou les interrompre à tout moment.
a. Consentement pour les Services Internet. Le dispositif concédé sous licence peut
contenir une ou plusieurs des fonctionnalités du logiciel décrites ci-dessous. Ces
fonctionnalités se connectent aux systèmes informatiques de Microsoft ou de fournisseurs de
services via Internet. Dans certains cas, vous ne recevrez pas de notification de connexion.

En utilisant ces fonctionnalités, vous consentez à la transmission de ces

Informations sur l’ordinateur. Les fonctionnalités suivantes utilisent des protocoles Internet,
qui transmettent aux systèmes appropriés des informations relatives à votre ordinateur, telles
que votre adresse IP, le type de système d’exploitation et de navigateur, et le nom et la
version du logiciel que vous utilisez. Microsoft utilise ces informations pour mettre à votre
disposition les services Internet. Rimage Corporation a choisi d’activer les fonctionnalités
suivantes dans le dispositif concédé sous licence.

Plug-and-Play et extensions Plug-and-Play. Vous pouvez connecter de nouveaux
matériels à votre dispositif. Votre dispositif peut ne pas être équipé des pilotes
nécessaires pour communiquer avec ledit matériel. Si tel est le cas, la fonctionnalité de
mise à jour du logiciel permet d’obtenir le pilote approprié auprès de Microsoft et de
l’installer sur votre dispositif.

Fonctionnalités de contenu Web. Les fonctionnalités du logiciel peuvent extraire du
contenu associé de Microsoft et vous le transmettre. Parmi ces fonctionnalités, citons les
images clipart, les modèles, la formation en ligne, l’assistance en ligne et Appshelp. Vous
pouvez décider de ne pas faire appel à ces fonctionnalités de contenu Web.

Certificats Numériques. Le logiciel utilise des certificats numériques basés sur la
norme x.509 version 3. Ceux-ci confirment l’identité des utilisateurs Internet envoyant
des informations et vous permettent de chiffrer ces informations. Le logiciel extrait ces
certificats et met à jour les listes de révocation des certificats via Internet.

Mise à jour automatique des certificats racine. La fonctionnalité Auto Root Update met à
jour la liste des autorités de certification approuvées. Vous pouvez désactiver cette
fonctionnalité.

Gestion des droits numériques de Windows Media. Les propriétaires de contenu utilisent
la technologie de gestion des droits numériques de Windows Media (WMDRM) pour
protéger leurs droits de propriété intellectuelle, y compris leurs droits d’auteur. Ce logiciel
et des logiciels appartenant à des tiers utilisent la technologie WMDRM pour lire et copier
du contenu protégé. Si le logiciel ne protège pas le contenu, les propriétaires de contenu
peuvent demander à Microsoft la révocation du droit du logiciel à utiliser ladite
technologie WMDRM pour lire ou copier le contenu protégé. La révocation n’affecte pas
d’autres contenus. Lorsque vous téléchargez des licences de contenu protégé, vous
reconnaissez que Microsoft peut inclure une liste de révocation avec lesdites licences. Les
propriétaires de contenu peuvent exiger de vous que vous mettiez à jour la technologie
WMDRM afin d’accéder à leur contenu. Le logiciel Microsoft qui inclut la technologie
WMDRM vous demandera votre autorisation avant de procéder à la mise à jour. Si vous
refusez la mise à jour, vous ne pourrez plus accéder au contenu qui nécessite la mise à
jour. Vous pouvez désactiver les fonctionnalités WMDRM qui accèdent à Internet. Une
fois ces fonctionnalités désactivées, vous pouvez lire le contenu pour lequel vous
disposez d’une licence valide.

Lecteur Windows Media. Lorsque vous utilisez le Lecteur Windows Media, celui-ci vérifie
auprès de Microsoft :

la compatibilité des services audio en ligne dans votre pays ;
•
les nouvelles versions du lecteur ; et
•
les codecs, si votre dispositif ne dispose pas des codecs appropriés pour lire le contenu.

Suppression des Logiciels Malveillants/Nettoyage lors de la Mise à Niveau. Avant de
lancer la procédure d’installation, le logiciel recherchera et supprimera de votre dispositif
certains logiciels malveillants répertoriés sur le site
www.support.microsoft.com/?kbid=890830 (les « Malware »). Lorsque le logiciel vérifie
l’absence de Malware sur votre dispositif, un rapport est envoyé à Microsoft sur tout
Malware détecté ou sur toute erreur survenue pendant cette vérification. Le rapport ne
contient aucune information permettant de vous identifier.

Reconnaissance du réseau. Cette fonction détermine si un système est connecté à un
réseau par une surveillance passive du trafic réseau ou des requêtes HTTP ou DNS
actives. La requête transfère uniquement des informations TCP/IP ou DNS standard à
des fins d’acheminement. Vous pouvez désactiver la fonction de requête active par le
biais d’un paramètre de registre.

Service de temps Windows. Ce service effectue une synchronisation avec www.timewindows.com une fois par semaine pour mettre votre ordinateur à l’heure exacte. La
connexion utilise un protocole NTP standard.
b. Utilisation d’informations. Microsoft peut utiliser les informations sur l’ordinateur, les
rapports d’erreurs et les rapports sur les logiciels malveillants (les « Malware ») pour
améliorer ses logiciels et services. Nous pouvons également être amenés à les partager avec
des tiers, tels que des fournisseurs de matériels et de logiciels. Ceux-ci peuvent utiliser ces
informations pour améliorer le fonctionnement de leurs produits avec le logiciel Microsoft.
c. Utilisation Inappropriée des Services Internet. Vous n’êtes pas autorisé à utiliser ces
services de quelque manière que ce soit qui pourrait leur porter atteinte ou perturber leur
utilisation par un autre utilisateur. Vous n’êtes pas autorisé à tenter d’accéder de façon non

6. VALIDATION.
a. La validation permet de vérifier que le logiciel a été activé et bénéficie d’une licence appropriée.
Elle vérifie également qu’aucune modification non autorisée n’a été apportée aux fonctions de
validation, de concession de licence ou d’activation du logiciel. En outre, la validation peut
rechercher la présence de certains logiciels malveillants ou non autorisés en rapport avec les
modifications non autorisées. Si le processus de vérification de validation confirme que vous êtes
titulaire d’une licence valide, vous pouvez continuer à utiliser le logiciel, ou certaines de ses

Durch die Verwendung der Software erkennen Sie diese Bestimmungen an. Falls Sie die

Wenden Sie sich stattdessen an Rimage Corporation, um von diesem seine Richtlinien für

dem lizenzierten Gerät zu verwenden.

c. Alternative Versionen. Sie dürfen nur die Version der Software nutzen, die auf dem
lizenzierten Gerät installiert ist. Sie dürfen sie nicht in eine andere Version ändern (beispielsweise
die 32-Bit- oder 64-Bit-Version oder eine andere Sprachversion).
3. ZUSÄTZLICHE LIZENZANFORDERUNGEN UND/ODER NUTZUNGSRECHTE.
a. Bestimmte Verwendung. Rimage Corporation hat das lizenzierte Gerät für eine bestimmte
Verwendung entworfen. Sie dürfen die Software nur zu dieser Verwendung nutzen.
b. Andere Software. Sie sind berechtigt, andere Programme mit der Software zu verwenden,
sofern die anderen Programme

die bestimmte Verwendung für das lizenzierte Gerät direkt unterstützen oder

Systemdienstprogramme, Ressourcenverwaltung oder einen Antivirus- oder ähnlichen Schutz
bereitstellen.
Software, die Verbraucher- oder Geschäftsaufgaben oder -prozesse bereitstellt, darf nicht auf
dem lizenzierten Gerät ausgeführt werden. Dies schließt E-Mail-, Textverarbeitungs-,
Tabellenkalkulations-, Datenbank-, Zeitplanungs- und persönliche Finanzsoftware ein. Das
lizenzierte Gerät kann Terminaldiensteprotokolle verwenden, um auf solche Software, die auf
einem Server ausgeführt wird, zuzugreifen.
c. Geräteverbindungen. Sie sind nicht berechtigt, die Software als Serversoftware zu verwenden.
Das heißt, es dürfen nicht mehrere Geräte gleichzeitig auf die Software zugreifen, sie anzeigen,
ausführen, gemeinsam verwenden oder verwenden. Sie sind berechtigt, bis zu zehn anderen

oder Hardware, die Verbindungen in einem Pool zusammenfasst, indirekt auf die Software
zugreifen. Sie sind berechtigt, jederzeit eine unbegrenzte Anzahl von eingehenden Verbindungen
über TCP/IP zu verwenden.
d. Remotezugriffstechnologien. Sie sind wie folgt berechtigt, mithilfe von
Remotezugriffstechnologien auf die Software von einem anderen Gerät aus zuzugreifen und sie
von einem anderen Gerät aus zu nutzen.
Remotedesktop. Der einzige Hauptnutzer des lizenzierten Geräts ist berechtigt, mithilfe von
Remotedesktop oder ähnlichen Technologien von einem anderen Gerät aus auf eine Sitzung
zuzugreifen. Eine „Sitzung“ bedeutet das Erlebnis der direkten oder indirekten Interaktion mit der
Software über eine beliebige Kombination von Eingabe-, Ausgabe- und Anzeigeperipheriegeräten.
Andere Nutzer sind berechtigt, mithilfe dieser Technologien von einem beliebigen Gerät aus auf
eine Sitzung zuzugreifen, wenn das Remotegerät gesondert für die Ausführung der Software
lizenziert ist.
Andere Zugriffstechnologien. Sie sind berechtigt, die Remoteunterstützung oder ähnliche
Technologien zu verwenden, um eine aktive Sitzung freizugeben.
Andere Remoteverwendungen. Sie sind berechtigt, einer beliebigen Anzahl von Geräten zu
ermöglichen, zu anderen als den in den Abschnitten „Geräteverbindungen“ und
„Remotezugriffstechnologien“ weiter oben beschriebenen Zwecken auf die Software zuzugreifen,
wie z. B. zum Synchronisieren von Daten zwischen Geräten.
e. Schriftartkomponenten. Während die Software ausgeführt wird, sind Sie berechtigt, ihre
Schriftarten zum Anzeigen und Drucken von Inhalt zu verwenden. Sie sind nur zu Folgendem

Symbole, ihre Bilder, ihren Ton und ihre Medien zu verwenden, jedoch nicht, sie weiterzugeben.
4. POTENZIELL UNERWÜNSCHTE SOFTWARE. Die Software enthält Windows Defender. Wenn
Windows Defender aktiviert ist, sucht es auf diesem Gerät nach „Spyware“, „Adware“ und anderer
potenziell unerwünschter Software. Wird potenziell unerwünschte Software gefunden, fragt die
Software Sie, ob Sie sie ignorieren, deaktivieren (in Quarantäne verschieben) oder entfernen
möchten. Jede potenziell unerwünschte Software mit dem Schweregrad „hoch“ oder
„schwerwiegend“ wird nach dem Scanvorgang automatisch entfernt, sofern Sie die
Standardeinstellung nicht ändern. Das Entfernen oder Deaktivieren von potenziell unerwünschter
Software kann dazu führen, dass

andere Software auf Ihrem Computer die Funktion einstellt oder

5. GÜLTIGKEITSBEREICH DER LIZENZ. Die Software wird lizenziert, nicht verkauft. Dieser Vertrag
gibt Ihnen nur einige Rechte zur Verwendung der Software. Rimage Corporation und Microsoft
behalten sich alle anderen Rechte vor. Sie dürfen die Software nur wie in diesem Vertrag
ausdrücklich gestattet verwenden, es sei denn, das anwendbare Recht gibt Ihnen ungeachtet dieser
Einschränkung umfassendere Rechte. Dabei sind Sie verpflichtet, alle technischen Beschränkungen

Außer wie in diesem Vertrag ausdrücklich vorgesehen geben Ihnen Rechte zum Zugriff auf die
Software auf diesem Gerät kein Recht, Patente von Microsoft oder anderes geistiges Eigentum von
Microsoft in Software oder Geräten zu implementieren, die auf dieses Gerät zugreifen.

INTERNETBASIERTE DIENSTE. Microsoft stellt mit der Software internetbasierte Dienste
bereit. Microsoft ist berechtigt, diese jederzeit zu ändern oder zu kündigen.
a. Zustimmung für internetbasierte Dienste. Das lizenzierte Gerät kann ein oder mehrere
der nachstehend beschriebenen Features der Software enthalten. Diese Features stellen über
das Internet eine Verbindung mit Computersystemen von Microsoft oder von

Kommunikation mit der jeweiligen Hardware benötigt werden. Ist dies der Fall, kann das
Updatefeature der Software den korrekten Treiber von Microsoft erhalten und auf Ihrem
Gerät installieren.

Webinhaltsfeatures. Features in der Software können zugehörigen Inhalt von Microsoft
abrufen und Ihnen bereitstellen. Beispiele für diese Features sind ClipArt, Vorlagen,
Onlineschulungen, Online Assistance und Appshelp. Sie können sich entscheiden, ob Sie
diese Webinhaltsfeatures verwenden möchten oder nicht.

Digitale Zertifikate. Die Software verwendet digitale Zertifikate, die auf dem x.509Standard Version 3 basieren. Mit diesen digitalen Zertifikaten wird die Identität von
Nutzern bestätigt, die einander Informationen senden, sowie die Verschlüsselung der

Verwaltung digitaler Rechte (Digital Rights Management) von Windows Media.
Inhaltseigentümer verwenden die Technologie zur Verwaltung digitaler Rechte von
Windows Media (WMDRM), um ihr geistiges Eigentum, einschließlich Urheberrechte, zu
schützen. Diese Software und Drittanbietersoftware verwenden WMDRM, um durch
WMDRM geschützten Inhalt abzuspielen und zu kopieren. Wenn die Software den Inhalt
nicht schützt, verlangen Inhaltseigentümer möglicherweise von Microsoft, die Fähigkeit
der Software zur Verwendung von WMDRM zum Abspielen oder Kopieren von

Entfernung bösartiger Software/Säubern beim Upgrade. Vor der Installation der Software
führt die Software eine Überprüfung aus und entfernt bestimmte bösartige Software, die
unter www.support.microsoft.com/?kbid=890830 aufgelistet ist („Malware“), von Ihrem
Gerät. Wenn die Software Ihr Gerät auf Malware überprüft, wird ein Bericht an Microsoft
gesendet, der Informationen über die gefundene Malware bzw. Fehler beinhaltet, die
während der Überprüfung auf Malware aufgetreten sind. Im Bericht sind keine
Informationen enthalten, anhand derer sich Ihre Identität feststellen lässt.

Netzwerkinformationen. Dieses Feature bestimmt mithilfe von entweder passiver
Überwachung des Netzwerkverkehrs oder aktiven DNS- oder HTTP-Abfragen, ob ein
System mit einem Netzwerk verbunden ist. Die Abfrage überträgt nur TCP/IP- oder DNSStandardinformationen zu Routingzwecken. Sie können das Feature für aktive Abfragen
über eine Registrierungseinstellung abschalten.

Windows-Zeitdienst. Dieser Dienst führt einmal pro Woche eine Synchronisierung mit
www.time-windows.com durch, um Ihrem Computer die korrekte Zeit bereitzustellen. Die
Verbindung verwendet das Standardprotokoll NTP.
b. Verwendung von Informationen. Microsoft ist berechtigt, Computerinformationen,
Fehlerberichte und Malwareberichte zu verwenden, um unsere Software und Dienste zu
verbessern. Außerdem sind wir berechtigt, diese Informationen an Dritte weiterzugeben, wie
Hardware- und Softwareanbieter. Diese wiederum dürfen die Informationen verwenden, um

originales COA (Certificate of Authenticity) Label als lizenzierte Software gekennzeichnet. Dies gilt
nur, wenn dieses Label auf dem Gerät angebracht oder auf oder in der Softwareverpackung von
Rimage Corporation enthalten ist. Wenn Sie das Label gesondert erhalten, ist es nicht gültig. Sie
sollten das Label auf dem Gerät oder der Verpackung als Nachweis dafür aufbewahren, dass Sie über

18. KEINE GARANTIEN FÜR DIE SOFTWARE. Die Software wird „wie besehen“ bereitgestellt.
Sie tragen sämtliche mit der Nutzung verbundenen Risiken. Microsoft gewährt keine
ausdrücklichen Gewährleistungen oder Garantien. Garantien, die Sie für das Gerät oder
die Software erhalten, stammen nicht von Microsoft oder ihren verbundenen
Unternehmen und sind für diese nicht bindend. Im durch das örtlich anwendbare Recht
zugelassenen Umfang schließen Rimage Corporation und Microsoft konkludente
Garantien der Handelsüblichkeit, Eignung für einen bestimmten Zweck und
Nichtverletzung von Rechten Dritter aus.
19. BESCHRÄNKUNGEN DER HAFTUNG. Sie können von Microsoft und deren verbundenen
Unternehmen nur einen Ersatz für direkte Schäden bis zu einem Betrag von
zweihundertfünfzig US-Dollar (250,00 USD) oder einem gleichwertigen Betrag in lokaler
Währung erhalten. Sie können keinen Ersatz für andere Schäden erhalten, einschließlich

Microsoft eine Vertragspflicht verletzt, deren Erfüllung die ordnungsgemäße
Durchführung des Vertrages überhaupt erst ermöglicht, deren Verletzung die Erreichung
des Vertragszwecks gefährdet und auf deren Einhaltung Sie regelmäßig vertrauen dürfen
(sog. „Kardinalpflichten“). In diesen Fällen ist die Haftung von Microsoft auf typische und
vorhersehbare Schäden beschränkt. In allen anderen Fällen haftet Microsoft auch in

20. AUSFUHRBESCHRÄNKUNGEN. Die Software unterliegt den Exportgesetzen und -regelungen der
USA sowie des Landes, aus dem sie ausgeführt wird. Sie sind verpflichtet, alle nationalen und
internationalen Exportgesetze und -regelungen einzuhalten, die für die Software gelten. Zu diesen
Gesetzen gehören Einschränkungen im Hinblick auf Bestimmungsorte, Endbenutzer und Endnutzung.

verwendete Ergänzungen, Updates, internetbasierte Dienste und Supportservices stellen den
gesamten Vertrag für die Software und die Supportservices dar.
22. ANWENDBARES RECHT.
a. Vereinigte Staaten. Wenn Sie die Software in den Vereinigten Staaten erworben haben, regelt
das Gesetz des Staates Washington die Auslegung dieses Vertrages und gilt für Ansprüche, die
aus einer Vertragsverletzung entstehen, ungeachtet der Bestimmungen des internationalen
Privatrechts. Die Gesetze des Staates Ihres Wohnorts regeln alle anderen Ansprüche,
einschließlich Ansprüche aus den Verbraucherschutzgesetzen des Staates, aus Gesetzen gegen
unlauteren Wettbewerb und aus Deliktsrecht.
b. Außerhalb der Vereinigten Staaten. Wenn Sie die Software in einem anderen Land erworben

Corporation との契約を構成します。以下のライセンス条項をお読みください。本ライセンス条項は、本デバイス
に含まれる本ソフトウェアに適用されます。本ソフトウェアには、お客様が本ソフトウェアを受け取った別個のメデ
ィアも含まれます。
本デバイス上の本ソフトウェアには、Microsoft Corporation またはその関連会社からライセンスされているソフト
ウェアが含まれます。
また、本ライセンス条項は本ソフトウェアに関連する下記マイクロソフト製品にも適用されるものとします。

なお、これらの製品に別途ライセンス条項が付属している場合には、当該ライセンス条項が適用されるものとしま

お客様が更新プログラムまたは追加ソフトウェアをマイクロソフトから直接入手された場合は、Rimage
Corporation ではなく、マイクロソフトが当該更新プログラムまたは追加ソフトウェアのライセンスを付与します。
以下に説明するように、本ソフトウェアを使用することにより、インターネットベースのサービスのために特定のコ
ンピューター情報を送信することにお客様が同意されたものとします。
本ソフトウェアを使用することにより、お客様は本ライセンス条項に同意されたものとします。本ライセンス条項に
同意されない場合、本ソフトウェアを使用することはできません。この場合、Rimage Corporation に問い合わ
せて、お支払いいただいた金額の払い戻しに関する方針を確認してください。
お客様がこれらのライセンス条項を遵守することを条件として、お客様には以下が許諾されます。
1. 総則。
a. ソフトウェア。本ソフトウェアには、デスクトップ オペレーティング システム ソフトウェアが含まれます。本
ソフトウェアに、Windows Live のサービスは含まれません。Windows Live サービスは、マイクロソフト
が別個の契約において提供するサービスです。
2. 使用に関する権利。
a. 使用。本ソフトウェア ライセンスは、お客様が本ソフトウェアと共に取得されたデバイスに永続的に割り
当てられます。このようなデバイスを「ライセンスを取得したデバイス」といいます。お客様は、本ソフトウ
ェアをライセンスを取得したデバイスで使用することができます。
b. プロセッサに関する制限。お客様は、一度に 2 つのプロセッサを上限として本ソフトウェアを使用するこ
とができます。
c. 代替バージョン。お客様は、ライセンスを取得したデバイス上にインストールした本ソフトウェアのバージ
ョンのみを使用することができます。お客様は、本ソフトウェアを他のバージョン (32 ビット版または 64
ビット版、もしくは別の言語バージョンなど) に変更することはできません。
3. 追加のライセンス条件および追加の使用権
a. 特定用途。Rimage Corporation は、ライセンスを取得したデバイスを特定用途向けに設計しました。お
客様は、当該用途に限り本ソフトウェアを使用することができます。
b. その他のソフトウェア。お客様は、その他のプログラムが以下の条件を満たす場合に限り、本ソフトウェ
アと共にその他のプログラムを使用することができます。

ライセンスを取得したデバイスに関する特定用途を直接サポートしている。または

システム ユーティリティ、リソース管理、あるいはウイルス対策または同様の保護を提供している。
コンシューマー タスクまたはプロセスや、ビジネス タスクまたはプロセスを提供するソフトウェアを、ライ
センスを取得したデバイス上で実行することはできません。これには、電子メール、ワード プロセッシン
グ、表計算、データベース、スケジュール作成、家計簿ソフトウェアが含まれます。ライセンスを取得した
デバイスは、ターミナル サービス プロトコルを使用して、サーバー上で実行されているかかるソフトウェ
アにアクセスすることができます。
c. デバイスの接続。お客様は、本ソフトウェアをサーバー ソフトウェアとして使用することはできません。つ
まり、複数のデバイスから同時に、本ソフトウェアにアクセスしたり、本ソフトウェアを表示、実行、共有、
または使用したりすることはできません。お客様は、最大 10 台の他のデバイスから本ソフトウェアにアク
セスして、以下のサービスを使用することを許可できます。

ファイル サービス

プリント サービス

インターネット インフォメーション サービス、および

インターネット接続の共有およびテレフォニー サービス
上記の 10 台という接続数制限は、「マルチプレキシング」または接続数をプールするその他のソフトウ
ェアもしくはハードウェアを介して本ソフトウェアに間接的にアクセスするデバイスにも適用されます。お
客様は、TCP/IP を介して無制限の受信接続を随時使用することができます。
d. リモート アクセス テクノロジ。お客様は、以下の条件に従う場合に限り、リモート アクセス テクノロジを
使用して他のデバイスから本ソフトウェアにリモート アクセスして使用することができます。
リモート デスクトップ。ライセンスを取得したデバイスの特定の 1 名の主要ユーザーは、リモート デスク
トップ機能またはこれに類似するテクノロジを使用して、他のデバイスからセッションにアクセスすること
ができます。「セッション」とは、入力、出力、および表示用の周辺機器を利用して直接または間接に本ソ
フトウェアを双方向で使用できる状態を意味します。リモート デバイス用の本ソフトウェアを実行するた
めのライセンスが別途取得されている場合、その他のユーザーもこれらのテクノロジを使用して、任意の
数のデバイスからセッションにアクセスすることができます。
その他のアクセス テクノロジ。お客様は、リモート アシスタンスまたはこれに類似するテクノロジを使用し
てセッションを共有することができます。
その他のリモート使用。お客様は、任意の数のデバイスに、デバイス間でのデータの同期など上記の
「デバイスによる接続」および「リモート アクセス テクノロジ」の項に記載されている以外の目的で、本ソ
フトウェアにアクセスすることを許可することができます。
e. フォント コンポーネント。本ソフトウェアの実行中、お客様は本ソフトウェアに付属のフォントを使用してコ
ンテンツを表示および印刷することができます。以下の操作のみが許可されます。

フォントの埋め込みに関する制限の下で許容される範囲でコンテンツにフォントを埋め込む。

コンテンツを印刷するために、フォントをプリンターまたはその他の出力デバイスに一時的にダウン
ロードする。

アイコン、画像、および音声。本ソフトウェア作動中、本ソフトウェアのアイコン、イメージ、サウンド、およ
びメディアを使用することはできますが、これらを共有することはできません。
4. 問題を起こす可能性のある危険なソフトウェア。本ソフトウェアには、Windows Defender が含まれていま
す。Windows Defender を有効にした場合、「スパイウェア」や「アドウェア」など、問題を起こす可能性のある
危険なソフトウェアが本デバイスに存在しないかが Windows Defender によって検索されます。問題を起こ
す可能性のあるソフトウェアが見つかった場合、そのソフトウェアを無視するか、無効にするか (隔離)、また
は削除するかを確認するメッセージが表示されます。既定の設定を変更していない限り、問題を起こす可能
性のある危険なソフトウェアのうち「高」または「重大」と評価されるものは、スキャン後に自動的に削除されま
す。問題を起こす可能性のあるソフトウェアを削除するか、無効にする場合、次の点に注意する必要がありま
す。

コンピューターにある他のソフトウェアが動作しなくなる場合がある。

本デバイス上の他のソフトウェアを使用するためのライセンスに抵触する場合がある。
本ソフトウェアを使用することで、問題を起こす可能性のあるソフトウェアではないソフトウェアも削除された
り、無効化されたりする可能性があります。
5. ライセンスの適用範囲。本ソフトウェアは使用許諾されるものであり、販売されるものではありません。本ライ
センス条項は、お客様に本ソフトウェアを使用する限定的な権利を付与します。Rimage Corporation および
マイクロソフトはその他の権利をすべて留保します。適用される法令により上記の制限を超える権利が与え
られる場合を除き、お客様は本ライセンス条項で明示的に許可された方法でのみ本ソフトウェアを使用する
ことができます。この場合、お客様は、使用方法を制限するために本ソフトウェアに組み込まれている技術的

本ソフトウェアの技術的な制限を回避して使用すること。

本ライセンス条項で規定されている数以上の本ソフトウェアの複製を作成すること。

第三者が複製できるように本ソフトウェアを公開すること。

本ソフトウェアをレンタル、リース、または貸与すること。

本ソフトウェアを商用ソフトウェア ホスティング サービスで使用すること。
本ライセンス条項に明示的に規定されている場合を除き、本デバイス上の本ソフトウェアにアクセスする権利
は、本デバイスにアクセスするソフトウェアまたはデバイスにおいてマイクロソフトの特許またはその他の知
的財産権を行使する権利を、お客様に付与するものではありません。

インターネットベースのサービス。マイクロソフトは、本ソフトウェアについてインターネットベースのサー
ビスを提供します。マイクロソフトは、いつでもこのサービスを変更または中止できるものとします。
a. インターネットベースのサービスに関する同意。ライセンスを取得したデバイスには、以下に記載さ
れている 1 つ以上のソフトウェア機能が含まれている場合があります。これらの機能は、インターネ
ットを経由してマイクロソフトまたはサービス プロバイダーのコンピューター システムに接続します。
接続が行われた際、通知が行われない場合があります。これらの機能の詳細については、

これらの機能を使用することで、お客様は、この情報の送信に同意されたものとします。マイクロソ
フトは、これらの情報を利用してお客様の特定またはお客様への連絡を行うことはありません。
コンピューター情報。以下の機能はインターネット プロトコルを使用しており、お客様の IP アドレス、
オペレーティング システムの種類、ブラウザーの種類、使用している本ソフトウェアの名称およびバ
ージョンなどのコンピューター情報を適切なシステムに送信します。マイクロソフトは、お客様にイン
ターネットベースのサービスを提供するためにこの情報を使用します。Rimage Corporation は、ライ
センスを取得したデバイスで以下の機能を有効にすることを選択しています。

プラグ アンド プレイおよびプラグ アンド プレイの拡張。お客様は、お客様のデバイスに新しい
ハードウェアを接続することができます。デバイスには、かかるハードウェアと通信するために必

能により、マイクロソフトから適切なドライバーを取得し、お客様のデバイスにインストールするこ

Web コンテンツ機能。本ソフトウェアには、関連するコンテンツをマイクロソフトから取得し、お客
様に提供する機能が含まれます。これらの機能の例としては、クリップ アート、テンプレート、オ
ンライン トレーニング、オンライン アシスタンス、および Appshelp が挙げられます。お客様は、
これらの Web コンテンツ機能を使用しないことも選択できます。

デジタル証明書。本ソフトウェアは x.509 バージョン 3 デジタル証明書を使用します。これらの
デジタル証明書によってお互いに情報を送信してユーザーの身元を特定したり、お客様はかか
るデジタル証明書を使用して情報を暗号化したりすることができます。本ソフトウェアは、インタ
ーネットを経由して証明書を取得し、証明書失効リストを更新します。

Auto Root 更新。Auto Root 更新機能は、信頼できる証明機関のリストを更新するものです。こ
の機能は無効にすることができます。

Windows Media デジタル著作権管理。コンテンツ権利者は、著作権を含む知的財産を保護す
る目的で、Windows Media デジタル著作権管理技術 (WMDRM) を使用しています。本ソフトウ
ェアおよび第三者のソフトウェアは、WMDRM が保護するコンテンツを再生、複製する際に
WMDRM を使用します。本ソフトウェアがコンテンツを保護できない場合、コンテンツ権利者がマ
イクロソフトに対して、保護されたコンテンツを WMDRM で再生または複製する本ソフトウェアの
機能を無効にするよう要求することがあります。無効にされた場合も、その他のコンテンツは影
響を受けません。お客様は、保護されたコンテンツのライセンスをダウンロードすることでマイク
ロソフトがライセンスに失効リストを含めることに同意したものとします。コンテンツ権利者は、お

ることができます。この機能が解除されている場合でも、正規のライセンスを取得しているコンテ
ンツを再生することは可能です。

Windows Media Player。お客様が Windows Media Player を使用すると、マイクロソフトに対し
て以下が確認されます。
• お客様の地域において利用可能なオンライン音楽サービス

Windows Media Player の最新バージョン
•
コーデック (コンテンツの再生に必要なコーデックがデバイスにない場合)

アップグレード時における悪質なソフトウェアの削除/除去。本ソフトウェアのインストール前に、
www.support.microsoft.com/?kbid=890830 に掲載されている特定の悪質なソフトウェア
(「マルウェア」といいます) がお客様のデバイスにインストールされていないかが自動的に確認
され、お客様のデバイスから削除されます。お客様のデバイスでのマルウェアの確認時に、検
出されたすべてのマルウェアまたはマルウェア確認中に発生したエラーに関する報告がマイク
ロソフトに送信されます。この報告には、お客様を識別するための情報は一切含まれません。

ネットワーク認識。ネットワーク トラフィックのパッシブ モニタリングまたはアクティブ DNS (また
は HTTP) クエリにより、システムがネットワークに接続されているかどうかが判別されます。こ
のクエリでは、ルーティングのための標準的な TCP/IP 情報または DNS 情報の送信のみを行
います。お客様は、レジストリ設定により、このアクティブ クエリ機能を解除することができます。

Windows タイム サービス。このサービスは、週に 1 回、www.time-windows.com との間で同
期を行い、お客様のコンピューターに正確な時刻を提供します。接続には標準の NTP プロトコ
ルを使用します。
b. 情報の使用。マイクロソフトでは、ソフトウェアの改善およびサービスの向上を目的として、コンピュ
ーターの情報、エラー報告、およびマルウェア報告を使用します。また、ハードウェア ベンダーやソ
フトウェア ベンダーなど、他の企業と情報を共有する場合があります。これらの第三者は、マイクロ
ソフト製ソフトウェアと連携して動作する自社製品の改良のため、この情報を使用することがありま
す。
c. インターネットベースのサービスの不正使用。お客様は、これらのサービスに損害を及ぼす可能性
のある方法、または第三者によるこれらのサービスの使用を妨げる可能性のある方法で、これらの
サービスを使用することはできません。また、サービス、データ、アカウント、またはネットワークへの
不正アクセスを試みるためにこれらのサービスを使用することは一切禁じられています。
6. 検証。
a. 検証では、本ソフトウェアがアクティベーションされており、正式にライセンス供与されていることを確認し
ます。また、本ソフトウェアの検証、ライセンス、またはアクティベーションの各機能に不正な変更が加え
られていないことを検証します。検証では、該当する不正な変更に関連する特定の悪質または不正なソ
フトウェアの確認も行う場合があります。お客様が正式に使用許諾されていることが検証により確認され
た場合、お客様は、本ソフトウェアおよび本ソフトウェアの特定の機能の使用継続ないし追加特典の取
得が可能になります。お客様が検証を回避することは禁止されています。これは、本ソフトウェアの不正

b. 本ソフトウェアは、本ソフトウェアの有効性を随時検証することがあります。有効性の検証が、本ソフトウ

効にするために、本ソフトウェアで検証、ライセンス、およびアクティベーションの各機能の更新または追
加のダウンロードが必要になることがあります。更新やダウンロードは本ソフトウェアが適切に機能する

また、お客様は以下を行うことができなくなる場合があります。

d. お客様は、マイクロソフトまたは正規マイクロソフト販売代理店 (Rimage Corporation を含みます) 以外
から、本ソフトウェアの更新プログラムまたはアップグレードを入手することはできません。正規マイクロ

7. 製品サポート。サポート オプションについては、Rimage Corporation にお問い合わせください。その際、デバ

8. MICROSOFT .NET のベンチマーク テスト。本ソフトウェアは、.NET Framework のコンポーネント (以下
「.NET コンポーネント」といいます) を 1 つ以上含んでいます。お客様は、これらのコンポーネントの内部ベン
チマーク テストを実施することができます。お客様は、go.microsoft.com/fwlink/?LinkID=66406 に掲載さ
れている条件に従うことを条件に、これらのコンポーネントのベンチマーク テストの結果を開示できます。
マイクロソフトと別途の合意がある場合でも、お客様が当該ベンチマーク テストの結果を開示した場合、マイ
クロソフトは、go.microsoft.com/fwlink/?LinkID=66406 に掲載されている条件と同じ条件に従うことを条件
に、該当する .NET コンポーネントと競合するお客様の製品についてマイクロソフトが実施したベンチマーク
テストの結果を開示する権利を有します。
9. バックアップ用の複製。お客様は、本ソフトウェアのバックアップ用の複製を 1 部作成することができます。バ
ックアップ用の複製は、お客様が本ソフトウェアを、デバイスに再インストールする場合に限り使用することが
できます。
10. ドキュメント。お客様のコンピューターまたは内部ネットワークに有効なアクセス権を有する者は、お客様の内
部使用目的に限り、ドキュメントを複製して使用することができます。
11. アップグレード。お客様は、アップグレード ソフトウェアを使用する場合、アップグレード対象ソフトウェアのラ
イセンスを取得済みである必要があります。アップグレード前のソフトウェアのライセンス条項は、アップグレ
ードした時点で、本ライセンス条項によって置き換えられるものとします。アップグレード後は、アップグレード
前のソフトウェアは使用できません。
12. ライセンス証明書 (「PROOF OF LICENSE」または「POL」)。お客様が本ソフトウェアをデバイスにインスト
ールされた状態、または CD-ROM またはその他のメディアで入手された場合、本ソフトウェアのライセンスが
正当に取得されたものであることは、正規の Certificate of Authenticity ラベルが正規の本ソフトウェアの複
製に付属していることにより識別することができます。ラベルが有効であるためには、このラベルがデバイス
に貼付、あるいは Rimage Corporation の本ソフトウェア梱包に貼付または含まれていなければなりませ
ん。ラベルが本ソフトウェアの梱包とは別に提供されたものである場合、そのラベルは無効です。お客様が本
ソフトウェアのライセンスを取得していることを証明するため、ラベルが貼付されたデバイスもしくは梱包材を

13. 第三者への譲渡。本ソフトウェアは、デバイス、Certificate of Authenticity ラベル、および本ライセンス条項
が付属している場合にのみ直接第三者に譲渡することができます。譲渡の前に、本ソフトウェアの譲受者は
本ライセンス条項が本ソフトウェアの譲渡および使用に適用されることに同意しなければなりません。お客様
は、バックアップ用の複製を含む本ソフトウェアの複製を保持することはできません。
14. H.264/AVC 規格、VC-1 規格、MPEG-4 規格、および MPEG-2 規格に関する注意。本ソフトウェアに
は、H.264/AVC、VC-1、MPEG-4 Part 2、および MPEG-2 画像圧縮テクノロジが含まれていることがありま
す。本ソフトウェアにこれらの画像圧縮テクノロジが含まれている場合、MPEG LA, L.L.C. により以下の注意
書きを表示することが義務付けられています。
本製品は、消費者による個人使用および非商業的使用を前提とし、「AVC PATENT PORTFOLIO

います)、または (ii) 個人使用および非商業的活動に従事する消費者がエンコードしたビデオをデコードす
る、もしくは、かかる特許ポートフォリオ ライセンスに基づいてビデオを提供するライセンスを有するビデオ プ
ロバイダーから取得したビデオをデコードすること。本ライセンスは、本製品と共に単一の製品に含まれてい
るかどうかにかかわらず、他の製品に適用されることはありません。その他の用途については、明示か黙示
かを問わず、いかなるライセンスも許諾されません。詳細情報については、MPEG LA, L.L.C. から入手できま

15. 非フォールト トレラント。本ソフトウェアは、フォールト トレラントではありません。Rimage Corporation
は、本ソフトウェアをデバイスにインストールしており、本ソフトウェアのデバイス上での動作に責任を負うも
のとします。
16. 使用制限。マイクロソフト ソフトウェアは、フェール セーフ性能が不要なシステム用に設計されました。お客
様は、本ソフトウェアの誤動作があった場合に人身傷害または死亡の予測できるリスクをもたらすデバイスま
たはシステムで、マイクロソフト ソフトウェアを使用することはできません。これには、核施設、航空機のナビ
ゲーションまたは通信システム、航空交通管制の操作が含まれます。
17. 第三者のプログラム。本ソフトウェアには第三者のプログラムが含まれています。お客様によるこれらのプロ
グラムの使用には、プログラムに付属するライセンス条項が適用されます。
18. 本ソフトウェアの無保証。本ソフトウェアは、現状有姿のまま瑕疵を問わない条件で提供されます。本ソフト
ウェアの使用に伴うあらゆる危険は、お客様の負担とします。マイクロソフトは、明示的な瑕疵担保責任また
は保証責任を一切負いません。デバイスまたは本ソフトウェアに関してお客様が受けている保証は、マイク
ロソフトまたはその関連会社から与えられるものではなく、マイクロソフトまたはその関連会社がその保証に
よる拘束を受けることはありません。法律上許容される最大限において、商品性、特定目的に対する適合
性、侵害の不存在に関する黙示の保証について、Rimage Corporation およびマイクロソフトは一切責任
を負いません。
19. 責任の制限。マイクロソフトおよびその関連会社の責任は、250 米ドル (U.S. $250.00) またはその現地
通貨相当額を上限とする直接損害に限定されます。その他の損害 (派生的損害、逸失利益、特別損害、間
接損害、および付随的損害を含みますがこれらに限定されません) に関しては、一切責任を負いません。
この制限は、以下に適用されるものとします。

ースのサービス、およびサポート サービスに関する使用条件は、本ソフトウェアおよびサポート サービスに
ついてのお客様とマイクロソフトとの間の完全なる合意です。
22. 準拠法。
a. 日本。お客様が本ソフトウェアを日本国内で入手された場合、本ライセンス条項は日本法に準拠するも
のとします。
b. 米国。お客様が本ソフトウェアを米国内で入手された場合、抵触法にかかわらず、本ライセンス条項の
解釈および契約違反への主張は、米国ワシントン州法に準拠するものとします。消費者保護法、公正取
引法、および違法行為を含みますがこれに限定されない他の主張については、お客様が所在する地域
の法律に準拠します。
c. 日本および米国以外。お客様が本ソフトウェアを日本国および米国以外の国で入手された場合、本ライ
センス条項は適用される地域法に準拠するものとします。

Se o Adquirente obtiver actualizações ou suplementos directamente da Microsoft, a Microsoft, e não o
Rimage Corporation, licencia os mesmos.
Como descrito infra, a utilização do software também actua como o consentimento do
Adquirente para a transmissão de determinadas informações do computador para serviços
baseados na Internet.
Ao utilizar o software, o Adquirente aceita estes termos. Caso o Adquirente não aceite os
termos, não deverá utilizar o software. Em vez disso, contacte o Rimage Corporation para
determinar a respectiva política de devoluções no sentido de obter um reembolso ou crédito.
Se o Adquirente cumprir com os presentes termos de licenciamento, terá os direitos
descritos infra.
1. DESCRIÇÃO GERAL.
a. Software. O software inclui software de sistema operativo para estação de trabalho. Este
software não inclui os serviços do Windows Live. Os serviços do Windows Live estão disponíveis a
partir da Microsoft ao abrigo de um contrato em separado.
2. DIREITOS DE UTILIZAÇÃO.
a. Utilização. A licença de software é atribuída de forma permanente ao dispositivo com o qual
adquiriu o software. Esse dispositivo é o “dispositivo licenciado”. Poderá utilizar o software no
dispositivo licenciado.
b. Limite do Processador. O software pode ser utilizado num máximo de dois processadores
numa determinada altura.
c. Versões Alternativas. O Adquirente só poderá utilizar a versão do software que está instalado
no dispositivo licenciado. O Adquirente não a poderá alterar para outra versão (como a versão de
32 bits ou de 64 bits ou outra versão noutro idioma).
3. REQUISITOS DE LICENCIAMENTO ADICIONAIS E OU DIREITOS DE UTILIZAÇÃO.
a. Utilização Específica. O Rimage Corporation concebeu o dispositivo licenciado para uma
utilização específica. Só pode utilizar o software para esse fim.
b. Outro Software. O Adquirente poderá utilizar outros programas com o software desde que os
outros programas

suportem directamente a utilização específica do dispositivo licenciado, ou

forneçam utilitários do sistema, gestão de recursos ou protecção antivírus ou outra
semelhante.
Software que fornece tarefas ou processos de consumidor ou comerciais poderá não ser
executado no dispositivo licenciado. Isto inclui software de correio electrónico, processamento de
texto, folhas de cálculo, base de dados, agendamento ou financeiro pessoal. O dispositivo
licenciado poderá utilizar protocolos de serviços de terminal para aceder a esse software em
execução num servidor.
c. Ligações de Dispositivo. O Adquirente não poderá utilizar o software como software de
servidor. Por outras palavras, mais de um dispositivo poderá não conseguir aceder, apresentar,
executar, partilhar ou utilizar o software ao mesmo tempo. O Adquirente poderá permitir que até
dez dispositivos possam aceder ao software para utilizarem

Serviços de Ficheiros,

Serviços de Impressão,

Serviços de Informação Internet, e

Partilha de Ligações da Internet e Serviços de Telefonia.
O limite de dez ligações aplica-se a dispositivos que acedem ao software indirectamente através
de "multiplexação" ou de outro software ou hardware que reúna ligações. Poderá utilizar ligações
de entrada ilimitadas em qualquer altura através de TCP/IP.
d. Tecnologias de Acesso Remoto. O Adquirente poderá aceder e utilizar o software
remotamente a partir de outro dispositivo com tecnologias de acesso remoto da seguinte forma.
Estação de Trabalho Remota. O primeiro utilizador individual do dispositivo licenciado pode
aceder a uma sessão a partir de outro dispositivo utilizando a Estação de Trabalho Remota ou
outras tecnologias semelhantes. Uma "sessão" traduz-se na experiência de interacção com o
software, directa ou indirectamente, através de qualquer combinação de periféricos de entrada,
saída e visualização. Outros utilizadores podem aceder a uma sessão a partir de qualquer
dispositivo utilizando estas tecnologias, desde que o dispositivo remoto esteja licenciado em
separado para executar o software.
Outras Tecnologias de Acesso. Pode utilizar a Assistência Remota ou outras tecnologias
semelhantes para partilhar uma sessão activa.
Outras Utilizações Remotas. O Cliente poderá permitir que qualquer número de dispositivos
aceda ao software para outros fins que não os descritos nas secções Ligações de Dispositivos e
Tecnologias de Acesso Remoto acima, como, por exemplo, para sincronizar dados entre
dispositivos.
e. Componentes de Tipos de Letra. Enquanto o software está a ser executado o Adquirente
pode utilizar os seus tipos de letra para visualizar e imprimir conteúdo. Ao Adquirente é permitido
apenas
f.

incorporar tipos de letra em conteúdo de acordo com o permitido pelas restrições de
incorporação dos tipos de letra; e

transferi-los temporariamente para uma impressora ou outro dispositivo de saída para
imprimir conteúdo.
Ícones, imagens e sons. Enquanto o software está a ser executado, pode utilizar ícones,
imagens, sons e multimédia, mas não pode partilhá-los.
4. SOFTWARE POTENCIALMENTE INDESEJADO. O software inclui o Windows Defender. Se o
Windows Defender estiver activado, procurará “spyware”, “adware” e outro software potencialmente
indesejado neste dispositivo. Se encontrar software potencialmente indesejável, o software
perguntará ao Adquirente se o pretende ignorar, desactivar (colocar em quarentena) ou remover.
Qualquer software potencialmente indesejável classificado como “alto” ou “grave”, será
automaticamente removido após a verificação, a menos que o utilizador altere a predefinição. A
remoção ou desactivação do software potencialmente indesejável poderá resultar em

outro software do computador deixar de funcionar ou

a violação por parte do Adquirente de uma licença de utilização de outro software neste
dispositivo.
Ao utilizar este software, é possível que também remova ou desactive software que não seja
potencialmente indesejável.
5. ÂMBITO DA LICENÇA. O software é licenciado e não vendido. Este contrato concede apenas
alguns direitos de utilização do software. O Rimage Corporation e a Microsoft reservam-se todos os
outros direitos. Salvo se a legislação em vigor conferir mais direitos, não obstante esta limitação, o
Adquirente pode apenas utilizar o software conforme expressamente permitido no presente contrato.
Ao fazê-lo, o Adquirente deverá respeitar quaisquer limitações técnicas no software que permitem
utilizá-lo apenas de determinadas formas. Para mais informações, consulte a documentação do
software ou contacte o Rimage Corporation. O Adquirente não pode:
•
contornar quaisquer limitações técnicas no software;
•
proceder a engenharia inversa, descompilação ou desassemblagem do software;
•
efectuar mais cópias do software do que aquelas especificadas neste contrato;
•
publicar o software para que outros o copiem;
•
alugar, proceder a locação financeira (“leasing”) ou emprestar o software; ou
•
Utilizar o software para serviços de alojamento de software comercial.
Salvo disposição expressa em contrário fornecida neste contrato, os direitos de acesso ao software
neste dispositivo não conferem ao Adquirente quaisquer direitos de implementação de patentes da
Microsoft ou de outros elementos de propriedade intelectual da Microsoft em software ou em
dispositivos que acedam a este dispositivo.
•
SERVIÇOS BASEADOS NA INTERNET. A Microsoft fornece serviços baseados na Internet com
o software. A Microsoft reserva-se o direito de os alterar ou cancelar em qualquer altura.
a. Consentimento para Serviços Baseados na Internet. O dispositivo licenciado poderá
conter uma ou mais das funcionalidades do software descritas abaixo. Estas funcionalidades
estabelecem ligação com a Microsoft ou com os sistemas informáticos do fornecedor de
serviços através da Internet. Em alguns casos, o Adquirente não receberá uma notificação
em separado quando a ligação for estabelecida. Para mais informações sobre estas

Ao utilizar estas funcionalidades, o Adquirente está a autorizar a transmissão
destas informações. A Microsoft não utiliza as informações para identificar ou contactar o
Adquirente.
Informações sobre o Computador. As seguintes funcionalidades utilizam os protocolos IP,
que enviam informações do computador para os sistemas adequados, tais como o endereço
IP, o tipo de sistema operativo e o browser e o nome e a versão do software utilizado. A
Microsoft utiliza estas informações para disponibilizar ao Adquirente os serviços baseados na
Internet. O Rimage Corporation optou por activar as seguintes funcionalidades no dispositivo
licenciado.

Plug and Play e Extensões Plug and Play. É possível ligar novo hardware ao dispositivo. O
dispositivo do Adquirente poderá não ter os controladores necessários para comunicar
com esse hardware. Se tal acontecer, a funcionalidade de actualização do software pode
obter da Microsoft o controlador necessário e instalá-lo no seu dispositivo.

Funcionalidades de Conteúdo Web. As funcionalidades existentes no software podem
obter conteúdo relacionado da Microsoft e fornecer esse conteúdo ao Adquirente. Alguns
exemplos destas funcionalidades são ClipArt, modelos, formação online, ajuda online e
Appshelp. O Adquirente pode optar por não utilizar estas funcionalidades de conteúdo
Web.

Certificados Digitais. O software utiliza certificados digitais x.509 versão 3. Estes
certificados digitais confirmam a identidade dos utilizadores enviando informações uns
para os outros e permitem encriptar as informações. O software obtém certificados e
actualiza listas de revogação de certificados através da Internet.

Actualização de Raízes Automática. A funcionalidade de Actualização de Raízes
Automática actualiza a lista de autoridades de certificação fidedignas. É possível
desactivar esta funcionalidade.

Gestão de Direitos Digitais do Windows Media. Os proprietários do conteúdo utilizam a
tecnologia de gestão de direitos digitais do Windows Media (WMDRM, Windows Media
Digital Rights Management) para protegerem a respectiva propriedade intelectual,
incluindo direitos de autor. Este software e software de terceiros utilizam o WMDRM para
reproduzir e copiar conteúdo protegido por WMDRM. Se o software falhar na protecção
do conteúdo, os proprietários do conteúdo podem solicitar que a Microsoft revogue a
capacidade do software para utilizar o WMDRM para reproduzir ou copiar conteúdo
protegido. A revogação não afecta outro conteúdo. Quando transfere licenças para
conteúdo protegido, o Adquirente aceita que a Microsoft possa incluir uma lista de
revogação com as licenças. Os proprietários do conteúdo podem solicitar a actualização
da versão do WMDRM para poderem aceder ao respectivo conteúdo. O software da
Microsoft que inclui o WMDRM solicitará consentimento do Adquirente antes de efectuar
a actualização de versão. Se o Adquirente recusar uma actualização, não conseguirá
aceder a conteúdo que requer a actualização. Pode optar por desactivar as
funcionalidades de WMDRM que acedem à Internet. Quando estas funcionalidades estão
desactivadas, pode continuar a reproduzir conteúdo para o qual tenha uma licença
válida.

Windows Media Player. Quando o Adquirente utiliza o Windows Media Player, este
verifica com a Microsoft a existência de
• serviços de música online compatíveis na sua região;
•
novas versões do leitor; e
•
codecs, se o seu dispositivo não tiver os correctos para reproduzir conteúdo.

Remoção de Software Malicioso aquando da Actualização. Antes de proceder à
instalação, o software irá procurar e remover do seu dispositivo software malicioso
(“software maligno”), listado em www.support.microsoft.com/?kbid=890830. Quando o
software verifica se o dispositivo do Cliente tem Software Maligno instalado, é enviado
um relatório para a Microsoft sobre qualquer Software Maligno detectado ou erros que
ocorreram enquanto o software verificava a existência de Software Maligno. Não são
incluídas no relatório quaisquer informações que possam ser utilizadas para o identificar.

Detecção Automática de Rede. Esta funcionalidade determina se um sistema está ligado
a uma rede através de monitorização passiva do tráfego de rede ou de consultas activas
de DNS ou HTTP. A consulta apenas transfere informações padrão de TCP/IP ou DNS
para fins de encaminhamento. É possível desactivar a funcionalidade de consultas activas
através de uma configuração do registo.

Serviço de Hora do Windows. Este serviço efectua a sincronização com o Web site
www.time-windows.com uma vez por semana para fornecer ao computador a hora
correcta. A ligação utiliza o protocolo NTP padrão.
b. Utilização de Informações. A Microsoft pode utilizar as informações do computador,
relatórios de erros e de Software Maligno para melhorar o software e os serviços que presta.
A Microsoft poderá também partilhá-las com terceiros, tais como fornecedores de hardware e
software. Estes poderão utilizar as informações para melhorar a forma como os seus
produtos funcionam com software da Microsoft.
c. Utilização Indevida dos Serviços Baseados na Internet. Não é permitida a utilização
destes serviços de qualquer forma que os possa danificar ou impedir a utilização dos mesmos
por terceiros. Não é permitida a utilização dos serviços para obter acesso não autorizado a
qualquer serviço, dados, conta ou rede por qualquer meio.
6. VALIDAÇÃO.
a. A validação verifica se o software foi activado e se está devidamente licenciado. Verifica também
se não foram efectuadas alterações não autorizadas às funções de validação, licenciamento ou
activação do software. A validação também pode verificar se existe algum software malicioso ou
não autorizado relacionado com essas alterações não autorizadas. Uma verificação de validação
que confirme que o Adquirente está devidamente licenciado permite-lhe continuar a utilizar o
software, determinadas funcionalidades do software ou obter benefícios adicionais. O
Adquirente não está autorizado a contornar a validação. Esta medida serve para evitar
uma utilização não licenciada do software. Para mais informações, consulte

b. O software irá, de tempos a tempos, efectuar uma verificação de validação do software. A
verificação pode ser iniciada pelo software ou pela Microsoft. Para activar a função de activação e
as verificações de validação, o software pode, de tempos a tempos, necessitar de actualizações
ou de transferências adicionais de funções de validação, licenciamento ou de activação do
software. As actualizações ou transferências são necessárias para o funcionamento correcto do
software e podem ser transferidas e instaladas sem que o Adquirente receba uma notificação.
Durante ou após a verificação de validação, o software pode enviar à Microsoft informações
sobre o software, o computador e os resultados da verificação de validação. Estas informações
incluem, por exemplo, a versão e chave de produto do software, quaisquer alterações não
autorizadas efectuadas à validação, funções de licenciamento ou de activação do software,
qualquer software malicioso ou não autorizado relacionado encontrado e o endereço IP do
computador. A Microsoft não utiliza as informações para identificar ou contactar o Adquirente. Ao
utilizar o software o Adquirente está a autorizar a transmissão destas informações. Para mais

c. Se, após uma verificação de validação, se constatar que o software é falsificado, está
indevidamente licenciado, é um produto Windows não genuíno ou se inclui alterações não
autorizadas, a funcionalidade e experiência de utilização do software serão afectadas. Por
exemplo:
A Microsoft pode

reparar o software e remover, colocar em quarentena ou desactivar quaisquer alterações não
autorizadas que possam interferir com a utilização correcta do software, incluindo o
contornar de funções de activação ou validação do software; ou

verificar e remover software malicioso ou não autorizado identificado como estando
relacionado com essas alterações não autorizadas; ou

fornecer uma notificação de que o software foi indevidamente licenciado ou de que se trata
de um produto Windows não genuíno;
e o Adquirente pode


receber lembretes para obter uma cópia do software devidamente licenciada; ou
necessitar de seguir as instruções da Microsoft para obter a licença para utilizar o software e
reactivá-lo;
e não pode
 utilizar ou continuar a utilizar o software ou algumas das funcionalidades do software; ou
 obter determinadas actualizações da Microsoft.
d. Apenas a Microsoft ou fontes autorizadas lhe poderão fornecer actualizações para o software
(incluindo o Rimage Corporation). Para mais informações sobre a obtenção de actualizações de

7. SUPORTE TÉCNICO. Contacte o Rimage Corporation para obter opções de suporte. Consulte o
número de suporte fornecido com o dispositivo.
8. TESTES DE BENCHMARK DO MICROSOFT .NET. O software inclui um ou mais componentes do
.NET Framework (“Componentes .NET”). O Adquirente poderá realizar testes de referência internos
desses componentes. Poderá divulgar os resultados de quaisquer testes de referência desses
componentes, desde que respeite as condições estipuladas em
go.microsoft.com/fwlink/?LinkID=66406.
Não obstante quaisquer outros acordos que possa ter com a Microsoft, se revelar os resultados dos
testes de referência, a Microsoft terá o direito de revelar os resultados dos testes de referência que
realiza nos seus produtos que competem com o Componente .NET aplicável, desde que respeite as
mesmas condições estipuladas em go.microsoft.com/fwlink/?LinkID=66406.
9. CÓPIA DE SEGURANÇA. O Adquirente pode efectuar uma cópia de segurança do software. Esta só
deve ser utilizada para reinstalar o software no dispositivo.
10. DOCUMENTAÇÃO. Qualquer pessoa com acesso válido ao computador ou à rede interna do
Adquirente pode copiar e utilizar a documentação para fins de referência interna.
11. ACTUALIZAÇÕES. Para actualizar o software, tem de ter licença para utilizar esse software elegível
para actualização. Ao proceder à actualização, este acordo tem primazia sobre o constante no
software a partir do qual fez a actualização. Depois de actualizar, deixará de ser possível actualizar o
software a partir do qual actualizou.
12. PROVA DE LICENÇA (“PROOF OF LICENSE” ou “POL”). Se adquiriu o software no dispositivo,
num disco ou noutro suporte de dados, uma etiqueta de Certificado de Autenticidade genuína com
uma cópia genuína do software identifica o software licenciado. Para ser considerada válida, esta
etiqueta tem de estar colada no dispositivo ou incluída na embalagem de software do Rimage
Corporation. Se o Adquirente receber a etiqueta separadamente, esta não é considerada válida. O
Cliente deve manter a etiqueta no dispositivo ou na embalagem para provar que está licenciado para
utilizar o software. Para identificar software genuíno da Microsoft, consulte www.howtotell.com.
13. TRANSFERÊNCIA PARA TERCEIROS. O Adquirente poderá transferir o software apenas com o
dispositivo, a etiqueta do Certificado de Autenticidade, e estes termos de licenciamento, directamente
para um terceiro. Antes da transferência, essa parte tem de concordar que estes termos de
licenciamento se aplicam à transferência e utilização do software. Não pode guardar cópias do
software, incluindo a cópia de segurança.
14. AVISO RELATIVO À NORMA VISUAL H.264/AVC, A NORMA DE VÍDEO VC-1, A NORMA
VISUAL MPEG-4 E A NORMA DE VÍDEO MPEG-2. Este software poderá incluir tecnologia de
compressão visual H.264/ AVC, VC-1, MPEG-4 Parte 2 e MPEG-2. Se o software incluir essas
tecnologias de compressão visual, MPEG LA, L.L.C. requer esta notificação:
ESTE PRODUTO É LICENCIADO AO ABRIGO DE UMA OU MAIS LICENÇAS DE PORTEFÓLIO DE

CONSUMIDOR NUMA ACTIVIDADE PESSOAL E NÃO COMERCIAL E/OU OBTIDO A PARTIR DE UM
FORNECEDOR DE VÍDEO LICENCIADO PARA FORNECER O VÍDEO AO ABRIGO DESSAS LICENÇAS DE
PORTEFÓLIO DE PATENTES. NENHUMA DAS LICENÇAS É APLICÁVEL A QUALQUER OUTRO
PRODUTO INDEPENDENTEMENTE DESSE PRODUTO ESTAR INCLUÍDO NESTE PRODUTO NUM
ÚNICO ARTIGO. NENHUMA LICENÇA É CONCEDIDA OU SERÁ IMPLÍCITA PARA QUALQUER OUTRA
UTILIZAÇÃO. PODERÁ OBTER INFORMAÇÕES ADICIONAIS A PARTIR DE MPEG LA, L.L.C. CONSULTE
WWW.MPEGLA.COM.
15. NÃO TEM TOLERÂNCIA A FALHAS. O software não tem tolerância a falhas. O Rimage
Corporation instalou o software no dispositivo e é responsável pelo respectivo
funcionamento no dispositivo.
16. UTILIZAÇÃO RESTRITA. O software Microsoft foi concebido para sistemas que não requerem um
desempenho isento de falhas. Não pode utilizar o software Microsoft em qualquer dispositivo ou
sistema no qual uma avaria do software resultaria num risco previsível de lesão ou morte para
qualquer pessoa. Isto inclui o funcionamento de sistemas de instalações nucleares, de comunicação
ou navegação aérea e de controlo do tráfego aéreo.
17. PROGRAMAS DE TERCEIROS. O software contém outros programas de terceiros. Os termos de
licença com esses programas aplicam-se à utilização que deles é feita.
18. EXCLUSÃO DE GARANTIAS PARA O SOFTWARE. O software é fornecido “tal como está”. O
Adquirente é responsável pela utilização do mesmo. A Microsoft não concede quaisquer
garantias ou condições expressas. Quaisquer garantias recebidas pelo Adquirente
relativamente ao dispositivo ou software não têm origem e não estão vinculadas à
Microsoft nem às respectivas empresas afiliadas. Quando for permitido pelas leis locais, o
Rimage Corporation e a Microsoft excluem as garantias implícitas de comercialização,
adequação a um fim específico e não infracção.
19. LIMITAÇÕES DE RESPONSABILIDADE. A Microsoft e respectivas empresas afiliadas
ressarcirão o Adquirente apenas por danos directos e até ao montante de duzentos e
cinquenta dólares americanos (U.S. $250,00) ou equivalente na moeda local. O
Adquirente não poderá ser ressarcido por quaisquer outros danos incluindo prejuízos
consequentes, lucros perdidos, prejuízos extraordinários, danos indirectos ou incidentais.
Esta limitação aplica-se a:
•
qualquer assunto relacionado com o software, serviços, conteúdo (incluindo o
código) em sites da Internet de terceiros ou programas de terceiros e
•
queixas por violação do contrato, violação da garantia ou condição,
responsabilidade objectiva, negligência ou outro acto ilícito até à extensão
permitida pela lei aplicável.
Aplica-se igualmente se a Microsoft devia ter tido conhecimento da possibilidade de
ocorrência de tais danos. A limitação supra mencionada poderá também não se aplicar ao
Adquirente, por o país em que reside não permitir a exclusão ou limitação de danos
incidentais, consequentes ou outros.
20. RESTRIÇÕES À EXPORTAÇÃO. O software está sujeito às leis e normas de exportação dos
Estados Unidos. Terá de cumprir com todas as leis e normas de exportação locais e internacionais
que se apliquem ao software. Estas leis incluem restrições a destinos, utilizadores finais e utilização

21. CONTRATO INTEGRAL. Este contrato, os termos adicionais (incluindo termos de licenciamento
impressos que acompanham o software e podem modificar ou substituir alguns ou todos este
termos) e os termos de suplementos, actualizações, serviços baseados na Internet e serviços de
suporte utilizados pelo Adquirente, constituem o contrato integral para o software e os serviços de
suporte.
22. LEI APLICÁVEL.
a. Estados Unidos. Caso o Adquirente tenha adquirido o software nos Estados Unidos, as leis do
estado de Washington regulam a interpretação do presente contrato e aplicam-se às acções por
violações do mesmo, independentemente dos conflitos de princípios de leis. As leis que vigoram
no estado onde o Adquirente reside regulam todas as outras acções, incluindo as acções ao
abrigo da legislação de protecção do consumidor do Estado, legislação de concorrência desleal e
acto ilícito.
b. Fora dos Estados Unidos. Se o software tiver sido adquirido noutro país, aplicam-se as leis
desse país.

Los presentes términos de licencia constituyen un contrato entre usted y Rimage Corporation. Le
rogamos que los lea atentamente. Son de aplicación al software incluido en este dispositivo. El software
incluye también cualesquiera soportes físicos independientes en los que lo haya recibido.
El software de este dispositivo incluye software licenciado de Microsoft Corporation o su filial.
Estos términos también se aplicarán a los siguientes elementos de Microsoft:
Actualizaciones,
Suplementos,
Servicios basados en Internet i
Servicios de soporte
Todos ellos deben corresponder a este software, salvo que existan otros términos aplicables a dichos
elementos. En tal caso, se aplicarán eso otros términos.
Si obtiene actualizaciones o complementos directamente de Microsoft, será Microsoft y no Rimage
Corporation quien le otorgue las licencias.
Tal y como se describe a continuación, la utilización por su parte del software constituirá su
consentimiento para la transmisión de determinada información para los servicios basados
en Internet.
Al hacer uso del software, estará aceptando estos términos. Si no los acepta, no utilice el
software. En su lugar, póngase en contacto con Rimage Corporation para conocer su
directiva de devoluciones con el fin de obtener un reembolso o crédito.
Si cumple los presentes términos de licencia, dispondrá de los siguientes derechos.
1. INTRODUCCIÓN.
a. Software. El software incluye el software del sistema operativo de escritorio. Este software no
incluye servicios de Windows Live. Microsoft ofrece los servicios de Windows Live en virtud de un
contrato independiente.
2. DERECHOS DE USO.
a. Uso. La licencia de software se asigna permanentemente al dispositivo con el que adquirió el
software. Ese dispositivo será el “dispositivo con licencia”. Podrá usar el software en el dispositivo
con licencia.
b. Límite de Procesadores. Podrá usar el software en un máximo de dos procesadores al mismo
tiempo.
c. Versiones Alternativas. Solamente podrá utilizar la versión del software instalada en el
dispositivo con licencia. No podrá cambiarla a ninguna otra versión (por ejemplo, la versión de
32 ó 64 bits o la versión en otro idioma).
3. REQUISITOS DE LICENCIA Y/O DERECHOS DE USO ADICIONALES.
a. Uso Específico. Rimage Corporation ha diseñado el dispositivo con licencia para un uso
específico. Usted sólo podrá utilizar el software para dicho uso.
b. Otro Software. Podrá utilizar otros programas con el software, siempre que los otros
programas:

permitan directamente el uso específico del dispositivo con licencia, u

ofrezcan utilidades del sistema, administración de recursos, antivirus o métodos similares de
protección.
No se podrá ejecutar en el dispositivo con licencia software que proporcione procesos o tareas
empresariales o para consumidores. Esto incluye software de correo electrónico, procesamiento
de texto, hojas de cálculo, bases de datos, programación y finanzas personales. El dispositivo con
licencia podrá utilizar protocolos de servicios de terminal para obtener acceso a dicho software si
éste se ejecuta en un servidor.
c. Conexiones de Dispositivos. Usted no podrá usar el software como software de servidor. Es
decir, no podrá obtener acceso al software ni visualizarlo, ejecutarlo, compartirlo o utilizarlo en
más de un dispositivo al mismo tiempo. Podrá permitir que diez dispositivos, como máximo,
tengan acceso al software para utilizar:

Servicios de Archivo,

Servicios de Impresión,

Internet Information Services y

Internet Connection Sharing y Servicios de Telefonía.
El límite de diez conexiones será de aplicación a los dispositivos que accedan indirectamente al
software a través de “multiplexación” u otro software o hardware que agrupe conexiones. Usted
podrá utilizar en todo momento un número ilimitado de conexiones entrantes mediante TCP/IP.
d. Tecnologías de Acceso Remoto. Usted podrá obtener acceso al software y utilizarlo de forma
remota desde otro dispositivo utilizando las siguientes tecnologías de acceso remoto:
Escritorio remoto. El usuario principal y único del dispositivo con licencia podrá obtener acceso a
una sesión desde cualquier otro dispositivo mediante el Escritorio remoto o tecnologías similares.
Por “sesión” se entiende la experiencia de interactuar, directa o indirectamente, con el software a
través de cualquier combinación de periféricos de entrada, salida y visualización. Otros usuarios
pueden obtener acceso a una sesión desde cualquier dispositivo mediante estas tecnologías,
siempre y cuando el dispositivo remoto disponga de una licencia propia para ejecutar el software.
Otras Tecnologías de Acceso. Puede utilizar la Asistencia Remota o tecnologías similares para
compartir una sesión activa.
Otros usos remotos. Podrá autorizar cualquier número de dispositivos para que obtengan acceso
al software con fines que no sean los descritos en los apartados Conexiones de Dispositivos y
Tecnologías de Acceso Remoto, por ejemplo, para sincronizar datos entre dispositivos.
e. Componentes de Fuente. Mientras se ejecuta el software, puede utilizar sus fuentes para
mostrar e imprimir el contenido. Solamente puede:

incrustar las fuentes en el contenido de acuerdo con las restricciones de incrustación de
fuentes y

descargarlas temporalmente en una impresora u otro dispositivo de salida para imprimir
contenido.
Iconos, imágenes y sonidos. Mientras se ejecuta el software, puede utilizar, pero no
compartir, sus iconos, imágenes, sonidos y soportes físicos.
4. SOFTWARE POTENCIALMENTE NO DESEADO. El software incluye Windows Defender. Cuando
esté activado, Windows Defender buscará en el dispositivo “spyware”, “adware” y otro software
potencialmente no deseado. Si encuentra software potencialmente no deseado, el software le
preguntará si desea omitirlo, deshabilitarlo (ponerlo en cuarentena) o eliminarlo. Si no se modifica la
configuración predeterminada, tras el análisis se eliminará automáticamente cualquier software
potencialmente no deseado cuyo riesgo se considere “alto” o “grave”. La eliminación o inhabilitación
del software potencialmente no deseado puede hacer que

otro software del equipo deje de funcionar;

incumpla la licencia de uso de otro software instalado en el dispositivo.
Al utilizar este software, es posible que también quite o inhabilite otro software que no sea software
potencialmente no deseado.
5. ÁMBITO DE LA LICENCIA. El software se cede sujeto a licencia y no es objeto de venta. El
presente contrato solo le otorga algunos Derechos de Uso del software. Rimage Corporation y
Microsoft se reservan todos los demás derechos. A menos que la ley aplicable le otorgue más
derechos a pesar de esta limitación, sólo podrá utilizar el software tal como se permite expresamente
en este contrato. Al hacerlo, deberá ajustarse a las limitaciones técnicas del software que sólo

Eludir las limitaciones técnicas del software

Realizar ingeniería inversa, descompilar ni desensamblar el software

Realizar más copias del software de las que se especifican en este contrato

Hacer público el software para que otros lo copien

Alquilar, arrendar o prestar el software ni

Utilizar el software para prestar servicios de hospedaje de software comercial
Excepto por lo descrito expresamente en este contrato, los derechos de acceso al software en este
dispositivo no le otorgan ningún derecho para implementar patentes u otras propiedades
intelectuales de Microsoft en programas de software o dispositivos que tengan acceso a este
dispositivo.

SERVICIOS BASADOS EN INTERNET. Microsoft proporciona servicios basados en Internet
con el software. Microsoft puede modificarlos o cancelarlos en cualquier momento.
a. Consentimiento para Servicios Basados en Internet. El dispositivo con licencia puede
contener una o varias de las características de software descritas a continuación. Estas
características se conectan a través de Internet a los sistemas informáticos de Microsoft o del
proveedor de servicios. En algunos casos, usted no recibirá ninguna notificación
independiente cuando esto ocurra. Para obtener más información acerca de estas

Al utilizar estas características, estará dando su consentimiento para que se
transmita esta información. Microsoft no utilizará esta información para identificar ni
ponerse en contacto con usted.
Información del Equipo. Las siguientes características utilizan protocolos de Internet, que
envían a los sistemas correspondientes información sobre su equipo, como su dirección de
protocolo de Internet, el tipo de sistema operativo y de explorador, el nombre y la versión
del software que está utilizando. Microsoft utiliza esta información para poner los servicios
basados en Internet a su disposición. Rimage Corporation ha decidido activar las siguientes
características en el dispositivo con licencia:

Plug and Play y extensiones Plug and Play. Quizás desee conectar nuevo hardware a su
dispositivo. Es posible que el dispositivo no disponga de los controladores necesarios
para comunicarse con ese hardware. Si es así, la característica de actualización del
software puede obtener el controlador correcto de Microsoft e instalarlo en el dispositivo.

Características de contenido web. El software incorpora características que recuperan
contenido relacionado de Microsoft y se lo facilitan a usted. Algunos ejemplos de estas
características son las imágenes prediseñadas, las plantillas, la formación y la asistencia
en línea, así como Appshelp. Puede optar por no utilizar estas características de
contenido web.

Certificados digitales. El software utiliza certificados digitales x.509 versión 3. Dichos
certificados digitales confirman la identidad de los usuarios que se envían información
mutuamente y permiten cifrar la información. El software recupera los certificados y
actualiza las listas de revocación de certificados a través de Internet.

Actualización Automática de Raíz. La característica de Actualización Automática de Raíz
actualiza la lista de entidades de certificación de confianza. Usted tiene la opción de
desactivar esta característica.

Administración de los Derechos Digitales de Windows Media. Los propietarios de
contenido utilizan la tecnología de administración de derechos digitales de Windows
Media (WMDRM) para la protección de su propiedad intelectual e industrial, incluidos los
derechos de autor. El software y los programas de software de terceros utilizan WMDRM
para reproducir y copiar contenido protegido por WMDRM. Si el software no logra
proteger el contenido, los propietarios del contenido pueden exigir a Microsoft que
revoque la capacidad del software para utilizar WMDRM con fines de reproducción o
copia de contenido protegido. Esta revocación no afecta al resto del contenido. La
descarga de licencias de contenido protegido implica que acepta que Microsoft pueda
incluir una lista de revocación con las licencias. Los propietarios del contenido pueden
exigirle que actualice WMDRM para obtener acceso a su contenido. Los programas de
software de Microsoft que incluyan WMDRM le solicitarán su autorización antes de
proceder a la actualización. Si decide no realizar la actualización, no podrá tener acceso
al contenido que requiera actualización. Tiene la opción de desactivar las características
de WMDRM que obtienen acceso a Internet. Aunque dichas características estén
desactivadas, puede seguir reproduciendo contenido para el que disponga de una
licencia válida.

Reproductor de Windows Media. Cuando utilice el Reproductor de Windows Media, éste
comprobará con Microsoft si:
• existen servicios de música en línea compatibles en su zona geográfica,
•
existen nuevas versiones del reproductor y
•
existen los códecs pertinentes si su dispositivo no dispone de los adecuados para
reproducir contenido.

Eliminación o limpieza de software malintencionado al actualizar. Antes de su instalación,
el software comprobará la existencia de determinado software malintencionado
cotejando el enunciado en www.support.microsoft.com/?kbid=890830 (“Malware”) y lo
quitará del dispositivo. Cuando el software intercepte código malintencionado en su
dispositivo, se enviará un informe a Microsoft sobre cualquier tipo de código
malintencionado detectado o errores encontrados durante la búsqueda de código
malintencionado. En el informe no se incluirá información con la que se le pueda
identificar.

Reconocimiento de Redes. Esta característica determina si un sistema está conectado a
una red mediante la supervisión pasiva del tráfico de la red o mediante consultas DNS o
HTTP activas. La consulta solamente transmite la información de TCP/IP o DNS estándar
con vistas al enrutamiento. Puede optar por desactivar la característica de consultas
activas modificando un valor del registro.

Servicio de hora de Windows. Este servicio se sincroniza con www.time-windows.com
una vez a la semana para comunicar al equipo la hora correcta. La conexión usa el
protocolo NTP estándar.
b. Uso de la Información. Microsoft podrá utilizar la información del equipo, los informes de
error y los informes de código malintencionado para mejorar su software y servicios.
Asimismo, podemos compartirlos con otros, como proveedores de software y hardware, que
podrán utilizar la información para mejorar el funcionamiento de sus productos con el
software de Microsoft.
c. Uso Indebido de Servicios Basados en Internet. No podrá utilizar dichos servicios de
una manera tal que pueda perjudicar u obstaculizar su uso por parte de otros usuarios.
Tampoco puede utilizar los servicios para intentar obtener acceso no autorizado a cualquier
servicio, dato, cuenta o red, sean cuales fueren los métodos.
6. VALIDACIÓN.
a. La validación comprueba que se ha activado el software y que cuenta con una licencia adecuada.
También comprueba que no se hayan efectuado cambios no autorizados en las características de
validación, licencia o activación del software. Asimismo, la validación puede comprobar la
existencia de determinado software malintencionado o no autorizado en relación con esos
cambios no autorizados. La comprobación de validación confirma que usted cuenta con la licencia
adecuada y le permite seguir utilizando el software o algunas de sus características, u obtener
ventajas adicionales. No está permitido eludir la validación. Se ha diseñado así para evitar el

b. El software realizará cada cierto tiempo una comprobación de validación del propio software.
Microsoft o el propio software podrá iniciar la comprobación. Para habilitar la característica de
activación y las comprobaciones de validación, el software podrá requerir cuando estime
oportuno actualizaciones o descargas adicionales de las funciones de validación, licencia o
activación del software. Las actualizaciones o descargas son necesarias para que el software
funcione correctamente y se pueden descargar e instalar sin previo aviso. Durante o después de
una comprobación de validación, el software puede enviar a Microsoft información sobre el
propio software, el equipo y los resultados de la comprobación de validación. Esta información
incluye, por ejemplo, la versión y la clave de producto del software, las modificaciones no
autorizadas en las funciones de validación, licencia o activación del software, cualquier software
malintencionado o no autorizado relacionado que se haya encontrado y la dirección de protocolo
de Internet del equipo. Microsoft no utilizará esta información para identificar ni ponerse en
contacto con usted. El uso del software constituirá un consentimiento por su parte para la

c. Si, tras la comprobación de la validación, se descubre que se trata de software falsificado, que no
dispone de la licencia apropiada, que no es un producto Windows original o que incluye
modificaciones no autorizadas, entonces la funcionalidad y el uso del software se verán
afectados. Por ejemplo:
Microsoft puede:

reparar el software, quitar, poner en cuarentena o deshabilitar las modificaciones no
autorizadas susceptibles de interferir en el uso adecuado del software, lo que incluye eludir
las funciones de activación o validación del software;

comprobar y quitar el software malintencionado o no autorizado que esté relacionado con
dichas modificaciones no autorizadas; o
 notificar que el software no tiene la licencia apropiada o es un producto Windows no original.
Usted puede:


recibir avisos para obtener una copia licenciada adecuada del software o
seguir las instrucciones de Microsoft a fin de obtener la licencia para utilizar el software y
reactivarlo.
Usted no puede:
 utilizar o seguir utilizando el software o algunas de sus características o
 obtener determinadas actualizaciones o mejoras de Microsoft.
d. Sólo Microsoft u otras fuentes autorizadas (incluida Rimage Corporation) pueden proporcionar
actualizaciones o mejoras del software. Para obtener más información sobre cómo obtener

7. SOPORTE TÉCNICO DEL PRODUCTO. Póngase en contacto con Rimage Corporation para obtener
información acerca de las opciones de soporte técnico. Consulte el número de soporte técnico
proporcionado con el dispositivo.
8. PRUEBAS COMPARATIVAS DE MICROSOFT .NET. El software incluye uno o varios componentes
de .NET Framework (“Componentes .NET”). Podrá realizar pruebas comparativas internas de dichos
componentes. Podrá divulgar los resultados de cualquier prueba comparativa de dichos componentes
siempre que cumpla con las condiciones que se establecen en
go.microsoft.com/fwlink/?LinkID=66406.
Sin perjuicio de cualquier otro contrato que haya formalizado con Microsoft, si divulga los resultados
de tales pruebas comparativas, Microsoft tendrá derecho a divulgar los resultados de las pruebas
comparativas que lleve a cabo sobre los productos de su propiedad que compitan con el componente
.NET pertinente, siempre que cumpla las mismas condiciones establecidas en
go.microsoft.com/fwlink/?LinkID=66406.
9. COPIA DE SEGURIDAD. Puede realizar una única copia de seguridad del software. Solamente
puede utilizarla para volver a instalar el software en el dispositivo.
10. DOCUMENTACIÓN. Toda persona que tenga acceso válido a su equipo o a la red interna puede
copiar y utilizar la documentación a efectos internos de consulta.
11. ACTUALIZACIONES. Para utilizar el software de actualización, deberá disponer primero de una
licencia para el software objeto de la actualización. Al actualizar, el presente contrato reemplazará el
contrato del software actualizado. Después de la actualización, ya no podrá utilizar el software a
partir del cual haya actualizado.
12. PRUEBA DE LICENCIA. Si adquirió el software instalado en el dispositivo, en un disco o en otro
soporte físico, la etiqueta original de Certificado de Autenticidad (Certificate of Authenticity) que
viene con una copia original del software indica que el software tiene licencia. Para que esta etiqueta
sea válida, debe estar adherida al dispositivo o incluida en el paquete de software de Rimage
Corporation. La etiqueta no será válida si la recibe por separado. Deberá conservar la etiqueta en el
dispositivo o en el paquete a fin de justificar que tiene licencia para utilizar el software. Para
identificar el software original de Microsoft, consulte www.howtotell.com.
13. TRANSMISIÓN A TERCEROS. Usted sólo puede transferir el software directamente a un tercero
junto con el dispositivo, la etiqueta de Certificado de Autenticidad y estos términos de licencia. Antes
de la transmisión, el tercero deberá aceptar que estos términos de licencia se aplican a la transmisión
y al uso del software. No podrá conservar ninguna copia del software, incluyendo copias de
seguridad.
14. AVISO ACERCA DEL ESTÁNDAR VISUAL H.264/AVC, EL ESTÁNDAR DE VÍDEO VC-1, EL
ESTÁNDAR VISUAL MPEG-4 Y EL ESTÁNDAR DE VÍDEO MPEG-2. Este software puede incluir
H.264/AVC, VC-1, MPEG-4 Part 2 y tecnología de compresión visual MPEG-2. Si el software incluye
dichas tecnologías de compresión visual, MPEG LA, L.L.C. requiere la inclusión de este aviso:

INCLUYE JUNTO CON ÉSTE EN UN ARTÍCULO ÚNICO. NO SE OTORGA NINGUNA OTRA LICENCIA
PARA NINGÚN OTRO USO, NI SE DEBE PRESUPONER SU OTORGAMIENTO. PARA OBTENER
INFORMACIÓN ADICIONAL DE MPEG LA, L.L.C. CONSULTE WWW.MPEGLA.COM.
15. NO TOLERANTE A ERRORES. El software no tolera errores. Rimage Corporation ha
instalado el software en el dispositivo y es responsable de su funcionamiento en el
dispositivo.
16. USO RESTRINGIDO. El software de Microsoft está diseñado para sistemas que no requieran un
rendimiento de alta seguridad. No utilice el software de Microsoft en ningún dispositivo o sistema en
el que los posibles errores de funcionamiento del software puedan provocar un riesgo previsible de
lesión o muerte de alguna persona. Esto incluye las operaciones en instalaciones nucleares,
navegación aérea o sistemas de comunicación y control del tráfico aéreo.
17. PROGRAMAS DE OTROS FABRICANTES. El software contiene programas de otros fabricantes.
Los términos de licencia de dichos programas serán de aplicación al uso que haga de los mismos.
18. SOFTWARE SIN GARANTÍAS. El software se proporciona “tal cual”. Usted acepta todos
los riesgos de utilizarlo. Microsoft no otorga ninguna garantía ni condición explícitas.
Ninguna de las garantías que reciba asociadas al dispositivo o al software procede de
Microsoft o sus filiales, ni los vinculan. En la medida en que así lo permita la legislación
de su Estado o país, Rimage Corporation y Microsoft excluyen las garantías implícitas de
idoneidad para una finalidad particular y ausencia de infracción.
19. LIMITACIONES DE RESPONSABILIDAD. La cantidad máxima que se podrá obtener de
Microsoft y de sus filiales como indemnización por daños directos será de doscientos
cincuenta (250,00) dólares estadounidenses, o cantidad equivalente en la divisa local. No
podrá obtener indemnización alguna por daños de otra índole, incluidos los daños
consecuenciales, por lucro cesante, especiales, indirectos o incidentales.
Esta limitación se aplica a:

Cualquier cuestión relacionada con el software, los servicios, el contenido
(incluido el código) que se hallen en sitios de Internet de terceros o programas de
terceros y
•
Reclamaciones por incumplimiento de contrato, incumplimiento de garantía o
condición, responsabilidad objetiva, negligencia u otra responsabilidad
extracontractual en la medida permitida por la legislación aplicable.
También será de aplicación incluso si Microsoft debería haber conocido la posibilidad de
que se produjesen dichos daños. Asimismo, se pueden producir situaciones en las que no
se pueda aplicar a su caso la limitación precedente porque su jurisdicción no admite la
exclusión o limitación de daños consecuenciales, incidentales o de otra índole.
20. RESTRICCIONES EN MATERIA DE EXPORTACIÓN. El software está sujeto a las leyes y a los
reglamentos en materia de exportación de Estados Unidos. Debe cumplir todas las leyes y
disposiciones, nacionales e internacionales, en materia de exportación que sean de aplicación al
software. Dichas leyes incluyen limitaciones en cuanto a destino, usuarios finales y uso final. Para

21. CONTRATO ÍNTEGRO. Este contrato, los términos adicionales (incluidos los términos impresos de
la licencia que acompañen al software y modifiquen o reemplacen una parte o la totalidad de dichos
términos) y los términos aplicables a complementos, actualizaciones, servicios basados en Internet y
servicios de soporte técnico que usted utilice, constituyen el contrato completo del software y de los
servicios de soporte técnico.
22. LEGISLACIÓN APLICABLE.
a. Estados Unidos. Si adquirió el software en los Estados Unidos de América, la interpretación del
presente contrato se regirá por la legislación del Estado de Washington, que se aplicará a las
reclamaciones por incumplimiento del mismo, con independencia de conflictos de principios
legales. Para el resto de reclamaciones, será aplicable la legislación de su estado de residencia,
incluidas las reclamaciones en virtud de las leyes estatales en materia de protección al
consumidor, competencia desleal y responsabilidad extracontractual.
b. Fuera de Estados Unidos. Si adquirió el software en otro país, se aplicará la legislación de
dicho país.
