An Act to Affirm and Ratify a certain Proclamation relating
to The Sugar Board
[ASSENTED TO 21ST OCTOBER, 19661
BE IT ENACTED by the Queen's Most Excellent Majesty, by and
with the advice and consent of the Legislative Assembly of Queensland
in Parliament assembled, and by the authority of the same, as follows:1. Short title.
of 1966."
This Act may be cited as " The Sugar Board Act
2. Authority to make Proclamation . It is hereby declared that the
power of the Governor in Council to make and publish inf the Gazette
Proclamations under "The Sugar Acquisition Act of 1915," includes,
and always has included, power to make and publish in the Gazette the
Proclamation (in this Act referred to as the " said Proclamation ") a
copy whereof is set out in the Schedule to this Act, and the said
Proclamation is hereby affirmed and ratified accordingly.
3. Proclamation to have force of law . The said Proclamation shall
have, and it is hereby declared always had on and from the date of the
publication thereof in the Gazette, the force of law as though the said
Proclamation were an enactment of this Act.

THE SCHEDULE
" THE SUGAR ACQUISITION ACT OF 1915 "
A PROCLAMATION
By His Excellency the Honourable Sir ALAN JAMES MANSFIELD, Knight
Commander of the Most Distinguished Order of Saint Michael
and Saint George, Governor in and over the State of Queensland
and its Dependencies, in the Commonwealth of Australia.

WHEREAS by " The Sugar Acquisition Act of 1915," it is amongst other
things provided that the Governor in Council may, from time to time,
make and publish in the Gazette all such Proclamations as he thinks
fit for giving full effect to that Act: Now, therefore, 1, Sir ALAN
JAMES MANSFJELD, the Governor aforesaid, acting by and with the advice
of the Executive Council, do, by this my Proclamation, declare and
direct as follows:1. For the purpose of borrowing money under the authority of this
Proclamation The Sugar Board established by Proclamation under the
said Act as constituted at the date of the publication in the Gazette of
this Proclamation and thereafter by the persons thereunto appointed
from time to time by Proclamation under the said Act shall be a body
corporate under the name and style of "The Sugar Board ", with
perpetual succession and a common seal, which shall be judicially
noticed, and may acquire, hold and dispose of property, real or personal,
and shall be capable of suing and being sued in its corporate name and
of doing and suffering all such other acts and things as bodies corporate
may by law do and suffer.
2. Additionally to any other power, function or duty conferred or
imposed upon it by any other Proclamation under the said Act, The
Sugar Board(a) may, with the approval of the Minister for the time being
administering the said Act, take and do all such steps and
things as it deems necessary or desirable; and
(b) shall take and do all such steps and things as the Minister for
the time being administering the said Act directs,
for assisting the marketing of sugar acquired by Proclamation under
the said Act or pursuant to clause 5 of the Sugar Agreement 1962, a
copy whereof is set out in the Schedule to the Sugar Agreement Act
1962 of the Commonwealth, (or of any future agreement between the
Commonwealth and the State making further provision substantially in
accordance with that made by the Sugar Agreement 1962 and in particular
continuing the provision for the acquisition of sugar contained in the
said clause 5), in a manner calculated to secure to owners from whom
the sugar has been acquired the prices therefor payable to them
respectively by virtue of a Proclamation under the said Act or in terms
of the acquisition pursuant to the said clause 5 or any such future
agreement.
3. For assisting the marketing of sugar as provided by this
Proclamation The Sugar Board may from time to time borrow money
in such manner, at such times, in such amounts, and on such terms as
the Treasurer approves.
4. The repayment of any money borrowed under the authority of
this Proclamation and the payment of interest thereon shall be made
from the proceeds of the sale of sugar acquired as set out in clause 2 of
this Proclamation.

5. The Treasurer on behalf of the State may guarantee the
repayment of any money borrowed by The Sugar Board under the
authority of this Proclamation and the payment of interest thereon.
Any payment required to be made by the Treasurer pursuant to
such a guarantee shall be paid out of the Consolidated Revenue, which
is hereby appropriated accordingly.
