Terms and Conditions
1. The ‘Win a Nissan Navara Prize Give Away’ Promotion (Promotion) commences at 9:00am
Australian Western Standard Time (AWST) on Thursday, 17 March 2016 and concludes at
1:00pm (AWST) on Wednesday, 8 June 2016 (Promotion Period).
2. The Promotion is promoted by Vicinity Custodian Pty Ltd ACN 077 870 243 as trustee for
VCX Property Management Trust ABN 21 969 875 489 (Promoter) of Halls Head Central,
14 Guava Way, Halls Head WA 6210 (Halls Head Central).
3. All entrants will be subject to, and will need to adhere to, the terms and conditions as set out
by the Promoter and any future terms and conditions or alterations to these terms and
conditions.
Prizes
4. The Promotion prize pool has a total value of $47,425.34 and consists of:
a. one (1x) Nissan NP300 4x4 2.3 DSL MAN DC RX valued at $44,410.85 (RRP,
including on road costs) (Major Prize); and
b. three (3) prize packs, each valued at $1004.83 and consisting of:
i. One (1x) Outdoor Equipped 4EV tent (valued at $299.99);
ii. Four (4x) Coleman Rambler chairs (each valued at $139.96);
iii. Four (4x) Bobin sleeping bags (each valued at $159.96);
iv. One (1x) 2 burner stove (valued at $79.99);
v. Four (4x) Splash single airbeds (each valued at $119.96);
vi. One (1x) Oztrail classic table (valued at $44.99);
vii. One (1x) Coleman 34lt Cooler (valued at $79.99); and
viii. One (1x) Coleman Rugged lantern (valued at $79.99) (each a Prize Pack)
5. The Major Prize and Prize Packs together constitute the prizes (Prizes).
6. The Prizes are supplied by Mandurah Auto Pty Ltd ABN 60 121 304 792 of 53 Pinjarra
Road, Mandurah WA 6210 trading as Mandurah Nissan (Mandurah Nissan or Supplier).
How to win the Major Prize
7. To enter the Promotion, entrants must, during the Promotion Period:
a. make a purchase of any value at a participating retailer listed in Schedule 1
(Participating Retailer) and retain the receipt as proof of purchase (Purchase);
b. collect an official entry form for the Promotion from the Participating Retailer
where the Purchase was made (Entry Form);
c. correctly and completely fill out the Entry Form with the personal details
requested; and
d. place the Entry Form into the entry barrel located next to the Nissan Navara
(Barrel) in Halls Head Central (Nissan Navara Stand).
8. Complying with Clause 7 constitutes one (1x) valid entry (Entry).
9. Entrants must retain and present the receipt evidencing proof of purchase during the
Promotion Period to collect a Prize should they be a winner.
10. Entrants are only entitled to one (1) Entry Form for each Purchase.
11. Entry Forms that are not in accordance with these terms and conditions are invalid.
How to Receive 10 Free Entries
12. To receive ten (10x) free entries, an entrant must, during the Promotion Period:
a. sign up for the Nissan Navara Drive Experience, either at the Nissan Navara
Stand
or
by
emailing
an
expression
of
interest
to
[email protected] or phone 08 9531 8995
b. participate in a scheduled test drive of a Nissan Navara at Mandurah Nissan;
c. collect the ten (10x) free Entry Forms at the conclusion of the test drive at
Mandurah Nissan;
d. correctly and completely fill out the Entry Form with the personal details
requested; and
e. place the Entry Form into the entry barrel located at the Nissan Navara Stand.
13. An entrant may only receive the ten (10x) free entries once within the Promotion Period.
How to win a Prize Pack
14. A total of three (3x) Prize Packs will be given away throughout the Promotion Period.
15. Halls Head Central Centre Management will draw one (1x) Entry Form each month and the
first valid entry drawn will be deemed the winner of the Prize Pack (each a Winner and
collectively the Winners).
16. The prizes will be randomly drawn by hand from the barrel at approximately 5:00pm on
Friday 8 April 2016, 5:00pm on Monday 9 May 2016 and 2:00pm on Wednesday 8 June
2016.
17. After the Winners have been notified, the Entry Form will be placed back into the barrel for
the chance to win the Major Prize on Saturday 18 June 2016.
18. Entrants are eligible to win a maximum of one Prize Pack during the Promotion Period.
How to win the Major Prize
19. The Major Prize will be randomly drawn by hand from the barrel by Halls Head Central
Centre Management and Mandurah Nissan at the Nissan Navara Stand after 1:00pm
(AWST) on Wednesday, 8 June 2016. The first valid entry drawn will be deemed the winner
of the Major Prize (Major Prize Winner).
General Terms and Conditions
20. Entrants may enter the Promotion as many times as they wish subject to, and in accordance
with, these terms and conditions.
21. Entry Forms must be originals and no copies or facsimiles of Entry Forms will be accepted.
22. The winning Entry Forms drawn must conform to all terms and conditions. No responsibility
will be accepted for late, lost, incomplete or misdirected Entry Forms. Entry Forms which
contain incorrect contact details shall be deemed invalid. The Promoter reserves the right in
its sole discretion to disqualify any entrant who the Promoter has reason to believe has
breached any of these terms and conditions, or engaged in unlawful or other improper
misconduct calculated to jeopardize the fair and proper conduct of the Promotion.
The
Promoter’s legal rights to recover damages or other compensation from such a person are
reserved.
23. Any decision made by Centre Management at Halls Head Central in respect of the
Promotion is final and binding and no correspondence will be entered into.
24. The Winners and Major Prize Winner do not need to be present at the draws and will be
notified by telephone or mail. Halls Head Central Centre Management will arrange a time
with the Winners, the Major Prize Winner and Mandurah Nissan to pick up the Prizes. All
costs involved in collecting a Prize or the Major Prize are the responsibility of the Winner or
Major Prize Winner as applicable and the Promotion or the Supplier accepts no liability in
respect of collection costs whatsoever.
25. If the Promoter has not had return communication from any initial intended Winner or Major
Prize Winner (i.e. attempts to contact a Winner or Major Prize Winner have met with failure)
then that person shall be deemed no longer eligible for the Prize and the Promoter must
announce a replacement winner.
26. If the Winners or the Major Prize Winner cannot be contacted within three (3) months of the
draw, they will no longer be entitled to the Prize and the Promoter may undertake a re-draw
at a time and place determined by the Promoter. In such case, the first valid Entry Form
drawn in the re-draw will be entitled to the relevant Prize as applicable (Replacement
Winner). The Replacement Winner is then the winner of the Prize for the purposes of these
terms and conditions.
27. If a Prize is unavailable for whatever reason, the Promoter reserves the right to substitute
the Prize for a prize of equal or greater value, subject to any applicable statutory
requirements.
28. Proof of identity will be required to claim a Prize or Major Prize.
29. If the Winner or Major Prize Winner is under 18 years of age, the Prize or Major Prize will be
awarded to the Winner’s nominated parent/guardian upon presentation of photo
identification. The parent/guardian shall be deemed the Winner or Major Prize Winner (or
Replacement Winner as the case may be) for the purposes of these terms and conditions.
All participants under the age of 18 must have prior consent from their parent or guardian
before entering the Promotion and must be able to provide evidence of such consent on
request.
30. By entering the Promotion, the entrants hereby give Halls Head Central and the Promoter
authority to publicly announce their name at the time of the draw and at any stage thereafter.
31. The Promotion is open to all residents of Western Australia, except employees, contractors,
agents of Halls Head Central sponsors of the Promotion and their immediate families;
employees of Vicinity Limited or related body corporate and their immediate families; tenants
in Halls Head Central and their immediate families; the staff of tenants in Halls Head Central
and their immediate families; the contractors of tenants in Halls Head Central and their
immediate families; the proprietors and staff of companies involved in the production,
publishing and administration of the Promotion and their immediate families. Immediate
families means spouse, defacto spouse, parent, child or sibling (whether natural or by
adoption) and grandparents. Tenant means lessees, licensees and, in the case of a
corporation, includes their directors.
32. By partaking in the Promotion, entrants agree that the Promoter may use information
provided on a registration or in connection with claiming a Prize in accordance with Vicinity
Centres’ Privacy Statement. A copy of Vicinity Centres’ Privacy Statement will be available
for viewing at the Centre Management Office, Halls Head Central.
33. The Prizes must be taken as offered and are not transferable, refundable or exchangeable
for cash or kind and are subject to these terms and conditions.
34. The warranty on the goods and services obtained as a result of the Promotion remains the
sole responsibility of the Supplier of the Prize.
35. The Promoter (including its related entities) and its respective officers, employees,
contractors and agents shall not be liable for any loss or damage whatsoever which is
suffered (including but not limited to indirect or consequential economic loss) or for personal
injury suffered or sustained, as a result of the Promotion or in connection with a Prize.
36. The Promoter accepts no responsibility for any tax implications that may arise from the
Prize.
37. The Promotion is not valid in conjunction with any other offer.
38. By participating in the Promotion, each entrant acknowledges and agrees that the Promoter
collects personal information about entrants for the purposes of:
a. including entrants in the Promotion and, where appropriate, awarding Prizes; if
the personal information requested is not provided, the entrant may not
participate in the Promotion; and
b. enabling the Promoter to use the information to assist the Promoter in improving
goods and services and to contact the entrant in the future with information on
special offers or provide entrants with marketing materials via any medium
including mail, telephone and commercial electronic messages (SMS (Short
Message Service), MMS (Multimedia Message Service), IM (Instant Messaging)
and email) or any other form of electronic, emerging, digital or conventional
communications channel whether existing now or in the future. The Promoter
may share information with its Australian related companies or promotional
partners, who may contact the entrant with special offers in this way. By entering
the promotion, an entrant agrees that the Promoter may use the entrant's
personal information in this manner. Entrants may opt out by clicking on the
“unsubscribe" link in the email or as set out in the SMS/MMS.
39. Photos will be the property of Halls Head Central and can be used and replicated in any way
to further promote the Promotion and Halls Head Central. If you no longer wish for your
photo to be used, contact Centre Management, Halls Head Central.
