Communications Commission of Kiribati P.O Box 529 Betio, Tarawa Republic of Kiribati Telephone: (686)-25488/ 25431 Website: www.cck.ki Email: [email protected] PUBLIC NOTICE TO CONDUCT A CONSULTATION ON DEVELOPING RULES FOR RADIOCOMMUNICATIONS LICENSING AND RELATED FEES In accordance with Section 34 of the Communications Act of 2012, the Communications Commission of Kiribati (CCK) shall, before making radiocommunications rules, conduct a public consultation and publish a draft of such rules. Accordingly, the CCK gives notice that it has initiated a consultation process during which interested parties may submit their comments and views regarding its existing radiocommunications licensing practices and related fees and make any proposals for changes. The Communications Act of 2012 gives the Commission the authority to develop radiocommunications rules specifying the: 1. types of apparatus licences and spectrum licences that may be issued in relation to spectrum blocks or particular frequencies; 2. technical requirements that apply to the use of parts of the radio spectrum, particular devices or particular spectrum licensees or apparatus licensees; 3. circumstances in which a radio frequency transmitting device is exempt from licensing; 4. parts of the radio spectrum for which an apparatus licence or spectrum licence may only be issued following a request for applications published by the Commission; 5. process for submitting an application for an apparatus licence or spectrum licence including the intended timeframe for the Commission to process an application; 6. licence fees payable to the Commission (CCK’s current fees for radiocommunications licences are attached to this Notice); 7. eligibility criteria for an apparatus licence or spectrum licence; 8. fair and transparent method or methods of selecting applicants in circumstances where applications for apparatus licences or spectrum licences exceed the available spectrum, which may include a competitive tender; and 9. general licence conditions for spectrum licences, apparatus licences and permits. Stakeholders are encouraged to submit comments and recommendations for any of the nine (9) areas of specification listed above. Responses to this Notice should include any information or rationale to support expressed positions, recommendations and arguments. In the interest of transparency, CCK will publish all written responses to this consultation on its website, subject to the confidentiality of any information that the respondent has marked as confidential. Once the CCK has considered any responses received, it will publish a draft version of the radiocommunications rules, which shall be published on its website for the further review and consideration of stakeholders.
