Appendix 1 Scottish Government Two Models for Integration Both covered by Partnership Agreements Scottish Government Description (summarised from “Integration of Adult Health and Social Care In Scotland. Consultation: Scottish Government Response, February 2013 and Public Bodies (Joint Working) (Scotland) Bill ) Bill Description Board/ Committee ArrangementsEffective, appropriate, joint governance of Health and Social Care Partnerships will be of key importance regardless of which model is used. Delegation Between Partners Model “delegation of functions by the local authority to the Health Board,” or “delegation of functions by the Health Board to the local authority,” or “delegation of functions by the local authority to the Health Board and delegation of functions by the Health Board to the local authority.” “The local authority and the Health Board must jointly establish a committee (an “integration joint monitoring committee”) for the purpose of monitoring the carrying out of integration functions for the area of the local authority. No new body in law, but there will be a partnership agreement and a Joint Strategic Commissioning Plan Chief Officer ( previously referred to as the Chief Executive of the Host Partner Joint Accountable Officer-) becomes accountable for the functions delegated. Body Corporate Model “delegation of functions by the local authority to a body corporate that is to be established by order under section 9 (an “integration joint board”) and delegation of functions by the Health Board to the integration joint board,”. The Board and local authority will describe within the Integration Plan (partnership agreement) an intention to delegate functions to an integration joint board. If the integration plan is approved, the Scottish Ministers will establish the integration joint board. New body in law – a Joint Board of the Local Authority and NHS Board and will not operate separately from the governance or influence of the two parent bodies. The integration joint board will appoint as a member of staff (seconded from either the NHS or local authority) a chief officer. Appendix 1 Staff Employment Funding - Scope – services to be integrated Staff can remain employees of the parent body or employment may be transferred to the host body under TUPE arrangements Funding is delegated from one partner organisation to the other to support delivery of the delegated functions Integrated budget formed by the transfer of funding from one partner to the other, combined with the lead partners own resource. No difference between models National Outcomes – No difference between models Joint and equal accountability for delivery of nationally agreed outcomes. Community Planning – Arrangement Parent bodies both members of CPP between Community Planning Partnership(CPP) and Health & Social Care Partnership (H&SCP) not hierarchical Locality Planning- a duty to engage with Duty will apply regardless of model and involve local professionals, the third and independent sectors and representatives of patients, people who use services, and carers regarding how to put in place local arrangements for planning service provision Body Corporate cannot employ staff. Staff remain employees of the parent bodies Funding is not distributed to the partnership directly from the Scottish Government but via the parent bodies as per the integration plan. “… joint boards general powers (such as powers to contract, acquire or dispose of property or rights or borrow money or incur other liabilities) in connection with the carrying out of their functions. Chief Officer will provide a single, senior point of joint and integrated management down through the delivery mechanisms in each organisation. Staff cannot be employed by the body corporate and therefore remain employees of the parent organisation. Joint Board has equal numbers of Councillors and Health Board Members to ensure parity of voting
