Condizioni di vendita

Con la trasmissione della proposta d’ordine il Cliente accetta tutte le nostre condizioni di vendita e di consegna elencate qui di seguito. L’ordine è
vincolante per il cliente mentre impegna Rubinetterie Toscane Ponsi solo dopo l’emissione di conferma d’ordine alle condizioni in essa indicate.

I termini di consegna indicati nel prospetto delle finiture del listino Ponsi 2013 alle pagine 352 e 353 non so no impegnativi e l’eventuale ritardo non dà
luogo ad indennizzi o risarcimenti da parte nostra. I ritardi che superano una settimana sulla data prevista in conferma sono comunicati via telefono o fax.
Per eventuali esigenze di termini certi e confermati è necessario che sia consultato in via preventiva il nostro Ufficio Commerciale.
Gli ordini sono sospesi in caso di ritardo nei pagamenti.

La merce è resa sempre franco partenza. L’incarico dato al corriere per effettuare il trasporto è un atto di servizio che esclude qualsiasi nostra
responsabilità successiva; qualunque sia la condizione del trasporto, la merce viaggia a rischio e pericolo del committente.

Il controllo della quantità e gli eventuali rilievi di difformità dovranno essere segnalati entro otto giorni dal ricevimento della mer.ce. Qualsiasi
reclamo dovuto a danneggiamento del materiale a causa del trasporto deve essere rivolto direttamente al vettore al momento della consegna
effettuando riserva scritta.

I pagamenti sono ritenuti validi solo se eff ettuati direttamente o tramite istituto bancario a nostro favore. Per forniture di importi inferiori a 100 Euro la
spedizioneviene effettuata in contrassegno con la maggiorezione richiesta dal corriere. Per forniture di importi da 100 a 400 Euro il pagamento sarà
effettuato in un’unica soluzione. Per forniture di importi da 400 a 600 Euro il pagamento sarà effettuato in massimo due rate. Per importi superiori a
600 Euro il pagamento sarà regolato come da condizioni contrattuali pattuite.

Per effetto di tale impostazione è escluso il riconoscimento od il risarcimento di qualsiasi tipo di danno diretto od indiretto, subito od insorto a causa
dei nostri prodotti.

Garanzia per il rivenditore

I nostri prodotti sono garantiti da difetti di fabbricazione con le seguenti modalità:
a) garanzia di 5 anni su vitoni e cartucce a condizione che l’impianto sia dotato di adeguati dispositivi di filtrazione dell’acqua.
b) garanzia di 10 anni sulla finitura superficiale di cromatura, a condizione che la manutenzione di pulizia sia stata effettuata in modo adeguato
e continuativo.
c) La garanzia sulla funzionalità ha validità a condizione che l’impianto sia dotato di adeguati dispositivi di filtraggio dell’acqua e di regolatori di

E’ escluso il riconoscimento od il risarcimento di qualsiasi tipo di danno subito od insorto a causa dei nostri prodotti.
Metodo di utilizzo della garanzia:
1) Lo scontrino od altra prova di vendita devono essere conservati dall’acquirente
2) La richiesta di sostituzione accompagnata dalla documentazione deve essere effettuata tramite il rivenditore
3) Il materiale difettoso dovrà pervenire alla nostra sede in porto franco
4) Al ricevimento il materiale sarà immediatamente controllato; qualora il reclamo sia ritenuto fondato la sostituzione sarà effettuata e resa franco
destino. In caso di infondatezza, le motivazioni saranno dichiarate con il mezzo di comunicazione ritenuto più idoneo e temp
estivo.
Garanzia al consumatore
Il consumatore (utente) ha diritto a 2 anni di garanzia come da normativa CE (vedi tagliando di controllo inserito nella confezione di ogni articolo).
Note e consigli per l’uso e la manutenzione da comunicare al consumatore:
I prodotti installati e lasciati in disuso per lungo tempo sono soggetti ad alterazioni della funzionalità e delle superfici
La pulizia di qualsiasi finitura deve essere effettuata con sapone diluito in acqua; i prodotti devono essere asciugati con un panno morbido per
impedire la formazione di depositi di calcare. I depositi di calcare od altre impurità nei filtri degli aeratori devono essere rimossi con appositi prodotti
o per immersione per mezza giornata in soluzione di acqua ed aceto (80/20).

L’uso di sostanze o strumenti aventi caratteristiche abrasive od acide danneggia irrimediabilmente la superficie dei rubinetti.
Questo listino annulla e sostituisce qualsiasi documentazione o comunicazione precedente.

By placing an order the customer accepts in full our conditions of sale as listed here. The order is binding for the customer, while it is binding for Rubinetterie
Toscane Ponsi only after issue of order confirmation according to the proposed terms
Terms of delivery as listed in the table at pages 352-353 of the 2013 Ponsi price list are not binding and in case of delay shall not give rise either to
indemnitie or compensation of any type on our part. Delivery delays that exceed one week are notified via phone or fax. In order to be notified of the exat
terms of deliveries. our Sales Departement should be consulted before hand. Order deliveries are interrupted in case of delays in payments.

Goods are delivered free ex facto ry. The transport task we assign to the carrier is a service and as such it excludes any consequent responsibility on our
part; whatever the conditions of transpor t may be, goods travel at the customer’ s risk.

Quantity control and eventual complaints must be repo rted within eight days on receipt of goods . Complaints related to material damage due
to transpo rtation must be addressed upon delivery directly to the carrier, stating acceptance on condition.

Payments are considered valid only if made to us directly or through a bank.

All pictures contained in our price-lists, catalogue and brochures are only indicative of the single articles, therefore are not binding to their true workmanship.
Moreover , the company reserves itself the right to modify or suppress single items and complete ranges.

The statements, promises and guarantees granted by staff, agents or sales representatives other than the conditions agreed upon or included in this price-list
become legally binding and enforceable only after having been confirmed in writing by the managing Board.

The operational procedures and instructions used for the controls and tests inside our Quality System certified UNI EN ISO 9001:2000 are availlable for
consultation. We are not liable for cont rols or tests carried out on our products once installed. Such operation fall within the exclusive responsibility of
the installer during his own tests on the system to certify installation conformity.
Therefore the recognition or the compensation of any direct or indirect damage, undergone or provoked by our products, is excluded.

All sale agreements and contracts are concluded at our offices; therefore, any dispute that may arise is exclusive jurisdiction of the Lucca Law
Court (Tribunale di Lucca).
Warranty for retailer
Our products are guaranteed to cover manufacturing defects under the following conditions:
a) A 5-year warranty is valid for headworks and cartrdges provided that the plumbing installation is fitted with adequate water filters
b) A 10-year warranty is valid for surface chrome plated finish provided that the product has been regularly cleaned and maintained
c) Warranty on mechanical parts is valid provided that the plumbing installation is fitted with adequate water filters and pressure regulation devices
in order to avoid misfunctioning in case of pressure shocks
d) Adviced pressure is between 3 and 5 bars.
Exclusion
Use of the warranty
We do not acknowledge compensation related to direct or indirect damage, caused by our products.

1) The receipt or any proof of purchase must be kept by the purchaser.
2) The warranty claim together with the adequate paper work must be processed through one of our retail suppliers.
3) Delive ry cost of faulty goods to our premises must be borne by the sender.
4) Upon receipt, the alleged faulty goods will be examined and should the complaint be founded, replacement goods will be sent free of charge. If
the complaint is unfounded, an official notification giving reasons for refusal will be sent.
Warranty for user
The purchaser has right at 2-years guarantee according to the European Norms (see guarantee coupon included in each item box).
Suggestions for correct use and maintenance, to be communicated to the consumer:
products, which are installed but not used for long periods of time, may deteriorate in both function and finish
the sur face finish should be cleaned with soap diluted in water; the product should be dried with a soft cloth in order to prevent limescale deposits
limescale deposit or other impurities in filters of flow guides may be removed either by using the appropriate products or by immersing in vinegar
solution (80/20) for half a day.
We recommend that product maintenance should be carried out at least monthly
.
NOTICE:
The use of substances or instruments containing abrasive or acidic agen ts will irrever sibly damage the surface finish of the produc t.
This price list cancels and replaces any previous edition.
