TITLE IX
Linda Mangum
Division of Human Resources
North Carolina Agricultural and Technical State University
North Carolina Agricultural and Technical State University
What is Title IX?
•  Title IX of the Education Amendments Act of 1972 protects
people from discrimination based on sex in education and
activities that receive federal financial assistance.
§  No Person in the United States shall, on the basis of sex, be excluded
from participation in, be denied the benefits of, or be subjected to
discrimination under any education program or activity receiving federal
financial assistance.
•  Title IX of the Education Amendments of 1972 prohibits sexual
discrimination in any form; to include any form of sexual harassment and
gender discrimination.
North Carolina Agricultural and Technical State University
Sexual Harassment Definition
§  Unwelcome conduct of a sexual nature
» Includes unwelcome sexual advances, requests for
sexual favors, and other verbal, nonverbal, or physical
conduct of a sexual nature.
§  Student to student harassment:
» Creates hostile environment if conduct is sufficiently
serious that it interferes with or limits a student’s
ability to participate in or benefit from the school’s
programs.
24 ww
w.nc
North Carolina Agricultural and Technical State University
Sexual Violence Definition
§  Sexual violence is a form of sexual
harassment prohibited by Title IX
» Sexual violence refers to physical sexual acts
perpetrated against a person’s will or where a
person is incapable of giving consent due to the
victim’s use of drugs or alcohol
» An individual also may be unable to give consent
due to an intellectual or other disability
» May include rape, sexual assault, sexual battery,
and sexual coercion
25 ww

North Carolina Agricultural and Technical State University
Sexual Assault
§  Alcohol and other substances are used
intentionally by men who commit rape
(alcohol is the “weapon of choice”).
§  55% of men who admitted to committing
rape and 53% of women who experienced
rape were drinking at the time.
26 ww
w.nc
North Carolina Agricultural and Technical State University
Effective Consent
§  Is informed, freely and actively given, and is based on
rational and reasonable judgment. It requires clear
communication between all persons involved in the sexual
encounter.
§  Consent must be communicated verbally. In whatever way
consent is communicated, it must be mutually
understandable.
§  Consent is mutually understandable when a reasonable
person would consider the words that you and your
partner(s) have expressed demonstrate a desire to do the
same thing, at the same time, in the same way, with one
another.
27
North Carolina Agricultural and Technical State University
Effective Consent
§  The initiators must fully understand what their partner wants and does not
want sexually.
§  Consent to one form of sexual activity does not imply consent to another
form of sexual activity. Each new sexual act requires new consent.
Effective consent has time boundaries.
§  Consent at one time does not imply consent at any other time.
§  The existence of a dating/romantic relationship between the persons
involved or the fact of a previous sexual relationship does not automatically
establish effective consent for future sexual activity.
§  Consent is not the absence of resistance.
§
Silence is an inactive behavior
28
North Carolina Agricultural and Technical State University
Reporting
§  The University is committed to creating an environment in
which students who have experienced an incident of any type
of sexual harassment/sexual misconduct are encouraged to
come forward and make a report.
§  Immediate reporting is essential for your protection,
protection of all students, and it helps the university in
maintaining a safe community.
29
North Carolina Agricultural and Technical State University
COMPLAINTS
§  You can file a complaint with the Title IX Coordinator or
University Police Department.
» Website – Current Students Gateway and to file a
complaint, or visit or call the Title IX Coordinator,
Deputy Title IX Coordinator, Dean of Student Office.
§  Complaints will be promptly reviewed and investigated.
30 ww
w.nc
North Carolina Agricultural and Technical State University
Grievance Process
§  NC A&T has equitable procedures in place to promptly, thoroughly and
fairly address concerns and complaints of harassment or discrimination
while being mindful of the rights and unique needs of all parties and of
due process.
§  Both parties have an opportunity to meet (separately) with all
investigative and conduct administrators to present their perspectives,
provide witnesses or information, and is provided an Advisor to bring to
the investigation and/or hearings, to ask questions and seek clarification.
§  After a review of the information and facts of a complaint, a decision
will be made about whether it is more likely than not that a violation of
code or policy took place and sanctions, if appropriate, will be issued.
Appropriate options for review or appeal will be given to all parties.
31
North Carolina Agricultural and Technical State University
Grievance Process
§  Interim actions can be taken before any decisions on the conduct
are made. An interim action does not identify responsibility.
§  Interim actions are short-term, remedial measures to ensure the
safety of all individuals involved and the fairness of the complaint
process. They can include no contact orders, changes to on-campus
housing, or changes to class or activity schedules and in some cases,
interim suspension.
32
North Carolina Agricultural and Technical State University
CONFIDENTIALITY ISSUES
§  “If the complainant requests confidentiality or asks that the
complaint not be pursued, the school should take all reasonable
steps to investigate and respond to the complaint consistent with
the request for confidentiality or request not to pursue an
investigation.” April 4, 2011 Dear Colleague Letter
§  We will endeavor to maintain confidentiality and privacy to the
extent of the law. When you keep it confidential, it limits the
investigation process.
33 ww
w.nc
North Carolina Agricultural and Technical State University
Amnesty
§  NCAT encourages reporting of incidents of sexual misconduct.
Sometimes, complainants are hesitant to make reports because
they fear that they may be charged with violations of the
Student Code of Conduct, such as underage drinking at the time
of the incident. To encourage reporting of sexual misconduct
incidents, the university may exercise leniency towards a
complainant with respect to taking action for other violations of
the Student Code of Conduct.
34
North Carolina Agricultural and Technical State University
Retaliation
§  Retaliatory action of any kind will not be tolerated against any
person for making a good faith report of discrimination or
based on that person's participation in any allegation,
investigation or proceeding related to the report of
discriminatory conduct.

Refund Checks
What are they? •  A refund check is a check issued to the student ater all school-‐
related costs have been paid for •  (Financial Aid Award Package)-‐(TuiKon + Room and Board + Miscellaneous Fees) = Refund Check •  They are to be used to cover extra expenses you might encounter throughout the semester •  Examples: Books, Computer, Printer, etc. •  Before you spend the extra funds make sure that you’re only receiving funds that are a part of your award package. •  Schools can make mistakes and over-‐award students; they always expect misappropriated funds to be returned to them, even if it was a mistake on their part. •  Refund checks are designed to last your ENTIRE semester. •  Refund checks can also be loan money that must be repaid. Bank Accounts
•  When you receive a refund check, where should you put it? •  Savings Accounts are designed to earn money on the principle amount. These accounts earn interest on the running total deposited into the account. •  Withdrawal Methods: ATM Card, physical withdrawal at bank •  Checking Accounts are similar to savings accounts but typically do not earn interest on the principle amount. •  Withdrawal Methods: Debit Card for everyday transacKons (can be used at an ATM as well), physical withdrawal at bank •  Overdrat/Insufficient Funds Fees •  Phone ApplicaKons (iPhone, Android, Blackberry) •  Help you keep track of funds •  Deposits Credit Cards
•  A credit card establishes a revolving credit agreement between you and the issuer. You are given an account with a credit limit; once you pay back the amount you charge, that money is available to use again up to the credit limit. •  Must be paid back with interest •  Interest is the percentage an insKtuKon will charge you for using their funds •  Should be used for emergencies and/or travel expenses •  Freeze It! Credit Card (Continued)
•  Important Tips to remember: •  Can be used to build credit history •  Pay each month on Kme •  If possible, pay more than the minimum amount due •  Once reported to a naKonwide consumer reporKng agency, a missed payment can stay on your credit report for 7 years! •  Read everything you receive in the mail regarding the card •  SomeKmes interest rates change, which is something you can speak with the insKtuKon about Credit Scores
•  A credit score is a numerical measure of how responsible you are with the credit that has been given to you in the past and present •  The higher, the beher •  Determined by: •  Payment history, amounts you owe, length of credit history, new credit and types of credit •  Credit score raKng example: •  720 -‐ 850 Excellent •  690 -‐ 720 Good •  650 -‐ 690 Fair •  350 -‐ 650 Poor •  000 -‐ 349 No Credit Credit Scores (Continued)
•  Check your credit score before you apply for new credit to gauge where you stand. •  Your credit score directly impacts interest rates. You can save thousands of dollars if your score is in good shape before you apply. •  To check your credit score, go to credit checking websites like freecreditscore.com. •  Allows you to check your credit status for free once a year •  Equifax •  Experian •  Transunion •  Be careful with offers for a free credit score from for-‐profit companies that automaKcally enroll you for a 30-‐day trial membership of their credit monitoring program or some other product. •  Before you accept their offer, decide whether you will remember to track the trial period. If you don't cancel within 30 days, you will be charged a monthly fee for services you may not need. •  The importance of good credit outside of credit cards: •  Mortgages in the future •  Car Notes •  Employment Budgeting
•  CreaKng a game plan for your funds •  What are your standard payments each month? •  Example: cell phone bill, car note, insurance •  How much money will you put towards food outside of the dorm room? •  How much money will you spend on transportaKon? •  Break each cost down and set a specific amount to be allohed to that category each month or week. •  SKck to your game plan!
