Terms of Reference On October 27, 2005, the Minister of Finance (the Minister), referred to the Canadian International Trade Tribunal (the Tribunal) pursuant to Section 19 of the Canadian International Trade Tribunal Act, an inquiry into the availability from Canadian production of apparel fabrics classified under certain tariff items in the Customs T a r s The terms of reference for the inquiry are reproduced at Appendix 1. In his, letter, the Minister noted that, on June 30, 2005, the Tribunal released its Report on the Production in Canada of Certain Fibres, Yarns and Apparel Fabrics and that the Tribunal did not receive sufficiently detailed production information during the course of that inquiry to enable it to make tariff relief recommendations on a number of tariff items ihat contain a wide variety of products. For 12 of these tariff items, the Minister asked the Tribunal to carry out additional inquiry. The Minister indicated that it is the government’s objective to retain duties only on those fabrics that the Tribunal determines are sold to Canadian apparel producers or are produced in Canada for the intemal production of apparel and for which the Tribunal provides detailed product descriptions and associated new eight-digit tariff items. Fabrics not produced in Canada would be classified under the related residual “other” provisions at a free rate of duty. The Tribunal was also directed to estimate the total value of the fabrics sold to Canadian apparel producers or, where applicable, the total value of the fabrics produced for the intenial production of apparel, for each of the eight-digit tariff items and the significance of these amounts to domestic textile manufacturers. Furthermore, the Tribunal was also directed to report on any other matter that it determines to be of relevance to this inquiry. On November 23, 2005, the Minister further directed the Tribunal, where appropriate, in identifying new eight-digit tariff items, to ensure that the scope of the product descriptions reflects market realities by considering the nature of the competition between products in the marketplace and the imminent production of any fabric. The revised terms of reference are reproduced at Appendix II. The ïribunal must submit its report to the Minister by April27,2006. Part II is comprised of 12 sections, one for each of the original 12 tariff items subject to this inquiry. Each section lists the textile manufacturers reporting the availability of the subject apparel fabrics (including sales to domestic apparel producers or productioii for internal apparel manufacturing) in the period under review. It then defines a nurnber of fabric groupings within the tariff item and provides information on the dollar value of sales andor internal transfer for apparel manufacturing for each of the groupings. Competitive products, as identified by the textile manufacturers, are then reported. Next, the section identifies draft tariff structures based on the availability of the subject apparel fabrics in the Canadian market. Finally, each section reports the financial significance, in percentage terms, of domestic sales andor internal transfer value for apparel manufacturing of the subject apparel fabrics under proposed new tariff items, in relation to a Company’s total aggregate sales, including sales for non-subject goods and sales for export markets. 3. Period Covered by the Inquiry The Minister directed the Tribunal to consider fabric availability since January 1, 2003. In exceptional circumstances, however, the Tribunal may also consider fabric availability since January 1, 2002. 4. Conduct of the Inquiry to Date On November 14, 2005, the Tribunal notified al1 government departments and associations known to have an interest in the commencement of the inquiry into the availability of apparel fabrics subject to the inquiry. It published a notice in the November 26, 2005, issue of the Canada Gazette.’ The Tribunal’s notice included a detailed schledule of events, giving dates when parties were to file notices of participation, make submissions and reply to the submissions of others. The notice also advised that the Tribunal may hold a public hearing on the matter. The preliminary information-gathering and analysis of the inquiry was based on a questionnaire: survey of known producers of the subject apparel fabrics. The Tribunal consulted primarily with the Canadian Textile Institute (the CTI) and the Canadian Apparel Federation (CAF) in the development of the questionnaire. Tribunal staff also visited several firms to provide them with technical advice and to explain the type of information required by the Tribunal. On November 14, 2005, and shortly thereafter, the Tribunal sent the notice and questionnaire: to 3 1 potential domestic textile manufacturers. Appendix IV provides a list of these firmi;. On December 1 and 2,2005, the Tribunal notified questionnaire recipients that, pursuanit to the Minister’s revised terms of reference, respondents should also include any imminent production of apparel fabrics. In total, 21 firms responded to the Tribunal’s producers’ questionnaire and reported domestic sales andor imminent production of the subject apparel fabrics as follows: 1. Appendix VI provides a cietailed listing of the main characteristics of the subject apparel fabrics reported by questionnaire respondents. The listing does not include information reported by textile manufacturers for non-subject fabrics. 6. Methodology Used by Tribunal Staff In thle Tribunal’s questionnaire, textile manufacturers were asked to provide detailed infoimation4 on the characteristics of domestically-available fabrics, e.g. weight, types and percentages of fibres, weave, yam thickness, and range of apparel end-uses. Using this detailed information, Tnbunal staff identified possible fabric groupings and developed associated draft tariff items to encompass domestically-available apparel fabrics and tlistinguish them from apparel fabrics not produced in Canada, and from fabrics produced for non-apparel end-uses. These draft tariff items are preliminary and are put fonvard for the purpose of discussion. Tribunal staff generally added a margin of five percent (rounded to the nearest multiple of ilve) to the reported ranges for key fabric characteristics. For example, if textile manufacturers reported sales of apparel fabrics weighing from 100 g/m2 to 200 g/m2, the proposed new tariff item would include fabrics weighing from 95 g/m2 to 210 g/m2. M i l e the issue of competitive products is noted in each of the detailed sections of the report, the draft tariff structures are strictly based on demonstrated and imminent production. 7. Future Inquiry Events Interested parties are invited to make written submissions on the draft tariff structures contained in this report by February 13, 2006. Al1 parties may file reply submissions by February 24,2006. The Tribunal will inform parties by February 28, 2006, of its decision as to whether a hearing is required. Should one be required, it will begin by March 6, 2006. 3. This Appenciix is intended to outline a number of key points made by the respondents to the Tribunal’s questionnaire. Irriported products have an edge in pricing, whereas Victor is more competitive in terms of dlelivery times, available quantities and arrangements for payment. Victor also stated that, if the content of wool in a particular fabric were lowered to 50 percent, the fabric would fa11 into tariff item No. 5515.13.90,’ another subject tariff item.
