Title This Local Law is the Consumption of Liquor Local Law of the Mornington Peninsula Shire Council. 2. Objectives of this Local Law The objectives of this Local Law are to: 3. (a) Regulate and control the consumption of alcohol in designated areas, and prohibit the possession of alcohol in other areas, within the Municipal District; (b) Protect against behaviour which causes detriment to the amenity and environment of the Municipal District; (c) Protect the community interest; (d) Provide for the enforcement of this Local Law, including issue of infringement notices, noting that enforcement of this Local Law would usually be the role of Members of the Victoria Police; (e) Provide generally for the administration of Council’s powers and functions; (f) Lead and educate the public as to what is, and what is not, appropriate behaviour; and (g) Provide generally for the peace, order and good government of the Municipal District. Authorising Provision This Local Law is made under Section 111 of the Local Government Act 1989 (“the Act”). 4. Operation Date This Local Law comes into operation on 5 October, 2012. 5. Revocation Date This Local Law ceases to operate on 5 October, 2022 unless sooner revoked by Council. 6. Repeal of Local Law From the commencement of this Local Law, the Consumption of Liquor and Behaviour in Public Places Local Law No. 6 (2005) is repealed. 7. Application of this Local Law Except as otherwise provided, this Local Law will apply to and operate throughout the whole of the Municipal District. Definitions Unless the contrary intention appears in this Local Law, the following words are defined to mean: WORDS MEANING The Act means the Local Government Act 1989. Authorised Officer means any Person appointed under Section 224 and 224A (Members of Victoria Police) of the Act. Council means the Mornington Peninsula Shire Council. Council Land means land, buildings and facilities which are owned, occupied or vested in the Council or in respect of which the Council has the care and management and to which the public has access whether an entry fee is paid or not and includes a public place. Liquor has the same meaning as the Liquor Control Reform Act 1998. Motor Vehicle has the same meaning as in Section 3 of the Road Safety Act 1986. Municipal District means the Municipal District of Council. Penalty Unit has the same meaning as in Section 110 of the Sentencing Act 1991. Permit means a Permit in writing issued pursuant to the provisions of this Local Law. Person includes a partnership, unincorporated body or association or a corporation. Public Notice means a notice in a newspaper generally circulating throughout the Municipal District. Public Place has the same meaning as in the Summary Offences Act 1966. Definitions (Cont’d) Unless the contrary intention appears in this Local Law, the following words are defined to mean: WORDS MEANING Road means a highway, street, lane, bridge, thoroughfare or other place that is open to or used by the public for passage with vehicles. It includes a public highway, carriageway, Footpath, Traffic island, nature strip and any area that is provided to separate Vehicle Traffic on a highway, street, lane, bridge, thoroughfare or other place. It also means any place that is defined as a road, a road related area or a highway under Section 3(1) of the Road Safety Act 1986. Traffic means the movement of people by foot or in or on vehicles, along, across or within a Road. Vehicle means a conveyance that is designed to move, to be moved, or to be towed on Land and includes a Motor Vehicle. It includes an animal that is either driven or ridden and a trailer but does not include: (a) a train; or (b) a Toy Vehicle; or (c) in respect of an injured or disabled Person, a wheelchair or a motorised wheelchair that is capable of a speed of no more than seven (7) kilometres per hour. Mornington Peninsula Shire Council Page 3 of 62 Consumption of Liquor Local Law – 2012 PART 2 – CONSUMPTION OF LIQUOR The restrictions and limitations in this Part do not apply to a person who is taking liquor in a sealed container from a point of sale to a vehicle or private residence for consumption. 9. Restrictions on the Consumption and Possession of Liquor (1) A Person must not consume Liquor, or have in his or her possession or control any Liquor other than in a sealed container within: (a) those parts of the Municipal District which are delineated on the plans in Schedules 3 to 19 (inclusive), 21 to 27 (inclusive), 30 to 36 (inclusive), 39 to 43 (inclusive), 45 to 51 (inclusive); and (b) on a Road or Council Land1, including in or on a stationary vehicle on a Road or Council Land; (c) any other parts of the Municipal District determined by the Council from time to time and described in a Public Notice. Penalty: First Offence: Second or Subsequent Offence: (2) A Person must not between the hours of 8:00 p.m. and 8:00 a.m. on the following day, within those parts of the Municipal District which are delineated on the plans in Schedules 20, 28, 29, 37, 38 and 44 have in his or her possession or control any Liquor. Penalty: First Offence: Second or Subsequent Offence: (3) 10. 5 Penalty Units 10 Penalty Units Where the restrictions in Clauses 9(1) and 9(2) do not apply, a Person must not, between the hours of 11pm and 7am on the following day, consume Liquor or have in his or her possession or control any Liquor other than in a sealed container, (a) On a Road (including in or on a stationary vehicle on a Road); or (b) In, on or at any Council Land (including in or on a stationary vehicle on any Council Land or any Public Place). Penalty: First Offence: Second or Subsequent Offence: (4) 5 Penalty Units 10 Penalty Units 5 Penalty Units 10 Penalty Units The Council may by resolution vary the hours specified in Clauses 9(2) and 9(3) either generally or specifically in respect of any area described in the resolution and must give notice of those variations in a Public Notice. Exemptions to the Restrictions The restrictions in Clauses 9(1), 9(2) and 9(3) do not apply to a Person: (a) 1 Taking part in a function or activity in respect of which Council has given a written exemption from this Local Law; The definition of “Council Land” includes a “Public Place” as defined in the Summary Offences Act 1960. Taking part in any function or activity on Council Land that: (i) Has been leased to the Person carrying on the function or activity; or (ii) Having specific permission for the function or activity from the Person having the care, control or management of that Council Land; and Within authorised premises or licensed premises under the Liquor Control Reform Act 1998. New Year Controls A person must not, between 9:00 p.m. on 30 December and midnight on the following 1 January (inclusive): (a) Have in his or her possession any liquor in a glass container while on a Road or Council Land; (b) Have in his or her possession any sealed container of liquor on a Road or Council Land; or (c) Consume or be in possession of an open container of Liquor on any Road (including any place set aside for parking Motor Vehicles by the public) or Council Land. Penalty: First Offence: Second or Subsequent Offence: 12. 5 Penalty Units 10 Penalty Units Exemptions to the Restriction A person is exempted from the restrictions in Clause 11 if they are in: 13. (a) Licensed premises within the meaning of the Liquor Control Reform Act 1998; or (b) An area in which the consumption of Liquor is permitted in accordance with a permit granted under the Liquor Control Reform Act 1998; or (c) An area in which Council has issued a Permit for the consumption of Liquor; or (d) Camping sites on the foreshore in which the occupants thereon possess a current camping permit Australia Day Controls A person must not, between 11.00 pm on 25 January and 8.00 am on the following 27 January (inclusive): (a) Have in his or her possession any liquor in a glass container while on a Road or Council Land; (b) Have in his or her possession any sealed container of Liquor while on a Road or Council land; or Mornington Peninsula Shire Council Page 5 of 62 Consumption of Liquor Local Law – 2012 PART 2 – CONSUMPTION OF LIQUOR (CONT’D) 13. Australia Day Controls (Cont’d) (c) Consume or be in possession of an opened container of Liquor on any Road (including any place set aside for parking Motor Vehicles by the public) or Council Land. Penalty: First Offence: Second or Subsequent Offence: 14. 5 Penalty Units 10 Penalty Units Exemptions to the Restriction A person is exempted from the restrictions in Clause 13 if they are in: (a) Licensed premises within the meaning of the Liquor Control Reform Act 1998; or (b) An area in which the consumption of Liquor is permitted in accordance with a permit granted under the Liquor Control Reform Act 1998; or (c) An area in which Council has issued a Permit for the consumption of Liquor; or (d) Camping sites on the foreshore in which the occupants thereon possess a current camping permit. Application for Permit (1) An application for a Permit under this Local Law must be submitted to Council and be accompanied by the required fee. (2) An application for a Permit must be generally in the form set out in Schedule 1. Granting a Permit (1) The Council may grant a Permit for the consumption of Liquor and the possession of Liquor in unsealed containers. (2) A Permit issued under this Clause must specify by reference to a plan the place in which Liquor may be consumed or be in unsealed containers and must further specify the date and times at which such Permit is in operation. The Council may grant a Permit subject to such conditions as it considers appropriate including: (a) A condition that specified things are to be done to the satisfaction of Council; (b) A condition that the Permit is not to come into effect unless an existing Permit is cancelled or amended; (c) In relation to a Permit for a use for a specified time, a condition that: (d) 18. (i) Any use carried out on the Land under the Permit is to be removed at the end of the specified time; or (ii) The Land is to be restored to a specified state at the end of the specified time; and That the Applicant give notice in a manner specified by Council. Further Information The Council may require an Applicant to provide it with more information before it deals with an application. 19. Notice of Application The Council may require an Applicant to give public notice of an application for a Permit in the manner specified by Council. Mornington Peninsula Shire Council Page 7 of 62 Consumption of Liquor Local Law – 2012 PART 3– ADMINISTRATION AND ENFORCEMENT (CONT’D) Division 1 – Permits and Administration (Cont’d) 20. Consideration of Applications In addition to any other matter which must be considered under this Local Law, in considering an application for a Permit, Council may consider: 21. (a) Any objections or submission that may be received in respect of the application; (b) Any comment that may be made in respect of the application by any public authority, government department or community organisations; or (c) Any other relevant matter. Date of Operation A Permit operates from the date specified in the Permit or if no date is specified the day on which it is issued. 22. Date of Expiry A Permit expires on the date specified in the Permit or if no date is specified one (1) year after the date of commencement of the Permit. 23. Correction of Permits (1) (2) 24. Council may correct a Permit if it contains: (a) A clerical mistake or an error arising from any accident, a slip or omission; or (b) An evident material miscalculation of figures in the description of any Person, thing or property referred to in the Permit. The correction must be noted in the Register of Permits. Grounds for Cancellation or Amendment (1) (2) The Council may cancel or amend any Permit if it considers that there has been: (a) A material miss-statement or concealment of fact in relation to the application for the Permit; (b) A substantial failure to comply with the conditions of the Permit; (c) A material mistake in relation to the grant of the Permit; or (d) A material change of circumstances which has occurred since the grant of the Permit. The cancellation or amendment must be noted in the Register of Permits. Change and Transferability (1) The Council may correct, cancel or amend a Permit at the request of any Person. (2) A Permit is not transferable by any holder to any other Person without the consent of Council. Register of Permits (1) The Council must keep and maintain a Register of Permits. (2) Any determination made by an Authorised Officer under this Local Law must be maintained in a register kept for that purpose. (3) The register must be made available for inspection at the Municipal during normal office hours. Office Offences A Person who obtains or attempts to obtain a Permit by wilfully making or causing to be made any false representation whether oral or in writing is guilty of an offence. Penalty: 28. 10 Penalty Units Exercise of Discretions In exercising any discretion contained in this Local Law, the Council or an authorised officer must have regard to: 29. (a) The objectives and standards of this Local Law; and (b) Any other relevant matter. Service of Notices Any notice required to be served on or given to a Person under this Local Law, may be served on or given to the Person by: (a) Delivering the notice to the Person; (b) Leaving the notice at his or her usual or last known place of residence or business with a Person apparently over the age of eighteen (18) years and apparently residing or employed at that place; and (c) Sending the notice by post addressed to the Person at his or her last known place of residence or business. Appeals Any Person who is aggrieved by the administration or enforcement of this Local Law may apply to a Committee or Review Panel, appointed by Council for the purpose, to be heard and may make a written submission for consideration by the Council Committee or Review Panel, but this right will not in any way remove that Person’s obligation to act in accordance with any directions or notices which are applicable under this Local Law. Division 2 – Enforcement Powers 31. Power to Impound An Authorised Officer may impound and dispose of any Liquor which: 32. (a) Is in the possession or control of a Person, contrary to Clause 9(1), 9(2), 9(3), 11 or 13; or (b) Is within 25 metres of a Person reasonably suspected by the Authorised Officer of having contravened Clause 9(1), 9(2), 9(3), 11 or 13 which the Authorised Officer reasonably believes was formerly in the possession or control of such Person or which is apparently abandoned. Failing to Give Name and Address A Person whom an Authorised Officer has reason to believe is guilty of an offence under this Local Law must not refuse or fail to state his or her full and correct name and address and date of birth or state a false name or address and date of birth when required. Penalty: 33. 10 Penalty Units Infringement Notices (1) An Authorised Officer must serve a Local Law infringement notice in a form specified by the Infringements Act 2006 on a person whom the officer believes has committed an infringement against this Local Law requiring the person to pay the penalty for that infringement within 28 days of the issue of the infringement notice. (2) If the infringement notice is not withdrawn and the person pays to Council the amount referred to in the infringement notice within the period of 28 days or such further period as Council or an Authorised Officer may allow, no conviction will be recorded against that person for the alleged infringement. (3) A person issued with an infringement notice may make a written representation to Council, within 28 days of the issue of the infringement notice. (4) The Chief Executive Officer may authorise any person to consider any written representation and any other relevant information and that person must consider any such material brought to his or her attention. Infringement Notices (Cont’d) (5) Subject to sub-clause 33(1) the decision of the person authorised under sub clause 33(4) on any representation received will be final. (6) Council or the Chief Executive Officer or any other person authorised for the purpose may at any time withdraw an infringement notice either as a result of consideration of any representation made or with a view to prosecuting for an offence. (7) Where an infringement notice is withdrawn, the person upon whom it was served is entitled to a refund of any payment, which that person has made on the infringement notice. (8) If the penalty referred to in an infringement notice has been paid within 28 days of its issue and no representation has been received by Council or its officers, no decision may be made to withdraw the infringement notice and prosecute the offence after the expiry of 28 days from the issue of the infringement notice. (9) Any notice of withdrawal of an infringement notice may be served in accordance with Section 234 of the Act. (10) In the event of the failure of a person served with an infringement notice to pay the amount specified within 28 days of the issue of the notice or such further time as Council or an Authorised Officer may allow, Council or an Authorised Officer may pursue the matter by prosecuting for an offence or by taking any steps which may be available for enforcing penalties by registration of infringement notices. (11) Any person served with a Local Law infringement notice is entitled to disregard the notice and defend the prosecution in Court. 34. Penalties Except as otherwise provided, the penalties fixed for Infringement Notices are set out in Schedule 2. 35. Additional Penalty In addition to any penalty imposed pursuant to this Local Law a penalty not exceeding two (2) Penalty Units shall apply for each day after conviction for an offence during which a contravention of this Local Law continues. 36. Delegations Each and every power, duty and function of the Council under this Local Law, including the power to enforce this Local Law, to issues notices to comply, to issue infringement notices, to issue Permits and to bring a prosecution in any Court of competent jurisdiction, is delegated to each Authorised Officer of Council.
