Hamsar’s Limited Product Warranty: The following warranty is exclusive and in lieu of all other warranties, whether expressed, implied or statutory with respect to or relating to any product shipped hereunder (the "Product"), including, but not limited to any warranty of merchantability or fitness for any particular purpose. Hamsar Diversco
Inc. warrants that the Product is, at the time of shipment to the Purchaser, free of material and workmanship defects provided that there shall be no warranty with respect to
any Product which has been repaired or altered in any way, which has been subject to negligence, accident, improper storage or damaged in shipment without the fault of
Hamsar Diversco Inc. or has not been installed, used or maintained in accordance with normal practice and in conformity with the recommendations or the published specifications of Hamsar Diversco Inc. Hamsar Diversco Inc. shall, at its option, repair or replace any defective Product or refund the purchase price of a Product provided a warranty claim is made within one (1) year of the date of shipment of the Product and this shall be the full extent of Hamsar Diversco Inc.'s liability for breach of warranty.
