Selling Live Plants
Potted plants, such as herbs, vegetable transplants, and seedlings can be sold at farmers
markets. Before bringing live plants to market, vendors must obtain the appropriate license.
• Any vendor engaged in growing live plants intended for sale is required to be licensed as
a plant grower. Under the same license a plant grower is also permitted to purchase and
resell plants.
• Any vendor engaged in purchasing and reselling live plants is required to be licensed as
a nursery dealer.
• Vendors are not required to obtain both a plant grower and nursery dealer certification.
• The license must be posted in public view when selling potted plants at the market.
• Licensing fees are $100 every two years per location.
• The application process and acceptance usually takes 4 days.
• Unlicensed vendors will be subject to a fine of $300 and the withholding of the plants.
• A valid New York State Sales Tax Certificate is also needed for the sale of plants on the
market.
