ANNUAL CONFERENCE IN ASHEVILLE
They came together under one roof as one
team with one goal. The NCBAA annual conference and Hall of Fame Induction in Asheville proved to be a big hit. Members, sponsors and surety companies all came together
to learn from each other, share stories and
help out their community by partnering with a
local charity. The membership elected a new
Board of Directors at the annual meeting.
Friday evening, four more outstanding individuals were inducted into the Hall of Fame and
the PAC raffle proved to be one of the best
ever, thanks to a PAC chairman (Sharona
Stokes) who can always take a challenge and
run with it. Congratulations to new Board
members, Janet Hammond and Chad Taylor
and Hall of Fame Inductees, Janet Hammond,
Dennis and Donna Johnson and Lloyd Patter-
son. The NCBAA staff did a great job of
getting people in the team spirit with their
referee striped shirts and their willingness to
work so well under pressure. Thanks to Dana
Rutledge, Brian Olds and Erin Shelton for
assisting this year. And if you didn’t get a
chance to go by the NCBAA logo table, you
really missed out on the opportunity to interact with Angie Bradley. Angie is the wife of
Donny Bradley and although she is not a licensed bail agent, she supports his bail bond
office and NCBAA. She volunteers her time
every year at the conference and for that we

NC BAIL AGENTS HONORED FOR BRINGING
CLOSURE TO THE FAMILY OF KELLI BORDEAUX

Many of you remember the case of Kelli
Bordeaux, a 23-year-old Army combat
medic stationed at Fort Bragg that went
missing on April 14, 2012. Months of
searching the immediate area turned up
nothing, even with people coming from
across the country to volunteer. The police had a suspect but he offered no help
and with little evidence, nothing could be
done. The case caught the attention of
North Carolina Bail Agent and NCBAA
member David Marshburn. David repeatedly watched television interviews of the
suspect for months. The suspect claimed
to have no knowledge of what happened
to Kelli but David knew better and didn’t
believe him for a second. He began his
own investigation into the case and it became personal to him and his partner,
Marsha Ward. David decided to befriend
the suspect. He began visiting, calling and
even helped him financially in an effort to
gain his trust. It was extremely hard for
David, taking him through many emotions.
He had to control his temper at times because he truly believed the suspect was
responsible for Kelli’s disappearance and
possibly her death. Months and years
passed before he made any real progress
in the case. He had spent more than
$30,000 already but the suspect had finally
become comfortable with David. On May
15, 2014, the suspect agreed to tell the
truth and led Marshburn and Ward to a
wooded area along River Road in Fayetteville, near the I-295 corridor. They began
searching and were able to locate the shallow grave containing the remains of Kelli
Bordeaux. They notified the local authorities and the suspect was charged immediately. NCBAA members David Marshburn
and Marsha Ward were finally able to
offer closure to Kelli’s family and friends.
They were glad it was over but said they
would have continued for as long as it took
to bring her home. David and Marsha
were honored at the 2016 NCBAA Annual
Conference for their hard work on this
case and we are very proud of them. This
is just another example of bail agents
working to give back to their communities.

LEGISLATIVE UPDATE—SENATE BILL 508
BECOMES LAW THIS FALL
Senate Bill 508 was signed into law on July 22, 2016. Parts of the bill will become effective on
October 1, 2016 and other parts on December 1, 2016. Among other things, this bill does the
following:

Allows you to be relieved of liability on a bond for a 90-96 or deferred judgment

Makes it a requirement that all jails provide a copy of the release order to the bail agent

Prevents a bail agent from writing bonds anywhere in the state if they have unsatisfied
judgments

Changes the renewal of a bail bond license from every year to every two years with fingerprints required every four years.

A FUTURE FOR BAIL BONDING IN NC
Pretrial Release Of Defendants Is
Targeted by North Carolina
Commission on Administration of
Law and Justice
If you have ever questioned whether it is important to belong to NCBAA—the only nonprofit trade association for bail bonding in
North Carolina—the answer is a resounding YES,
YES, YES. In September of 2015, Chief Justice
Mark Martin empaneled a new Commission to
study the criminal justice system in North Carolina. The commission set five committees to
study different areas of the system and make
recommendations to the 2017 General Assembly. Those committees were:

Civil Justice

Criminal Investigation and Adjudication

Legal Professionalism

Public Trust and Confidence

Technology
Within the Criminal Justice and Adjudication
Committee falls the Pretrial Release of Defend
ants and Pretrial Release has taken another
opportunity to pitch their idea of how pretrial
defendants should be released. They use the
risk assessment tool to place the records of
defendants into a “point system” and what
comes out the other end? A recommendation
that dangerous violent offenders should be
released to the supervision of those that are not
qualified nor have the authority that bail agents
have to do the job. They want to create government programs to supervise defendants and the
taxpayer is supposed to foot the bill. There are
already more than 1600 private business men
and women doing this job at NO COST TO THE
TAXPAYER. They also don’t believe in the ability
of our police officers, magistrates and judges to
make these decisions for themselves, citing a
recent study of five counties’ jail populations.
Defendant release decisions are made at least
three times from the time of arrest but pretrial
believes these educated members of our judicial system can’t make a good decision. We
know better and for years commercial bail has
proven that our rate of return to court is higher
than government funded pretrial release programs.
