Final FCA rules banning promotion of UCIS and close
substitutes to retail clients

On Tuesday 04 June 2013 the Financial Conduct Authority (FCA) published a policy statement on rule changes which will introduce a
ban on the promotion of unregulated collective investment schemes (UCIS) and so called “close substitutes” (including certain SPV
issued notes) to the majority of retail clients.
The rule changes are designed to address concerns by the FCA’s predecessor, the FSA, that the majority of retail promotions and sales
of UCIS and related products fail to meet the relevant requirements and are exposing ordinary investors to significant potential detriment.
They are the result of a consultation launched by the FSA in August 2012 in Consultation Paper 12/19.
