PLAN TO PARTICIPATE IN UPCOMING DEALER EVENTS
Work on the 110th Denver Auto Show is in high gear. Last year’s show broke records for attendance and size. There were more than 500 vehicles from 30 manufacturers, plus accessories and
aftermarket products on display, covering a half-million square feet of the Colorado Convention
Center. We think this year’s show from March 21-25 will be even better. I’d like to thank Herm
Brocksmith , general manager of Kuni Honda for his tireless efforts as chair of the Denver Auto
Show committee this year .
With the economy showing signs of growth, there’s a huge pent-up demand for all things automotive. The Denver Auto Show will really wow consumers with what you have to offer in terms

“A space at the Automotive Career Fair will give your HR folks a great opportunity to meet people who are eager to work in the industry and who have the passion to succeed in a business that is leading the American economic recovery,” according to our organizer,
Debbie Taylor. The sooner you reserve your space, the better visibility your business will have for the hundreds of interested people

The CADA Innovative Dealer Summit is expanding to two days this year – March 21-22 – also at the Convention Center. The
Summit really is one-stop shopping for dealers and their senior managers to learn the
best practices in dealership operations.
We’ve gotten such positive response to last year’s summit events that we lined up

AUTO DEALER LAW: NEW LEGAL & FEDERAL COMPLIANCE GUIDE
AVAILABLE TO CADA MEMBERS AT DISCOUNT PRICE!
Two of the most well-respected and nationally renowned dealership attorneys teamed-up to pull
together—in one guide—key legal and federal compliance issues that all dealerships need to know.
CADA has purchased a quantity of this guide so that we may make it available to our members at a
discount. The standard price is $395—CADA members are able to purchase through CADA at $295.
Further, members who have also purchased a Colorado Dealer Compliance Guide covering state issues will receive another $25 discount.
Auto Dealer Law is divided into three parts:
Part I: Buying and Selling the Dealership discusses the many aspects of dealership buy/
sells including what both the buyer and the seller should be looking for, standard and essential contract terms, and factory approval issues. In addition, this part addresses issues related
to bankruptcy and the closing of dealerships.
Part II: Running the Dealership focuses on the myriad of legal issues involved with running
es litigation management, insurance, parts and service, antitrust concerns, record retention, and emergency preparedness.
Part III: Compliance devoted entirely to legal compliance. Dealers continue to struggle with an ever-expanding array of laws
complex. This part sets forth federal compliance requirements in easy to understand terms. This part also provides some best-

On November 9, 2010, the IRS issued Revenue Procedure 2010-44, which created two optional safe harbor methods of accounting

cost to consumers will be much closer to $5,000. Even those who can afford the price hike will avoid the substantial upfront cost and
will choose a pre-owned car or truck or simply hold on to their current vehicle longer. Either way, real energy security and environmental gains will not be realized if consumers do not buy or cannot afford to put these new technologies on the road.

Consequently, dealers whose tax year corresponds with the calendar year and who did not elect these methods for the 2010 tax

REMINDER! MAKE SURE ALL SALESPERSON LICENSES ARE CURRENT
More instances of unlicensed salespersons continue to come before the dealer board, and the Auto Industry Division has indicated
that more cases are coming. It is coming to light that many dealerships have overlooked renewals or have not followed through to
ensure that all applications submitted were issued. Dealerships must ensure that every salesperson has been issued a license and that
the license is on display. A salesperson cannot sell until a license is issued by the Division. These cases have cost some dealerships up

DEALER ACTION ALERT
DENVER AUTO SHOW REMINDER:
Dealers MUST Obtain Off-Premise Permits BEFORE the Start of the Auto Show
This is to remind all member dealers who intend to engage in any sales activity* at the Denver Auto Show, which runs March 21
through March 25 this year, that an off-premise permit must be obtained BEFORE the start of the show.
The Auto Industry Division has asked CADA to advise that you will not be allowed to obtain a permit at the event; you must have this
application submitted ahead of time to the Auto Industry Division, 1881 Pierce Street, Suite 142, Lakewood, CO, 80214.
The basis for this requirement is that the relevant statue states that a request for an off-premise permit must be obtained PRIOR to the
event – which means prior to the start of the event, even if your dealership may not be sending personnel until later during the course
of the show.

While new-car dealers see value in having clean and modern facilities, many have questions

asked to do will result in an increased return on investment, according to a new study by Glenn
Vegas. “These programs – intended to encourage dealers to invest in store expansion, moderniza-
evidence on the return of investment this spending might yield,” Mercer said.
In response to dealer concerns, NADA commissioned last August the “Factory Image Programs” study to provide an objective, unbiased and neutral analysis of the various factors that drive the economics of facility programs. “The NADA research project brought all
the various perspectives on this issue out into the open by speaking with a wide range of industry participants,” Mercer added. “Our goal
was to open up a dialog in which all parties could discuss facility requirements on a more rational, informed and fact-driven footing.”
Based on numerous interviews and discussions with automaker executives and a diverse selection of dealers, recommendations
were provided to both parties, such as working together to reduce some of the tensions that exist over these issues. The executive summary and full report are available at www.nada.org/facilitystudy.
Montana Auto Dealer Bill Underriner Takes the Helm at NADA
tions about the federal government’s fuel economy proposal of 54.5 miles per gallon by 2025, which threatens
to price millions of Americans out of the market. “NADA is asking tough questions about this proposed rule.
And so far the government hasn’t provided any answers,” said Underriner, a multi-franchise dealer from Billings, Mont. “We want a full and fair public debate on the underlying assumptions of this rule. And we simply
don’t understand the rush.” Underriner took the helm of NADA on Feb. 6 at its annual Convention and Expo in
Las Vegas.
Underriner also spoke about NADA’s long-range planning efforts, including its review of almost every aspect of the annual convention, streamlining communications with members and use of social media. As NADA vice chairman in 2011, Underriner launched
an initiative to get more “next generation” dealers involved in the association by appointing a NextGen member to each of NADA’s
major operating committees, including Convention, Dealership Operations, Industry Relations, Government Relations, Regulatory Affairs and Public Affairs.“It’s no secret that the next generation communicates differently, and we are adapting,” he said. “We’re active
on a variety of social media. We are keeping in touch with them and getting them involved.”
Sales of small cars, SUVs and other light trucks will lead the way toward what Paul Taylor, NADA chief economist, predicts is a
rebuilding year for the auto industry resulting in more than 13.9 million new cars and light trucks sold and leased in 2012. A return to
better credit conditions, more generous incentives from manufacturers and low interest rates are all credited for the turnaround in this
year of economic recovery. “With the age of cars and trucks on the road today at an average 11.1 years, many consumers feel they can
no longer delay making a purchase of a new or newer vehicle,” he said.

2. Return to stabilized credit
4. The wild card: gasoline prices
5. Stabilizing home prices
NADA Convention Posts 22% Attendance Increase
The 2012 NADA Convention and Expo, held Feb. 3-6 in Las Vegas, drew more than 22,000
NADA and American Truck Dealers (ATD) conventions were held simultaneously in the same
with 507 companies exhibiting at the NADA Expo and 64 exhibitors at the ATD Expo. Firsttime exhibitors represented more than 25 percent of the roster with another 50 companies on the
waiting list.
For the next six months, the virtual NADA and ATD expos are still open for business at www.
nadaconventionandexpo.org. “It’s a virtual one-stop shop that offers dealers and their managers
business operations,” says Steve Pitt, NADA vice president of conventions and expositions.
