1. DEFINITIONS
In these Terms and Conditions:
“Applicant” means the person requesting the connection of their
Supply Address to the Distribution System whose details appear on
the front of this Form;
“Connection Charges” means the Red Connection Fee and/or the
Network Connection Charge;
“Distribution System” means the Victorian natural gas distribution
and transmission system which is used to supply natural gas to
consumers in Victoria;
“Network” means the company which owns and manages the part of
the Distribution System in the area in which the Supply Address is
located and who holds a gas distribution licence as required under
the Gas Industry Act 2001 (VIC);
“Network Connection Charge” means the charge imposed by the
Network for the connection of a Supply Address to the Distribution
System that is passed through (at cost) by Red to the Applicant;
“Form” means this form requesting the connection of natural gas to a
Supply Address;
“Gas Supply Agreement” means Red’s standard terms and
conditions on which Red agrees to supply and sell natural gas to
customers;
“Red” means Red Energy Pty Limited ABN 60107479372;
“Red Connection Fee” means the fee of $50.00 charged by Red for
requesting the connection of a Supply Address to the Distribution
System; and
“Supply Address” means the property at which the Applicant
requires natural gas to be connected.
2. GAS CONNECTION
2.1 Submission of the Form to Red
(1) The completion and submission of this Form to Red is
deemed acceptance of these Terms and Conditions by the
Applicant.
(2) Subject to clause 2.2, within 30 days of receipt of a
satisfactorily completed Form by Red, Red will request for
the connection of the Supply Address to the Distribution
System based on the information provided by the Applicant
on this Form.
2.2 Connection by the Network
(1) Red will notify the Applicant if a Network Connection
Charge is payable by the Applicant, prior to any work being
carried out by the Network and the Applicant must instruct
Red whether or not to proceed with the connection of the
Supply Address.
(2) If a Network Connection Charge is payable by the Applicant
and the Applicant has instructed Red to proceed with the
connection in accordance with clause 2.2(1), the Applicant
must pay Red the Network Connection Charge by no later
than 14 days following the receipt of a tax invoice provided
by Red to the Applicant, requesting payment of the Network
Connection Charge.
(3) Red will not, and is under no obligation to, arrange for the
Network to carry out the connection of the Supply Address
to the Distribution System unless and until the Applicant
pays any and all Network Connection Charges.
(4) Within a reasonable timeframe following the connection of
the Supply Address to the Distribution System, Red will
notify the Applicant that the Supply Address has been
connected.
2.3 Other Installation Requirements
(1) Following the receipt of notification from Red under clause
2.2(4), the Applicant must obtain and provide to Red a
plumbing certificate of completion (“Plumbing Certificate”),
which must specify that the relevant household appliances
are safe to operate on gas and comply with the relevant gas
safety requirements.
(2) Subject to clause 2.3(3), within 30 days of receipt of the
Plumbing Certificate, Red will arrange for:
(a) a gas meter to be installed at the Supply Address; and
(b) the gas meter to be unplugged in order to allow gas to
flow from the Distribution System to the Supply
Address.
(3) Red will not arrange for the installation of a gas meter unless
and until the Applicant has entered into a Gas Supply
Agreement with Red.

(1) Red will invoice the Applicant the Red Connection Fee on the
Applicant’s first energy bill provided by Red under a Gas Supply
Agreement (Energy Bill). The Applicant must pay the Red Connection
Fee in accordance with the payment terms on the Energy Bill.
4. TERMINATION
4.1 Termination by Red
Red may terminate the process of connecting the Supply Address to
the Distribution System, by notifying the Network and the Applicant, if
Red does not:
(1) receive instructions from the Applicant within 30 days of notifying
the Applicant of the Network Connection Charge that is payable,
in accordance with clause 2.2(1);
(2) receive payment of the Network Connection Charge in
accordance with clause 2.2(2); or
(3) receive a Plumbing Certificate in accordance with clause 2.3(1),
4.2 Termination by the Applicant
The Applicant may terminate the process of connecting the Supply
Address to the Distribution System at any time prior to the completion
of that connection, by notifying Red in writing.
4.3 Effect of Termination
If the process of connecting the Supply Address to the Distribution
System is terminated for any reason, the Applicant must pay Red any
and all outstanding Network Connection Charges incurred by the
Applicant as at the date of termination.
5. MISCELLANEOUS
5.1 APPLICANT ACKNOWLEDGEMENTS
The Applicant acknowledges and agrees that:
(1) the purpose of this Form is for persons to make a request for
Red to arrange the connection of the Supply Address to the
Distribution System;
(2) this Form does not constitute a Gas Supply Agreement or any
other form of agreement to supply gas, between the Applicant
and Red;
(3) the process of connecting the Supply Address to the
Distribution System is not physically carried out by Red as a
retailer and the process of gas connection involves many
factors outside the control of Red;
(4) the Network will carry out the connection of the Supply Address
to the Distribution System in accordance with the Network’s
processes and its standard terms and conditions; and
(5) Red may provide the Network with a copy of this Form for the
purposes of the Network undertaking the gas connection of the
Applicant’s Supply Address to the Distribution System.
5.2 No Liability of Red
Red will not in any way be liable to the Applicant for any loss, damage,
liabilities, claim or expense (including legal costs) incurred by the
Applicant arising directly or indirectly as a result of or in connection
with:
(1) the connection or disconnection of the Supply Address to the
Distribution System;
(2) the termination of the process of connecting the Supply Address
to the Distribution System;
(3) any Connection Charges; or
(4) the acts or omissions of the Network.
