Capacity Audit Standards
Standard one
The person’s name, date of birth and address and/or other identifier e.g.
NHS number must be recorded.
Standard two
The assessor’s name and job title is recorded.
Standard three
The date/s of assessment and date of when the report was written is
recorded.
Standard four
The decision is documented and if more than one decision is made this is
recorded.
Standard five
Reason the assessment has been requested and/or why the capacity has
been questioned.
Standard six
The nature of the impairment or disturbance in the functioning of their
mind or brain should be documented in the report.
Standard seven
The report has documented that consideration has been given to
whether or not the decision can be delayed.
Standard eight
The report documents the level of knowledge that the person must
meet to demonstrate capacity.
Standard nine
The report documents that the person understands the decision in
question.
Standard ten
The report documents the person’s ability to retain information long
enough to make a meaningful decision.

The report documents the person’s ability to weigh up relevant
information (this should include risks and benefits).
Standard twelve
The report provides a clear conclusion in term of the person’s ability to
communicate their decision.
Standard thirteen
The report documents how information was adapted to help the person
understand the information.
Standard fourteen
If an impairment in capacity is found the report makes reference to
whether this is permanent or whether it could be gained/regained.
Standard fifteen
The report presents a clear conclusion? i.e. capacity or lack of capacity.
Standard sixteen
The assessment provides recommendations (regardless of conclusion).
Standard seventeen
If a lack of capacity is found does the report make clear that the inability
to make the decision is BECAUSE of the impairment of the mind or brain.
