Provides that all individuals residing in the State are covered under the Illinois Health Services Program for health insurance. Sets forth the health coverage benefits that participants are entitled to under the Program. Sets forth the qualification requirements for participating health providers. Sets forth standards for provider reimbursement. Provides that it is unlawful for private health insurers to sell health insurance coverage that duplicates the coverage of the Program. Provides that investor-ownership of health delivery facilities is unlawful. Provides that the State shall establish the Illinois Health Services Trust to provide financing for the Program. Sets forth the requirements for claims billing under the Program. Provides that the Program shall include funding for long-term care services and mental health services. Provides that the Program shall establish a single prescription drug formulary and list of approved durable medical goods and supplies. Creates the Pharmaceutical and Durable Medical Goods Committee to negotiate the prices of pharmaceuticals and durable medical goods with suppliers or manufacturers on an open bid competitive basis. Sets forth provisions concerning patients' rights. Provides that the employees of the Program shall be compensated in accordance with the current pay scale for State employees and as deemed professionally appropriate by the General Assembly. Will Guzzardi State Bill Page: HB108 HB122 INS-FEEDING-SUPPLEMENTS (FLOWERS M) Amends the Illinois Insurance Code to provide that accident and health insurance policies and managed care plans must provide coverage for intravenous feeding, prescription nutritional supplements, and hospital patient assessments. Makes corresponding changes in the State Employees Group Insurance Act of 1971, Counties Code, Illinois Municipal Code, School Code, Health Maintenance Organization Act, Voluntary Health Services Plans Act, and Illinois Public Aid Code. Amends the Emergency Medical Treatment Act to provide that every hospital licensed under the Hospital Licensing Act shall comply with the Hospital Emergency Service Act. Amends the Hospital Emergency Service Act in a provision concerning the Department of Public Health's rules regarding hospital emergency services. Repeals the provision concerning long-term acute care hospitals. Amends the Health Carrier External Review Act. Sets forth provisions concerning standard information for application forms; medical underwriting; the requirement to send to the applicant a copy of the health care service plan contract along with a notice; rescission and cancellation; postcontract investigation; and continuation. Makes changes in the provision concerning standard external review. Amends the Medical Patient Rights Act. Provides that each patient has a right to be informed of his or her inpatient or outpatient status. Amends the State Mandates Act to require implementation without reimbursement by the State. Removes a provision requiring the Department of Healthcare and Family Services to impose limitations on prescriptions drugs such that the Department shall not provide reimbursement for more than 4 prescriptions, including 3 brand name prescriptions, for distinct drugs in a 30-day period, unless prior approval is received for all prescriptions in excess of the 4prescription limit; and removes certain exemptions to the 4-prescription limit. Provides that any label of fresh, frozen, or processed fish or shellfish, wild or farm raised, offered for sale at wholesale or retail shall clearly identify (1) the species of fish or shellfish by its common name, (2) whether the fish or shellfish was farm raised or wild caught, and (3) whether the fish or shellfish was caught domestically or imported. Provides that a retail food facility that sells or offers for sale any fresh, frozen, or processed fish or shellfish, wild or farm raised, may not knowingly misidentify or misbrand (1) the country of origin of the fish or shellfish or (2) whether the fish or shellfish was farm raised or wild caught. Sets forth provisions concerning misbranding and the presumption of knowledge. Provides that electors may petition for a referendum at the next general election to dissolve a non-home rule unit of local government. Sets forth the requirements for the petition, together with the form and requirements for the ballot referendum. Provides for the transfer of all real and personal property, and any other assets, together with all personnel, contractual obligations, and liabilities of the dissolving unit of local government to the receiving unit of local government. Amends the Election Code to provide exceptions for the Local Government Dissolution Act. Effective immediately. Provides that the Department shall adopt any rules necessary to implement this provision. Provides that drugs in the following therapeutic classes shall not be subject to prior approval as a result of the 4prescription limit: immunosuppressant drugs, oncolytic drugs, anti-retroviral drugs, "antipsychotic drugs, and, on or after July 1, 2015, anti-depressant and anti-anxiety drugs" (rather than immunosuppressant drugs, oncolytic drugs, anti-retroviral drugs, and, on or after July 1, 2014, antipsychotic drugs). Removes references to a written collaborative agreement and anesthesia plan throughout the Act. Repeals certain Sections of the Act and a Section of the Podiatric Medical Practice Act of 1987 concerning written collaborative agreements. Amends various other Acts to make related changes. Sets forth provisions concerning qualifications, grounds for disciplinary action, and administrative procedures. Amends the Regulatory Sunset Act to set a repeal date for the new Act of January 1, 2026. Also amends the Medical Practice Act of 1987, the Nurse Practice Act, and the Illinois Public Aid Code to make related changes. Effective immediately. Provides that an eligible patient with a terminal illness who has considered all other treatment options approved by the United States Food and Drug Administration may acquire from a manufacturer an investigational drug, biological product, or device that has successfully completed Phase I of a clinical trial, but has not been approved for general use by the United States Food and Drug Administration. Provides that a manufacturer may, but is not required to, provide an investigational drug, biological product, or device to an eligible patient, either with or without receiving compensation. Provides that an accident and health insurer may, but is not required to, provide coverage for an eligible patient seeking such a drug, product, or device. Contains a penalty provision. Defines required terms. Contains legislative findings. Amends the Medical Practice Act of 1987. Provides that the Department of Financial and Professional Regulation may not revoke, suspend, place on probation, reprimand, refuse to issue or renew, or take any other disciplinary or nondisciplinary action against the license or permit of a physician to practice medicine based solely on the physician's recommendation to an eligible patient regarding, or prescription for, or treatment with an investigational drug, biological product, or device. Current Status: 2/4/2015 - Referred to House Rules State Bill Page: HB1335 HB1344 MEDICAID-DEMONSTRATION PROJECT (HARRIS G) Amends the Illinois Public Aid Code. Prohibits the State from accepting any special terms and conditions for federal approval of any Medicaid research and demonstration project waiver proposal submitted to the U.S. Department of Health and Human Services on June 4, 2014. Requires the State to immediately withdraw all pending Section 1115 research and demonstration project waiver proposals submitted on or after June 4, 2014. Provides that the State shall not submit to the U.S. Department of Health and Human Services any Section 1115 demonstration project waiver proposal without first receiving specific statutory authority detailing the parameters of the proposal prior to its submission for federal approval. Requires that all premises of a permitted food establishment, including indoor play areas, be kept clean, fully operative, and in good repair. Sets forth specific requirements for an owner or operator of a permitted food establishment with an indoor play area. Sets forth mandatory procedures for when vomiting or fecal accidents occur in or around an indoor play area. Sets forth provisions concerning signage. Creates an income tax checkoff for the Mental Health Income Tax Checkoff Fund. Amends the State Finance Act to create the Fund. Provides that moneys in the Fund may be used by the Department of Public Health for the purpose of making grants to providers of mental health services in the State. Effective immediately. Requires the Department of Healthcare and Family Services to create a 3-year Diabetes Prevention Pilot Program to establish an evidence-based diabetes prevention program in St. Clair County, DeKalb County, and Rock Island County from funds appropriated for that purpose. Provides that the Department shall designate a single community-based, not-for-profit provider of healthy living services to manage and administer the pilot program; and that the designated provider shall receive reimbursement under the medical assistance program for the diabetes prevention programs established under the pilot program. Provides that any individual seeking a food service sanitation manager certificate or a food service sanitation manager instructor certificate must receive a passing score on the examination set by the certification exam provider accredited under standards developed and adopted by the Conference for Food Protection or its successor organization (rather than a score of at least 75% on the examination). Authorizes the Department of Public Health to adopt rules to implement the requirement. Provides that every individual born between the years of 1945 and 1965 who receives health services from a hospital as an inpatient or in the emergency department of a hospital or who receives primary care services in an outpatient department of a hospital or who receives health services from a health care practitioner providing primary care shall be offered a hepatitis C-related test, unless the health care practitioner providing the services reasonably believes that certain conditions are present. Althoff Report Position: Support State Bill Page: SB661 SB734 GENETICALLY ENGINEERED FOOD (KOEHLER D) Creates the Genetically Engineered Food Labeling Act. Provides that beginning on the effective date of the Act, any food offered for retail sale in this State is misbranded if it is entirely or partially produced with genetic engineering and that fact is not disclosed in a certain manner. Provides that the Act shall not be construed to require either the listing or identification of any ingredient or ingredients that were genetically engineered, nor that the term "genetically engineered" be placed immediately preceding any common name or primary product descriptor of a food. Provides that until the effective date of the Act, any processed food that would be subject to the provision concerning the labeling of genetically engineered foods solely because it includes one or more materials produced by genetic engineering is not misbranded provided that the engineered materials in the aggregate do not account for more than a certain amount of the total weight of the processed food. Sets forth provisions concerning applicability and the right of action for violations, damages, and attorneys' fees. Provides that the Department of Public Health shall adopt rules necessary to implement the Act. Defines terms. Contains a severability provision. Effective January 1, 2017. Collins Report Position: Support State Bill Page: SB734 SB748 DENTAL RESPONDER-DEFINITION (BARICKMAN J) Amends the Illinois Dental Practice Act. Changes the term "dental emergency responder" to "dental responder". Changes the definition of the term to mean a dentist or dental hygienist who is appropriately certified in disaster preparedness, immunizations, and dental humanitarian medical response consistent with the Society of Disaster Medicine and Public Health and training certified by the National Incident Management System or the National Disaster Life Support Foundation (rather than a dentist or dental hygienist who is appropriately certified in emergency medical response, as defined by the Department of Public Health). Makes corresponding changes in the provisions concerning dental emergency responders. Provides that a dentist who administers vaccinations as provided in the Illinois Dental Practice Act at a public health clinic operated pursuant to the Public Health District Act, without charge to the patient or the receipt of a fee or compensation from that clinic, shall not be liable for civil damages as a result of his or her acts or omissions in providing vaccinations, except for willful or wanton misconduct. Makes a corresponding change. Current Status: 2/3/2015 - Referred to Senate Assignments State Bill Page: SB751 SB788 MEDICAID-MANAGED CARE (STEANS H) Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to develop and implement an algorithm that is based on quality scores and other operational proficiency criteria developed, defined, and adopted by the Department, by rule, to automatically assign Medicaid enrollees served under the Family Health Plan and the Integrated Care Program and those Medicaid enrollees eligible for medical assistance pursuant to the Patient Protection and Affordable Care Act into managed care entities, including Accountable Care Entities, Care Coordination Entities, Children with Special Needs Care Coordination Entities, Managed Care Community Networks, and Managed Care Organizations. Provides that the algorithm developed and implemented shall favor assignment into managed care entities with the highest quality scores and levels of compliance with the operational proficiency criteria established. Current Status: 2/5/2015 - Referred to Senate Assignments State Bill Page: SB788 SB815 MEDICAID-INCOME VERIFICATION (RIGHTER D) Amends the Illinois Public Aid Code. In a provision concerning the Department of Healthcare and Family Services' proposed Medicaid integrated eligibility system, provides that until the system is operational the Department shall (rather than may) enter into a contract with the vendor selected as necessary to obtain certain electronic data matching. Provides that no later than 70 days (rather than 60 days) after the effective date of the amendatory Act, the Chief Procurement Officer for General Services, in consultation with the Department of Healthcare and Family Services, shall conduct and complete any procurement necessary to procure a vendor to verify eligibility for assistance under the Code.
