The following is a compilation of those comments, updated as necessary: Water Supply Proof This Department has reviewed the water supply documents submitted with this application. In our opinion the applicant has demonstrated a legal right to a water supply for the proposed development as required by the Jefferson County Zoning Resolution Section 1.I.3.a.(20). In this case the applicant proposes to use well 188676 as the water supply for in-house use in the manager’s on-site residence located at 5937 South Brook Forest Road and in 5 short term and/or long term lodging units located at 5947, 5957, 5967, 5977 and 5979 South Brook Forest Road. Together the 6 units are known as the Bauer’s Spruce Island Chalets. In addition to use for the 6 units at Bauer’s Spruce Island Chalet, the applicant intends to reserve the right to use well 188676 for use on the property located at 5987 South Brook Forest Road. The Colorado Division of Water Resources Field Inspection Form indicated the “use of well” is service to the Harrison house and 6 seasonal daily and weekly rental units and no outside use of the water. We note that 5987 S. Brook Forest Road is one of the addresses listed in the Field Inspection Form. Condition four of the existing well permit 188676 limits water use to 1-acre foot per year. Condition five of the existing well permit 188676 includes maintaining the totalizing flow meter in good working order, keeping permanent records of water use and providing these records to the local water commissioner. The applicant has provided a recent photograph of the totalizing flow meter. If we assume that the meter was installed in 1995, is in good working order and the current meter reading is 3,089,400 gallons, the average water use is estimated to be 181,729 gallons per year or 0.558 acre feet per year. Although the applicant is not required to submit water quality data for this rezoning proposal we recommend that the applicant submit water quality test results for the 40 parameters listed in the Land Development Regulation 21.A.4.1.a. This Department will then compare those results to the maximum contaminant levels recommended for human health and welfare and will provide treatment options for any parameters that exceed the maximum contaminant levels. Please note that if the well serving the rental units and the single family dwelling will serve as a drinking water supply for 25 people or more per day for more than 60 days per year then the water supply would meet the definition of a non-community drinking water supply as stipulated in the Colorado Primary Drinking Water Regulations. The water supply would then require a Colorado Department of Public Health and Environment (CDPHE) approved water treatment system, water quality monitoring, and a state licensed water treatment plant operator. If this well will be used in this manner, please contact the Water Quality Control Division, CDPHE at 303.692.3500 for application and monitoring requirements. This Department would inspect such a drinking water supply for compliance once in operation. Wastewater This Department has no records of individual sewage disposal systems servicing the property known as the Bauer’s Spruce Island Chalets (5979, 5977, 5967, 5957, or 5947 S. Brook Forest Road) or the single family residence located at 5937 S. Brook Forest Road. The applicant must have a registered professional soils engineer evaluate what types of sewage disposal systems are servicing all of the cabin rental units and the single family dwelling. This report must include an As-Built drawing of each individual sewage disposal system that documents the estimated capacity of each system, the size of each septic tank, and the size of each absorption bed. This report must be submitted to this Department for review and will replace the requirement of the Wastewater Collection Report as specified in the Jefferson County Zoning Resolution Section 1.l.3.a. (23). Contact Craig Sanders at 303.271.5759 for information on this process. This Department's Regulations apply to all Individual Sewage Disposal Systems. Absorption systems with a maximum design flow of 3000 gallons per day or more, or average daily flow of 2000 gallons per day or more must also comply with the Colorado Water Control Act, Article 8, Title 25 of the Colorado Revised Statutes, and Regulations adopted by the Colorado Water Quality Control Commission. A site approval from the Colorado Department of Public Health and Environment would then be required. It appears on the Bauer’s Spruce Island Chalets ODP that the absorption beds of two of the individual sewage disposal systems are partially installed in the lawn area and in the 100 year flood plain. Please note that all individual sewage disposal system components must not be compacted or watered. If these absorption fields are located in the lawn area, they should be fenced off to avoid compaction and they should not be watered. If the septic tanks are located in the flood plain area, these tanks would need to be anchored. Contact Craig Sanders at 303.271.5759 for more information. 3 Environmental Questionnaire This Department has reviewed the Environmental Questionnaire and Disclosure Statement. The applicant checked "No" on all categories of environmental concern on the cover sheet. From this information it does not appear that any environmental factors exist which would negatively impact the property. Regulated Facilities Certain commercial uses, such as, the serving of food, may be subject to plan reviews and routine inspections by this Department, or referred to State agencies. Any food catered to guests must have an approved retail food service establishment license to serve food. Please contact Leslie Frank, Plan Review Coordinator (303.271.5776) for specific requirements. "Retail food establishment" means a retail operation that stores, prepares, or packages food for human consumption or serves or otherwise provides food for human consumption to consumers directly or indirectly through a delivery service, whether such food is consumed on or off the premises or whether there is a charge for such food. Colorado Revised Statutes 25-4-1602(14). The applicant must specify the type of services that will be provided in the 2 car garageshop. The applicant should have a plan in place to address how fluid leakage from vehicles or equipment will be handled. Any waste materials generated from repair operations must be properly contained and stored on the site prior to transporting to an approved recycling or disposal facility. On site disposal of any such materials is prohibited. Noise The Colorado Revised Statutes (Sections 25-12-101 through 108) stipulate that maximum residential noise levels must comply with the following 25 feet from the property line: • 55dB(A) between 7:00 a.m. and 7:00 p.m. • 50dB(A) at all other times. The Colorado Revised Statutes (Sections 25-12-101 through 108) stipulate that commercial areas must comply with the following maximum noise levels 25 feet from the property lines: • 60dB(A) from 7:00 a.m. to 7:00 p.m. • 55dB(A) at all other times.
