EMBERTONE エンドユーザー使用許諾契約書 © クリプトン・フューチャー・メディア株式会社 Embertone 社エンドユーザー使用許諾契約書 Embertone LLC 社製品（製品を構成する全てのソフトウェア、サウンド、関連メディア、印刷物、オンライン上または電子的に提供されるドキュメントを含みます）（以下、総称して「本製品」と言います）をご使用になる前に、以下の使用許諾契約書（以下、「本契約」といいます）の各条項を必ずお読みください。本製品をインストール、コピーまたは使用することによって、お客様は本契約に同意するものとします。本契約の条項に同意しない場合、本製品をインストールしないで下さい。本契約は本製品を正規にご購入された個人または法人組織であるオリジナル・エンド・ユーザー、及び本製品を使用する権利を許諾されたユーザー（以下、「お客様」と言います）と Embertone LLC 社（以下、「Embertone」と言います）との間に締結される法的な契約です。ライセンスの許諾 Embertone は本製品を使用する権利（以下、「本ライセンス」と言います）をお客様一個人に対して許諾します。お客様のみが使用することを条件に、Embertone はお客様が所有する複数台のコンピュータへ本製品をインストールすることを許可します。本製品にふくまれている、全てのサウンド、プログラミング、画像、スクリプト、デザイン、文章の所有権、及び著作権は Embertone が留保しています。本ソフトウェアは、制作元である Embertone よりお客様にその使用が " 許諾 " されるものであり、" 販売 " されるものではありません。お客様は、商用、または非商用を問わず、本製品を用いて制作した音楽作品を、効果音、映像作品、ライブ演奏、放送、または同等の完成された制作物へ使用することができます。本製品に収録されているライブラリの全てのサウンド、及びサンプルを、商用目的の楽曲制作、サウンドデザイン、ポストプロダクション、コンテンツ制作に使用する場合も、追加ライセンス料を Embertone へ支払う必要は一切ありません。 Embertone は本契約の条項を自由裁量で変更する権利、及び、本製品を販売することを拒否する権利を留保しています。禁止事項お客様は以下の行為が禁じられています。本製品について (a サンプルライブラリ、及びソフトウェア音源に使用 (b サーバーやトレント上にアップロード、配布 (c 事前の書面による許諾なしで、本ライセンスを無断で第三者に譲渡すること。クリプトン・フューチャー・メディア株式会社（以下「当社」）は、本製品の契約原文（以下「契約原文」）を日本語に翻訳したものである本契約について、翻訳の完全性を保証するものではありません。もし本契約と契約原文に相違があったときには、契約原文を優先するものとします。また、その様な相違によって損害が生じたとしても、当社は保障いたしません。契約原文および本契約は、変更することがあります。その場合当社は、本契約の最新版を当社 WEB サイトにて公表するものとします。本契約に関してご質問がある場合、当社テクニカルサポートまでお問い合わせください。 EMBERTONE エンドユーザー使用許諾契約書 © クリプトン・フューチャー・メディア株式会社 EMBERTONE End User License Agreement This End User License Agreement ("EULA") represents a legal contract between you and Embertone LLC. By downloading and installing any Embertone Product, you are acknowledging your agreement to the terms and conditions presented within this EULA. If you do not agree to the following terms and conditions, you must remove all Embertone products from any data storage devices on which you have installed it. All Embertone products and the containing audio samples remain in the ownership of Embertone LLC. You are simply assigned a license to use them in your productions. This license is for a single-user and is not transferable without the direct, written permission of Embertone LLC. All sounds, programming, imagery, scripting, and designs contained in our product are copyrights of Embertone LLC. This software is licensed, NOT SOLD, to the user by Embertone, for commercial and non-commercial use in the production of music, sound-effects, audio/ video multimedia productions, live performance, broadcast, video game audio development or similar finished content-creation and production use. Individual license holders are permitted to install this library on multiple computers or other equipment only if they are the SOLE OWNER and user of all equipment with which this software is installed, accessed or otherwise used on in any way. Embertone permits the licensee to use any of the sounds and samples in the library(s) they have purchased for the creation and production of commercial recordings, music, sound design, post production, or other content creation without paying any additional license fees or providing source attribution to Embertone. There is no special license needed to embed Embertone sound samples into your commercial recordings, music, sound design, post production, or other creative content. However, this license expressly forbids the use of any Embertone library in the production of any other sample library or virtual instrument without our express written consent. Additionally, you are NOT allowed to: - Upload or distribute any Embertone product or the containing audio samples to any server or torrent site. - Use any Embertone products’audio samples or patches to create other sample libraries. Embertone LLC reserves the right to change the terms and conditions of this EULA at any time, and to deny the sale of a license to use any Embertone product at any time.
