( Approx. 150 Containers 20 feet / 40 feet & Piecemeal Consignment upto 2 MT.)

We intend to transport (approximately 150 Containers of 20 feet / 40 feet & Piecemeal
Consignment upto 2 MT) of Security Paper / Other Material / Machines from Mumbai to ISP Nashik
Road as per the attached terms and conditions and Schedule of work (Job Specification).

Please arrange to submit your tender as per details given below:i) Last date of receipt of tender
: 04.01.2011 by 02.30 PM.
ii) Date of Opening of Techno-Commercial Tender : 04.01.2011 at 03.00 PM.

Tenders are to be sent in two parts i.e. Techno Commercial Bid & Price Bid in two separate
covers & envelopes to be superscribed as “Techno Commercial Bid /Price Bid due on 04.01.2011” &
both the envelopes to be sealed in one common envelope duly marked “Techno Commercial/ Price
Bid for transportation of Security Paper / Other Material / Machines due on 04.01.2011. In the
Techno-Commercial Tender, full Technical details & Commercial terms ( excluding Price of
Transportation) to be given. The transporter who wish to participate in this may send their offer along
with a Demand Draft of Rs. 1,125/- (Rs. One thousand one hundred & twenty five only) as tender fee
without which tender will be rejected. Offers received after due date shall not be considered. Postal
delay will not to be condoned.

Earnest Money Deposit of Rs. 60,000/- (Rs. Sixty thousand only ) should be enclosed along
with the Techno Commercial Tender in the form of Demand Draft/Fixed Deposit Receipt/ Bankers
Cheque drawn in favour of India Security Press, A Unit of SPMCIL Nashik Road, payable at Nashik
Road, from any Indian Scheduled commercial Bank, without which Tender will be rejected. Demand
Draft from Co-operative banks will not be accepted. You are also requested to enclose advance stamp
receipt for faster refund of Earnest Money Deposit. Earnest Money Deposit will be forfeited to ISP
account for any breach of Contractual Obligation.

TERMS AND CONDITIONS TO ISP TENDER NOTICE NO. 36/2010 DATED 29.11.2010 FOR
TRANSPORTATION OF SECURITY PAPER / OTHER MATERIAL / MACHINES FROM
JAWAHARLAL NEHRU PORT TRUST (NHAVA-SHEVA) /VARIOUS DGS&D GODOWNS /
PORTS AT MUMBAI TO INDIA SECURITY PRESS, NASHIK ROAD IN APPROX. 2000 M.T.
PAPER / MACHINES ( APPROX. 150
CONTAINERS OF 20’ / 40’ & PIECEMEAL
CONSIGNMENT UPTO 2 MT).
1. Security Consignment shall be transported during day time only alongwith Security escorts of CISF
Personnel to be provided by ISP, for that advance intimation to be given to ISP by transporter.
2. To facilitate opening of container to unload boxes during de-stuffing, opening door of containers
should be faced to back side of trailer.
3. Transporter will co-ordinate with clearing agent Balmer Lawrie & Co. Ltd., Mumbai and with ISP.
4. Loading of container containing paper/Machines/ other material/ at Mumbai will be arranged by
Transporter. Unloading of paper / Machines / Other Material at India Security Press will be done
by ISP.
5. a) Loading and unloading arrangement of containers is to be made by transporter
b) Loading of Container on Lorries at loading site will be done by Transport Contractors.
6. LOCKING: The containers of Security Paper will be locked by clearing agent with consignee’s
lock provided for this purpose and keys will be handed over to head of escorting CISF party of
India Security Press in a sealed cover to hand over to consignee at India Security Press.
7. STRICTLY CONFIDENTIAL : The details of goods and other particulars and movement shall be
kept confidential by transporter and shall be known only to Balmer Lowrie & Co. Ltd., Mumbai,
clearing agent, consignee and CISF.
8. Transporter, in co-ordination with clearing agent, Balmer Lowrie & Co. Ltd., Mumbai, CISF escort
and consignee shall arrange movement in such a manner that consignment shall not be required to
be detained for unloading/destuffing at consignee’s end. No detention charges for whatsoever
reasons will be paid.
9. “CARRIER RISK” clause will be applicable for any damage to consignment alongwith container.
Damage will be assessed by consignee and shall be payable by transporter without dispute.
Damages in transit if any shall be the sole responsibility of transporter.
10. Transporter shall quote in terms of transportation charges per container of 20’/40’& piecemeal

11. The transportation contract will be for a period of 2 years from the date of issue of contract. The
approximate number of 20’ and 40’ loaded containers to be transported during this period will be
150 or actual receipts of 2000 MT Security paper / machines stuffed in 20’ or 40’containers upto 2
years whichever is applicable.
12. ESCORT CHARGES : Transporter shall quote the rate excluding Escort Charges, since Escort
will be done by CISF personnel of ISP and Armed CISF escort will accompany the containers of
only Security Paper. The CISF escort will be deployed only for Security Paper and not for
Machines and other Paper/ item.
13. Transporter shall ensure that only Transport vehicle in good running condition is deployed for this
purpose and crew with vehicle shall be skilled and of credentials deemed fit for accompanying
consignment of high value and security.
14. In case of Security Paper the Transporter shall inform their movement everyday to police stations
on route and also to consignee by faxing message of movement. In case of any brake down or any
difficulties immediate information shall be conveyed to nearest police station and also to
consignee.
15. Consignments of Security Paper shall always be escorted by CISF and under no circumstances
shall be left unescorted during transit till receipt at India Security Press.
16. INDEMNITY: Transporter shall give indemnity on stamp paper to General Manager, India
Security Press, for the cost of the containers under his custody for transportation and will remain
responsible for container till received back by the owner of the container with clear receipt reports.

17. ELIGIBILITY CRITERIA :
a) The transporter should have executed at least one similar work of transportation of at least 40
containers of 20’and 40’ capacity in the past one year ending 30-11-2010.
b) They should have annual turn over of at least Rs.8,00,000/- in any of the previous five financial
years ending 31.03.10 & it should not have suffered any financial loss for more than 2 years.
Copies of balance-sheets duly certified by Chartered Accountant for last five financial years upto
31.03.10 to be submitted. All the intending Tenderers shall submit Banker’s certificate showing
financial position.
c) Tenderers must specifically note that it is their responsibility to establish their credentials,
capacity and capability to execute the tendered work and tenderers not accompanying adequate
documents for the same are liable to be rejected outright without any reference.
d) The firm should not have been black listed.
e) The net worth of the firm should not have been eroded by more than 50% in any of preceding 5
financial year.
18. PAYMENTS : 100% of payment will be made within 30 days after successful completion of each
transportation job as per schedule of work and without any damage/loss and without any dispute of
correct receipt of consignments on production of bill alongwith receipt of containers by shipping
company duly endorsed by Balmer Lawrie & Co. Ltd., Mumbai.
19.VERIFICATION: Transporter shall submit Police Verification report (PVR) before job is
entrusted to them for their two supervisors who will accompany the transport, alongwith other
applicable registration documents/certificates from Government.
20. Number of containers to be transported each time and whenever movements shall take place shall
be pre-decided by transporter in consultation with consignee.
21. TERMINATION OF CONTRACT: The General Manager, India Security Press reserves the right
to terminate the contract at any time and without assigning any reasons thereof by giving 7 days
notice of their intention to do so in writing to the Transporter and Transporter shall not be entitled
to any compensation by reasons of such termination.
22. An Earnest Money Deposit of Rs. 60,000/- by Demand Draft /Fixed Deposit Receipt/ Bankers
Cheque drawn in favour of India Security Press, A unit of SPMCIL, Nashik Road, payable at
Nashik Road, from an Indian Scheduled Commercial bank only should be enclosed with the
Tender. The details of Demand Draft amount and date should be mentioned in the Tender. Earnest
Money Deposit by cheque will not be accepted. Tender without Earnest Money Deposit will be
rejected.
23. SUBMISSION OF TENDER: Tender shall be submitted in a sealed cover. The tender should be
marked “Tender Notice No.36/2010 dated 29.11.2010 for Transportation of Security Paper / Other
Material / Machines containers due on 04.01.2011”. Tender should have all information &
documents required by India Security Press. Earnest Money Deposit should be enclosed in
Techno-commercial tender only. Terms and conditions duly signed should also be enclosed in
Techno-Commercial Tender. Price should be quoted in price tender as rates per details in Para 10
above for delivery upto India Security Press, Nashik Road.
24. Prices and payment agreed and indicated in contract will remain firm during the period of Contract
and for agreed number of containers for contract. No increase in agreed rate will be allowed due to
change in market prices on any account other than increase on Government levies/taxes.

25. The contractor will abide by all terms and condition of supply order. SAFE TRANSPORTATION
AND SAFE DELIVERY OF GOODS WITHOUT LOSS/DAMAGE UPTO CONSIGNEE’S
PREMISES is the essence of this contract.
26. Consignment shall invariably be accompanied by CISF Escort in case of Security Paper, during
transit, which will be provided by India Security Press. One ISP Vehicle will carry CISF Personal
& one vehicle from Transporter will carry ISP Staff from ISP to Mumbai & Back to ISP. The
Transportation Charges shall be inclusive of Charges of Vehicle provided to carry ISP Staff
for Security Papers. Therefore the transporter has to quote separately for Security Paper
and for Non Security Items.
27. India Security Press shall have option to extend the period of contract for further period/ No. of
containers by +/- 25% on the same terms and conditions after giving notice of its intention to do so
before one month of the expiry of contract.
28. SECURITY DEPOSIT:
(i) Security deposit of 10% of total cost shall be furnished within 21 days from the date of issue of
contract by transporter in the form of Demand Draft/Bank Guarantee from any Indian Scheduled
Commercial bank only, valid for 2 years from date of order.
(ii) This sum is liable to be forfeited or appropriated towards any loss that may be sustained by the
Government as a result of breach of any of the terms and conditions of this contract.
(iii) India Security Press will not be liable for payment of any interest on the Security Deposit or
any depreciating thereof for the time it is held by India Security Press.
(iv) The Security deposit will be returned on due and satisfactory performance of work and on
completion of all obligation by the Transporter under the contract, after deducting all costs and
other expenses that ISP may have incurred and all due and other sums of money including all
losses and damages which ISP is entitled to recover from the contractor.
(v) Earnest Money Deposited will be returned on submission of Security Deposit.
29. RESPONSIBILITIES IN REGARDS TO LOSS, DAMAGES, SHORT RECEIPT ETC.
The transporter shall take all steps to prevent loss and damage to goods received by them on
behalf of India Security Press for transportation. It is the responsibility of the transporter to
examine carefully all packages received from Clearing Agent. They shall promptly obtain survey
report/damage report from Clearing Agent in case there is any damage/loss etc. The transporter
shall also lodge formal claim for loss or damage to goods on receipt under advice to consignee.
The transporter will have to make good to ISP any loss due to negligence on their part or failure to
do so.
30. LIABILITIES OF THE TRANSPORTER REGARDING LOSS, DAMAGE ETC.
i) The transporter shall abide by all instructions that may be given to them from time to time by
the General Manager, India Security Press or any officer authorized by him on that behalf. They
will also be bound to act with diligence and to use skill and to make compensation to ISP for the
neglect, want of skill or misconduct of themselves or their servants and agents in carrying out
such instructions.
ii) The Transporter shall exclusively be responsible for all the losses or damages due to any
cause whatsoever from the time they receive the consignment from Clearing agent during the
period it is held by they till the time the consignment is delivered to consignee.

31. SUBLETTING OF THE CONTRACT :
The Transporter shall not sublet, transfer or assign the contract as a whole or part thereof ,
without the previous written approval of the General Manager, India Security Press. The
transporter shall continue to be responsible for losses suffered by ISP even in case of their
obtaining permission of the General Manager, India Security Press for such action.
32. FORCE MAJEURE CLAUSE:
If at any time, during the continuance of the contract the performance in whole or in part by
either party or any obligation under this contract shall be prevented or delayed by reason of any
war, hostility acts of the public enemy, civil commotion, sabotage, fires, floods, explosions,
epidemics, quarantine restrictions, strikes, lockouts or acts of god (hereinafter referred to as event)
then provided notice of happening of any such event is given by either party to the other within 48
hours from the date of occurrence thereof, neither party shall be reason of such event, be entitled to
terminate this contract nor shall either party have claim for damages against the other in respect of
such non-performance or delay in performance.
33. ARBITRATION:
In the event of any question, dispute or difference arising under these conditions or any special
conditions of contract, or in connection with this contract except as to any matters the decision of
which is specially provided for by these or the special conditions the same shall be referred to the
sole arbitration of an officer in the Ministry of Law appointed to be the arbitrator by the General
Manager, India Security Press, Nashik Road. It will not be an objection that the arbitrator is a
Government servant, that he had to deal with matters to which the contract relates or that in the
course of his duties as a Government servant he has expressed views on all or any of the matters in
dispute or difference. The award of the arbitrator shall be final and binding on the parties to this
contract.
ii) In the event of the Arbitrator dying, neglecting, or refusing to act or resigning or being
unable to act for any reason, or his award being set aside by the court for any reason, it shall be
lawful for the General Manager, India Security Press, to appoint another arbitrator in place of the
outgoing arbitrator in the manner aforesaid.
iii) It is further a term of this contract that no person or other than the person appointed by
the General Manager , India Security Press, as aforesaid should act as arbitrator and that, if for any
reason that is not possible, the matter is not to be referred to arbitration at all.
iv) The arbitrator may from time to time with the consent of all the parties to the contract
enlarge the time for making the award.
v) Upon every and any such reference, the assessment of the costs incidental to the
reference and award respectively shall be in the discretion of the arbitrator.
vi) Subject as aforesaid, the Arbitration Act, 1940 and the rules there under and any
statutory modification thereof for the time being in force shall be deemed to apply to the
arbitration proceedings under this clause.

vii) If the value of the claim in reference exceeds Rs. 1 Lakh, the arbitrator shall give reasoned
award.
viii) The venue of arbitration shall be at Nashik or any other place as determined by the General
Manager, India Security Press, at his discretion.

DGS & D Transit Depot at Ghatkopar /CFS Mulund / Other Ports to India Security Press,
Nashik Road in a secured manner without any loss/damage to paper / Material / Machines and
container.
2. Returning of destuffed emptied container back to shipping company/container depot at
Mumbai / at a location as directed by clearing agent or Balmer Lawrie & Co. Ltd., Mumbai.
3. Transportation of Consignee escort in a passenger transport from India Security Press, Nashik
Road to Mumbai and back.
4. Arranging CISF escort in consultation with Consignee.
