“J`AIME LA TOUR EIFFEL” GAME RULES SECTION 1

“J’AIME LA TOUR EIFFEL” GAME RULES
SECTION 1 – PRESENTATION OF THE ORGANISING COMPANY
The Eiffel Tower’s operating company (S.E.T.E), hereafter referred to as “The Organising Company”,
SAEML with a company capital of 1 million Euros, registered in the Register of Commerce and Trade
of Paris number B 482 622 529, with its company headquarters at 1, quai de Grenelle - 75015 – Paris,
FRANCE, is organising a free game with no obligation to purchase (hereafter referred to as “the
Game”).
The Game is entitled “I love the Eiffel Tower” and is accessible on internet.
SECTION 2 - Conditions for participation
The Game, with no obligation to purchase, is accessible:
- on the Eiffel Tower website - both its French and English versions:
"http://www.tour-eiffel.fr " and "http://www.eiffel-tower.com"
- on the official Eiffel Tower Facebook page: "http://www.facebook.com/TourEiffel "
Facebook is neither the organiser nor the sponsor of this operation. The personal data
collected is for the organising company’s use, not that of Facebook.
The game is open to any natural person who has access to internet and who has an email address on
the start date of the Game, residing in any location, except for:
-
-
-
persons residing in Italy
staff members of S.E.T.E, staff members of the companies offering services or temporary
employment engaged by S.E.T.E, corporate shareholders and subsidiary companies of S.E.T.E
who have participated directly or indirectly in the development of the Game, as well as
members of their families (having the same last name and same postal address)
staff members of the UNITEAM company, a communication agency, who has participated
directly or indirectly in the development of the Game, as well as members of their families
(having the same last name and same postal address)
staff members of the Ludilex company (Rule-Legal.net) and Officers of the Court who are
depositories of these rules, as well as their families.
as well as any other person who has participated directly or indirectly in the development of
the Game.
In addition, in order for their entry to be valid, the participant is required to respect the conditions
cited below:
- only one entry per household is allowed (same last name and same postal address);
- it is forbidden for the same person to enter the Game several times using different email
addresses;
- it is strictly forbidden to play on behalf of another person.
The Organising Company reserves the right to carry out all the necessary checks regarding the
identity and address of participants. Any incorrect or fraudulent information will lead to withdrawal
of the entry.
Breach of any of the rules of participation enumerated above will lead to the participant’s entry
being withdrawn.
For the participation of minors, it is presumed that agreement has been obtained from their legal
guardian. The Organising Company reserves the right to request written proof of this at any time,
particularly during allocation of the prizes. In the event that proof cannot be provided, the minor’s
disqualification will be pronounced.
Participation in the Game implies acceptance, without reserve, of these Rules in their entirety (the
“Rules”), ethical rules in force on internet, as well as the laws, Regulations (especially tax-related) as
well as other legal texts applicable to Games in France.
Non-respect of conditions of participation listed in these Rules will lead to participation being
rendered null and void.
The Organising Company will not, under any circumstances, be under any obligation whatsoever in
the event of participation by a person residing in a country other than mainland France.
Any attempt to enter via any means other than those indicated below will not be considered valid
entries.
SECTION 3 - DURATION
The Game will start on 7 September (at 12h00), and run until 31 October 2011 (at 23h59), based on
Paris time, with the server date binding.
The Organising Company reserves the right to postpone, change, cancel or renew the Game should
circumstances require this. In any event, it will not be held liable in this regard.
SECTION 4 – OPERATION OF THE GAME
The principle of the game is simple, and identical on Facebook and on the Eiffel Tower website: the
Participant is invited to declare themselves a fan of the monument in order to make the Eiffel Tower
grow. The more "likers" of the Eiffel Tower there are (entered in the game), the taller the monument
will grow (a sliding graphical scale will represent the Eiffel Tower’s size).
The Game will be played in four stages:
1) In order to play, the Participant must first:
choose a country of participation
enter their email address
accept the game’s terms and conditions.
2) The Participant is then invited to pull a stick attached to an Eiffel Tower snow globe.
3) An animation is played which increases the size of the Eiffel Tower
4) At the end of the animation, the Participant sees immediately whether they have won one of
the prizes or not.
There are no particular actions or criteria affecting the result: this is a random game based on the
"instant winner" principle described below.
4.1 Instant winners
When the Participant has shaken up their Eiffel Tower, the instant winner functionality is activated
and the Participant knows immediately whether they have won a prize or not.
Instant winners will be predetermined by the Organising Company based on random computer
generation which operates with strict respect for randomness and which guarantees equal treatment
of all Participants.
The choice of country at the start of the Game in no way influences the instant winner result; the
same goes for the number of participants in the Game: this is an entirely random game.
To claim their prize, the Participant who has won an instant winner prize needs to register by means
of a registration form that appears at the end of the animation, entering their full details (last name,
first name, address, postal code, town, country and telephone number).
The Participant may then print out their winning voucher. They will also receive a copy of it, sent to
the email address entered at the start of the game.
4.2 Number of entries
The Participant may try their luck by playing:
on the Eiffel Tower website
on the official Eiffel Tower Facebook page
A Participant who has already played on at least one of the two places and who has lost, has two
additional chances:
one chance if they share the Game on Facebook
one chance if they share the Game on Twitter.
Each Participant therefore has, in total, four chances of winning one of the game prizes.
A completed chance is no longer actionable, and a Participant who has already won a prize may no
longer participate, even if all of their chances have not yet been used up.
SECTION 5 – Prize money
The prizes that can be won in a random manner during the Game starting on 7 September and
running until 31 October 2011 inclusive, are as follows:
•
3 (three) "VIP Passes" to the unitary value of 233.80 Euros incl. tax (two hundred and thirty
three Euros and eighty cents inclusive of all taxes) each, or a total value of 701.40 Euros incl.
tax (seven hundred and one Euros and forty cents inclusive of all taxes).
Each "VIP Pass" includes the following benefits, to be used on the same day, until 30
December 2011:
o 2 free "quick pass" entries valid until 30 December 2011, permitting a visit to the
Eiffel Tower up to the top
o A dinner at the 58 Tour Eiffel restaurant for 2 people
o A guided "behind-the-scenes" tour of the Eiffel Tower for 2 people
The VIP Passes may not be used on 25 December 2011.
•
500 (five hundred) pairs of free entries, or 1,000 (a thousand) entries offered, each to the
value of 13.40 Euros incl. tax (thirteen Euros and forty cents inclusive of all taxes ), or a total
value of 13,400 Euros incl. tax (thirteen thousand, four hundred Euros inclusive of all taxes).
These entries, to visit the monument up to the top, are valid until 30 December 2011.
Transport and accommodation costs as well as any other additional costs are to the Participant’s
account.
The exhaustive list of winners will not be published on internet, nor anywhere else: the Participants
are informed immediately if they have won one of the prizes.
However, the Organising Company reserves the right to publish news on the Eiffel Tower website with the VIP winners’ consent - describing their day spent at the monument.
SECTION 6 – ALLOCATION OF PRIZES
The Participant is informed immediately if they have won one of the prizes: a screen appears at the
end of the Game animation indicating whether the Participant has won and, if so, the nature of the
prize won (free entries or VIP Passes).
Once the confirmation form has been completed by the Participant:
- The Participant may print the "gift voucher" directly, which they need to exchange in terms
of the terms and conditions described on the voucher, and presented below.
- The Participant will receive an email from the Organising Company bearing the "gift voucher"
which will be sent to the email address entered for participation.
The terms for collection will differ depending on whether the internet user has won a pair of free
entries or VIP Passes:
-
-
Free entries
The Participant needs to go to the "presales information counter" situated at the western
column of the Eiffel Tower with their printed gift voucher in order to collect their two
invitations.
The Participant may not enjoy their prize on the same day they won it (a 48-hour delay is
required, to provide enough time for the Eiffel Tower’s presales information counter to be
informed).
Both tickets are to be used on the same day.
VIP Passes
The winner needs to book their behind-the-scenes tour and dinner at the 58 Tour Eiffel
through the Cultival company : Marie at 01 70 39 14 64 / [email protected]
The VIP Passes may not be used on: 25 December 2011.
All services included in the VIP PASS (visit + dinner at Eiffel Tower 58) are to be used the
same day.
The prizes offered may not, under any circumstances, be resold by the Participant, subject to legal
proceedings.
The prizes may, under no circumstances whatsoever, be exchanged at the Participant’s request for
other prizes, cash, or for other goods or services. The Organising Company does however reserve the
right to replace one of the prizes offered with a prize of equivalent or higher value, in particular, in
the case of circumstances rendering delivery of the envisaged prizes impossible within a reasonable
time delay.
If a Participant is unable to enjoy their prize, they may transfer it by transferring their gift voucher to
the person of their choice. The VIP Passes may also be transferred to persons of their choice on
condition that the name of the new VIP PASS holders is provided during the telephonic booking of
the PASS prize.
The value indicated for the prize(s) is the posted price including tax currently in force or reckoned on
the date of writing the rules; it is provided as a simple indication and is likely to change.
The Organising Company reserves the right to ask the Winner to prove their identity and to prove
conformity with these Rules.
The Organising Company reserves the right to refuse to exchange the gift voucher in the event that
the winner has not respected the collection processes implemented and defined on the winning
coupon.
The Organising Company will not be held liable in the case of identity theft.
SECTION 7 – LODGING AND CONSULTATION OF THE RULES
The full set of Rules is lodged at the offices of SELARL PETEY –GUERIN – BOURGEAC, associated
Officers of the Court, 221 rue du faubourg Saint Honoré 75008 Paris.

Any change in the Rules will require them to be relodged at the offices of SELARL PETEY – GUERIN –
BOURGEAC, associate Officers of the Court, 221 rue du faubourg Saint Honoré 75008 Paris; they will
enter into force from the time they are placed online and all Participants will be deemed to have
accepted them through the simple act of their participation in the Game, from the date that the
change entered into force. Any Participant who rejects the change or changes made will be required
to stop participating in the Game.
SECTION 8 – REIMBURSEMENT
Costs for participation in the Game will be reimbursed, limited to one connection per Participant;
reimbursement is limited to 1 entry per household (same last name and/or same postal address
and/or same mobile telephone number), with costs based on 3 (three) minutes of a local call, or 0.11
Euros incl. tax (eleven Euro cents inclusive of all taxes), per participation, on condition that S.E.T.E

request received by S.E.T.E before 31 November 2011.
Reimbursement will take place following a simple written request, accompanied by a copy of the
invoice detailing the connections concerned, clearly highlighted, sent to the following address:
S.E.T.E – "J’aime la tour Eiffel" Game, 1, quai de Grenelle - 75015 – Paris, together with proof (a copy
of the invoice serving as proof, with the connection dates and times clearly highlighted), on
condition that S.E.T.E verifies the effective participation of the person submitting the request.
The Organising Company has implemented the technical means necessary to prove the participation
or non-participation of an internet user. It is therefore agreed that, except in the event of any
apparent error, the data contained in the Organising Company’s information systems may serve as
probative evidence concerning elements relating to connection and to information resulting from
computer-related processing relating to the game.
The reimbursement request must be sent via post, strictly before 31 November 2011 (postal stamp
serving as proof), and is required to indicate the email address registered during registration as well
as complete banking details or postal address.
Costs incurred by the Participant for the reimbursement request will be reimbursed following a
simple request (reimbursement for postage based on second class stamp in force - 20g). Costs
relating to photocopies of documents providing proof shall be reimbursed on the cost basis of 10
cents per page, following a simple request stipulated in the request for reimbursement of connection
costs.
SECTION 9 – LIMITATION OF LIABILITY
Participation in the Game implies knowledge and acceptance of the nature and limits of internet,
particularly concerning technical performance, response times to view, request or transfer
information, risks of an interrupted service, and in general the risks inherent to any connection and
transmission on internet, the absence of protection of certain data against possible hijacking and the
risk of contamination by possible viruses present on the network.
Consequently, under no circumstances will the Organising Company be held liable, including, but
without the list being limited to:
- the transmission and/or the reception of any data and/or information on internet;
-any malfunctioning of the internet network preventing the correct operation/functioning of the
game;
- the failure of any receiving equipment or lines of communication;
- the loss of any sent item – whether paper-based or electronic and, generally, the loss of any data;
- problems relating to transportation;
- the functioning of any software;
- the consequences of any virus, IT-related bug, anomaly, technical failure;
- any damage sustained by a Participant’s computer;
- any technical, equipment or software failure of any sort, that has prevented or limited the
possibility of participation in the game or that has damaged a Participant’s system.
It is stated that the Organising Company shall not be held liable for any direct or indirect damage
caused by any interruption or malfunctioning of any sort and for any reason whatsoever, or for any
direct or indirect damage that will result from this, in whatever manner, due to connection to the
site.
It is the responsibility of all Participants to take appropriate measures in order to protect their own
data and/or software stored on their computer-related equipment against any unauthorised access.
Any person connecting to the site as well as the participants’ participation in the game is done so
entirely at their own risk.
The Organising Company may cancel all or a portion of the game should it appear that fraud has
been committed in any form whatsoever, particularly IT-related within the context of participation in
the game or the determining of winners. In this eventuality, it reserves the right not to allocate the
prizes to the fraudsters and/or to institute legal proceedings against the persons responsible for
committing the fraud, before the competent courts.
SECTION 10 – NOMINATIVE DATA
In application of law no. 78-17 of 6 January 1978 relative to information technology, computer files
and freedom of information, Participants who enter the Game possess rights of opposition (sect. 26),
access (sects. 34 to 38), correction and deletion (sect. 36) of their personal data. These rights may be
exercised by sending written notification to the Organising Company, at the following address:
Société d’Exploitation de la Tour Eiffel, Direction des Clientèles, 5, avenue Anatole France – Champ
de Mars – 75007 Paris, together with proof of identity.
Nominative data registered compulsorily within the context of this Game is necessary for
acknowledgment of participation in the Game and for the allocation of prizes; it will only be used by
the Organising Company, or, if the need arises, its partner and solely for the allocation of prizes and
within the exclusive context of the Game and advertising relating to the Game.
SECTION 11 – AGREEMENT AS TO PROOF
It is agreed that, except in the event of any apparent error, the Organising Company could cite, in
particular for the purposes of providing proof for any action, deed or omission, programmes, data,
computer files, registrations, operations and other elements (such as progress or other reports) of a
nature or in computer or electronic formats and forms that have been established, received or kept
directly or indirectly by the Organising Company, particularly by its information systems with due
respect for the law of 6 January 1978 relative to information technology, computer files and freedom
of information.
Participants undertake not to oppose the admissibility, validity or probative force of elements of a
nature or in computer or electronic formats cited above, on the basis of any legal provision
whatsoever and which specify that certain documents must be written or signed by the parties in
order to provide proof.
Thus, the elements considered constitute proof and, if they are produced as a means of proof by the
Organising Company in any contentious proceedings or other, they will be admissible, valid and
opposable between the parties in the same manner, under the same conditions and with the same
probative force as any document that would be established, received or kept in writing.
SECTION 11 – APPLICABLE LAW AND INTERPRETATION
The Rules are governed exclusively by French law.
Any question regarding the application or interpretation of the rules, or any unforeseen question
that arises, will be settled without appeal, depending on the nature of the question, by the
Organising Company, with respect for French legislation.
