IMPORTANCE:

7/27/11 - ARC adopted PLAN 2040, a Unified Plan for the Atlanta region, in two sections: (1)
PLAN 2040 Regional Agenda for the 10-county planning area developed pursuant to state
requirements, and (2) PLAN 2040 RTP/TIP for the 18-county transportation planning area
developed pursuant to federal requirements, including a Conformity Determination Report. On
9/6/11, USDOT in consultation with USEPA made a conformity determination on the PLAN
2040 RTP/TIP for both the 20-county Atlanta ozone and 22-county Atlanta pm2.5 nonattainment
areas.

12/5/12 - ARC adopted Amendment #1 to the PLAN 2040 RTP/TIP which included
documentation that the PLAN 2040 RTP/TIP conforms to the new federal clean air requirements
for the 15-county Atlanta ozone nonattainment area designated by EPA on 7/20/12. On 12/14/12,
USDOT in consultation with USEPA made a conformity determination on TIP Amendment #1
for the 15-county Atlanta ozone nonattainment area.
In May 2013, GDOT requested Amendment #2 to the PLAN 2040 RTP/TIP for the I-75 South
Managed Lanes project (AR-ML-630 and AR-ML-640) as detailed in the attached Table 1. The
purpose of the amendment is to shift remaining funds for right-of-way acquisition and construction
from state bonds to the federal National Highway Performance Program (NHPP) category. Federal
STP Urban funds previously authorized for preliminary engineering will also be reprogrammed for use
on construction. Funds will be drawn from existing funding program balances and the changes will
eliminate the need to incur bond financing charges in delivering these projects. This amendment will
not necessitate a conformity determination. (For additional information on the PLAN 2040 RTP/TIP

Pursuant to the ARC Community Engagement Plan, a 10-day public comment period was conducted,
May 9 to 19, and the results provided to TCC, TAQC and the ARC Board.
In late summer or fall of 2013, ARC will be developing TIP Amendment #3 to accommodate several
other non-conformity-related changes. An update of the PLAN 2040 RTP/TIP is targeted for adoption
in early 2014

A RESOLUTION ADOPTING AMENDMENT #2
PLAN 2040 RTP AND TIP
WHEREAS, the Atlanta Regional Commission is the designated Metropolitan Planning
Organization (MPO) for transportation planning in Atlanta Metropolitan Transportation Planning
Area which includes all or parts of eighteen counties; and
WHEREAS, Moving Ahead for Progress in the 21st Century (MAP-21) and the Clean Air Act
(CAA) Amendments of 1990 require the MPO to develop and adopt a long-range regional
transportation plan (RTP) and short-range transportation improvement program (TIP) that
conform with the applicable State Implementation Plan (SIP) for air quality; and
WHEREAS, under State code, the Atlanta Regional Commission also has the responsibilities of
a Regional Commission for the ten county area, and is required to develop a Regional Agenda,
and
WHEREAS, in July 2011, ARC adopted PLAN 2040, a regional unified plan that includes the
Regional Agenda (RA) for the ten county area; and the Regional Transportation Plan (RTP) and
associated Transportation Improvement Plan (TIP) for the eighteen county area; and
WHEREAS, a conformity determination was made on the PLAN 2040 RTP/TIP on September
6, 2011, by the US Department of Transportation in consultation with the US Environmental
Protection Agency, which determined based on the PLAN 2040 Conformity Determination
Report, that the PLAN 2040 RTP and TIP conform to the requirements of the Clean Air Act
under 40 CFR Part 93 for the 8 hour ozone 1997 standard (20 county nonattainment area) and
particulate matter 2.5 standard (22 county nonattainment area); and
WHEREAS on July 20, 2012, the US Environmental Protection Agency designated a 15-county
ozone Atlanta Nonattainment Area under the 2008 standard, with an associated requirement for a
conformity determination; and
WHEREAS, on December 5, 2012, ARC adopted Amendment #1 to the PLAN 2040 RTP and
TIP with an associated conformity analysis demonstrating compliance with the 15-county ozone
Atlanta Nonattainment Area; and
WHEREAS, on December 14, 2012, a conformity determination was made on the PLAN 2040
RTP/TIP by the US Department of Transportation in consultation with the US Environmental
Protection Agency, which determined that the PLAN 2040 RTP and TIP conform to the
requirements of the Clean Air Act under 40 CFR Part 93 for the 8 hour ozone 2008 standard (15
county nonattainment area); and

WHEREAS, in May 2013, the Georgia Department of Transportation did request Amendment
#2 to the Plan 2040 RTP and TIP to make funding source changes to two line items of the I-75
South Managed Lanes project, as shown in the attached Table 1; and
WHEREAS, funds will be drawn from existing funding program balances and the changes will
eliminate the need to incur bond financing charges in delivering these projects; and
WHEREAS, this amendment will not necessitate a conformity determination; and
WHEREAS, Amendment #2 to the PLAN 2040 RTP/TIP was developed consistent with the
requirements of 23 CFR 450.316 and in adherence with the participation processes and
guidelines outlined in ARC Community Engagement Plan, 2012 Update as follows:

Notice of such an amendment was published in a legal organ for a 10 day public comment
period on May 9, 2013;

Interested parties were provided the opportunity to comment on the amendment through the
ARC website.

Results of this public comment period were provided to the Transportation Coordinating
Committee, the Transportation & Air Quality Committee and the ARC Board for
consideration.
NOW, THEREFORE, BE IT RESOLVED that the Atlanta Regional Commission adopts
Amendment #2 to the PLAN 2040 RTP/TIP, as defined above; and
BE IT FURTHER RESOLVED that the Commission authorizes staff, with approval of the
Chair of the Atlanta Regional Commission, to make nonsubstantive technical corrections to the
final documents as necessary; and
BE IT FURTHER RESOLVED that the Commission directs the staff to continue the regular
reporting on PLAN 2040 management and implementation.
