CONDITIONS OF SERVICE – Monthly Paid Employees
Full details of your particular Terms and Conditions of Employment will be provided in a
written Statement of Particulars should you be successful.
Sheffield City Council has recently completed a Review of Pay and Terms and Conditions.
The outcomes of the review will be implemented on 1 April 2010 and you will receive a
further statement of particulars at that time. If the information provided below will change as
a result of the review, this is indicated**.
SALARY


Paid monthly in 12 equal instalments by credit transfer to your bank or building society
account on 30th or last banking day prior to the 30th, each calendar month
Incremental progression is annual up to the maximum of the scale for the post
PROBATIONARY PERIOD

Employees joining local government service are subject to a minimum 6 months
probationary period of employment
HOLIDAYS



Basic entitlement 24 days increasing to 29 days after five years continuous local
government service
8 Public Holidays plus 1 floating day. The floating day may be set by the Directorate
Job Share and part-time employees receive pro-rate entitlement
SICKNESS/INJURY ALLOWANCE

Entitlement rises from 1 month’s full pay during the first year of service to 6 months full
pay and 6 months half pay after five years service
NOTICE PERIOD


The minimum notice you are entitled to receive is:
Seven days if you have worked for less than one month
One month if you have worked for over one month then one week for each complete
year of service rising to a maximum of twelve weeks after twelve years service
The minimum notice you are obliged to give is:
One to three months depending on the grade of the post
** with effect from 1April 2010 the minimum notice you are entitled to receive is 4 weeks if
you have worked for less than 4 years, and then one additional week for each complete
year of service rising to a maximum of twelve weeks after twelve years service
HOURS OF WORK

37 per week in total
Flexible working operates in most areas
MATERNITY LEAVE/PAY

52 weeks leave including 13 weeks full pay and 13 weeks half pay if you have over one
year’s continuous local government service.

If you have less than one year’s continuous local government service, you are entitled to
52 weeks leave including 6 weeks at the higher rate of Statutory maternity pay, i.e.
90% of average earnings and 33 weeks at the lower rate – SMP, if you have less than
one year’s continuous local government service. Statutory Maternity Pay, if you qualify,
will be paid, otherwise Maternity Allowance may be payable from the Benefits Agency.
PATERNITY LEAVE

10 days paid leave (pro rata if part-time)
ADOPTION LEAVE/PAY

13 weeks full pay and 13 weeks half pay if you have over one years continuous Local
Government Service and up to 52 weeks leave

52 weeks leave if you have less than one year’s continuous Local Government Service
SUPERANNUATION

You will automatically be entered into the Local Government Pension Scheme
irrespective of hours worked. You may however choose to opt out of the Scheme
The percentage of your pay that you contribute towards your pension depends on your full
time equivalent (FTE) pay. There are 7 pay bands, each with a different pension
contribution rate.

REMOVAL EXPENSES

If you have moved home to take up your new appointment with the City Council you may
be entitled to removal expenses. Your existing home must normally be more than 20
miles from your new base and your new home must be within the City boundary to
qualify for reimbursement.

Here are some hints and tips on how to put a good application together:
Every vacancy we advertise will have as a minimum a Job Description, a Person
Specification and a Health Declaration Form which will tell you all the details about the post.
You should read all these documents before you begin to complete your application form.
We aim to treat every individual applicant for each post as fairly as we can and our selection
decisions are based solely on the information you give us in your application form
We genuinely welcome applications from people from all kinds of backgrounds, so you
should use all your life experiences when filling in your application form. You can write
about voluntary work you have done, educational experiences, training schemes,
experiences gained through your personal interests, domestic life as well as any jobs that
you have done. We only ask that you focus what you write so that you convince us that you
do have the skills we are looking for, no matter where you acquired them.
The Job Description/Person Specification
The job description will give you the duties and responsibilities involved in the role, whilst
the person specification shows the essential skills, knowledge and experience we are
looking for.
Having read both documents you should be ready to show us how you meet each
requirement. You should give examples to back up each statement. These examples can be
from your current or previous work, voluntary work or personal life.
Try not to just say “I’ve got good communication skills and good teamwork skills, so I can do
the job”. Where did you gain your skills? How do you put them to use? How often?
As well as telling us what you have done, you can also tell us something about your views.
For example: If we ask for good customer care skills, as well as telling us when and where
you have provided customer service, you can also tell us something about what you
personally mean by “good” customer service.

Health Information Sheet
Each post has a Health Information Sheet. This sheet gives information on the challenges
and demands of each post, which will allow you to decide whether you have any current, or
past health related problems that may affect your health and safety, or the health and safety
of others.
If invited for interview, you will be sent a Health Declaration Form to sign. The information
you put on this form will only be looked at if we decide to offer you a post. If you sign to say
you have/had a health problem we may ask you to meet with an Occupational Health Nurse.
This gives us an opportunity to discuss any issues, which may affect the way you do the job
before we make an offer.
At the end of your interview you’ll be asked if you need any aids, adaptations or other
requirements to help you to do the job. This information does not form part of the
assessment process and will only be considered if we are thinking of making you an offer of
employment. The information you give us at this stage of the selection process allows us to
explore ways in which the job could be altered to accommodate your needs. This could
include changes to the job duties, equipment provided and even adjustments to
location/premises.

Guidance for Disclosure Applicants
You have been asked to complete the attached form to enable the Council to obtain
information regarding your suitability for a post you have just been interviewed for. The
following information should answer any questions you may have regarding the process.
1.0
WHAT IS A DISCLOSURE?
1.1
A Disclosure is a document containing information held by the police and government
departments. It can be used by employers and voluntary organisations to make safer
recruitment decisions. Disclosures are provided by the Criminal Records Bureau
(CRB, an executive agency of the Home Office.
1.2
The Disclosure service offers organisations a means to check the background of job
applicants to ensure that they do not have a history that would make them suitable
for posts they are trying to fill. Disclosures will provide details of a person’s criminal
record including convictions, cautions, reprimands and warnings held on the Police
National Computer (PNC). If the position involves working with children, Disclosures
will also contain details from lists held by the Department of Health (DH) and the
Department for Education and Skills (DfES) of those considered unsuitable for this
type of work. Depending upon the level of Disclosure, it might also contain
information held by local police forces.
1.3
We may request one of the following levels of disclosure.
A
Standard Disclosures
1.4
These are primarily for posts that involve working with children or vulnerable adults.
Standard Disclosures may also be issued for people entering certain professions
such as members of the legal and accountancy professions.
1.5
The Standard Disclosure contains details of all convictions held on the Police
National Computer including current and ‘spent’ convictions as well as details of any
cautions, reprimands of final warnings.
1.6
If a position involves working with children, the Disclosure will indicate whether
information is held on government department lists, held by the DfES and the DH, of
those who are banned from working with children. The Disclosure also includes
information held by the DH of those considered unsuitable to work with vulnerable
adults.
B
Enhanced Disclosures
1.7
These are for posts involving a far greater degree of contact with children or
vulnerable adults. In general the type of work will involve regularly caring for,
supervising, training or being in sole charge of such people. Examples include a
teacher, scout or guide leader. Enhanced Disclosures are also issued for certain
statutory purposes such as gaming and lottery licences.
1.8
This level of Disclosure involves an additional level of check to those carried out for
the Standard Disclosure. An Enhanced Disclosure includes a check on local police
records. Where local police records contain additional information that might be
relevant to the post the applicant is being considered for, the Chief Officer of police
may release information for inclusion in an Enhanced Disclosure. Exceptionally, and
in a very small number of circumstances (typically to protect the integrity of current
police investigations), additional information may be sent under separate cover to the
Countersignatory and should not be revealed to you.
2.0
WHY HAVE I BEEN ASKED TO APPLY FOR A DISCLOSURE?
2.1
You may have been asked for a Standard or an Enhanced Disclosure because you
will be working with children or vulnerable adults; or will be working in an
establishment that is wholly or mainly for children; or will be working in healthcare; or
have applied to be a foster carer, adoptive parent of childminder. There are also a
number of other specified positions and professions for which a Disclosure can be

3.0
CAN I REFUSE TO APPLY FOR A DISCLOSURE?
3.1
Yes. However, there are some posts for which a Disclosure is required by law. If
you refuse to apply for a Disclosure in this instance, the Council would be within its
rights not to take your job application any further.
3.2
If you are currently employed and the organisation you are working for asks you to
apply for a Disclosure, then you can refuse although a number of considerations
must be taken into account.
4.0
WHAT IF I ALREADY HAVE A DISCLOSURE?
4.1
If you already have a Disclosure and would like to use it, please let us know, we can
then decide whether to accept it. When making this decision we will take into
account the length of time that has elapsed since that Disclosure was issued; the
level of Disclosure; the nature of the position for which the Disclosure was issued;
and the nature of the position for which you are now applying.
5.0
WHAT IF I HAVE LIVED OVERSEAS?
5.1
If you’ve lived overseas for a substantial period of time, it may not be worth applying
for a Disclosure, and the CRB does not generally have access to overseas criminal
records. We can, however, advise you on how to obtain equivalent information from
the overseas authorities, where available. You should discuss this further with the
Council.
5.2
However, the Council has a statutory duty to check a prospective employee against
one or both of the lists held by the DH (those individuals considered unsuitable to
work with children) and the DfES (those considered unsuitable to work in the
teaching profession). Therefore, if you are a foreign national (with either a limited or
no prior period of residence in the UK) and your application is for a post covered by
this statutory duty to check the lists, you will be required to apply for either a
Standard or Enhanced Disclosure. Applying for these higher-level Disclosures is the
only way to check individuals against the lists held by the DH and DfES.
5.3
If, as a foreign national, you have also lived in the UK for a substantial period of time,
a Disclosure may be required, in addition to any overseas information your
prospective employer deems necessary.
6.0
HOW WILL I KNOW WHICH LEVEL OF DISCLOSURE IS REQUIRED?
6.1
The Council will decide the appropriate level of Disclosure for the position and
communicate this to you.
7.0
HOW DO I APPLY FOR A DISCLOSURE?
7.1
By completing the enclosed application form. Once you have completed the
application form please forward it to the Council Officer who asked you to apply for a
Disclosure, together with any original identify documents that are requested.
8.0
WHAT INFORMATION DO I NEED TO GIVE?
8.1
You will be asked for your full name and any other name that you may have been
known by; addresses where you have lived during the past five years; your date and
place of birth; your national insurance number; and other information such as
passport/driving licence details. This is not a complete list, as the questions asked
will depend upon the answers you provide. The information requested is to ensure
the applicant has given their true identity and current address.
8.2
The CRB is committed to compliance with the Data Protection Act. This means that
any personal information that you submit to us will be protected. For full details,
please telephone the CRB information line on 870 90 90811 and request a copy of
our data protection leaflet.
9.
WHO WILL RECEIVE MY DISCLOSURE?
9.1
You will receive your Disclosure in the post. A copy of the Disclosure will also be
sent to the Council officer who countersigned the Disclosure application form. This
officer has been registered with the CRB and, as such, has agreed to comply with the
Code of Practice.
10.
WHEN WILL I RECEIVE MY DISCLOSURE?
10.1
You should receive your Standard Disclosure within one week, or your Enhanced
Disclosure within three weeks, of the completed application form being posted to the
CRB. There will be a dedicated phone line for disputes.
11.0
HOW DO I KNOW THAT THE INFORMATION CONTAINED ON MY DISCLOSURE
WILL BE KEPT CONFIDENTIAL?
11.1
Organisations using the Disclosure service must comply with the CRB Code of
Practice, which is there to make sure the while process works fairly.
11.2
Under the provisions of the Code, sensitive personal information must be handled
and stored appropriately and must be kept for only as long as it is necessary. The
Code of Practice is published on the CRB website, or you can request a copy from
the person who asked you to apply for the Disclosure.
12.0
WHAT IF I HAVE A CRIMINAL RECORD THAT MAY NOT BE RELEVANT TO THE
POSITION FOR WHICH I AM APPLYING?
12.1
Safeguards and guidelines have been introduced to ensure that conviction
information is not misused and that ex-offenders are not treated unfairly. Exoffenders will retain the protection afforded by the Rehabilitation of Offenders Act
1974. The Code of Practice for Registered persons and other recipients of
Disclosure information will govern Registered Bodies’ conduct and prevent abuse of
the system.
12.2
The CRB is working with a number of organisations, such as the Chartered Institute
of Personnel and Development (CIPD) and the National Association for the Care and
Resettlement of Offenders (NACRO), who have produced guidance information for
employers on this matter. Information can be obtained from the CRB website.
13.0
CAN I CHALLENGE THE INFORMATION ON MY DISCLOSURE IF IT IS
INCORRECT?
13.1
If you think that any information contained on your Disclosure is incorrect, please
contact the Disclosure dispute line on 0870 90 90 778 immediately and ask about the
dispute procedures.
14.0
FOR HOW LONG WILL DISCLOSURES BE VALID?
14.1
Each Disclosure will show the date on which it was printed, therefore the older the
Disclosure the less reliable it is. However, there will be no expiry date.

POLICY STATEMENT ON THE RECRUITMENT
OF EX-OFFENDERS
1. As an organisation using the Criminal Records Bureau (CRB) Disclosure service to
assess applicants’ suitability for positions of trust, Sheffield City Council complies fully
with the CRB Code of Practice and undertakes to treat all applicants for positions fairly.
It undertakes not to discriminate unfairly against any subject of a Disclosure on the basis
of conviction or other information revealed.
2. Sheffield City Council is committed to the fair treatment of its staff, potential staff or users
of its services, regardless of race, gender, religion, sexual orientation, responsibilities for
dependants, age, physical/mental disability or offending background.
3. We have written a policy on the recruitment of ex-offenders, which is made available to
all individuals who are required to complete a Criminal Records Bureau disclosure.
4. We actively promote equality of opportunity for all with the right mix of talent, skills and
potential and welcome applications from a wide range of candidates, including those with
criminal records. We select all candidates for interview based on their skills,
qualifications and experience.
5. A Disclosure is only requested after a thorough risk assessment has indicated that one is
both proportionate and relevant to the position concerned. Appendix 1 contains an
indicative list of posts subject to disclosure. This list is not exhaustive and may be
amended from time to time. For those positions where a Disclosure is required, all
application forms, job adverts and recruitment briefs will contain a statement that a
Disclosure will be requested in the event of the individual being offered the position.
6. Where a Disclosure is to form part of the recruitment process, we encourage all
applicants called for interview to provide details of their criminal record at an early stage
in the application process. We request that this information is sent under separate,
confidential cover, to a designated person within the Council and we guarantee that this
information is only seen by those who need to see it as part of the recruitment process.
7. We will ensure that those Officers involved in the recruitment process will be suitably
informed as to how to identify and assess the relevance and circumstances of Officers.
8. Unless the nature of the position allows the Council to ask questions about your entire
criminal record, we only ask about “unspent” convictions as defined in the Rehabilitation
of Offenders Act 1974.
9. At interview, or in a separate discussion, we ensure that an open and measured
discussion takes place on the subject of any offences or other matter that might be
relevant to the position. Failure to reveal information that is directly relevant to the
position, could lead to withdrawal of an offer of employment.
10. We make every subject of a CRB Disclosure aware of the existence of the CRB Code of
Practice and make a copy available on request.
11. We undertake to discuss any matter revealed in a Disclosure with the person seeking
the position before withdrawing a conditional offer of employment.
12. Having a criminal record will not necessarily bar you from working with us. This
will depend on the nature of the position and the circumstances and background of your
offences.

UNSPENT CRIMINAL CONVICTIONS
1.0
REHABILITATION OF OFFENDERS ACT (ROA) 1974
1.1
The Rehabilitation of Offenders Act (ROA) 1974 sets out to help people who have
been convicted of a criminal offence and who have since lived on the right side of the
law. In general, a person convicted of a criminal offence and who receives a
sentence of no more than two and a half years in prison, benefits from the Act if they
are not convicted again during a specified period. This period is called the
rehabilitation period.
1.2
In general terms, the more severe a penalty is, the longer the rehabilitation period.
Once a rehabilitation period has expired and no further offending has taken place, a
conviction is considered to be ‘spent’. Once a conviction has been spent, the
convicted person does not have to reveal or admit its existence in most
circumstances, including, for example, when applying for a job. In most
circumstances, an employer cannot refuse to employ someone, or dismiss them, on
the basis of a spent conviction.
2.0
WHAT IS AN ‘UNSPENT’ CONVICTION?
2.1
If you’ve ever been convicted of an offence for which a sentence of more than 2
and a half years was imposed (regardless of the amount of time you actually spent
in prison) this conviction can never become ‘spent’: it’s an ‘unspent’ conviction which
you must disclose when asked about your criminal convictions (such as when
applying for a job).
3.0
IS THIS THE ONLY TIME A CONVICTION IS ‘UNSPENT’?
No. If you were given a sentence of two and a half years or less, your conviction may
still be unspent. Whether or not depends on the length of time that’s elapsed since
the date of your conviction. This time is called the rehabilitation period – and it
differs according to the type of sentence passed.
4.0
SO, WHAT IS THE REHABILITATION PERIOD FOR MY SENTENCE?
4.1
The following tables show the range of rehabilitation periods for different sentences
imposed. Until such time has passed from the date of your conviction, your
conviction will remain ‘unspent’ and you will have to declare it to a potential employer.
If this is the case, you should enter a cross in the YES box on the Disclosure
application form at Section H, line 66. If your conviction is spent, you may cross the
NO box.

4.2
Except an absolute discharge, all of the periods above are halved if the person
convicted was under 18 at the time. If you were under 18 and received a probation
order on or after 3 February 1995, the rehabilitation period is two and a half years or
until the order expires – which ever is longer.
4.3
In the past, there were sentences that could be imposed only on young people.
The rehabilitation periods for sentences like this are as follows:

4.4

In Scotland, supervision requirements made by Children’s Hearings have the
same rehabilitation periods as care or supervision orders.
5.0
WHAT ABOUT PEOPLE IN THE ARMED SERVICES?
Rehabilitation periods for imprisonment in the Services are the same as in civilian
life. For specific Service offences, the periods are as follows:

6.0
WHAT IF I’VE BEEN CONVICTED AGAIN AFTER THE ORIGINAL OFFENCE?
6.1
It depends. Later convictions only affect the rehabilitation periods of earlier
convictions if they are imposed before the first conviction is completely ‘spent’.
6.2
If it is one of the less serious offences, which can be tried only in a magistrates’ court
(some more serious offences can be tried both by a Crown Court and by magistrates)
the first conviction becomes spent at the time originally fixed. The rehabilitation
period for the second offence will then run for its normal length.
6.3
But if the later conviction is for an offence which could be tried in a Crown Court (for
example, stealing) then neither conviction will become spent until the rehabilitation
periods for both offences are over.
6.4
If, however, the second conviction is so serious that it incurs a prison sentence of
more than two and a half years, then neither the second nor the first conviction will
ever become spent.
