n January 2010, the United States Customs and Border
Protection agency (CBP) began active enforcement
of the expanded ocean importer security filing (ISF)
requirements, commonly referred to as the “10+2” rule.
Under this regulation, importers are required to provide
advanced information regarding ocean cargo bound for the
United States in order to better secure our borders from
terrorist threats.
Failure to provide the information required on the ISF accurately and in a
timely manner adds significant financial risks to your supply chain. Not only
might you be fined for failing to file the ISF on time—24 hours before vessel
loading begins—but the CBP can also issue “do not load” restrictions at the
port of origin or seize the goods at customs upon their arrival in the United
States—either of which could cause delays in shipments and result in
lost sales.

Gathering the data elements that compose the ISF in a timely manner is
challenging for most importers. Information pertaining to the buyer, seller,
consignee and freight forwarder is required, but some of this typically isn’t
available until much later than the CBP mandates. As a result, the majority of
the industry has chosen to rely on freight forwarders or brokers to handle the
filing—for a fee. Given the expense of a filing service and the lack of control
over the process when leveraging a partner, many businesses would rather
own and manage the filing process themselves.
