If you have found a suitable plot and made a decision to build on it, it is desirable to be
acquainted with a unified procedure for exercising the right to build and use the facilities.
Practice has shown that ignorance of the process of construction in most cases causes
complications that may lead to delays in carrying out construction works on your building and
probably to cost increases.
In accordance with the Law on planning and construction, the exchange of
documents and submissions within unified procedure is carried out electronically.

1. LOCATION INFORMATION
Location information is not an obligatory document in the procedure of issuing building permits. A
person requesting location information may neither be the owner of the plot, that is, the plot for which the
request is submitted, nor shall have any contract with the owner regarding use, ownership or any other right
on the plot.
Location information is a document of informative character that interested parties may obtain in
order to have access to the data on the possibilities and limitations of construction on the cadastre plot or
more cadastre plots.
Information about location is issued by the authority responsible for issuing location conditions
within eight days from the date of the submission of request, together with a fee of actual costs for issuing such
information.

2. LOCATION CONDITIONS
Location conditions are a public document that contains all the information about the possibilities and
limitations of building on land plot which meets the conditions for building plot and contains all the
conditions for the preparation of technical documents.
The deadline for issuing location conditions is 5 (five) working days from the date of obtaining all
the necessary conditions and other data from the holder of public authority.
Validity period: Location conditions are valid 12 months from the date of issuing, and if a building
permit or a decision on the approval of executing works is issued within 12 months, based on the
location conditions, then they are valid until their expiry.
Note: Location conditions can be issued to any interested natural or legal entity that made the
request, submitted the required documents and paid the required taxes and fees. The entity
should neither be the owner of the plot or plots for which the request is made, nor should it
have any kind of agreement with the plot owner related to the use, ownership or any other right
to the plot.

The request may be submitted personally or by a proxy. If the request is submitted by a proxy, together with
the request the scanned copy of the power of attorney (electronic form) should be attached, which should not
be certified by the authority legally responsible for certification, however, the competent authority may
subsequently request the certified power of attorney be submitted, if there are doubts in its veracity.
Before applying there is a screen with paying orders whose payment is necessary to be realized in order to
proceed with the procedure of issuing location conditions.

After making a payment, a money order should be scanned, signed by a qualified electronic signature and
submitted on the portal for electronic submission of requests for construction.
2.2. CONCEPTUAL DESIGN
Conceptual design is made for the purpose of issuing location conditions and it can be a part of urban
project for the needs of urban-architectural elaboration of the location. Conceptual design is submitted
in electronic form.

CONDITIONS FOR DESIGN AND CONNECTION OF THE BUILDING
The competent authority obtains ex officio all the conditions for connection to communal,
transport and other type of infrastructure at the expense of the applicant together with a fee of
actual issuance costs. Holders of public authorities are obliged to submit the conditions upon the
request of the competent authority within 15 days from the day the request has been submitted.

facilities in the protective zone has been forbidden (state roads of category I - highways,
40 meters, other state roads of category II 20 meters, state roads of category II 10 meters,
municipal roads 5 meters)

reconstruction of the existing facilities and performing other works that may permanently
or temporarily influence the changes in the water regime, the City of Leskovac, acting ‘ex
officio’ requests that ‘WMC Morava’, with its seat in Nis, issue water requirements.
If the building is constructed in railway infrastructure zone (zone on both sides of the
railway, with a width of 25 m, starting from the axis of end tracks) it is necessary to obtain
the approval of infrastructure administrator, which is issued in the form of decision.
If the applicant stated in the request for issuing location conditions that he firstly would like to declare
whether he accepts the costs of issuing conditions for design and connection, about which he is informed, the
competent authority shall, after sending the note, stop the procedure and continue only when the applicant
pronounces upon accepting the costs of issuing location conditions.

Building permit is the final document based on which one can start with construction. The deadline for issuing
building permit is 5 days from the day the completed request has been submitted.

Study of energy efficiency makes a component part of the building permit project and is made according
to the Regulation on energy efficiency of buildings and contains a statement of the engineer responsible
for energy efficiency of buildings who makes energy efficiency study on the anticipated measures for
achieving prescribed energy performance.

3.4.3. STUDY OF THE ENVIRONMENTAL IMPACT ASSESSMENT
Study of the assessment of impact on the environment is necessary if the building is on the list
of projects for which the estimation of influence is obligatory or on the list of projects for which impact
assessment may be required, as determined by the competent authority, that is, Department for
Environmental Protection of the City of Leskovac.
If the study of the assessment of impact on the environment is required, it must be made in accordance
with the regulations governing this area and contain a statement by a legal entity or an entrepreneur
(registered in the appropriate register for projecting, engineering and carrying out studies and analyses)
on anticipated measures with the aim of preventing, reducing or eliminating potential significant adverse
effect on the environment.

Study of the assessment of impact on the environment
Is a document that analyzes and assesses the quality of environmental factors and their sensitivity
to the particular space and mutual impacts of the existing and planned activities, predicts direct and
indirect adverse effects of the project on the environmental factors, as well as measures and
conditions for preventing, reducing and eliminating adverse effects on the environment and
people’s health.

The competent authority: 
Study of the assessment of impact can be carried out by a legal entity or an entrepreneur if
registered in the appropriate register for projects, engineering and conducting studies and analyses.


The main project of fire protection is made for the facilities of public purposes (cinemas, schools,
hotels, petrol stations for motor vehicles, sports halls, galleries, museums, etc.) as well as for

3.5. AGREEMENT BETWEEN INVESTOR AND FINANCIER
The agreement between investor and financier is an agreement between the person for whose needs the facility
is constructed and whose name the building permit carries and the entity that finances or co-finances the
construction. This contract is not obligatory if the investor does not have additional financiers or co-financiers in
the procedure of constructing the facility that is a subject to issuing a building permit.
3.6. ENERGY PERMIT
Energy permit is issued by the Ministry of Mining and Energy for the construction of energy facilities for
which obtaining energy permit is required, in accordance with the Regulation on facilities classification,
while for other facilities from the Regulation this permit is not necessary. Energy permit, in other words,
approval is issued in the form of decision within 30 days from the date of the submission of request for

METHOD OF PAYMENT OF LAND PLANNING CONTRIBUTION:
The amount of contribution for construction land shall be reduced by 30% when the payment is made in the
whole amount.
If the contribution for the construction land is paid in installments, the first installment is paid in the amount of
20% of Defined Contribution and the remaining amount is paid in 36 monthly installments, which will be
adjusted according to the official published indicator of consumer price growth, according to data of the
Republic Institute for Statistics, for the period from the base date of calculation of the contribution to the last day
of the month, and are paid to the 15th day of the following month.

responsible for issuing building permit and the competent inspection authorities minimally eight (8)
days before the commencement of works.

4.2. REGISTRATION OF THE BUILT FOUNDATION AND THE STRUCTURAL COMPLETION OF THE

The contractor submits to the competent authority the statement on the completion of the foundation
and the statement on the structual completion of the facility through CIS, immediately after completion of their
construction.

4.3. CONNECTION OF THE FACILITY TO INFRASTRUCTURE
In order to obtain certificate of occupancy approvals for connecting the building to communal
infrastructure are required. If the building is designed in accordance with the building permit and the
main design, the holder of public authorities is obliged to make a connection of the building to the
communal or other type of infrastructure and to inform the competent authority within 15 days from
the day the request for the connection of the building has been submitted.

MAIN DESIGN WITH INVESTOR’S APPROVAL AND CERTIFICATION
The main design with approval and certification of investor, the professional supervisor and the contractor
is required as evidence that the constructed building is equal to the projected. In the event that during
construction it was not deviated from the main design and if the project of the constructed building was
carried out in accordance with the Regulation governing the content of the technical documentation, then
the project of the constructed building carried out in accordance with the Regulation governing the content
of the technical documentation should be submitted.
5.3. TECHNICAL INSPECTION REPORT OF THE COMMISSION
This report determines that the building is suitable for use, with a proposal for issuing usage permit. Technical
inspection of facilities is performed by the commission, company or other legal entity to whom the investor has
entrusted implementation of such activities and that has been registered in the appropriate register for
performing such activities.

Technical inspection of the facility
5.4. CERTIFICATE OF ENERGY FEATURES OF THE BUILDING
The certificate is necessary if the requirement to obtain a certificate of energy properties has been prescribed
for the building. Energy permit is issued by the Ministry of Mining and Energy for the construction of energy
facilities for which there is the requirement of obtaining energy permit in accordance with the Regulations on
facilities classification, while for other facilities from the Regulations this permit is not necessary. Energy permit,
that is, approval is issued in the form of Decision within 30 days from the day the request for issuing energy
permit has been submitted.

5.7. THE REGISTRATION OF THE TITLE TO THE BUILT FACILITY
Within five working days after the issued certificate of occupancy has gone into effect, the competent
authority ex officio submits the certificate of occupancy, the study of surveying works for the building and its
special parts, as well as the study of surveying works for underground installations to the authority
responsible for state survey and cadastre, that is, to Republic Geodetic Office.
Republic Geodetic Office issues a Decision on house number and performs the registration of title to
the building or special parts of the building and informs the investor and the competent authority within seven
days from the day the certificate of occupancy has been submitted, and within 30 days performs the
corresponding entry into the cadastre of real estates.
