SUBSTANTIVE DUE PROCESS
• Those rights that are so fundamental that
government can not regulate or interfere with them
• What is fundamental has changed over time by the courts
• Congress makes laws and the courts interpret law
cases
DOCTRINE OF INCORPORATION
• Supreme Court looking to make certain states are
not infringing on those substantive due process
rights
• State constitutions are to ensure fulfillment of rights - take
action when not
LESSON 19 – EQUAL PROTECTION
• Equal protection of the law
• Equality of opportunity
• Equality of condition
• Equality in life – personal possessions, living standards, ect
