ISSUE:
Shall City Council adopt Resolution No. 2013-69, declaring a public need to acquire and the City
of Salem's intent to negotiate for the acquisition of easements for construction of the S-1 Trunk
Main, Phase II, water distribution improvements along Boone Road SE between 36th Avenue SE
and Eastland Avenue SE and along Turner Road SE in the vicinity of Mill Creek?
RECOMMENDATION:
Staff recommends City Council adopt Resolution No. 2013-69, declaring a public need to
acquire and the City of Salem's intent to negotiate for the acquisition of necessary easements
for construction of the S-1 Trunk Main, Phase II, water distribution improvements along Boone
Road SE between 36th Avenue SE and Eastland Avenue SE and along Turner Road SE in the
vicinity of Mill Creek.
BACKGROUND:
The S-1 Trunk Main, Phase II, water distribution improvements project is a Capital Improvement
Project funded by System Development Charges. Improvements include construction of an
18-inch water main between Trelstad Avenue SE and Turner Road SE. The project is currently
in the design phase and will be constructed in the 2014 construction season.
FACTS AND FINDINGS:
This project is being designed and constructed in the public interest and there is a public need
to acquire private property in order to construct the required public improvements. Acquisitions
will be necessary from five adjacent properties. The Attachment identifies properties to be
acquired, the owner of record, and type of acquisition required. The City will negotiate with
property owners to acquire the required easements, and will pay just compensation for all areas
acquired.

RESOLUTION NO. 2013-69
A RESOLUTION DECLARING THE PUBLIC NEED TO ACQUIRE REAL PROPERTY FOR
THE PURPOSE OF CONSTRUCTING WATER DISTRIBUTION IMPROVEMENTS
ALONG BOONE ROAD SE AND TURNER ROAD SE
Whereas, for the purposes of the S-1 Trunk Main, Phase II Water Distribution Improvements
Project ("Project"), it is necessary for the City of Salem ("City") to acquire temporary
construction and permanent easements over certain real property depicted on "Exhibit 1," which
is attached hereto and incorporated herein by this reference ("the Properties"); and
Whereas, the construction of water distribution improvements along Boone Road SE and Turner
Road SE is an approved capital improvement project currently being designed for construction;
and
Whereas, for the public purposes of improving the water distribution system, including the
construction of the Project, the City Council has deemed necessary the acquisition of certain
Properties or property rights, which the City is authorized by law to acquire;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SALEM, OREGON,
RESOLVES AS FOLLOWS:
Section 1. The City does hereby find the Project to be in the public interest and declares a public
need for the Properties in order to construct the public improvements for the Project.
Section 2. The City shall negotiate to acquire easements from those persons or entities with
property interests depicted on "Exhibit 1" and pay just compensation therefor.
Section 3. This resolution is effective upon adoption.
