What is Public Law 102-477?
Public Law 102-477 is the Indian Employment,
Training, and Related Services Demonstration
Act that was signed into law by President
George H. W. Bush in 1992.

PL 102-477 was enacted to:
• Demonstrate how Indian tribal governments can integrate the
employment, training, and related services they provide in
order to improve the effectiveness of those services;
• Reduce joblessness in Indian Country; and
• Serve Tribally-determined goals that are consistent with the
policies of self-determination.

P.L. 102- 477and CSBG
•
PL102-477 consolidated plans - often referred to as “477 Plans” are
submitted to and administered by the Department of Interior (DOI), Bureau
of Indian Affairs (BIA)
•
CSBG, with its aims of self-sufficiency and moving families off of public
assistance and its explicit authorization of funds to be used for employment
and training activities, can be understood to support the employmentoriented purposes of the 477 Act
•
Participation is limited to federally-recognized Tribes and Tribal
Organizations
•
Participation in P.L. 102-477 is voluntary

To include CSBG in a P.L. 102-477 Demonstration Project, a
Tribe or Tribal Organization:
• Must be Federally-recognized with an existing direct Federal
CSBG grant in operation for at least one (1) year.
• Must have at least two (2) programs eligible for incorporation
into P.L. 102-477.
• Must be able to show a proven record of financial
responsibility, demonstrated by three years of recent “clean”
audits.

• Prior to submitting an application, Tribal CSBG Program
Directors should contact the Division of State Assistance and
confirm that minimum criteria are met.

Waivers:
• All applicable CSBG program statute, regulations, and policy
continue to apply (unless ACF grants a waiver) to CSBG funds
approved to be included in a P.L. 102-477 demonstration
project.
• Tribes do have the right to requests waivers as long as the
waiver is consistent with the purpose of P.L. 102-477 or with
provisions of the CSBG Act.
• Waiver requests may be submitted as a part of the Tribe’s
plan

• If you elect to participate in a 102-477 demonstration pilot in
FY 2017, you must submit your plan no later than July 1,
2016.
• 102-477 Plan applications may be submitted at any time
during the fiscal year.
• Please note that, because CSBG is administered on an annual
basis, if an application is submitted after January 1st of a
given fiscal year, it will not become effective until the CSBG
Plan is accepted and funds are made available in the next
available fiscal year.

• After an initial review by BIA, plans will be forwarded to OCS
for final review and acceptance.
• The entire plan review process must be completed within 90
days of receipt.

What to Expect
• OCS will either accept the plan, or return the plan to BIA if
additional information or clarification is needed. Be sure to do
a thorough review of your plan.
• Applicants that do not meet the minimum criteria will not be
reviewed. OCS will provide BIA with an explanation.

services;
o Information on the number of and characteristics of clients served;
o How the grantee met its goals and objectives;
o Information on the types of projects supported by CSBG funds;
o Accomplishments of projects and activities; and
o Outcome data that addresses the implementation of the national
goals.

• Tribes or Tribal Organizations that: 1) have previously
submitted a two year CSBG plan; 2) are currently in the first
year of an accepted CSBG two-year plan cycle; AND 3) are
transitioning to the P.L. 102-477, will only be required to
submit a Letter of Intent, an Annual Report and the SF-424M
to BIA.

Withdrawal Steps
Tribes participating in 102-477 plans may withdraw at any time.
To do so:
– The Tribal Chief, Chair or CEO must submit a letter to the “477” Lead
Agency at DOI, with a copy to OCS.
– The letter must state that the Tribe is withdrawing its CSBG funds
from its existing 102-477 Plan and specify the approved 102-477 Plan
period.
– Withdrawals will become effective at the beginning of the following
fiscal year.
Note: The CSBG Fiscal Year begins October 1 of a given year and ends
on September 30 of the following year.

Re-Submission Steps
• The Tribal Chief, Chairman or CEO must submit a letter to
OCS requesting re-submission, along with a completed
CSBG application and Plan for the requested fiscal year no
later than 30 days prior to the beginning of the first fiscal year
covered by the plan.
