Infrastructure agreement
Brisbane City Council levies infrastructure charges as part of the development
assessment process to fund trunk infrastructure in the transport, community purposes,
and waterways networks. These infrastructure charges apply when a subdivision
(reconfiguring a lot) or material change of use occurs because these activities generally
create additional demand on trunk infrastructure networks.
Council also levies infrastructure charges on behalf of Queensland Urban Utilities for
trunk infrastructure in the water supply and sewerage networks. For all enquires relating

The Sustainable Planning Act 2009 provides an alternative for a developer to pay
infrastructure charges to Council, whereby the developer may provide trunk infrastructure
works and/or land identified in Council’s Priority Infrastructure Plan (PIP) instead.
In many cases Council will manage this process through the issue of simple notices or
forms between the developer and Council. However in some cases, where the process is
more complicated (such as a multiple stage development) it may be appropriate for the
developer and Council to enter into an infrastructure agreement. Where the developer is
seeking a refund of infrastructure charges, Council’s Adopted Infrastructure Charge
Resolution (Resolution) requires the developer to enter into an infrastructure agreement.
An infrastructure agreement is a contractual arrangement between Council and a
developer to establish obligations and entitlements for each party, including a schedule of
infrastructure and the timing of payment of charges or provision of infrastructure. An
Infrastructure Agreement provides clarity and certainty to all parties and is a publicly
available document.
The time an infrastructure agreement takes to draft typically depends on the scope,
required negotiations and complexity of the agreement. A fee is applicable to the
preparation of an Infrastructure Agreement.
Requesting an infrastructure agreement
To request an infrastructure agreement the applicant must:
1. Lodge an Infrastructure Agreement Request Notice and attach the supporting
documentation as outlined in the form. Documentation must include:

Copies of all Infrastructure Offset Decision Notices, Infrastructure Set Off
Decision Notices and Infrastructure Refund Notices issued by Council

If requesting a refund, provide evidence that all aspects of the development
have been completed in accordance with an approved development
application and all outstanding financial infrastructure charges to Council
have been paid
2. Lodge the Infrastructure Agreement Request Notice with Council’s Infrastructure
Coordination section by emailing the Notice and supporting documentation to:
