TERMS & CONDITIONS
Super Hot Tub Hire requires all persons hiring equipment to
have read and understood the contents of this document
before signing. If you do not understand the information
contained within this document, or require further clarification
on said points, please speak to your installation engineer or
contact Super Hot Tub Hire on 07754481771
1. Definition of Terms
1.1 ‘The Owner is Super Hot Tub Hire.
1.2 ‘The Hirer’ is the company, firm or persons specified
below, including their successors or personal
representatives.
1.3 ‘Equipment’ includes all hot tubs, spa’s, marquees,
generators, accessories and other hire equipment that the
owner agreed to hire to the hirer.
2. Extent of Contract and Title
2.1 No conditions or warranties other than specified herein
shall be implied or deemed to be incorporated to form part
of the contract.
2.2 The Owner will retain the title and ownership to the
equipment.
3. Suitability and Delivery in Good Order
3.1. The Equipment shall be deemed to be in good order
and in accordance with the Hirer’s satisfaction unless
notification is received by the Owner on the day of delivery.
3.2 No warranty is given that the Equipment is suitable for
the purposes of the hirer.
4. Security
4.1 The Hirer shall be responsible for the ensuring the
security of the equipment at all times. Any costs arising
from the Equipment not being secured are chargeable to
the Hirer.
5. Bookings
5.1 The booking becomes binding once
5.2 We have received your security deposit/payment.
5.3 Super Hot Tub Hire has confirmed the dates of your hire
period.
6. security deposit
6.1 You are required to pay a 20% deposit prior to
delivery/installation. The rental charge for equipment is
either paid full or by the day of installation.
7. We require the following;
7.1 Prior to arrival – Venue / location confirmation
7.2 On arrival – A copy of your identification with proof of
address.
7.3 Confirmation of acceptance of these Contract Terms
and Conditions.
8. Cancellation
8.1 Cancellation of more than 14 days notice prior to
installation will forfeit the total booking deposit
8.2 Cancellation of less than 14 days prior to installation will
forfeit the total booking deposit, plus total outstanding
balance of the hire.
10. Hot Tub and Equipment Usage
10.1 You are responsible for any damage and loss caused
to the equipment regardless of culpability during the hire
period as stated on the booking form.
10.2 No naked flames are permitted inside or within 1 meter
of our hot tubs.
10.3 No dogs or other animals are allowed inside our hot
tubs.
10.4 You agree that Super Hot Tub Hire, its Agents,
Officers or Employees, accept no liability for any personal
injury or damage to any persons or property suffered during
the period of your usage.
10.5 If you have any issue with our hot tubs or equipment
during your hire, please contact Super Hot Tub Hire
immediately using the contact details supplied to you.
11. Venue booking
11.1 References to the Venue include, but not limited to,
Festivals, roof gardens, campsites, fields and private
addresses.
11.2 You are responsible for ensuring your chosen venue is
reserved in your name for the dates and times specified on
the booking form. We are not liable for any issues or errors
regarding venue booking.
11.3 We require access to your chosen venue a minimum
of two hours before your arrival for set up of equipment.
More time may be required for multiple Hot Tubs.
11.4 You must vacate the hot tub(s) a minimum of two
hours prior to the venue’s specified departure time to allow
us to dismantle the equipment. More time may be required
for multiple hot tubs. Please note any additional venue
costs incurred by your late departure must be paid in full by
you.
11.5 You must ensure any venue fees are paid in full by
you before your departure. Super Hot Tub Hire is not
responsible for any instances where the venue prevents us
from erecting the equipment including lack of booking and
being prevented access from the premises and will not offer
refunds.
11.6 Super Hot Tub Hire is not responsible for the venue in
any way including, but not limited to, its facilities, location or
access. Any issues with the venue must be addressed with
the venue owners.
12. Connection to Mains Services.
12.1 Connection and disconnection to mains services on
site are the responsibility of the Hirer and must be
performed by a competent operative.
13. Maintenance, Care and Alterations
13.1 The Hirer shall be responsible for maintaining the
Equipment in the same condition and working order as on
the date of delivery and for ensuring the Equipment is in
good and clean condition on the completion of the hire
period. Any loss, damage or additional cleaning costs are
chargeable to the Hirer.
13.2 In the event of equipment damage of malfunction, the
Owner must be informed immediately in order to arrange for
a site visit. Any damage or malfunction caused by mis-use,
neglect or vandalism by agents of the Hirer will be
chargeable to the Hirer.
13.3 In the event of severe weather conditions, including
wind, frost, snow, hail, heavy rain and storms, the Hirer will
take action to minimise damage to the Equipment, including
ensuring that all equipment is secured.
13.4 No equipment or accessories may be removed from
the hire equipment. Replacement of lost items will be
charged to the Hirer.
14. Inspection
14.1 The Hirer shall at all times allow the Owner to have
reasonable access to the Equipment to inspect, test,
replace or repair.
15. Termination
15.1 The Owner will be entitled to terminate the agreement
and remove the Equipment in the event of failure by the
Hirer to comply with the terms and conditions of hire.
16. Loss and Damage
16.1 The owner accepts no liability or responsibility due to
or arising from the Equipment becoming unusable through
any cause what so ever whilst in the care of the Hirer,
except through the Owners negligence.
16.2 The Hirer will be charged for any damage caused to
the Equipment whilst in the Hirers possession.
16.3 If the Equipment is not returned or significantly
damaged, the Hirer will be charged for the replacement cost
of the Equipment including the calculated daily rate of hire
until the equipment is replaced.
17. Insurance
17.1 The Hirer shall arrange adequate insurance cover for
all equipment during the period of hire and shall fully and
completely indemnify the Owner in respect of all claims for
injury to persons or property caused by and in respect of all
costs and charges in connection with, whether arising under
statute or common law except through the Owners
negligence.
18. Sub Let
18.1 The Hirer shall not re-hire, sell, mortgage, charge,
pledge, part with possession of or otherwise deal with the
Equipment and shall protect against distress, execution or
seizure and shall indemnify the Owner against all damages,
losses, costs, charges and expenses that may be
occasioned by failure to observe and perform this condition
except in the case of government requisition.
18.2 The Hirer shall not assign his rights hereunder nor
sub-let or lend the Equipment or any part thereof to a third
party without the prior express consent of the Owner.
19. Force Majeure
19.1 You agree that Super Hot Tub Hire will not be held
liable for any: Act of God including tempest, fire, flood,
storm or natural disaster; War, civil war, sabotage or act of
terrorism; Government sanction, embargo, import or export
regulation or order; Labour disputes, including strikes,
lockouts, boycotts or other industrial action; Failure in the
transportation of equipment, machinery or personnel or in
the provision of any utility including power, gas, water, or
communication services.
20. Choice of Law
20.1 This contract will be governed by the laws of England.
21. Finally
21.1 We reserve the right to amend our website and our
terms and conditions at any time, without prior notice.
All hire equipment provided by Super Hot Tub Hire is
subject to the terms and conditions set out above. For
Hirers who are unable to comply with the above terms and
conditions we cannot hire you a hot tub at this time
