• Texas law requires “non-discriminatory” treatment of
certificated telecommunications providers with regard to
terms of access to Municipally-Owned Utility (MOU) poles.
• Entry of Google Fiber into San Antonio resulted in
innovative pole attachment terms.
• CPS Energy had over 35 entities with pole attachment
contracts, none of which were subject to unilateral
amendment on the part of CPS Energy.
• Any Attaching Entity could have refused to amend its pole
attachment contract and even threaten litigation on the
basis of discriminatory treatment.

LEGAL LANDSCAPE
• While Investor-Owned Utilities (IOUs) are required to comply
with the federal Pole Attachment Act (PAA) and FCC
implementing regulations, MOUs are not subject to the PAA.
• Federal law allows state public service commissions to choose
to exercise jurisdiction over pole attachment rates and
practices.

‒
Texas law requires MOUs to use the FCC Telecom Pole Attachment
Formula as a rate “ceiling.”
Under SB 1004/HB 2838, being considered by the Texas Legislature, MOUs
will be required to grant pole access to small cell wireless installations.
• FCC has not established “one-touch” or small cell wireless
facilities regulations, however, FCC recently released a NPRM
to consider further amendments to the Telecom Pole
Attachment Formula and adoption of a one-touch process.
• Federal and state regulations recognize the necessity for
utility specific pole attachment operational procedures.

ATTACHMENT PROGRAM
• CPS Energy recognized the need to change the way it
administered Pole Attachment Applications to address
new market realities increasing demand for access to
utility poles.
• Pole Attachments would now be viewed in the context
of a business process, not simply as an engineering
process.
• Therefore, CPS Energy “rebooted” the entire
Pole Attachment Program.

– To provide flexibility to address new technologies
while maintaining non-discriminatory practices.

PRO-FORMA AGREEMENTS
