Charity Cycle Ride Terms and Conditions
These are the terms and conditions that apply to the charity cycle ride organised by
Wimborne and Ferndown Lions Club. Participants must agree to the terms and
conditions before participating in the cycle ride.
1. Entry Forms and Fees
a. All persons taking part in the cycle ride must be registered with Wimborne and
Ferndown Lions Club to take part in the cycle ride.
b. Each participant must be included on an entry form whether participating as an
individual or as a family member.
c. Family entries must include the names of all family members and an address as
part of the registration process.
d. Entry forms must arrive a fortnight before the date of the cycle ride. However
participants will be accepted on the day of the cycle ride but must pay in cash.
e. Entry to the cycle ride is subject to the payment of the notified fee payable to
Wimborne and Ferndown Lions Club prior to participation in the cycle ride.
2. Age of Participants
For safety reasons participants in the 10 mile Family Ride who are under 16 will be
required to ride with an accompanying adult who is specified on their family entry
form.
3. Health and Fitness
a. All participants take part in the cycle ride at their own risk.
b. Participants who have any doubt about their health or have a medical condition
that could be affected by exercise, particularly a heart condition, must obtain their
doctor’s approval before participating in the cycle ride.
c. All participants agree that, as far as they are aware, they are sufficiently fit and
physically able to ride in the cycle ride and, to the extent that it may be necessary,
they have sought and relied upon any medical advice before the date of the cycle
ride. It is each participant’s own responsibility to assess their fitness and to ensure
that they participate only if sufficiently fit. Should any medical or physical condition
arise prior to the cycle ride which is likely to affect a participant’s ability to ride in the
cycle ride, the participant should withdraw from the cycle ride.
d. Wimborne and Ferndown Lions Club may prevent any participant from taking part
in the cycle ride (either at the start of or during the cycle ride) if Wimborne and
Ferndown Lions Club considers that a participant should not participate in the cycle
ride for health and/or medical reasons.
4. Safety and insurance
a. Wimborne and Ferndown Lions Club shall take all reasonable steps to assess the
safety and suitability of the cycle ride location prior to the cycle ride. Wimborne and
Ferndown Lions Club shall also arrange for the availability of an appropriate number
of first aid personnel appropriate to the nature of the cycle ride.
b. All participants must ensure that any equipment or clothing used is in good
condition and suitable for the cycle ride.
c. All participants acknowledge and agree that cycling on the highway can be
considered a dangerous activity. Whilst Wimborne and Ferndown Lions Club shall
take steps to ensure that the cycle ride take place in a safe manner, participants
acknowledge and agree that because cycle rides often take place in public spaces
Wimborne and Ferndown Lions Club cannot be held liable for any damage caused
outside of its direct control.
d. Wimborne and Ferndown Lions Club does not provide any insurance, whether life
or medical or liability, for any illness, accident, injury, death, loss or damage that may
arise in connection with the attendance at and/or participation in the cycle ride.
Participants shall be responsible for arranging their own suitable and adequate
insurance protection to cover their participation in the cycle ride, including without
limitation cover:
i. for material loss/damage to any equipment they may use in the cycle ride or
personal property (including clothing);
ii. any loss or damage they may cause to a third party; or
iii. negligence of any party.
e. Any accident or injury caused by a participant’s actions shall be the responsibility
of that participant.
f. Each participant is responsible for his/her actions whilst attending or participating
in the cycle ride. This includes at the cycle ride start point, during the cycle ride and
at the completion point. Wimborne and Ferndown Lions Club accepts no
responsibility for the actions of a participant nor the consequences of such actions.
5. Participation and Participant Numbers
a. Participants of all ages are each assigned a unique number for the cycle ride and
participants must clearly display their participant number provided by Wimborne and
Ferndown Lions Club at all times during the cycle ride. Failure to wear the correct
participant number may result in a participant being disqualified from the cycle ride.
b. All participants in the cycle ride must:
i. wear a cycle helmet at all times during the cycle ride;
ii. ensure that their bicycles are in a roadworthy condition;
iii. observe the rules of the Highway Code;
iv. ensure that the bicycle that they use during the cycle ride complies in all
respects with all relevant and applicable legislation.
6. Liability
a. Subject to paragraph 6(b), Wimborne and Ferndown Lions Club shall not be liable
for:
i. any injury or accident causing loss or damage to a participant or any third
party where this is sustained as a result of a participant taking part in the cycle
ride; or
ii. any loss or damage sustained by a participant as a result of: the
cancellation of the cycle ride by Wimborne and Ferndown Lions Club for any
reason;
any changes made to the cycle ride by Wimborne and Ferndown Lions Club
for safety or any other reasons;
or any circumstances beyond the control of Wimborne and Ferndown Lions
Club.
b. Nothing in these Terms and Conditions shall limit or exclude Wimborne and
Ferndown Lions Club’s liability in respect of death or personal injury sustained as a
direct result of:
i. the negligence, breach of statutory duty or fraudulent misrepresentation of
Wimborne and Ferndown Lions, its agents or contractors; or
ii. a deliberate act or omission of Wimborne and Ferndown Lions, its agents or
contractors.
c. Subject to the terms of paragraph 8 below, Wimborne and Ferndown Lions Club
shall not be liable for any loss or damage sustained by a participant as a result of:
the cancellation of the cycle ride by Wimborne and Ferndown Lions Club for any
reason; any changes made to the cycle ride by Wimborne and Ferndown Lions Club
for safety reasons; or any circumstances beyond the control of Wimborne and
Ferndown Lions Club.
d. Nothing in these Terms and Conditions shall affect any statutory rights to which
the participant may be entitled as a consumer.
7. Withdrawal and refunds
Refunds because of withdrawal will be made by Wimborne and Ferndown Lions, as
long as the withdrawal is made up to two weeks before the cycle ride.
8. Cancellation and changes to the cycle ride
a. In the event that Wimborne and Ferndown Lions Club are forced to cancel the
cycle ride for any reason, Wimborne and Ferndown Lions Club will notify each
participant as soon as possible.
b. Wimborne and Ferndown Lions Club reserves the right to alter the cycle ride date,
the start time or other details of the cycle ride as required. If changes to the cycle
ride are made, Wimborne and Ferndown Lions Club shall update the cycle ride
Information on the Website and notify all participants as soon as reasonably
practicable. No refund in full or part shall be made in respect of any change to the
cycle ride.
9. During the cycle ride
All participants must abide by any instructions given by Wimborne and Ferndown
Lions Club and their designated route marshals before, during and after the cycle
ride. Failure to follow any such instructions may result in Wimborne and Ferndown
Lions Club refusing to allow the participant to continue in the cycle ride. Participants
must retire at once from the cycle ride if ordered to do so for any reason by
Wimborne and Ferndown Lions, any route marshal or first aid staff.
10. Acceptance of these Terms and Conditions
a. By registering to participate in the cycle ride, a participant agrees to be bound by
these Terms and Conditions.
b. If any provisions in these Terms and Conditions, whether in full or in part, is held
to be invalid or unenforceable, all other remaining provisions (in full or in part) shall
continue to be valid and enforceable.
c. Wimborne and Ferndown Lions Club may vary these Terms and Conditions from
time to time and the up to date terms shall be available on the Website.
d. These Terms and Conditions and any dispute or claim that arises out of or in
connection with them is governed by and construed in accordance with English law.
The English courts have exclusive jurisdiction to settle any dispute or claim that may
arise out of or in connection with these Terms and Conditions.
