Authorization and Eligibility Requirements
ELIGIBLE APPLICANT DOCUMENTATION
1. Is the applicant a local agency as defined in Appendix B of the Guidelines?
Yes. The City of Nevada City is incorporated under the auspices of the State of
California.
2. What is the statutory authority or other legal authority under which the applicant was
formed and is authorized to cooperate?
Nevada City was incorporated consistent with applicable California law in 1851, when it
became the county seat of Nevada County.
3. Does the applicant have legal authority to enter into a grant agreement with the State of
California?
Yes.
4. Describe any legal agreements among partner agencies and/or organizations that ensure
performance of the Proposal and tracking of funds.
Utilizing materials prepared by other IRWMPs (RWA, North Coast, and Upper Feather),
CABY has developed a preliminary set of contract materials. These contracts would
serve to formalize the relationship between the project applicant and each of the project
sponsors. Counsel is reviewing these agreements and CABY expects to have a final
contract form developed by the end of March 2011.
CONSISTENCY WITH ADOPTED IRWMP
The CABY IRWMP was drafted as a living document to be continuously reviewed and revised
by its members over time. The IRWMP’s project identification and development process was
specifically designed to be dynamic, to allow for progressive refinement and expansion. As
stated in IRWMP section 10.2, Ongoing Project Evolution, “projects are being refined, updated,
created, merged, and revisited on a quarterly basis.”
Process for Inclusion in the CABY IRWMP
In order to ensure that the Plan remains a dynamic, durable, and relevant document, and that
new projects are included in a formal manner, the CABY RWMG developed a strategy that uses
appendices as a tool to update the IRWMP’s project and program information.
Appendix I provided CABY with a way to formally update IRWMP Chapter 10, Project
Implementation. It was adopted at the June 3, 2009 Planning Committee (PC) meeting, with an
updated version adopted at the October 7, 2009 PC meeting (see attached approval agenda and
meeting minutes). Through the Appendix I development and adoption, 35 new projects were
submitted by members, vetted by the CABY RWMG and stakeholders, reviewed and scored by
CABY staff and the Coordinating Committee using the CABY scoring criteria, and formally
adopted into the Plan. All of the projects included in this proposal were adopted for inclusion in
the IRWMP as part of Appendix I.
CABY announced a call for projects in the late fall of 2008 and received Step 1 applications from
more than two-dozen members by February 2009. The Step 1 application process enables project
sponsors to propose conceptual projects, partially developed projects, and ready-to-proceed
projects for inclusion in the IRWMP. The application requires project sponsors to provide basic
project information, and is literally the first step for sponsors in submitting projects to CABY,
both for inclusion in the IRWMP and submittal to funding sources. Once the Step 1 applications
have been received, they are reviewed by staff and integrated into Appendix I for subsequent
review and adoption by the PC.
Projects in this Proposal
As stated above, conceptual projects can be submitted as Step 1 applications and as CABY often
acts as an “incubator,” providing technical assistance to project sponsors, an intensive project
development period (referred to as Round 1, as project development activities are ongoing)
follows the adoption of Appendix I. In April 2009, the PC adopted a high-priority focus for this
intensive project development—water conservation and drought relief. The projects included in
this proposal were the focus of this intensive project development.

Each of the projects has been reviewed, adopted, and chosen for this Prop 84 IRWMP
Implementation Grant proposal by the CABY PC. The vetting, adoption, and approval process
is detailed below and corresponding meeting agendas and minutes are attached as
documentation.

The vetting, approval, and adoption process described above included an analysis of each
project’s consistency with the CABY IRWMP’s guiding principles, management strategies,
goals, and objectives.
The CABY RWMG determined that all of the projects are consistent with one of five IRWMP
guiding principles: “Reliably meet the long-term water needs of the watershed's residents, local
industry, agriculture, and natural resources.”
Each project’s overall consistency with the IRWMP’s management strategies, goals, and
objectives is illustrated in Table 1-2, while consistency with specific goals and objectives is
illustrated is Table 1-3.
