CITY OF EDMONTON BYLAW 12454 EDMONTON TRANSIT SYSTEM ADVISORY BOARD BYLAW (CONSOLIDATED ON AUGUST 30, 2005) THE CITY OF EDMONTON BYLAW 12454 EDMONTON TRANSIT SYSTEM ADVISORY BOARD BYLAW Whereas, pursuant to section 145 of the Municipal Government Act, S.A. 1994, c. M-26.1, Council may pass bylaws in relation to the establishment, functions, procedure and conduct of council committees and other bodies; Edmonton City Council enacts: PART I - PURPOSE, DEFINITIONS AND INTERPRETATION PURPOSE 1 The purpose of this bylaw is to establish the Edmonton Transit System Advisory Board and to prescribe powers, duties, functions, structure and procedures. DEFINITIONS 2 In this bylaw, unless the context otherwise requires: RULES FOR INTERPRETATION 3 (a) “Board” means the Edmonton Transit System Advisory Board; (b) “City” means the municipal corporation of the City of Edmonton; (c) “City Manager” means the Chief Administrative Officer of the City within the meaning of the Municipal Government Act or his delegate; (d) “Council” means the council of the City of Edmonton; (e) “Person” includes an individual, partnership, association, corporation, trustee, executor, administrator or legal representative; and (f) ”Vehicles” includes standard diesels, trolleys, articulated buses, mini-buses, light rail transit and alternate fuel vehicles. PART II - ESTABLISHMENT AND FUNCTIONS EDMONTON TRANSIT SYSTEM ADVISORY BOARD 4 The Edmonton Transit System Advisory Board is hereby established as a Council Committee. FUNCTIONS 5 The Board has the following functions: ADVOCACY 5.1 (a) to provide fiscally responsible advice and comments to Council and the City on issues relating to public transit; and (b) to conduct research, report on findings and make recommendations to Council on issues relating to public transit. (1)In addition to the functions outlined in section 5, if the Board identifies an issue under the jurisdiction of another order of government that affects public transit in the city of Edmonton, the Board may advise Council on the issue. (2)If the Board wishes to advocate on an issue identified in 5.1(1), the Board will: (a) request a decision on Council’s position on the issue; (b) advocate the City’s position on the issue, as approved by Council; and include in the Board’s annual report any advocacy actions taken and an evaluation of any results arising from the advocacy action. (S.2, Bylaw 14049, August 30, 2005) (c) PUBLIC TRANSIT ISSUES 6 Issues relating to public transit includes, but are not limited to: (a) ridership; (b) the appropriate mix of vehicles throughout the system; (c) public input to Edmonton Transit; (d) projects proposed by Edmonton Transit or Council which affect public transit; (e) public and political advocacy for the public transit system in Edmonton; (f) policy on the Edmonton Transit System; (g) fixed facilities related to the transit system including stations, signs and shelters; (h) light rail transit, and, (i) paratransit service. (S.2, Bylaw 13195, March 25, 2003) PART III - STRUCTURE AND PROCEDURES STRUCTURE 7 (1) The Board will consist of twelve (12) individuals, with an appropriate balance of representation from: (a) users of Edmonton Transit System regular services; (b) users of Edmonton Transit System paratransit services; (c) businesses that benefit from Edmonton Transit System services; and (d) citizens-at-large. (S.3, Bylaw 13195, March 25, 2003) (2) In addition to (1), the President of the Amalgamated Transit Union Local 569 shall serve on the board as an ex-officio member. (3) The City Manager will co-ordinate the selection of Board members. (4) The following organizations will be notified of recruitment campaigns to fill board vacancies: (a) the Advisory Board on Services for Persons with Disabilities; (b) the Edmonton Seniors’ One Voice Association; (c) the Edmonton Student Alliance; (d) Edmonton Public School Board; (e) the Edmonton Separate School Board; (f) the DATS Advisory Group, and (g) other groups as determined by the Board. (5) Each appointment made by Council is for a term of one year, to a maximum of six (6) consecutive terms. (6) Membership on the Board is voluntary and no remuneration will be paid for serving as a member. REMOVALS 8 PROCEDURES 9 The Board will request Council to terminate the appointment of any member who is absent from three consecutive meetings, or who misses three regular meetings in six months unless the absence is authorized by resolution of the Board. (1) Subject to this Part, the Board will follow the procedures prescribed by Bylaw 12300, Procedures and Committees Bylaw. (2) At the first meeting of the Board in January, the Board will: (a) elect an Acting Chairperson for the purpose of calling the meeting to order and to elect a permanent Chairperson; (b) elect a Chairperson and Deputy Chairperson; and (c) establish a schedule for monthly meetings to include at least ten meetings for the year. (3) Re-election of a Chairperson is permitted to a maximum of three years. (4) Quorum for a meeting shall be a majority of the existing appointed members of the Board. SUBCOMMITTEES 10 (1) The Board may establish subcommittees as required, including the following types of subcommittees: (a) Ridership Initiatives – to review and propose programs and comment on services or initiatives intended to increase transit ridership: (b) Vehicles – to review planning and user considerations on the trolley network and on all Vehicles; (c) Safety and Security – to review and advise on programs and practices in place for passenger and public safety; (d) Light Rail Transit – to review city-wide concerns about light rail transit short-term planning and operational issues; (e) Revenue – to review and comment on fares as well as on the annual budget submission prepared for Council, and to lobby for alternate sources of funding, and (f) Paratransit Services – to review and advise on services and initiatives relating to paratransit services. (S.4, Bylaw 13195, March 25, 2003) (2) The Board may appoint persons from outside the Board to a subcommittee. (3) Subcommittees shall: (a) be chaired by Board members, and (b) report back to the Board for consideration of findings. (4) The Board and subcommittees of the Board may solicit input from the public, or recommend to Council or the City Manager means for wider public participation, including: (a) open houses, (b) surveys, or (c) public meetings. (5) The following organizations will be kept informed or issues that the Board is dealing with and be actively solicited for input on those issues: (a) the Advisory Board on Services for Persons with Disabilities; (b) the Edmonton Seniors One Voice Association; (c) the Edmonton Students Alliance; (d) the Edmonton Public School Board; (e) the Edmonton Separate School Board; (f) the DATS Advisory Group, and (g) other groups as determined by the Board. PART IV - FINANCE AND ADMINISTRATION ADMINISTRATIVE SUPPORT TRANSPORTATION AND PUBLIC WORKS COMMITTEE 11 Administrative services and support for the Board will be provided by the City Manager, including: (a) technical, planning, and administrative resources; (b) a delegate to act in a liaison capacity; (c) provision of summary ridership and revenue reports; (d) provision of sufficient background information on proposed policy and services amendments that may impact the consumer; (e) responding to inquiries of the Board; and (f) provision of a recording secretary to support all of the meetings of the Board and its subcommittees. 12 (1) The Board will report through the Transportation and Public Works Committee. (2) The Board may initiate reports on specific service issues as determined by its membership. (3) The Board will submit an annual report no later than March 31 for the previous year ending December 31. ADVISORY INPUT 13 The City Manager may seek advisory input form the Board and its subcommittees on reports to Council referring to Edmonton Transit services, programs and initiatives. BUDGET 14 (1) Council must approve the Board’s budget and any other expense arising from the operation of the Board. (2) The Board’s budget will be administered by the City Manager. PART V - LIMITATIONS PROHIBITIONS 15 The Board shall not: (a) represent itself as speaking for Edmonton Transit, the City, or any department of the City; COMPLAINTS 16 (b) endorse any candidate for public office; (c) pay any money to any member; or (d) negotiate with union representatives on behalf of Edmonton Transit. Complaints received by the Board will be referred to the Edmonton Transit Customer Commendations and Concerns System for investigation. PART VI - GENERAL NUMBER AND GENDER REFERENCES 17 All references in this bylaw will be read with such changes in number and gender as may be appropriate according to whether the reference is to a male or female person, or a corporation or partnership. REPEALS 18 Bylaw 10720 is repealed. (NOTE: Consolidation made under Section 69 of the Municipal Government Act, S.A. 1994, c.
