Official Rules
Rules must be accepted to enter contest.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR
CHANCE OF WINNING.
GAME PERIOD:
Fazoli’s Pick 2 Name Game (the “Game”) begins at 10 AM Eastern Time (“ET”) on 2/7/17 and
ends at 11:59 PM ET on 3/19/17 (the “Game Period”).
SPONSOR:
Fazoli’s System Management, LLC, 2470 Palumbo Drive, Lexington, KY 40509.
GAME ADMINISTRATOR:
Wyng, 360 Park Avenue South, 20th Floor, New York, NY 10010
ELIGIBILITY:
The Game is open to legal residents of the 50 United States and the District of Columbia, who
are at least twenty-one (21) years of age. The Game shall only be construed and evaluated
according to U.S. law. Do not enter this Game if you are not physically located in and a legal
resident of the 50 United States or the District of Columbia. Employees of Fazoli’s (the
“Sponsor”) or Wyng (the “Administrator”), and their affiliates, subsidiaries, distributors,
suppliers, and the immediate families (parent, child, sibling and spouse of each) and household
members of each such employee are not eligible. Void where prohibited or restricted by law or
regulation.
AGREEMENT TO THE OFFICIAL RULES:
By participating, each Entrant fully and unconditionally agrees to and accepts these Official
Rules, and you represent and warrant that you meet the eligibility requirements set forth
herein. In addition, you agree to accept the decisions of the Sponsor and the Administrator
which are final and binding in all matters related to the Game. The Game is subject to all
applicable federal, state and local laws and regulations.
HOW TO ENTER:
To enter the Game: Enter the Fazoli’s Pick 2 Name Game by completing the online contest and
entry form. You (the “Entrant”) must submit your Entry by visiting
http://bit.ly/Pick2NameGame or hand print your selected menu item names, in addition to your
name, street address, day and evening phone numbers, email address and date of birth on a 3”
x 5” piece of paper along with a self-addressed stamped envelope and mail it with proper
postage to “Fazoli’s® Pick 2 Name Game,” c/o Fazoli’s System Management, LLC, 2470 Palumbo
Drive, Department: Marketing, Lexington, KY 40509, to submit your entry. Mail-in submissions
must be received by March 19, 2017, otherwise they will not be honored. Limit: 1 submission
per envelope. All submissions become the exclusive property of Sponsor and none will be
acknowledged or returned. Proof of sending or submission will not be deemed to be proof of
receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible,
illegible, misdirected or postage-due requests, which will be disqualified. At the end of the
Game Period, Sponsor will randomly select one (1) winner (“Winner”) to receive (2) Airline
Ticket Vouchers, (1) $250 Visa Gift Card and (1) $100 Fazoli’s Gift Card (ARV $1000).
GAME WINNER SELECTION:
One Entrant will be selected in a random drawing to occur on or about 3/20/17 from among all
eligible entries received. The Game drawing will be conducted by Sponsor from all eligible
entries received during the Game Period. Odds of winning a prize depend on the total number
of eligible entries received during the Game Period. Potential winners may be required to sign a
Winner’s Agreement, Waiver and Release and return it by date specified or prize will be
forfeited in its entirety and another potential winner may be selected. Prize will be sent by mail.
Game Winner will be contacted by the Sponsor by telephone or email. Winner will receive Prize
Package, which includes:
GRAND PRIZE: Two (2) Airline Ticket Vouchers, One (1) $250 Visa Gift Card and One (1) $100
Fazoli’s Gift Card. Value: ARV $1,000.00
An Entrant is not a winner of any prize, even if the Game should so indicate, unless and until
Sponsor has received all required documents within the time-frame requested, Entrant’s
eligibility and compliance with these Official Rules has been verified, and Entrant has been
notified that verification is complete.
GENERAL PRIZE CONDITIONS:
Any difference between ARV stated herein and actual value of the prize will not be awarded. All
expenses not specifically stated herein are the sole responsibility of Winner. Prize is
nonrefundable, nontransferable and not assignable. Sponsor reserves the right to substitute
the prize for one of equal or greater value for any reason. Odds of winning prize depend on the
total number of eligible entries received during the Game Period. No cash or other substitution
may be made. Except where prohibited by law, acceptance of prize constitutes permission for
Sponsor to use the Game Winner's name, hometown, likeness, statements (where applicable)
and other identifiable information for promotional advertising and marketing purposes in any
media throughout the world without additional prize, incentive, consideration, consent or
review; and upon request, Winner will provide written consent to such use. All potential prize
winners are subject to verification of eligibility and compliance with these Official Rules.
Federal, state and local taxes are the sole responsibility of the Winner. The winner of any prize
with an ARV of $600 or more will be issued a 1099 Tax Form for the total value of the prize in
the calendar year that he/she won the prize and will be required to provide Sponsor with
his/her social security number. In the event a potential prize winner is considered a minor in
his/her jurisdiction of residence, the prize and all components thereof will be awarded in the
name of the potential winner’s parent or legal guardian. By accepting a prize, such
parent/guardian further agrees to all obligations (including, but not limited to, tax liability) and
undertakings of Winner, both on behalf of himself/herself and Winner. Limit one (1) prize per
person/family/household/address. All prizes are awarded as is. Sponsor makes no
representations or warranties with regard to any prize (excluding only Sponsor’s products).
ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE
DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE
GAME AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED
RELEASE:
By participating and/or receipt of any prize, Entrants and Winner, their parents/legal guardians
if residents of a jurisdiction that deems them to be minors, heirs and assigns (a) agree to
indemnify, release and hold harmless Sponsor, its affiliated and related entities, its and their
respective members, directors, officers, agents and employees from any and all liability for any
claims, costs, injuries, losses or damages of any kind, including, but not limited to death, caused
by or related to their participation in this Game or as the winner of any prize, and (b)
acknowledge that said parties have neither made nor are in any manner responsible or liable
for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative
to a prize including, but not limited to the prize quality or availability with the Game prize.
Neither Sponsor, its affiliated or related entities, its and their members, directors, officers or
employees, nor any service providers are responsible for incorrect or inaccurate transcription of
Entry information, or for any human or other error, technical malfunctions, lost/delayed data or
voice transmission, omission, interruption, deletion, defect, line failures of any telephone
network, computer equipment, software, inability to access any online service or Website or to
complete a telephone call or facsimile transaction, or any other error or malfunction, or late,
lost or misdirected mail, or any injury or damage to participant’s or any other person’s
computer related to or resulting from participation in this Game. Any Entry (Contest or Game)
will be void if altered, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate,
incomplete, interrupted, late, non-deliverable, tampered with, unauthorized or unintelligible.
CAUTION: ANY ATTEMPT BY AN ENTRATNT OR ANY OTHER INDIVIDUAL TO DELIBERATELY
TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION
OF THE GAME MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN
ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF
ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED
BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a
waiver of that provision. If for any reason the Game is not capable of being executed as
planned, or tampering, unauthorized intervention, fraud, action of entrants, or any other
causes which in the opinion of and/or Sponsor, corrupt or affect the administration, security,
fairness integrity, or proper conduct of this Game, Sponsor reserves the right at its sole
discretion to disqualify any suspect Entry or Entrant and to cancel, terminate, modify or
suspend the Game. In the event of any cancellation, termination or suspension, determination
of the Game Winner will be made, from among all eligible, non-suspect Entries received as of
the date of the termination, cancellation or suspension, as Sponsor determines in its sole
discretion.
DISPUTES:
Entrants agree that (a) any and all disputes, claims and cause of action arising out of, or
connected with, the Game or prize awarded shall be resolved individually, without resort to any
form of action, including, but not limited to, class action; (b) any and all claims, judgments and
awards shall be limited to actual out-of-pocket costs incurred, including costs associated with
entering this Game but in no event attorneys’ fees; and (c) under no circumstances will entrant
be permitted to obtain awards for, and entrant hereby waives all rights to, claim punitive,
incidental and consequential damages multiplied or otherwise increased. SOME JURISDICTIONS
DO NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR
CONSEQUENTIAL DAMAGES SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions
concerning the construction, validity, interpretation and enforceability of these Official Rules,
entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with
the Game, shall be governed by, and construed in accordance with, the laws of the
Commonwealth of Kentucky, without giving effect to any choice of law or conflict of law rules
(whether of the Commonwealth of Kentucky or any other jurisdiction), which would cause the
application of the laws of any jurisdiction other than Commonwealth of Kentucky.

Game” to [email protected]. Requests must be received by 4/30/17.
