Public Contracts: Claims
• New claims resolution process applied
to all public works projects entered into on
or after January 1, 2016
• As written, claims could be submitted:
– at any time
– without any supporting documentation
• Claims potentially subject to 10 percent interest rate penalty
• Agencies would be allowed only 30 days to review and either
accept or reject the claim
• Process could needlessly raise project and contractor costs by
subjecting disputed claims to a costly mediation process
