Instructions for Cargo/Container Interests
providing General Average Security
Your kind attention is requested to the following: A. SUMMARY OF EVENTS
The m.v. “HANJIN ATHENS” was on a laden voyage with containerized cargo from various ports in
the Far East (Pusan, Shanghai, Ningbo, Hongkong, Yantian and Singapore) for delivery at Port Said,
Egypt, Napoli, Livorno and La Spezia all in Italy, when a fire broke out in vessel’s cargo hold No. 2 on
6th May 2014, south of the Suez Canal.
The Shipowners employed the services of professional Salvors, Svitzer, under contract. A significant
number of containers in hold no. 2 have been flooded with extinguishing water and at present it
appears that the fire has been extinguished.
In view of the extraordinary expenditure incurred and the sacrifice damages sustained by the property,
the Shipowners have declared General Average and have appointed RUDEK & CIE., (UK) Ltd.,
London as Average Adjusters. The Average Adjusters have appointed us, Albatross Adjusters
Limited, to arrange for collection of securities and documentation from all parties concerned in Cargo
and Containers.
B. SECURITY REQUIRED FROM CARGO AND CONTAINER INTERESTS
At the discharging port, the cargo and containers can only be released to the Receivers once all
General Average securities, blank forms hereto attached, as well as supporting documents have been
provided to the full satisfaction of Shipowners, as follows: AVERAGE BOND

To be (a) duly completed with details of the cargo and containers, (b) signed and (c) stamped by
Cargo Receivers or Shippers, stating their full style address and communication numbers.

A copy of the Bill(s) of Lading, front and reverse sides, covering the goods is to be attached to the
Average Bond.

A copy of the Commercial Invoice(s) covering the goods concerned is also to be attached to the
Average Bond.

If the commercial invoice does not cover the freight, a copy of the Freight Invoice covering the
goods concerned is also to be attached to the Average Bond.

If the commercial invoice does not cover the insurance premium, a copy of the Insurance
Premium Invoice covering the goods concerned is also to be attached to the Average Bond.

AVERAGE GUARANTEE

To be (a) duly completed by Cargo Insurers with details of the cargo and containers, (b) signed
and (c) stamped, stating their full style address and communication numbers.
N.B. Please note that a rating for Cargo Insurers should be submitted and Shipowners will only
accept Average Guarantee, as per wording requested, from Cargo Insurers with a credit
rating of BBB+ or better from Reputable Rating Agencies

If the cargo is not shipped on CIF terms and no Insurance Premium Invoice is submitted, the
Average Adjusters shall adopt an estimate of 0,1% of the CFR value of the goods as a notional
insurance premium.
N.B. In the event that the goods are not insured, Cargo Insurers are not prepared to sign the
General Average Guarantee in the tendered wording or Shipowners do not accept the
Guarantee tendered, a Cash Deposit of the US Dollar equivalent of 35% (thirty five
per cent) of the CIF, respectively the C&F, value of each cargo / container interest will
be required as General Average security. The Cash Deposit should be remitted into the

If cash is remitted, please ensure that the name "HANJIN ATHENS" and the relevant
Bill of Lading and container numbers are quoted on the remittance advice. A fax or email should be sent to ALBATROSS ADJUSTERS LIMITED (for contact details see
section C below) detailing the amount remitted, the Bill of Lading numbers, container
numbers and goods covered, together with evidence of the value of the cargo and
containers to enable us to identify the funds when received. Without this advice it will
NOT be possible to release any cargo and/or container. Upon receipt of the Cash
Deposit an Original General Average Deposit Receipt will be issued by us to parties
concerned, with additional instructions.

The security forms contain editable fields in which the cargo information e.g. Bill of Lading,
container numbers, cargo description, full style name and addresses, etc. may be typed in. For
good order’s sake, the security forms should be signed and stamped. We can confirm that
handwritten securities will also be acceptable, provided same are legible.

Shipowners do not accept any security forms other than those attached hereto and no additions,
deletions or amendments to the wording of the forms will be accepted.
4.
Copies of the full set of securities and supporting documents should be transmitted as soon as
possible to ALBATROSS ADJUSTERS LIMITED (for contact details see C below).
5.
At a later stage, the original security documents, i.e. Average Bond and General Average
Guarantee bearing the original signatures, have to be couriered to ALBATROSS ADJUSTERS
LIMITED (for the postal address, please refer to C below or the security forms).
6.
Provided that the security is accepted, written instructions will be given by the Average Adjusters
to the effect that the cargo may be released. For a list of RELEASED CONTAINERS please
refer to the Average Adjusters’ website.
7.
Please avoid re-sending copies of documents, as this will only delay the processing of
documents. In case you have any doubts or questions regarding the submission of securities,
please refer to the Frequently Asked Questions (FAQ) posted on the Average Adjusters website.
8.
