MERTHYR TYDFIL COUNTY BOROUGH COUNCIL Civic Centre, Castle Street, Merthyr Tydfil, CF47 8AN Main Tel: 01685 725000 www.merthyr.gov.uk LICENSING REPORT Date Written Report Author Exempt/Non Exempt Committee Date 31st July 2014 Amy Gould Non Exempt 27th August 2014 To: Chairman, Ladies and Gentlemen APPLICATION TO REVIEW A PREMISES LICENCE – MERTHYR GRILL HOUSE, 83 HIGH STREET, MERTHYR TYDFIL, CF47 8UG PURPOSE OF THE REPORT: To advise Councillors of an application to review a premises licence 1.0 INTRODUCTION AND BACKGROUND 1.1 An application to review a Premises Licence has been received from South Wales Police under the Licensing Act 2003 in respect of the above named premises. 1.2 The application to review the Premises Licence relates to the following licensing objectives: 1) The prevention of crime & disorder 2) Public safety Please see appendix for the full review application. 1.3 The Premises Licence for Merthyr Grill House has been held by Mr Camiran Merza since 5th February 2013 and is currently licensed for the following activities/hours: Late Night Refreshment Monday & Tuesday – 11.00 p.m. to Midnight Wednesday & Thursday – 11.00 p.m. to 1.30 a.m. Friday & Saturday – 11.00 p.m. 2.30 a.m. Sunday – 11.00 p.m. to 1.30 a.m. Opening Hours Monday & Tuesday – 11.00 a.m. to Midnight Wednesday & Thursday – 11.00 a.m. to 1.30 a.m. Friday & Saturday – 11.00 a.m. 2.30 a.m. Sunday – 11.00 a.m. to 1.30 a.m. 1.4 In accordance with procedure South Wales Fire Service, the Local Health Board and the Council’s Public Health, Trading Standards, Planning, Children’s Safeguarding Unit and Licensing were consulted on the application. An advertisement was placed at the Council Offices and notices were displayed at the premises and on the Council website in respect of the application. 2.0 REPRESENTATIONS Responsible Authorities 2.1 A letter of representation was received Child Protection (see appendix). 2.2 An email of representation was received from the Planning Division (see appendix). Interested Parties 2.3 No representations were received. 3.0 MEDIATION 3.1 The Licensing Act 2003 provides for mediation where representations are made by responsible authorities and interested parties. At the time of writing this report mediation has not taken place. 4.0 FINANCIAL IMPLICATION(S) 4.1 There are no financial implications 5.0 EQUALITY IMPACT ASSESSMENT 5.1 It has been identified that an Equality Impact Assessment (EqlA) is not required for the purpose of this report. 6.0 6.1 RECOMMENDATION(S) that In determining the application, Councillors must have regard to the four licensing objectives on which the Licensing Act 2003 is based. These are: • • • • The prevention of crime and disorder Ensuring public safety Prevention of public nuisance, and The protection of children from harm Councillors must have consideration to the representations and take such steps it considers appropriate for the promotion of the licensing objectives. The steps are: (i) (ii) (iii) (iv) (v) To modify the conditions of the licence. To exclude a licensable activity from the scope of the licence. To remove the designated Premises Supervisor. To suspend the licence for a period not exceeding three months. To revoke the licence.
