Official Rules - Build.com $1,000 Favorites List Sweepstakes
To Enter:
Enter the Build.com Favorites List Sweepstakes ("Sweepstakes") at the Build.com by following the entry form instructions on the website. Only one entry per household.
All required information must be provided for the entry to be considered accurate and complete.
Entry into the Sweepstakes will be accepted beginning at 12:00 a.m. PST on August 1, 2015 and end at 11:59 p.m. PST on August 31 31, 2015 (“Sweepstakes Period”). No
purchase necessary to enter. A purchase does not increase your chances to win. All entries become the exclusive property of Build.com, Inc. (“Build.com”) and will not be
returned. You understand that by submitting an entry you are: (1) accepting the terms of these Official Rules and agreeing to be bound by them; and (2) you are opting-in to
receive e-mail from Build.com. All e-mail related to the Sweepstakes will contain opt-out instructions. Entry is limited to one entry per household during the Sweepstakes
Period.
Eligibility:
The Sweepstakes is open to legal residents of the United States and the District of Columbia. Entrant must be 18 years of age or older at the time of entry. Entrants must
have a current email account to enter. The following persons are not eligible to enter the Sweepstakes: (a) employees of Build.com or its affiliates, subsidiaries or vendors;
and (b) any employees of Build.com or its affiliates or subsidiaries or vendors; and (c) immediate family members and persons living in the same household as the persons
identified in (b) and (c) above. Void where prohibited or restricted by law.
Grand Prize:
One Grand Prize winner will receive $1,000 worth of products from their Favorites List created at Build.com and supplied by Build.com. If Entrant’s Favorites List is
valued at less than $1,000, Entrant will receive products valued at any amount up to $1,000. Cash will not be awarded to make up any difference in value. Approximate
Prize Retail Value: $1,000. Prize is non-transferable and no substitution or exchange will be made except as provided herein at the Sponsor’s sole discretion. Sponsor
reserves the right to substitute any product for one of equal or greater value if the designated prize should become unavailable for any reason. Prize will not be exchanged
for cash. Odds of winning the prize depend on the number of eligible entries received during the Promotion Period. ALL FEDERAL, STATE AND LOCAL TAXES
THAT MAY APPLY FROM THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNER. IF FOR ANY REASON THE LUCKY WINNER IS
UNABLE TO ACCEPT THE PRIZE, THE PRIZE WILL BE AWARDED TO THE FIRST RUNNER UP.
Winner Notification:
The prize winner will be selected by a random drawing from all Favorites Lists received during the Sweepstakes Period by a panel of judges employed by Build.com.
Voting will take place on or about February 5, 2015. Odds of winning will depend upon the number of eligible entries received. The winner will be notified on or about
February 5, 2015 by email. Failure to comply with any rule, regulation or limitation will result in the forfeiture of the prize, in whole or in part. There will only be one
winner.
The winner will receive a copy of an Affidavit of Eligibility and Publicity Release (“Affidavit and Release”). Within ten (10) days of receipt of the Affidavit and Release,
the winner shall be required to sign, notarize and return the Affidavit and Release. The winner must provide their full legal name, mailing address (do NOT use a PO Box)
and social security number or federal ID tax number in the Affidavit and Release. Failure to sign and return the Affidavit and Release within the time requested may result
in forfeiture of the prize. No responsibility is assumed for lost, stolen, late or misdirected mail. The Affidavit and Release is null and void if incomplete, illegible or
erroneous.
Winner List:
Winner will be posted on the Build.com website.
General Conditions:
The Sweepstakes will be governed, construed and interpreted under the laws of the United States. By entering the Sweepstakes, participants agree to be bound by these
Official Rules and the decisions of Build.com on all matters relating to the Sweepstakes. Entrants consent to the use of their names, addresses, likeness, voice, entry photos
and any statements they make in connection with the Sweepstakes or about Build.com in general, without additional compensation unless prohibited by law. Entrants and
winners also consent to being contacted by Build.com or a third party with whom either company has a relationship regarding one or more of either company’s products or
services.
Limitations of Liability:
By entering the Sweepstakes, Entrant agrees to release Build.com and its respective affiliates, parents and subsidiaries, and their respective employees, agents, and
representatives (collectively, "Sponsor Entities"), and from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to person or
property that may be sustained in connection with entering the Sweepstakes or the receipt, ownership, or use of a prize or with participation in this Sweepstakes, including
malfunctions of electronic equipment, computer hardware, software, malfunctions of the entrant's email provider, incorrect email addresses, lost, late, incomplete, or
misdirected Entries. If for any reason (including tampering, unauthorized intervention, fraud, or any other cause that corrupts or affects the administration, security,
fairness, integrity, or proper conduct of this Sweepstakes), the Sweepstakes is not capable of being conducted as described in these Official Rules, Build.com shall have the
right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes.
Build.com reserves the right to disqualify any individual it finds has tampered with the entry process or the operation of the Sweepstakes, or who has acted in violation of
these Official Rules or any applicable state, federal, or local laws or regulations, or is acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse,
threaten, or harass any other person. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR
UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN
ATTEMPT BE MADE, SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO PROSECUTE SUCH PERSON AND/OR SEEK DAMAGES FROM ANY SUCH
PERSON TO THE FULL EXTENT PERMITTED BY LAW.
Opt-Out: Entrants may opt-out by emailing Build.com at [email protected] with the message “Please remove my name from the list of Entrants.”
Disputes:
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded
shall be resolved individually, without resort to any form of class action.
