ACCOUNT # __________ Date Paid: ______________ MARBURY WATER SYSTEM WATER USER’S AGREEMENT For Cleaning & Inspection Purposes State of Alabama County of Autauga THIS AGREEMENT between the Marbury Water System, a public corporation, organized and existing under and by virtue of the laws of the State of Alabama, hereinafter called “the System”, and the undersigned water user, hereinafter call “the Water User”. WITNESS: That, whereas, the Water User desires to purchase water for domestic, commercial, agricultural, industrial and other uses from the System, an enter into a User’s Agreement as required by the by-laws of the System. NOW THEREFORE, In consideration of the mutual covenants, promise and agreements herein contained, it is hereby understood and agreed: 1. The System shall furnish, subject to the limitations as provided for in the by-laws and Service Rules and Regulations hereinafter provided for, such quantity of water as the Water User may desire in connection with his occupancy of property. 2. The Water User shall install and maintain at his own expense a service line, which shall begin at a point designated by the System at his property line, and extend to the dwelling and other portions of his premises. 3. The System shall purchase and install a curb stop valve, a water meter, a backflow preventer, and one meter box on all new services installed after June 22, 2004. It is strongly recommended that the Water User also have a pressure regulator and a hand shutoff valve installed at the meter. The pressure regulator and the cut-off valve on the Water User’s side of the meter will belong to the Water User and be the responsibility of the Water User. The System will not be responsible for any pressure problems on the Water User’s line or in the home as we are not required to install these appurtenances nor regulate the Water User’s pressure. The System is responsible for the pressure at the meter only. 4. The Water User’s service line shall connect with the distribution mains at the place designated and provided by the System. The System will determine in advance that it has sufficient capacity to permit delivery of water to that point. 5. The Water User shall pay for such water at rates, time and place, as shall be determined by the System. 6. The System shall make the final determination in any question of the location of any service line connection to distribution system and shall determine the allocation of water to Water Users in the event of a water shortage. 7. The System may shut off the water of a User who allows a connection or extension to be made to his service line for the purpose of supplying water to another user. 8. The failure of a Water User to pay water charges, duly imposed, shall result in the following penalties: a. b. c. Non-payment by the 15th of the month will result in a penalty of ten percent (10%) of the total balance due on the account. Non-payment by the 15th of the month on the second month from the billing will result in the water being shut off from the Water User’s property and a $100.00 delinquent service charge will be imposed for each occurrence. The entire balance plus the $100.00 delinquent service charge must be paid in its entirety before water service will be restored. In the event it becomes necessary for the System to shut off the water on the Water User’s property for the violations of this agreement or Service Rules and Regulations of the System, a fee will be charged for the reconnection of the service. The foregoing not withstanding, the System reserves the right to make or amend the By-laws or the Rules and Regulations of the System from time to time, and the Water User to abide by such changes upon notice thereof. This connection is being turned on at the request of the property owner, real estate agent or builder for cleaning or inspection, etc. The User understands that a one time non-refundable $35.00 fee will be collected upon connection of service. When water is turned off, a bill will be sent out for water used according to our rates stated in The Marbury Water System, Inc. Rules and Regulations. Even if there is no water used, there will still be a minimum $25.00 charge as stated in our rate schedule. If this bill is not paid within 30 days, the account will be forwarded to a collection agency and water may be refused for future service. I understand, at the time this form is signed, that I will receive a copy of the Water User’s Agreement and also a copy of the Marbury Water System Rules and Regulations.
