Seventeenth Northern Marianas Commonwealth Legislature IN THE HOUSE OF REPRESENTATIVES ROTA LOCAL LAW NO. 17-2 House Local Bill No. 17-8 First Regular Session, 2010 A LOCAL APPROPRIATION BILL FOR AN ACT FOR THE FIRST SENATORIAL DISTRICT To increase the poker and pachinko slot machine annual local license fees in the First Senatorial District by amending 10 CMC § 1901; and for other purposes. BE IT ENACTED BY THE FIRST SENATORIAL DISTRICT DELEGATION PURSUANT TO CHAPTER 4, DIVISION I, TITLE 1 OF THE COMMONWEALTH CODE: 1 2 SECTION 1. FINDINGS AND PURPOSE. The Rota Legislative Delegation finds that the newly convened Rota Municipal 3 Scholarship Foundation is in dire need of financial assistance for its program, The Rota 4 Legislative Delegation further finds that Rota residents affected by Public Law 7-31, the 5 Commonwealth Compensation Adjustment Act of 1991, have been waiting for more than ten 6 years for their compensation adjustment. The Rota Legislative Delegation fmds that one way 7 to fund the foregoing activities is to increase the annual local license fees for poker and 8 pachinko slot machines which are a major source of revenue for the First Senatorial District. 9 Accordingly, the purpose of this Act is to increase the poker and pachinko slot machine annual ROTA LOCAL LAW NO. U-2 House Local Hill No. 17-8 I local license fee from $4,000 to $4,500 beginning on January I, 2011 and further increasing 2 the fees from $4,500 to $5,000 per machine beginning on January 1,2012. 3 SECTION 2. AMENDMENT. 10 CMC § 190I is amended to read as follows: "§ 190 I. 4 5 First Senatorial District: Pachinko Slot and Poker Machine Annual Local License Fees. "Pursuant to 4 CMC § 1503 and 1 CMC § 1402(c)(S) there is 6 7 established an annual local license fee of g licensed under 4 CMC § 1503(a)(2) and for each pachinko slot machine licensed under 9 4 CMC § IS03(a)(5) commencing on January I, 2011. $4,QQQ $4,500 for each poker machine The annual local license fee 10 shall increase to $5.000 per machine commencing on January 1, 2012: provided that II 50% of both increases shall be reserved for the Rota Municipal Scholarship Foundation 12 and the other 50% shall be reserved for the compensation of affected individuals under 13 Public Law 7-31." 14 SECTION 3. SEVERABILITY. 15 If any provision of this Act or the application of any such provision to any person or 16 circumstance should be held invalid by a court of competent jurisdiction, the remainder of this 17 Act or the application of its provisions to persons or circumstances other than those to which it 18 is held invalid shall not be affected thereby. 19 SECTION 4. SAVINGS CLAUSE. 20 This Act and any repealer contained herein shall not be construed as affecting any 21 existing right acquired under contract or acquired under statutes repealed or under any rule, Page 2 ROTA LOCAL LAW NO. 17-2 House Local Bill No. 17-8 1 regulation or order adopted under the statutes, Repealers contained in this Act shall not affect 2 any proceeding instituted under or pursuant to prior law, The enactment of the Act shall not 3 have the effect of terminating, or in any way modifying, any liability, civil or criminal, which 4 shall already be in existence on the date this Act becomes effective. 5 SECTION 5.
