(“Habitat”) in constructing homes for low-income persons, including but not limited to work in the ReStore. The undersigned understands that as a volunteer he or she will not be paid for his or her services, that the undersigned will not be covered by any medical or other insurance coverage provided by Habitat and that the undersigned will not be eligible for any workers’ compensation benefits. Not withstanding the foregoing, if the undersigned is injured on the worksite, Habitat provides a volunteer insurance policy which will pay for direct medical expenses only which are not paid by the undersigned’s health insurance company, up to a maximum of $250,000 for overall accident medical expenses. By executing below, the undersigned further represents to Habitat that undersigned is not registered on what is commonly referred to as a "sex offender registry". The undersigned expressly agrees that Habitat may (but shall not be required to) conduct any criminal background check or other similar background check on the undersigned as Habitat may deem appropriate, and without limiting the generality of the following sentence, Habitat reserves the right to terminate any volunteer that appears on any such background check. The undersigned further agrees that his or her participation in any Habitat project may be terminated at any time by either Habitat or the undersigned. THE UNDERSIGNED IS AWARE THAT, IN VOLUNTEERING FOR HABITAT, THE UNDERSIGNED MAY BE EXPOSED TO PERSONAL INJURY OR DAMAGE TO HIS OR HER PROPERTY AS A RESULT OF THE UNDERSIGNED’S ACTIVITIES, THE ACTIVITIES OF OTHER VOLUNTEERS, OR THE CONDITIONS UNDER WHICH THE UNDERSIGNED’S VOLUNTEER SERVICES ARE PERFORMED. WITH KNOWLEDGE OF THESE DANGERS, THE UNDERSIGNED AGREES TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH. In consideration of the opportunity afforded to the undersigned to participate in projects as a Habitat volunteer, the undersigned agrees that neither the undersigned nor the undersigned’s assignees, heirs, guardians, or legal representatives will make any claim or institute any action or suit at law or in equity against Habitat or any of its affiliated organizations, or their respective officers, directors, or employees, or any supplier of any materials or equipment that is used by Habitat in any project, any promoter, sponsor, or advertiser of Habitat, any owner or lessee of the project premises, or any of the volunteer workers (collectively, the “Releasees”), for any damages, costs, loss of services, expenses, or compensation for or on account of any injury, damage, death, or loss either to person or property, or both resulting or to result, known or unknown, past, present, or future arising from the undersigned’s participation in a Habitat project. Without limiting the generality of the foregoing, the undersigned releases, waives, and discharges the Releasees of and from any rights, actions, or caused of action resulting from personal injury or death to the undersigned, or damage to the undersigned’s property, sustained in connection with the undersigned’s participation in any Habitat project. THE UNDERSIGNED HAS READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTANDS ITS CONTENTS. THE UNDERSIGNED IS AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE UNDERSINGED AND HABITAT, AND SIGNS IT OF THE UNDERSIGNED’S OWN FREE WILL. BY SIGNING THIS AGREEMENT THE UNDERSIGNED CERTIFIES THAT HE OR SHE IS EIGHTEEN YEARS OF AGE OR OLDER OR HAS DELIVERED THE CONSENT OF THE UNDERSIGNED’S PARENT OR GUARDIAN TO HABITAT. By signing this form, I permit Habitat Wake Staff or other volunteers to take my picture on site. I recognize that Habitat Wake might use these pictures in printed materials, videos, the Habitat Wake webpage or in news media in efforts to promote Habitat for Humanity. If I do not wish my photo taken, I’ll notify the photographer or contact the Habitat Wake Communications Manager. The undersigned expressly agrees that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina, and that if any portion hereof is held invalid, it is agreed that the balance shall continue in full legal force and effect. ___________________________________________ Signature _______________________ Date
