MINUTES OF THE MEETING OF THE PLANNING & TRANSPORTATION COMMITTEE OF ASHBY de la ZOUCH TOWN COUNCIL HELD AT LEGION HOUSE, SOUTH STREET, ASHBY de la ZOUCH, LEICESTERSHIRE LE65 1BQ at 6.30pm on MONDAY 6th OCTOBER 2014. 167. PRESENT. Members: Councillor S.J. Hoult (Chairman) Councillors G. Allman, E. Avins, A. Badger, R.D. Bayliss, R. Gough, D.J.G. Jones, G. Mansfield and Mrs M Tuckey. Also present: Councillor C. Smith. Officer: Karen Edwards, Deputy Town Clerk 168. APOLOGIES. Apologies for absence were received from Cllrs. J.G. Coxon and Mrs D. Whetton. These were received and noted by the Committee. 169. PUBLIC QUESTION AND ANSWER SESSION. There were 20 members of the public present. The following points were raised: In respect of the proposed closure of Ashby Hospital it was suggested that if the Town Council is dissatisfied with the responses it has received to the letters sent to Leicestershire NHS Partnership Trust and West Leicestershire Clinical Commissioning Group the Town Council may wish to write to David Sharp at NHS England (Leicestershire and Lincolnshire). [Clerk’s note: this was discussed further during item 175] A member of the public expressed concern at the proposed development off Woodcock Way, highlighting: The spur roads that forms part of the development, which could be used for additional dwellings; 1,000 additional houses for Ashby have already been approved and the District Council’s 5 year land supply is already in place; The impact on Nottingham Road, which already has 15,000 cars a day; Asking the Committee to object to this scheme as it has done to other similar schemes on the site. Concerns were raised about the planned traffic lights at the Wood Street/ Upper Church Street junction and the negative impact this would have on both roads with queues of traffic forming. The Committee responded that the traffic lights were part of a planning condition imposed on David Wilson Homes by North West Leicestershire District Council. A resident commented on the planning application for the erection of 32 retirement apartments on Kilwardby Street, expressing concern about the use of 3 storeys for part of the 1 building facing Churchside Walk. Highlighting the impact on cottages on Churchside Walk. She also drew the Committees attention to the use of UPVC windows and doors within the conservation area. 170. DECLARATIONS OF INTEREST. There were no declarations of interest. 171. REQUESTS FOR DISPENSATIONS. There were no requests for dispensations. 172. MINUTES. RESOLVED: that the minutes of the meeting of the Committee held on Monday 1st September 2014 be approved as a correct record and be signed by the Chairman. 173. PLANNING APPLICATIONS. RESOLVED: that the planning applications from the Local Planning Authority are received and replies to consultations made as shown attached. 174. PLANNING DECISIONS. RESOLVED: that the planning decisions from the Local Planning Authority as shown attached are received. 175. CLOSURE OF ASHBY HOSPITAL. Ashby Civic Society provided a brief up date on the campaign to prevent the closure of Ashby Hospital and requested that the Town Council obtains a copy of the deeds for the hospital site. The Deputy Town Clerk presented correspondence received from Leicestershire Parthership NHS Trust and West Leicestershire Clinical Commissioning Group in response to letters sent by Councillor Coxon on behalf of this Committee. This was received and noted by the Committee. RESOLVED: to write to David Sharp (NHS England) expressing the Town Council’s dissatisfaction with the responses it has received from Leicestershire NHS Partnership Trust and the West Leicestershire Clinical Commissioning Group to its concerns about the closure of the hospital and the provision of alternative care. Mr Sharp is to be invited to meet with the Town Council to discuss the process undertaken in deciding to close the hospital and the nature, quality and location of the alternative provision for inpatients and outpatients that is being put in place. 2 RESOLVED: to write to Leicestershire Partnership NHS Trust supporting the views given in the petition that the Ashby Civic Society is handing to the Partnership Trust’s Board Meeting on 30th October. RESOLVED: to investigate the ownership of the Ashby Hospital site. 176. PARKING ON DOUBLE YELLOW LINES AT THE TOP OF MARKET STREET, ASHBY DE LA ZOUCH Councillor C. Smith withdrew his motion on enforcement of the double yellow lines at the top of Market Street, Ashby. Councillor J.G. Coxon’s motion regarding enforcement when people park on the double yellow lines was discussed. Councillor R. Bayliss proposed the adoption of the resolution suggested by Councillor J.G. Coxon, seconded by Councillor E. Avins vis: “That the Chairman of the Planning and Tranportation Committee writes to North West Leicestershire District Council on behalf of Ashby de la Zouch Town Council regarding the concerns that parking restrictions ie. Double yellow lines at the top end of Market Street, Ashby are not being enforced in an evening when obstructions are taking place on the highway, which cause congestion, which could result in accidents and asking what measures can be taken to resolve the situation.” With 5 votes in favour and 4 votes against the resolution was supported by the meeting. RESOLVED: that the Chairman of the Planning and Tranportation Committee writes to North West Leicestershire District Council on behalf of Ashby de la Zouch Town Council regarding the concerns that parking restrictions ie. ACCOUNTS. The Deputy Town Clerk presented the accounts for payment. RESOLVED: to approve the accounts for payment in the sum of £5,665.03 as shown attached. 178. GRIT BINS. The Deputy Town Clerk presented correspondence received from Leicestershire County Council regarding the Council taking responsibility for supplying, fitting and maintaining grit bins at Abbotsford Road and Cheltenham Drive. This was received and noted by the Committee. RESOLVED: to seek Leicestershire County Council’s agreement to the Town Council locating grit bins on highways land at Abbotsford Road and Cheltenham Drive, Ashby. 3 RESOLVED: subject to permission to use Leicestershire County Council land, for the Town Council to supply, fit and maintain grit bins for Abbotsford Road and Cheltenham Drive in Ashby. 179. BUS STOPS ON ASHBY DE LA ZOUCH TOWN SERVICE. The Deputy Town Clerk presented correspondence received from Leicestershire County Council in response to a letter sent on behalf of the Committee concerning the introduction of formalised bus stops on the Ashby de la Zouch Town Service routes. This was received and noted by the Committee. 180. PROPOSED REDUCTION IN SPEED LIMIT ALONG A SECTION OF WILLESLEY WOOD SIDE, ASHBY DE LA ZOUCH. The Deputy Town Clerk presented correspondence sent to Leicestershire County Council on behalf of the Committee concerning the proposed reduction in speed limit along a section of Willesley Wood Side, Ashby de la Zouch. This was received and noted by the Committee. 181. IMPOSITION OF NO WAITING AT ANY TIME ORDER ON MONEY HILL AND WILLOWBROOK CLOSE, ASHBY DE LA ZOUCH. The Deputy Town Clerk presented details of the imposition of a no waiting at any time order for Money Hill and Willowbrook Close, Ashby de la Zouch, This was received and noted by the Committee. 182. REVOCATION ON NO WAITING AT ANY TIME AND IMPOSITION OF NO WAITING AT ANY TIME ORDER ON TRINITY CLOSE AND MARKET STREET, ASHBY DE LA ZOUCH. The Deputy Town Clerk presented details of the imposition of a no waiting at any time order for Trinity Close, Ashby de la Zouch and of amendments to the no waiting at any time order on Market Street, Ashby de la Zouch. This was received and noted by the Committee. 183. IMPOSITION OF NO WAITING AT ANY TIME ORDER ON PITHIVIERS CLOSE, TRINITY CLOSE AND WILFRED GARDENS, ASHBY DE LA ZOUCH. The Deputy Town Clerk presented details of the imposition of a no waiting at any time order for Pithiviers Close, Trinity Close and Wilfred Gardens, Ashby de la Zouch. This was received and noted by the Committee. 184. NEIGHBOURHOOD PLAN. 4 The Deputy Town Clerk provided a verbal update on progress with the Neighbourhood Plan. Informing the Committee of the significant progress being made by the five Focus Groups who are considering the objectives and policies for themes: Town Centre Vitality Housing and the Built environment Transport and Accessibility Economic Growth Education and Leisure The Focus Groups contain a wide representation from members of the local community and should conclude their work by the end of October. This was received and noted by the Committee. 185. ROAD SAFETY ON MARKET STREET, ASBHY DE LA ZOUCH. The Deputy Town Clerk presented details of an invitation from Leicestershire County Council to attend a meeting on road safety on Market Street, Ashby and to suggest representatives from the community to invite alongside. RESOLVED: that Councillors R.D. Bayliss, D.J.G. Jones, E. Avins and C. Smith attend the meeting, with a suggestion that two representatives each from Ashby Civic Society and from the Neighbourhood Plan Transport and Accessibility Focus Group be invited to attend. 186. PUBLIC FOOTPATH DIVERSION AT HEATH END, ASHBY DE LA ZOUCH. The Deputy Town Clerk presented details of a public footpath diversion order on Callans Lane, Heath End, Ashby de la Zouch. This was received and noted by the Committee. 187. UNAUTHORISED ADVERTISEMENT STREET, ASHBY DE LA ZOUCH. AT MANHATTAN’S, MARKET The Deputy Town Clerk provided details of a complaint made to North West Leicestershire District Council regarding unauthorised advertisement at Manhattan’s, Market Street, Ashby de la Zouch. This was received and noted by the Committee. 188. LEICESTERSHIRE PLANNING OBLIGATIONS POLICY DRAFT. The Deputy Town Clerk presented information on Leicestershire County Council’s consultation reviewing ‘The Statement of Requirements for Developer Contributions in Leicestershire’. This was received and noted by the Committeee. They are a poor and unsympathetic design; There are concerns regarding the ingress and egress from the site from Willesley Road. The fact that the County Council has installed speed bumps would seem to indicate that there are concerns with speeding on that part of the road.
