natureoftheimpairment,howitaffectsthestudent’saccesstotheschoolenvironmentortoschool activities,curricularorextracurricular,determineswhetherspecializedinstruction,relatedaidsor services,orprogrammodificationsareneededand,ifso,determinesthe504servicestobeprovided. 504TeamChairperson--TheSuperintendent,inconsultationwiththedistrictSection504Coordinator, willrecommendtotheBoardforapprovalalistof504teamchairpersonsbyjoborpositiontitle.The Superintendent,ordesignee,maydesignatewhichspecificstaffmemberonthatapprovedlistwillserve asthe504teamchairpersonforany504teammeeting. Accommodationsmeanspecializedinstruction,relatedaidsorservices,orprogrammodifications neededfora504eligiblestudenttoaccesstheschoolenvironmentorschoolactivities(curricularor extracurricular.) TheActorSection504meansSection504oftheRehabilitationActof1973,asamended AccommodationPlanmeansawrittendocumentsettingoutspecializedinstruction,relatedaidsor services,orprogrammodificationsneededtoenablethestudenttoaccesstheschoolenvironmentor schoolactivities. Adultstudentmeansonewhohasreachedtheageofmajorityunderstatelaw;hasbeenemancipatedby courtorder;oris,orhasbeen,married. AssistantSecretarymeanstheAssistantSecretaryforCivilRightsoftheU.S.DepartmentofEducation. DepartmentmeanstheU.S.DepartmentofEducation. Drugs:Currentillegaluseofdrugsexceptiontoprocedures: (a)Ingeneral:Theterm''individualwithadisability''doesnotincludeanindividualwhoiscurrently engagingintheillegaluseofdrugs,whenacoveredentityactsonthebasisofsuchuse. 3 Currentillegaluseofdrugsmeansillegaluseofdrugsthatoccurredrecentlyenoughtojustifya reasonablebeliefthataperson’sdruguseiscurrentorthatcontinuinguseisarealandongoingproblem. Illegaluseofdrugsmeanstheuseofoneormoredrugs,thepossessionordistributionofwhichis unlawfulundertheControlledSubstancesAct(21U.S.C.812).Thetermillegaluseofdrugsdoesnot includetheuseofadrugtakenundersupervisionbyalicensedhealthcareprofessional,orotheruses authorizedbytheControlledSubstancesActorotherprovisionsofFederallaw. (b)Rulesofconstruction:Apublicentityshallnotdiscriminateonthebasisofillegaluseofdrugsagainst anindividualwhoisnotengagingincurrentillegaluseofdrugsandwho: (1)Hassuccessfullycompletedasuperviseddrugrehabilitationprogramorhasotherwisebeen successfullyrehabilitated; (2)Isparticipatinginasupervisedrehabilitationprogram;or (3)Iserroneouslyregardedasengaginginsuchuse. (c)Itisnotaviolationofthelawforacoveredentitytoadoptoradministerreasonablepoliciesor procedures,includingbutnotlimitedtodrugtesting,designedtoensurethatanindividualwhoformerly engagedintheillegaluseofdrugsisnotnowengaginginthecurrentillegaluseofdrugs.Nothinginthis sectionshallbeconstruedtoencourage,prohibit,restrict,orauthorizetheconductoftestingforthe illegaluseofdrugs. (d)Apublicentityshallnotdenyhealthservices,orservicesprovidedinconnectionwithdrug rehabilitation,toanindividualonthebasisofthatindividual'scurrentillegaluseofdrugs,ifthe individualisotherwiseentitledtosuchservices. (e)Healthanddrugrehabilitationservices:Apublicentityshallnotdenyhealthservices,orservices providedinconnectionwithdrugrehabilitation,toanindividualonthebasisofthatindividual’scurrent illegaluseofdrugs,iftheindividualisotherwiseentitledtosuchservices. EducationoftheHandicappedActmeansthatstatute,asamended(nowIDEA). EqualOpportunitymeanstheprovisionofequallyeffectiveaids,benefits,andservices.Tobeequally effectivedoesnotrequiretheidenticalresultorlevelofachievementforanindividualwithadisability andnondisabledpersons,butmustaffordanindividualwithadisabilityequalopportunitytoobtainthe sameresult,togainthesamebenefit,ortoreachthesamelevelofachievement,inthemostintegrated settingappropriatetotheperson'sneeds. 4 Facilitymeansalloranyportionofbuildings,structures,sites,complexes,equipment,rollingstockor otherconveyances,roads,walks,passageways,parkinglots,orotherrealorpersonalproperty,including thesitewherethebuilding,property,structure,orequipmentislocated. Federalfinancialassistancemeansanygrant,loan,contract(otherthanaprocurementcontractora contractofinsuranceorguaranty),oranyotherarrangementbywhichtheDepartmentprovidesor otherwisemakesavailableassistanceintheformof: (1)Funds; (2) ServicesofFederalpersonnel;or (3) Realandpersonalpropertyoranyinterestinoruseofsuchproperty,including: (i) Transfersorleasesofsuchpropertyforlessthanfairmarketvalueorforreduced consideration;and (ii) ProceedsfromasubsequenttransferorleaseofsuchpropertyiftheFederalshareofits fairmarketvalueisnotreturnedtotheFederalGovernment. Individualwithadisabilitymeansonewho:(i)hasaphysicalormentalimpairment,evenifepisodicor inremission,thatsubstantiallylimitsoneormoremajorlifeactivitieswhenactive. MajorLifeActivities—Majorlifeactivitiesinclude,butarenotlimitedto,caringforoneself,performing manualtasks,seeing,hearing,eating,sleeping,walking,standing,lifting,bending,speaking,breathing, learning,reading,concentrating,thinking,communicating,andworking.Thesealsoincludetheoperation ofamajorbodilyfunction,includingbutnotlimitedto,functionsoftheimmunesystem,normalcell growth,digestive,bowel,bladder,neurological,brain,respiratory,circulatory,endocrine,and reproductivefunctions. Parentmeansanaturalparent,anadoptiveparent,alegalguardian,orasurrogateparentappointedto make504decisions. Placementmeansanyaccommodationthathasbeendeterminednecessaryforastudenteligiblefor504 services,includingthesetting(i.e.,regularprogramorotherenvironment)inwhichserviceswillbe delivered. 5 Physicalormentalimpairmentincludes,butisnotlimitedto,suchcontagiousandnoncontagious diseasesandconditionsasorthopedic,visual,speechandhearingimpairments,cerebralpalsy,epilepsy, musculardystrophy,multiplesclerosis,cancer,heartdisease,diabetes,mentalretardation,emotional illness,specificlearningdisabilities,HIVdisease(whethersymptomaticorasymptomatic),tuberculosis, drugaddiction,andalcoholism.Thephrasephysicalormentalimpairmentdoesnotinclude homosexualityorbisexuality. ProgramoractivitymeansalloftheoperationsoftheKentuckyPublicSchoolDistrict(MorganCounty Schools). Qualifiedindividualwithadisabilitymeans:Withrespecttopublicpreschool,elementary,and secondaryeducationalservices,anindividualwithadisability(i)ofanageduringwhichnondisabled personsareprovidedsuchservices,(ii)ofanyageduringwhichitismandatoryunderstatelawto providesuchservicestoindividualswithdisabilities,or(iii)towhomastateisrequiredtoprovideafree appropriatepubliceducationundersection612oftheEducationoftheHandicappedAct(nowIDEA). Recipientmeansanystateoritspoliticalsubdivision,anyinstrumentalityofastateoritspolitical subdivision,anypublicorprivateagency,institution,organization,orotherentity,oranypersonto whichFederalfinancialassistanceisextendeddirectlyorthroughanotherrecipient,includingany successor,assignee,ortransfereeofarecipient,butexcludingtheultimatebeneficiaryoftheassistance. RelatedServicesmeanstransportationandsuchdevelopmental,corrective,orsupportiveservicesas arerequiredtoassista504eligiblestudenttobenefitfromspecializededucationortoaccesstheschool environmentorschoolactivities(curricularorextra-curricular). SchoolDaymeansanydaywhenallMorganCountySchoolstudentsarescheduledtobeinattendance forinstructionalpurposes. Section504Coordinator/ComplianceOfficermeanstheindividualassignedtocoordinatetheMorgan CountySchool’seffortstocomplywithSection504oftheRehabilitationAct. StudentEvaluationmeansthegatheringofdatatodetermine(1)eligibilityfor504servicesand(2)the 504needsoftheeligiblestudent. 6 Substantiallylimitsmeans:Restrictedinperformingamajorlifeactivityascomparedtomoststudents inthegeneralpopulation.The504teammayconsiderthecondition,manner,ordurationunderwhich thestudentperformsaparticularmajorlifeactivityascomparedtomoststudentsinthegeneral population.Thedeterminationofwhetheranimpairmentsubstantiallylimitsamajorlifeactivityshallbe madewithoutregardtotheameliorativeeffectsofmitigatingmeasures,exceptforordinaryeyeglassesor contactlenses.“Ordinaryeyeglassesorcontactlenses”meanlensesthatareintendedtofullycorrect visualacuityoreliminaterefractiveerror. SurrogateParentisanindividualappointedbytheMorganCountySchool’sSection504Coordinatorto representthe504rightsofthestudentinthe504teamprocess.Inorderthateducationalrecordscanbe sharedwiththesurrogateparent,thisshallbeanindividualwithwhomthestudentlivesinahomewith noparentpresent. WorkDaymeansMondaythroughFriday,exceptforMorganCountySchoolsholidaysanddayswhen MorganCountySchools,school-basedadministrativestaffarenotcontractedtowork. 7 PROCEDURES LocationandNotification:ChildFind. TheSection504CoordinatoroftheMorganCountySchoolsshallannually: (a)Undertakeactivitiestoidentifyandlocateeveryqualifiedindividualwithadisability,agethree(3) totwenty-one(21),residingintheMorganCountySchoolDistrict'sjurisdictionwhoisnotreceivinga publiceducation,orwhomayneed504services;and (b)Takeappropriatestepstonotifyindividualswithdisabilitiesandtheirparentsorguardiansofthe MorganCountySchool'sdutyunderSection504. (c)Annually,MorganCountySchoolDistrictstaff,incollaborationwiththeSection504Coordinator providesinformationforschoolpersonnelabouttheproceduresforreferralofchildrenwhomay have504disabilitiesandneed504services. (1)TheMORGANCOUNTYSCHOOLDISTRICTshallhaveaprocedurefordeterminingwhethera childneedsasurrogateparentandassigningasurrogateparenttothechild.Thesurrogateparent ofthechildshallhavealltherightsaffordedparentsunderSection504law,tomakedecisionabout 504educationissuesforachild. (2)TheMORGANCOUNTYSCHOOLDISTRICTshallhaveaprocedureforselectingsurrogates.A surrogate: (a)ShallnotbeanemployeeofKDE,theMORGANCOUNTYSCHOOLDISTRICT,oranyother agencythatisinvolvedintheeducationorcareofthechild; (b)Shallnothaveanypersonalorprofessionalinterestthatconflictswiththeinterestsofthe child;and (c)Shallhaveknowledgeandskillsthatensureadequaterepresentationofthechild. (3)Apersonwhoisotherwisequalifiedtobeasurrogateparentshallnotbeconsideredan employeeoftheMORGANCOUNTYSCHOOLDISTRICTsolelybecauseheorsheispaidbythe MORGANCOUNTYSCHOOLDISTRICTtoserveasasurrogateparent. (4)Inthecaseofachildwhoisanunaccompaniedhomelessyouth,appropriatestaffofemergency shelters,transitionalshelters,independentlivingprograms,andstreetoutreachprogramsmaybe appointedastemporarysurrogateparentswithoutregardtothecriterialistedinsubsection(6)of thissectionuntilasurrogateparentcanbeappointedthatmeetsalltherequirementsofthis section. (5)TheappropriateMORGANCOUNTYSCHOOLDISTRICTRepresentativereviewsappropriate recordsandmaycontactappropriatestateagenciestoassistwiththedeterminationoftheneedfor a504surrogateparent. 8 (6)TheMORGANCOUNTYSCHOOLDISTRICTRepresentativeassuresthateachchildisrepresented byanappropriateeducationalrepresentativeatalldecision-makingpointsintheprocessof identification,evaluation,placementandprovisionofafreeappropriatepubliceducation(FAPE). (7)Assoonaspossibleafterthereferraliscompleted,theMORGANCOUNTYSCHOOLDISTRICT Representativedeterminesifthechildisemancipated,andthereforerepresentshimselfin educationaldecision-makingormustberepresentedbyanadult,suchasabiologicaloradoptive parent,legalguardian,personactingasaparentorsurrogateparent. (8)IftheMORGANCOUNTYSCHOOLDISTRICTRepresentativedeterminesthechildistobe representedbyalegalguardian,orisemancipatedbycourtorderormarriage,theMORGAN COUNTYSCHOOLDISTRICTRepresentativecontactstheDPP,whoisresponsibleforobtainingan officialcopyofthecourtorder,appointingtheguardian,oremancipatingthestudent,orofficial proofofthemarriage.Theofficialcopyofthecourtorderorproofofmarriagedocumentisplaced intheeducationalrecordsofthechild. (9)TheSection504Coordinator,ordesignee,developsapoolofpotential504surrogateparents. TheSection504Coordinatormaintainsafileofeligiblesurrogateparentapplications,includingthe namesaddresses,phonenumbersandtrainingstatusoftheindividualswhohaveagreedtoserveas surrogateparents. (10)TheSection504Coordinator,ordesignee,makesarrangementsfortrainingpersonsselectedas surrogateparentstoassistthemwithacquiringknowledgeandskillstoeffectivelyrepresentthe children. (11)Ifasurrogateisassignedbecausetheparentscannotbelocated,theSection504Coordinator, ordesignee,sendsanoticeofintenttoassignasurrogateparenttothelastknownaddressofthe child’sbiologicaloradoptiveparentsorlegalguardians.Ifthewhereaboutsofthebiologicalor adoptiveparentsorlegalguardiansbecomeknown,futurenoticesofmeetingsmustbesentto,and requiredsignaturesmustbeobtainedfromabiologicaloradoptiveparentorlegalguardianofthe child. (12)TheSection504Coordinator,ordesignee,notifiesthesurrogateinwritingofterminationof theneedforthesurrogateparentduetoexpirationoftheassignmentperiod;ifthewhereaboutsof thebiologicaloradoptiveparentsorlegalguardiansbecomeknown;uponemancipationofthe child,orifthesurrogatenolongermeetsthequalificationsandcriteriatoserveasasurrogate parent. (13)TheSection504Coordinatormaintainswrittendocumentationrelativetoanydisagreement regardingthechoiceofasurrogateinhis/heradministrativefiles. 9 (14)TheMORGANCOUNTYSCHOOLDISTRICTshallmakereasonableeffortstoensurethe assignmentofasurrogatenotmorethanthirty(30)daysafterthereisadeterminationbythe MORGANCOUNTYSCHOOLDISTRICTthatthechildneedsasurrogate.(15)Thesurrogateparent mayrepresentthechildinallmattersrelatingtotheidentification,evaluation,andeducational placementofthechildandtheprovisionof504servicestothechild. (16)Whenachildwithadisabilityreachestheageofmajority,alldecision-makingrightsunder Section504shalltransferfromtheparentstothechild,unlessthechildhasbeendeclared incompetentunderKRSChapter387inacourtoflaw.TheMORGANCOUNTYSCHOOLDISTRICT shallnotifythechildwithadisabilityandtheparentsofthetransferoftherights. PreplacementEvaluationRequired. TheMORGANCOUNTYSCHOOLDISTRICTshallconductanevaluationofanystudentwho,becauseof disability,needsorisbelievedtoneeda504accommodationplanbeforetakinganyactionwithrespect totheinitialplacementofthestudentin504andbeforeanysubsequentsignificantchangeof placement. ReferralandEvaluation.(YOUMAYMODIFYTHISSECTION.) Areferralmaybeinitiatedbyateacher,parent,administratororotherpersoninsideoroutsidethe MORGANCOUNTYSCHOOLDISTRICT.ASECTION504STUDENTREFERRALFORMmustbesubmitted totheschoolprincipalordesignee,whoassiststhereferringpersonwiththecompletionofthe504 referralform. Assoonaspossibleafterthereferraliscompleted,theappropriate504teamchairpersondeterminesif thestudentisemancipated,andthereforerepresentshimselfineducationaldecision-makingormust berepresentedbyanadultsuchasanatural,oradoptive,parent,orlegalguardian.Theappropriate 504teamchairpersonreviewsrecordsandmaycontactstateagenciestoassistwithdeterminingthe appropriateeducationalrepresentativeofthestudentorwhetherthestudentisemancipatedunder KentuckyLaw. Ifafterreasonableefforts,whichshallbedocumented,noparentwitheducationaldecision-making rightscanbeidentifiedorlocated;theMORGANCOUNTYSCHOOLDISTRICTshallappointasurrogate parenttorepresentthechildinthe504process. 10 Theappropriate504teamchairpersonschedulesthe504teammeetinginatimelymannerandinvites anyoneneeded.Theappropriate504teamchairpersonnotifiesparents,inwriting,thattheyare invitedtothemeetingtodiscusstheneedforinitial504evaluation.The504teamdetermineswhether thestudentneedstobeevaluatedfor504services.Theappropriate504teamchairpersonmustobtain writtenparentconsentforaninitial504evaluation.Ifaparentrefuses,orrevokes,consentforthe initialevaluation,theappropriate504teamchairpersonmustnotifytheMORGANCOUNTYSCHOOL DISTRICTSection504Coordinatortoscheduleadistrict-level504teammeetingtodiscusswhetherthe MORGANCOUNTYSCHOOLDISTRICTshouldseektooverridetheparentrefusalto,orrevocationof, consent. Assoonaspracticableafterreceiptofparentconsentforinitialevaluation,the504teammeetstoplan theevaluation.The504teamplanstheevaluationbaseduponthetypeofdisabilitysuspectedandthe typeofservicesthestudentappearstoneed.Theevaluationmustbesufficienttoassess(1)thenature andextentoftheimpairment;(2)itseffectonmajorlifeactivitiesaffectingthestudent’sabilityto accesstheschoolenvironmentorschoolactivities;and(3)neededaccommodations. Theevaluationwillbeconductedwithin60schooldaysaftertheMORGANCOUNTYSCHOOLDISTRICT receiveswrittenparentconsent.TheevaluationisthensummarizedontheSECTION504EVALUATION SUMMARY. EvaluationProceduresandMaterials. TheMORGANCOUNTYSCHOOLDISTRICTensuresthat: (1)Testsandotherevaluationmaterialshavebeenvalidatedforthespecificpurposeforwhichthey areusedandareadministeredbytrainedpersonnelinconformancewiththeinstructionsprovidedby theirproducer; (2)Testsandotherevaluationmaterialsincludethosetailoredtoassessspecificareasofeducational needandnotmerelythosewhicharedesignedtoprovideasinglegeneralintelligencequotient;and (3)Testsareselectedandadministeredsoasbesttoensurethat,whenatestisadministeredtoa studentwithimpairedsensory,manual,orspeakingskills,thetestresultsaccuratelyreflectthe student'saptitudeorachievementlevelorwhateverotherfactorthetestpurportstomeasure,rather thanreflectingthestudent'simpairedsensory,manual,orspeakingskills(exceptwherethoseskills arethefactorsthatthetestpurportstomeasure). 11 MultipleSourcesofInformationRequiredforPlacement. Ininterpretingevaluationdataandinmakingplacementdecisions,theMORGANCOUNTYSCHOOL DISTRICTshall(1)drawuponinformationfromavarietyofsources,includingaptitudeandachievement tests,teacherrecommendations,physicalcondition,socialorculturalbackground,andadaptive behavior;(2)ensurethatinformationobtainedfromallsuchsourcesisdocumentedandcarefully considered;(3)ensurethattheplacementdecisionismadebyagroupofpersons,includingpersons knowledgeableaboutthestudent,themeaningoftheevaluationdata,andtheplacementoptions;and(4) ensurethattheplacementdecisionismadeinconformitywith34CFR§104.34(leastrestrictive environment). Afterreviewingavailableinformationandinputfromtheparents,the504teamshallidentifywhat additionaldata,ifany,isneededtodeterminewhetherthestudentiseligiblefor504services,andif eligible,anyneededaccommodations. Eligibility. The504teamreconveneswithin60schooldaysaftertheMORGANCOUNTYSCHOOLDISTRICT’s receiptofwrittenparentconsentforinitialevaluationtoconsidertheevaluationdataanddetermine eligibilityfor504services. Tobeeligiblefora504accommodationplanastudentmusthaveeither(1)acurrentphysicalor mentalimpairmentor(2)anepisodicorin–remissionimpairmentwhich,whenactive,substantially limitssomemajorlifeactivity,causingthestudent’sabilitytoaccesstheschoolenvironmentoraschool activity(curricularorextra-curricular)tobesubstantiallylimited. Forstudents,atemporaryimpairmentdoesnotconstituteadisabilityunderSection504unlessits severityissuchthatitresultsinasubstantiallimitationonamajorlifeactivityforanextendedperiod oftime,sothatitsubstantiallylimitsaccesstotheschoolenvironmentortoatleastoneschoolactivity. Ifthe504teamdeterminesthereisnoimpairment,thestudentisnoteligiblefor504services. Ifthe504teamdeterminesthereisanimpairment,butthatimpairmentdoesnotcurrently,norwhen activeifepisodicorinremission,substantiallylimitaccesstotheschoolenvironmentortoanyschool activity,thestudentisnoteligiblefor504services. 12 Thisisdeterminedbythestudent’s504team. The504teamwilldocumenteligibilityontheSECTION504ELIGIBILITYFORM.Theappropriate504 teamchairpersonshallinvitetheparentsorstudentrepresentativetoameetingtodiscusseligibility anddiscussthe504accommodationplanandplacement,iffoundeligible.Ifsufficientinformationis availabletoprepareanaccommodationplananddetermineplacement,thismaybeaccomplishedatthe samemeetinginwhicheligibilityforservicesisdetermined,aslongtheteammeetstopreparean accommodationplananddetermineplacementwithin60schooldaysaftertheMORGANCOUNTY SCHOOLDISTRICT’sreceiptofwrittenparentconsentforinitialevaluation. FreeAppropriatePublicEducation. General.TheMORGANCOUNTYSCHOOLDISTRICTshallprovideafreeappropriatepubliceducationto eachqualifiedindividualwithadisabilitywhoisintheMORGANCOUNTYSCHOOLDISTRICT's jurisdiction,regardlessofthenatureorseverityoftheperson'sdisability. Appropriateeducation.Theprovisionofanappropriateeducationistheprovisionofregularor specializededucationandrelatedaidsandservicesthat(i)aredesignedtomeettheindividual educationalneedsofanindividualwithadisabilityasadequatelyastheneedsofnondisabledpersons aremet;and(ii)arebaseduponadherencetoproceduresthatsatisfytherequirementsofthelaw. ImplementationofanIndividualizedEducationProgramdevelopedinaccordancewiththeEducationof theHandicappedAct,asamended(nowIDEA),isonemeansofmeetingthisstandard. TheMORGANCOUNTYSCHOOLDISTRICTmayplaceanindividualwithadisabilityorrefersucha personforaid,benefits,orservicesotherthanthosethatitoperatesasitsmeansofcarryingoutthe requirementsofthelaw.Ifso,theMORGANCOUNTYSCHOOLDISTRICTremainsresponsiblefor ensuringthattherequirementsofthelawaremetwithrespecttoanyindividualwithadisabilityso placedorreferred. FreeEducation--(1)General.Forthepurposeofthissection,theprovisionofafreeeducationisthe provisionofeducationalandrelatedserviceswithoutcosttotheindividualwithadisabilityortohisor herparentsorguardians,exceptforthosefeesimposedonnondisabledpersonsortheirparentsor guardians.Itmayconsisteitheroftheprovisionoffreeservicesor,iftheMORGANCOUNTYSCHOOL DISTRICTplacesanindividualwithadisabilityorreferssuchpersonforaid,benefits,orservicesnot operatedbytheMORGANCOUNTYSCHOOLDISTRICTasitsmeansofcarryingouttherequirementsof thelaw,ofpaymentforthecostsoftheaid,benefits,orservices.Nothinginthissectionshallbe 13 construedtorelieveaninsurerorsimilarthirdpartyfromanotherwisevalidobligationtoprovideor payforservicesprovidedtoanindividualwithadisability. (2)Transportation.IftheMORGANCOUNTYSCHOOLDISTRICTplacesanindividualwithadisability orreferssuchpersonforaid,benefits,orservicesnotoperatedorprovidedbytheMORGANCOUNTY SCHOOLDISTRICTasitsmeansofcarryingouttherequirementsofthelaw,theMORGANCOUNTY SCHOOLDISTRICTshallensurethatadequatetransportationtoandfromtheaid,benefits,orservices isprovidedatnogreatercostthanwouldbeincurredbythepersonorhisorherparentsorguardians ifthepersonwereplacedintheaid,benefits,orservicesoperatedbytheMORGANCOUNTYSCHOOL DISTRICT. (3)ResidentialPlacement.IftheMORGANCOUNTYSCHOOLDISTRICTdeterminesapublicorprivate residentialplacementisnecessarytoprovideafreeappropriatepubliceducationtoanindividual withadisabilitybecauseofhisorherdisability,theplacement,includingnon-medicalcareandroom andboard,shallbeprovidedatnocosttothepersonorhisorherparentsorguardians. (4)PlacementofIndividualwithadisabilitybyParents.IftheMORGANCOUNTYSCHOOLDISTRICT hasmadeavailable,inconformancewiththerequirementsofthelaw,afreeappropriatepublic educationtoanindividualwithadisabilityandtheperson'sparentsorguardianchoosetoplacethe personinaprivateschool,theMORGANCOUNTYSCHOOLDISTRICTisnotrequiredtopayforthe person'seducationintheprivateschool.Disagreementsbetweenaparentorguardianandthe MORGANCOUNTYSCHOOLDISTRICTregardingwhethertheMORGANCOUNTYSCHOOLDISTRICT hasmadeafreeappropriatepubliceducationavailable,orotherwiseregardingthequestionof financialresponsibilityaresubjecttodueprocesshearingprocedures.SeetheMORGANCOUNTY SCHOOLDISTRICT504DueProcessHearingandReviewprocedure. EducationalSettingandLeastRestrictiveEnvironment. (a)Academicsetting.TheMORGANCOUNTYSCHOOLDISTRICTshalleducate,orshallprovideforthe educationof,eachqualifiedindividualwithadisabilityinitsjurisdictionwithpersonswhoarenot disabledtothemaximumextentappropriatetotheneedsoftheindividualwithadisability.The MORGANCOUNTYSCHOOLDISTRICTshallplaceanindividualwithadisabilityintheregular educationalenvironmentunlessitisdemonstratedbytheMORGANCOUNTYSCHOOLDISTRICTthat theeducationofthepersonintheregularenvironmentwiththeuseofsupplementaryaidsandservices cannotbesatisfactorilyachieved.WhenevertheMORGANCOUNTYSCHOOLDISTRICTplacesaperson inasettingotherthantheregulareducationalenvironmentpursuanttothisparagraph,itshalltakeinto accounttheproximityofthealternatesettingtotheperson'shome. 14 (b)Nonacademicsettings.Inprovidingorarrangingfortheprovisionofnonacademicand extracurricularservicesandactivities,includingtransportation,meals,recessperiods,andtheservices andactivitiessetforthin34CFR§104.37(a)(2)(nonacademicservices),theMORGANCOUNTY SCHOOLDISTRICTshallensurethatanindividualwithadisabilityparticipateswithnondisabled personsinsuchactivitiesandservicestothemaximumextentappropriatetotheneedsofthe individualwithadisabilityinquestion. (c)Comparablefacilities.IftheMORGANCOUNTYSCHOOLDISTRICT,incompliancewithparagraph(a) ofthissection,operatesafacilitythatisidentifiableasbeingforindividualswithdisabilities,the MORGANCOUNTYSCHOOLDISTRICTshallensurethatthefacilityandtheservicesandactivities providedthereinarecomparabletotheotherfacilities,services,andactivitiesoftheMORGANCOUNTY SCHOOLDISTRICT. NonacademicServices. (a)General.(1)TheMORGANCOUNTYSCHOOLDISTRICTshallprovidenonacademicand extracurricularservicesandactivitiesinsuchmannerasisnecessarytoaffordstudentswith disabilitiesanequalopportunityforparticipationinsuchservicesandactivities.(2)Nonacademic andextracurricularservicesandactivitiesmayincludecounselingservices,physicalrecreational athletics,transportation,healthservices,recreationalactivities,specialinterestgroupsorclubs sponsoredbytheMORGANCOUNTYSCHOOLDISTRICT,referralstoagencieswhichprovide assistancetoindividualswithdisabilities,andemploymentofstudents,includingbothemployment bytheMORGANCOUNTYSCHOOLDISTRICTandassistanceinmakingavailableoutsideemployment. (b)Counselingservices.IftheMORGANCOUNTYSCHOOLDISTRICTprovidespersonal,academic,or vocationalcounseling,guidance,orplacementservicestoitsstudents,itprovidestheseservices withoutdiscriminationonthebasisofdisability.TheMORGANCOUNTYSCHOOLDISTRICTensures thatqualifiedstudentswithdisabilitiesarenotcounseledtowardmorerestrictivecareerobjectives thanarenondisabledstudentswithsimilarinterestsandabilities. (c)Physicaleducationandathletics.(1)Inprovidingphysicaleducationcoursesandathleticsand similaraid,benefits,orservicestoanyofitsstudents,theMORGANCOUNTYSCHOOLDISTRICTdoes notdiscriminateonthebasisofdisability.TheMORGANCOUNTYSCHOOLDISTRICTprovidesqualified studentswithdisabilitiesanequalopportunityforparticipationinanyphysicaleducationcourses, interscholastic,club,orintramuralathleticsitoffersorsponsors.(2)TheMORGANCOUNTYSCHOOL DISTRICTmayoffertostudentswithdisabilitiesphysicaleducationandathleticactivitiesthatare 15 separateordifferentfromthoseofferedtonondisabledstudentsonlyifseparationordifferentiationis consistentwiththerequirementsof34CFR§104.34(leastrestrictiveenvironment),andonlyifno qualifiedstudentwithadisabilityisdeniedtheopportunitytocompeteforteamsortoparticipatein coursesthatarenotseparateordifferent. AccommodationPlanandPlacement.(YOUMAYMODIFYTHISSECTION.) Ifthe504teamdeterminesthestudentiseligiblefor504services,theteamdevelopsa504 accommodationplan,whichstatesthespecializedinstruction,relatedaidsorservices,orprogram modificationsneededforcurricularorextra-curricularactivities,andtheplacementsetting.The504 teamchairpersondocumentstheaccommodationsonthe504ACCOMMODATIONPLANFORM. AnappropriateaccommodationplanforastudenteligibleunderSection504mayconsistof participationinregularclassesorprogramswithneededaccommodations,and/ortheuseof specializedservicesorprogramsdesignedtomeetthestudent’suniqueneeds. Afterthe504accommodationplanhasbeenwrittenandtheplacementsettingdetermined,the appropriate504teamchairpersonshallmaketheimplementersawareoftheirimplementation responsibilitiesunderthe504accommodationplan.Theappropriate504teamchairpersonmustalso obtainwrittenparentconsentbeforeimplementationoftheinitial504accommodationplanand placement. Ifaparentrefusestoprovide,orrevokes,consentfortheinitial504accommodationplanortheinitial placement,theappropriate504teamchairpersonmustdocumentthatschoolpersonneldiscussed parentrightsunderSection504withtheparentsotheparentisinformedofwhatthestudentwillnot receive. Iftheeligiblestudentcurrentlyneedsnoaccommodation,the504teamChairpersondocumentsinthe SECTION504ACCOMMODATIONPLANthatthe504teammembershavebeentoldtobringany suspectedneedforaccommodationtothe504team. PeriodicReviewofAccommodationPlanandPlacement. The504accommodationplanandplacementmustbereviewedbythe504teamasneeded,butatleast onceayear.TheMORGANCOUNTYSCHOOLDISTRICTSection504Coordinatorshallmaintainalistof 16 all504identifiedstudentsandtheirreviewdates.Itistheresponsibilityoftheappropriate504team chairpersontoinitiatethereviewandschedulethe504planreviewmeeting. Reevaluation.TheMORGANCOUNTYSCHOOLDISTRICTshallreevaluate504studentsasdetermined necessarybythe504team,butatleasteverythreeyearsandpriortoasignificantchangeofplacement. Afterreviewingavailableinformationandinputfromtheparents,the504teamshallidentifywhat,ifany, additionaldataisneeded.Afterobtaininganyneededinformation,the504teamshalldetermineifthe studentstillqualifiesfor504services,andmakeanyneededmodificationstothestudent’s504 accommodationplanandplacement. ProceduralSafeguards.(IncludesHearingandGrievance) Withrespecttoactionsregardingtheevaluation,identification,oreducationalplacementofstudents who,becauseofdisability,needorarebelievedtoneeda504accommodationplan,theMORGAN COUNTYSCHOOLDISTRICThasasystemofproceduralsafeguardsthatincludesnotice;anopportunity fortheparentsorguardiansofthepersontoexaminerelevantrecords;animpartialhearingwith opportunityforparticipationbytheperson'sparentsorguardians;representationbycounsel;anda reviewprocedure. Ifaparent(s)disagreeswithanydecisionregardingevaluation,identification,oreducational placement,the504teamchairpersonwhochairedthatmeetingmustinformthat/thoseparent(s)ofthe righttofileagrievanceandtorequesta504dueprocesshearing.TheStayPutprincipledoesnotapply to504hearings,ortorevieworappealproceedings,unlessorderedbyahearingorreviewofficer,ora court. TheMORGANCOUNTYSCHOOLDISTRICTandtheparentshavetherighttorequestanimpartial504 dueprocesshearingregardingevaluation,identification,oreducationalplacementunderSection504. TheSuperintendent,withBoardapproval,shallcontractwithimpartial504hearingofficers,and impartialreviewofficers,whoarenotemployeesoftheMORGANCOUNTYSCHOOLDISTRICT.The MORGANCOUNTYSCHOOLDISTRICTandtheparentshavearighttofurtherreviewofthehearing officer’sdecision.SeetheMORGANCOUNTYSCHOOLDISTRICTSection504ImpartialHearingand Reviewprocedures. IndividualsmayfilealocalgrievanceconcerningdiscriminationunderSection504.TheMORGAN COUNTYSCHOOLDISTRICTgrievanceorcomplaintproceduremaybeusedtofile504grievances. 17 IndividualsmayalsofileacomplaintconcerningdiscriminationwiththeU.S.DepartmentofEducation OfficeforCivilRights.SeetheMORGANCOUNTYSCHOOLDISTRICTSection504ParentRights Statement. PriorWrittenNoticeandParentRights.Theappropriate504teamchairpersonshallinviteparentsto any504teammeetingatwhichdecisionswillbemaderegardingtheevaluation,identificationor educationalplacementof,theirchild(includespriorwrittennoticeandaSection504ParentRights Statement)atthefollowingtimes: 1.Onceeachschoolyear,andalsoatthefollowingtimes; 2.UponinitialreferralorparentrequestforaSection504evaluation; 3.PriortoanySection504reevaluation; 4.Priortoconsiderationofasignificantchangeofplacementbecauseofdisciplinaryremovals; 5.UponreceiptofaSection504dueprocesshearingrequest; 6.UponreceiptofaSection504serviceplangrievancefiledonbehalfofastudent; 7.Uponrequestbyaparent. Whenastudentreachestheageofmajority,orisemancipated,underKentuckylaw,allrightsunder Section504transferfromtheparentstothestudent,unlessthestudenthasbeendeclaredincompetent underKRSChapter387inacourtoflaw.SeedefinitionofAdultStudent.TheMORGANCOUNTY SCHOOLDISTRICT’sSection504ParentRightsStatementshallcontainthistransferofrightsstatement. TheparentsshallbenotifiedinwritingofanydecisionsmadebytheMORGANCOUNTYSCHOOL DISTRICTconcerningtheevaluation,identification,oreducationalplacementofthestudentunder Section504.ThenoticewillbegivenbyprovidingacopyoftheSECTION504CONFERENCESUMMARY REPORTandotherdocumentscompletedatthe504teammeetingtoparentsattheendofthe504team meetingifaparentattends,orbymailingthesedocumentstoparentswhodidnotattendthemeeting within5workdaysafterthemeeting.Changestothe504accommodationplanorplacementmaybe implementedimmediatelyiftheparentsreceivedthenoticedocumentsinthemeeting,andwithin10 workdaysaftermailingthenoticedocumentstoparentswhodidnotattendthemeeting,unlessa hearingorreviewofficer,oracourt,ordersotherwise. ParentConsent. 18 TheMORGANCOUNTYSCHOOLDISTRICTobtainswrittenparentconsentpriortoconductingtheinitial 504evaluationandpriortoimplementationoftheinitial504accommodationplanandplacement.The MORGANCOUNTYSCHOOLDISTRICTmayinitiatea504dueprocesshearingtorequestan independenthearingofficertooverrideparentrefusalorrevocationforevaluation.Adistrict-level504 teamwilldeterminewhethertorecommendtotheBoardofEducationthatitrequestahearingofficer tooverridethatparentrefusal.Thedistrictdoesnotrequestdueprocesshearingstooverriderefusalor revocationofconsentfor504serviceimplementation.TheSuperintendentwillnotifytheparentsifthe Boarddecidestorequestahearingofficertooverrideparentrefusalto,orrevocationof,consent througha504dueprocesshearing. IftheMORGANCOUNTYSCHOOLDISTRICToraparentrequestsa504hearingafterparentrefusal,or revocation,ofanyrequiredconsent,theMORGANCOUNTYSCHOOLDISTRICTdoesnot conduct/implementtheactivityrequiringconsentunless(1)thehearingorreviewofficer,oracourt, grantstheMORGANCOUNTYSCHOOLDISTRICTtheconsent,and(2)hearing,review,andappealrights havebeenexhausted. TransferStudents. Whenastudentwitha504accommodationplantransfersintotheMORGANCOUNTYSCHOOL DISTRICT,designatedschooldistrictpersonnelshallreviewthe504accommodationplan.Ifthe504 teamfindsthe504accommodationplannottobeappropriate,itshallconductareevaluationofthe student.IftheparentandMORGANCOUNTYSCHOOLDISTRICTagreethe504planisappropriate,the MORGANCOUNTYSCHOOLDISTRICTmayimplementthatplanuntiltimeforreviewoftheplanor reevaluationofthestudent.A504accommodationplanfoundtobeappropriatemaybeimplemented, orthe504teammaydevelopanew504accommodationplan. StudentNoLongerNeeds504Services. The504teamshallmakethedeterminationastowhetherastudentnolongerneeds504services.The teamshalldocumentthatthestudentnolongerneeds504servicesandgivewrittennoticetothe parentsassetoutintheProceduralSafeguardssection.TheMORGANCOUNTYSCHOOLDISTRICTshall maintainrecordsofthestudent’s504servicesinaccordancewithlaw,includingtheKentuckyRecords RetentionSchedule. 19 Discipline. 504studentsaredisciplinedaccordingtotheir504accommodationplansandinaccordancewith Section504oftheRehabilitationAct. SignificantChangeofPlacementBecauseofDisciplinaryRemovals. "Changeofplacementbecauseofdisciplinaryremovals"meansachangeofplacementoccursif: (a)Theremovalisformorethanten(10)consecutiveschoolsdays;or (b)Thechildhasbeensubjectedtoaseriesofremovalsthatconstituteapattern(whichisdetermined onacase-by-casebasis)because: (i)Theseriesofremovalstotalmorethanten(10)schooldaysinaschoolyear; (ii)Thechild’sbehaviorissubstantiallysimilartothechild’sbehaviorinpreviousincidentsthat resultedintheseriesofremovals;and (iii)Ofadditionalfactorsincludingthelengthofeachremoval,thetotalamountoftimethechildhas beenremoved,andtheproximityoftheremovalstoone(1)another. 11thDayandSubsequentRemovalPeriods. Beforethestudentisremovedforthe11thdayinanyschoolyearandbeforeeachsubsequentremoval periodduringthatschoolyear,thebuildingprincipalandtheMORGANCOUNTYSCHOOLDISTRICT Section504Coordinator,ordesignee,determineiftheremovalconstitutesasignificantchangeof educationalplacement.Theymustbeinagreementthattheremovalisnotasignificantchangeof educationalplacement.Iftheydonotsoagree,theremovalistreatedasasignificantchangeof educationalplacement. ManifestationDeterminationReview. A504teammeetingtoconductamanifestationdeterminationreviewshallbescheduledbythe appropriate504teamchairpersonforany504eligiblestudent,orforanystudenttheMORGAN COUNTYSCHOOLDISTRICThasreasontobelievemayneed504services,whoisbeingconsideredfora significantchangeofeducationalplacementbecauseofdisciplinaryremovals,whetherornotthe studentiscurrentlyreceiving504services. 20 The504teamfirstconsiders,intermsofthebehaviorsubjecttothedisciplinaryaction,allrelevant informationincludingevaluationanddiagnosticresults,relevantinformationsuppliedbytheparents, observationofthestudentandthestudent’s504accommodationplan. 1.The504teammustdeterminethebehaviorofthestudentwasamanifestationofthestudent’s disabilityif: (a)Theconductinquestionwascausedby,orhadadirectandsubstantialrelationshiptothe child’sdisability;or (b)TheconductinquestionwasthedirectresultoftheLEA’sfailuretoimplementtheSection504 plan. 2Theconductshallbedeterminedtobeamanifestationofthechild’sdisabilityiftheteam determinesthateitheroftheconditionsinsubsection(1)(a)or(b)ofthissectionwasmet. RequirementsifBehaviorisaManifestationofStudent’sDisability. Ifthe504teamfindsthebehaviorinquestionisamanifestationofthestudent’sdisability,thestudent’s placementcannotbechangedduetothebehaviorincidentunderreview,unlesstheparentsandthe LEAagreetoachangeinplacementaspartofmodificationofthebehavioralinterventionplan. Ifthe504teamdeterminestheconditiondescribedinsubsection(1)(b)oftheaboveManifestation DeterminationReviewSectionwasmet,theMORGANCOUNTYSCHOOLDISTRICTshalltakeimmediate stepstoremedythatdeficiency. IfBehaviorisNotaManifestationoftheStudent’sDisability. If,afterthemanifestationdeterminationreview,the504teamdeterminesthebehaviorwasnota manifestationofthestudent’sdisability,therelevantdisciplinaryproceduresapplicabletoallstudents maybeappliedtothestudentinthesamemannerinwhichtheywouldbeappliedtostudentswithout disabilities.Section504doesnotrequirecontinuationofeducationalservicesforsuchstudents.(Note: Continuationofeducationalservicesmayberequiredundersomeotherprovisionoflaw.) CurrentUseofIllegalDrugsorAlcoholExceptioninDisciplinarySituations. TheMORGANCOUNTYSCHOOLDISTRICTmaytakedisciplinaryactionpertainingtotheuseor possessionofillegaldrugsoralcoholagainstany504studentwhocurrentlyisengagingintheillegal useofdrugsorintheuseofalcoholtothesameextentthatsuchdisciplinaryactionistakenagainst nondisabledstudents.Furthermore,thedueprocessproceduresat34CFR104.36(orany correspondingsimilarregulationorruling)shallnotapplytosuchdisciplinaryactions. 21 Merepossessionofillegaldrugsoralcoholdoesnotresultinalossof504protections.Inorderto justifynotconductingamanifestationdetermination,thedistrictmusthaveevidencethatthestudentis acurrentuserofillegaldrug(s)oralcohol. ProtectionforStudentsSuspectedofNeeding504Services (1)Achildwhohasnotbeendeterminedtobeeligiblefor504andwhohasengagedinbehaviorthat violatedacodeofstudentconductmayassertanyoftheprotectionsprovidedforstudentsalready eligiblefor504iftheMORGANCOUNTYSCHOOLDISTRICThadknowledgethatthechildmightneed 504servicesbeforethebehaviorthatprecipitatedthedisciplinaryactionoccurred. (2)BasisofKnowledge–TheMORGANCOUNTYSCHOOLDISTRICTshallbedeemedtohaveknowledge thatachildisachildwithadisabilityif,beforethebehaviorthatprecipitatedthedisciplinaryaction occurred: (a)Theparentofthechildhasexpressedconcerninwriting(ororallyiftheparentcannotexpressit inwriting)tosupervisoryoradministrativepersonneloftheappropriateLEA(theMORGANCOUNTY SCHOOLDISTRICT),ortoateacherofthechild,thatthechildisinneedof504services; (b)Theparentofthechildhasrequestanevaluationfor504services;or (c)Theteacherofthechild,orotherpersonneloftheMORGANCOUNTYSCHOOLDISTRICT,has expressedconcernaboutapatternofbehaviororperformancedemonstratedbythechilddirectlyto theMORGANCOUNTYSCHOOLDISTRICTSection504Coordinatorortoothersupervisorypersonnel oftheMORGANCOUNTYSCHOOLDISTRICT. (3)TheMORGANCOUNTYSCHOOLDISTRICTshallnotbedeemedtohaveknowledgethatachildisa childwithadisabilityif,afterreceivinginformationthatthatchildmayhaveadisability,theMORGAN COUNTYSCHOOLDISTRICT: (a)Conductedanevaluationanddeterminedthechildwasnoteligiblefor504services; (b)Determinedanevaluationwasnotnecessaryandprovidednoticetotheparentsofthese determinations;or (c)Theparentsrefusedtoconsenttoanevaluationorrefusedinitialservices. (4)ConditionsthatApplyiftheMORGANCOUNTYSCHOOLDISTRICTdoesnothaveaBasisof Knowledge– (a)IftheMORGANCOUNTYSCHOOLDISTRICTdoesnothaveknowledgethatachildmightneed504 servicespriortotakingdisciplinarymeasuresagainstthechild,thechildmaybesubjectedtothe 22 samedisciplinarymeasuresappliedtochildrenwithoutdisabilitieswhoengagedincomparable behaviors. (b)Ifarequestismadeforanevaluationofthechildduringthetimeperiodinwhichthechildis subjectedtodisciplinarymeasures,theevaluationshallbeconductedinanexpeditedmanner. (c)Untiltheevaluationiscompleted,thechildshallremainintheeducationalplacementdetermined byschoolauthorities,whichmayincludesuspensionorexpulsionwithouteducationalservicesunless educationalservicesarerequiredundersomeotherprovisionoflaw. (d)Ifthechildisdeterminedtobeeligiblefor504services,takingintoconsiderationinformation fromtheevaluationconductedbytheMORGANCOUNTYSCHOOLDISTRICTandinformation providedbytheparents,theMORGANCOUNTYSCHOOLDISTRICTmustoffer504services. ReportingtoLawEnforcementAgencies (1)Notwithstandinganyprovisionsof707KARChapter1,anagencymayreportacrimecommittedby achildwithadisabilitytoappropriateauthorities.
