CONSIDERATIONS
Considerations:The Commissioner of Police (or his delegate) will consider the following when making a determination to release a vehicle
early:
•
public safety if vehicle is released early;
•
the seriousness of the alleged offending;
•
history of alleged offending (that is, both motor vehicle history and alleged offender history);
•
likelihood the motor vehicle would be used in the commission of further offences;
•
medical grounds (for example, the motor vehicle is essential for transport on medical grounds);
•
business circumstances (for example, the motor vehicle is essential to the income generation of a business entity);
•
employment or loss of income (for example, the financial impact on other persons, family);
•
any other reasonable grounds including but not limited to:
Ø accessibility to public transport;
Ø number of person’s dependent upon the motor vehicle;
Ø isolation from essential services;
Ø significant impact on a person regarding their education;
Ø employment or unemployment;
Ø involvement in community events and services;
Ø involvement in recreational activities;
Ø involvement with approved clubs that are affiliated with approved associations, and
Ø family care situations, including care of dependants.

nature of any impact on another person not directly involved in the alleged offending; and
•
any other relevant consideration.
