TWENTIETH CENTURY FOX FEDERAL CREDIT UNION ELECTRONIC FUNDS TRANSFER DISCLOSURE AND AGREEMENT FOR INTERNET HOME BANKING AND INTERNET BILL PAYMENT 1. INTRODUCTION This agreement governs the following services offered by 20th Century Fox Federal Credit Union, hereinafter referred to as (TCFFCU): TCFFCU offers Internet Bill Payment services through Netzee to those members who use our Internet Home Banking. This service allows you to make payments to merchants and other institutions from your designated TCFFCU checking account via the Internet. You can make one-time payments as well as set up recurring periodic payments. "We", "Our", "Us", and "TCFFCU" refer to 20th Century Fox Federal Credit Union and "You", "Your" refer to anyone authorized to sign checks or make withdrawals on your account(s) and to anyone else you authorize to perform bill payment services on your behalf. The provisions of this agreement apply to all transactions covered by this agreement except where otherwise noted. 2. PERSONAL IDENTIFICATION NUMBERS AND SECURITY To use Internet Home Banking you must use your PIN Number to log on to our Internet Home Banking for the initial sign on. You may continue to use this PIN to access Internet Home Banking, or you may change your PIN at any time. Bill Payment requires you to change your PIN Number during your initial sign on. 3. TYPES OF AVAILABLE ELECTRONIC TRANSFERS AND LIMITS You may perform the following transactions on accounts in your name: 1. Inquiries about your TCFFCU accounts. 2. Transfer funds between your TCFFCU checking and savings accounts. 3. Transfer funds from your TCFFCU checking or savings account to make a loan payment. 4. From your designated TCFFCU checking or savings account, pay any designated merchant, institution or individual a fixed recurring amount or a variable amount "on demand". 5. Obtain information (payee information, payment status information, etc.) about your Internet Bill Payment account status. 4. LIMITATIONS OF FREQUENCY AND DOLLAR AMOUNT OF TRANSACTIONS 1. Transfers which will overdraft or close your checking or savings account are not permitted. 2. If you initiate a bill payment, which creates an overdraft, your bill payment account will be blocked, stopping all further requests for payment. 3. If a check issued by the bill payment service has not cleared the merchant, at your written request, a stop payment will be placed on the check and the merchant will not be paid. If the check has cleared the merchant, you must reimburse the bill payment service. 4. Any transfers or bill payment which creates an overdraft will be charged an insufficient funds fee (NSF), see fee schedule. 5. Transfers cannot be made from any dormant or inactive account or an account that has been pledged for the purpose of a loan, or from any account subject to legal process or other encumbrance restricting the transfer. 5.POSTING AND TIMING OF TRANSACTIONS AND DOCUMENTATION OF TRANSATIONS Internet Banking account transactions performed Monday through Friday during regular business hours are posted to your account that day. Transactions completed after regular business hours and on Saturdays, Sundays, and Holidays will be posted to your account(s) on the next business day. Transaction inquiries will contain the posting date. A record of these transactions will be fully disclosed on your periodic statement. In addition, you will receive a confirmation number at the time of each transaction. You should allow at least 3 business days for electronic payments and at least 5 business days for merchants, institutions or individuals to receive your check payment. For recurring payments, your payment will be sent to the merchant, institution or individual on the date you selected or the next business day, if that date is a weekend or holiday. If you authorize an "on demand" payment to be made on the same business day, prior to 1:00 p.m. PST, your account will be debited that same day. Payments initiated after this time will be debited the following day. 6. LIABILITY FOR FAILURE TO MAKE TRANSFERS THROUGH OR ON INTERNET BANKING AND BILL PAYMENT If we do not complete a transfer from or to your account(s) on time or in the correct amount, for any reason due to human error or equipment failure, TCFFCU's liability is limited to only late fees you may have incurred as a result of the failure to effect the transfer. 7. MEMBERS LIABILITY FOR INTERNET BANKING AND BILL PAYMENT You are solely responsible for controlling the safekeeping of, and access to, your Personal Identification Number (PIN). You are liable for all transactions you make or that you authorize another person to make, even if that person exceeds his or her authority. If you want to terminate another person's authority, you must notify TCFFCU in writing and arrange to change your PIN. You will be responsible for any Bill Payment request you make that contains an error or is a duplicate of another Bill Payment. TCFFCU is not responsible for a Bill Payment that is not made if you did not properly follow the instructions for making a Bill Payment. TCFFCU is not liable for any failure to make a Bill Payment if you fail to promptly notify TCFFCU, after you learn that you have not received credit from a Merchant of a Bill Payment. TCFFCU is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communication facility, and no such party shall be deemed to be TCFFCU's agent. In any event, TCFFCU will not be liable for any special, consequential, incidental, or punitive losses, damages, or expenses in connection with this Agreement or the Service, even if TCFFCU has knowledge of the possibility of them. 8. DISCLOSURE OF ACCOUNT INFORMATION TCFFCU will disclose information to a third party about your account(s) or transfer(s): 1. When it is necessary to complete transfers, or 2. In order to verify the existence and condition of your account for a credit bureau, or 3. In order to comply with government agency or court orders, or 4. If you give us you're written permission. 9. AMENDMENT AND TERMINATION From time to time, we may amend this agreement. If an amendment results in increased cost to perform a TCFFCU transfer or service, or increased liability to you, decreases the type of electronic funds transfers available to you, or places stricter limitations on the frequency or dollar amount on transfers, written notice of the amendment will be mailed to your current address as shown on our records at least 21 days before the effective date of the amendment. However, if an immediate change in terms or conditions is necessary to maintain or restore the security of an electronic funds transfer system or account, we will provide written notice of the change to you on the next periodic statement or within 30 days, unless disclosure would jeopardize the security of the system or account. TCFFCU has the right to terminate this agreement at any time. You may terminate this Agreement by written notice to TCFFCU. TCFCU is not responsible for any fixed payment made before we have had a reasonable opportunity to act on your termination notice. You remain obligated for any payments made by TCFFCU on your behalf. 10. FEES The fee for the Internet Bill Payment service is $5.00 per month, for an unlimited number of monthly payments. There is no monthly charge for our Home Banking service.
